The commander of U.S. Army Europe may have been exposed to the coronavirus at a recent conference he attended, the army said in a statement on Monday.

Later, when the Supreme Court asked it to consider representations by crypto exchanges, RBI filed a response so general, that the court had to order a detailed point-wise reply within two weeks. Meanwhile, GoI also didn't publicise its consultation on regulating virtual currencies initiated on MyGov.in, meant to aid a government committee's deliberations. There is no way to verify whether the committee considered any comments on the platform, most of which are brief, rudimentary and unverifiable opinions.A robust consultation would have allowed GoI and RBI to appreciate technical intricacies and the impact of regulation on the cryptocurrency industry, and design an appropriate regulatory framework. Instead, the story of crypto regulation in India is now a classic example of the harms of opaque regulation on disadvantaged customers and an expensive litigation.Greater transparency in law-making allows businesses to plan and be future-ready. In India, firms with a presence in Delhi often enjoy greater government access. This, coupled with non-consultative policymaking, may result in privileging the stakeholder with proximity to GoI over one with the most innovation.Recognising this need to widen the stakeholder base, the Telecom Regulatory Authority of India (Trai) and the committee of experts tasked with framing India's privacy law held policy consultations outside Delhi in the past two years.Consultative processes are likely to increase the industry's confidence in regulation and create greater buy-in to regulatory aims. Documenting legislative intent through notes on stakeholder comments and meetings will ensure greater accountability for both the regulator and the regulated, reduce subjectivity in enforcement, and even inform academic discourse.Consultative approaches are particularly crucial in technology policy, where technological growth far outpaces law-making. Not only do they help regulators be well-informed, but they are also a means to solve for a lack of state capacity. In 2016, in the 'Cellular Operators Association of India vs Trai' case, Justices Kurian Joseph and JRF Nariman of the Supreme Court called upon Parliament to pass a law like one in the US, which would mandate transparency in subordinate rulemaking.They identified stakeholder consultations, a consideration of stakeholders' views, and a reasoned explanatory note outlining the regulator's position on these views as key elements of transparency.They opined that transparency would help reduce litigation around subordinate legislation being arbitrary, as stakeholders' grievances could be, at least partially, addressed even before the legislation was made, in addition to promoting openness and reducing arbitrariness in law-making. In the cryptocurrency judgment, sadly, the bench that included Justice Nariman, stopped short of finding RBI's consultations lacking. These principles on transparent law-making should apply to technology policy and law-making, irrespective of industry. Technology will, necessarily, have far-reaching implications on multiple stakeholders, all of whom are very differently placed. With the deadly virus now present in 100 countries, companies are unable to match demand for the masks needed by health workers. That's led governments to jockey for supplies, including the U.S., which is stockpiling, and Germany and South Korea, which banned exports of masks altogether.Public health officials are warning that restrictive trade measures tied to medical supplies could worsen the shortfall and risk making poorer nations more vulnerable to the coronavirus' spread. KOLKATA: Lakshmi Vilas Bank (LVB), its capital adequacy well below the minimum needed, has approached the Reserve Bank of India (RBI) with a plan to raise $250-300 million (Rs 1,800-2,200 crore) from overseas investors through the sale of a 49-60% stake, said people with knowledge of the matter.The bank has been in talks with threefour investors and one of them has brought a "specific deal" to the table, said a person close to the bank, without elaborating. He said the prospective investor could act on its own or lead a consortium."We are ready to give up a controlling stake to a long-term investor," LVB chief executive S Sunder told ET. "Capital is the limiting factor for us. We are trying our best to get one investor on board at the earliest."Concerns over the private sector lender's financial health have risen after the crisis at Yes Bank, experts said. Lakshmi Vilas Bank's capital adequacy ratio is at 3.46% against the regulatory minimum of 9%. MUMBAI: The Reserve Bank of India (RBI) will check whether Yes Bank's statutory auditor had raised any red flags in the past year, two people aware of the development told ET. The banking regulator last week proposed a rescue of the private-sector lender that will be led by State Bank of India (SBI).The central bank has been in touch with auditor BSR & Co., which is a part of KPMG India, over the past few months. But the central bank will now specifically look at whether the auditor had issued any warnings over the past 12 months. Officials aware of the central bank's plans told ET that RBI officials had already held meetings with Yes Bank's new audit committee."The RBI wants to know whether the auditor had specified anything related to the bank's health or other issues as a going concern or raised any other red flags over the past year," said a person with direct knowledge of the matter.74568404 The central bank will also likely question the auditor on the health of the bank and whether the SBI proposal will have 'any material impact' on the private sector lender's existing accounts, said one of the persons.The RBI could also look into the impact of the reconstruction scheme on Yes Bank's financial statements, the person added.Bad Loans Under-reportedThe central bank didn't respond to ET's emailed queries. A BSR spokesperson said, "As a policy, we cannot comment on any client- or company-specific matters."The financial markets were shut in Mumbai on Tuesday due to the Holi festival."The liquidity position of the bank and several other issues would now be asked not just by the RBI, but also by the incoming investors," said the second person.Last week, RBI superseded the Yes Bank board and announced a reconstruction plan that will entail an investment of up to 49% by SBI.BSR took over as Yes Bank's auditor last year after the central bank banned SR Batliboi & Co, part of EY, for a year, possibly over alleged lapses in the audit of Yes Bank. The RBI had only said at the time that Batliboi was banned due to "lapses identified in a statutory audit assignment carried out by the firm". Yes Bank was the audit assignment that led to the ban, according to central bank and EY insiders.The central bank's move had been based on the enforcement action framework drawn up by it in June 2018. The framework listed audit lapses resulting in errors in a bank's financial statement, wrong certifications and information given by auditors, misconduct of auditors and any other violations of RBI directions as grounds to penalise auditors.The RBI's audit revealed that Yes Bank had under-reported bad loans by Rs 3,226 crore and provisions by Rs 978 crore in FY19. It first noted a divergence for FY16 to the tune of Rs 4,176 crore and then of Rs 6,355 crore in the FY17 accounts.

ET Intelligence Group: A sharp fall in crude oil prices could lead to portfolio churning in energy stocks over the medium term. State-owned oil marketing companies (OMCs) Bharat Petroleum Corp, Hindustan Petroleum Corp and Indian Oil Corp are likely to be preferred over oil explorer Oil & Natural Gas Corp and Oil India, as the impact of falling crude oil price on the earnings of OMCs will be lower than on exploration companies. Energy stocks have a weight of 10.1 per cent in the BSE 200 index.The state-owned OMCs derive nearly two-thirds of their gross operating profit from marketing margins — the money earned from sales of retail fuel such as petrol and diesel. Their gross marketing margins are Rs 2-2.50 per litre on retail fuel on a normalised basis. As they have passed on only partial benefits from falling crude oil prices to the consumer, the gross marketing margins expanded to Rs 6.50 and Rs 3.80 per litre for diesel and petrol, respectively, at the beginning of the March 2020.Retail prices of diesel and petrol have been cut by up to 5 per cent since the beginning of February 2020, while international Brent crude oil dropped 38 per cent in the same period, according to data compiled by ETIG. This is the prime reason for expansion of the marketing margins. The extent of the marketing margin benefit will hinge on how the union government tweaks its excise duty in the next few days. During the last major correction seen in crude oil price, the government hiked excise duty to boost its revenue.The impact of every 50 paise increase in the marketing margin could potentially lift expected earnings of the OMCs for the next fiscal year in the range of 15-30 per cent. The biggest beneficiary will be HPCL, followed by BPCL and IOC. HPCL's proportion of marketing sales to refinery throughput is the highest. In the first nine months of FY20, HPCL had domestic marketing sales of 29 million tonnes, while its refinery throughput was 12.6 mt. BPCL had marketing sales of 32.4 mt and refining throughput of 23.5 mt. The benefit accrued from higher marketing margin minimises the earnings hit coming from the refinery segment due to inventory losses.Apart from marketing margin expansion, lower crude price reduces the working capital requirement of the OMCs and also lowers the amount of outstanding subsidy payment on LPG and kerosene from the government. The oil subsidy burden was Rs 28,684 crore and Rs 43,387 crore for FY18 and FY19, respectively, according to the Petroleum Planning and Analysis Cell.The shares of HPCL, BPCL and IOC are trading at1.07, 2.37 and 0.83 times their book value, which is 16-46 per cent lower than their five-year average. In the past five years, the market value of state-owned OMCs has doubled, while that of oil explorers has shrunk to half.
ET Intelligence Group: India Inc's revenue growth is likely to hit a fouryear low in the ongoing financial year, as slack demand in the first nine months and a higher base due to double-digit revenue increase in the previous fiscal year are expected to play spoilsport.Revenue of companies in the BSE 500 grew 2.4 per cent on average between April and December, the slowest pace since the same period in financial year 2016, an analysis by ET Intelligence Group showed.In the absence of any major sign of a turnaround, these companies may find it difficult to clock substantial revenue growth for the ongoing fiscal year given the steep 17.5 per cent growth seen in the year-ago period, which serves as a high base.ETIG surveyed 423 companies which reported financial numbers since financial year 2014 to arrive at the conclusion.Sales growth in the nine-month period of the ongoing fiscal year was lower due to poor showing by companies in the auto and ancillaries, cement, construction, metals, and oil and gas sectors. In comparison, it increased 29.3 per cent in the first nine months of the previous fiscal year, the analysis showed. 74562544 Net profit fell by 6.8 per cent in the first three quarters of the current fiscal year after losses at telecom service providers. It was the sharpest fall in at least five years.Separately, Care Ratings said in its report on India Inc's performance for the nine-month period that the "top-line of (our) sample set of companies analysed has been subdued and indicative of overall slowdown in various industries."ETIG's analysis also showed that for companies in the Nifty 50 index, net sales grew 2.1 per cent compared with the higher base of 37.6 per cent in the corresponding period of the previous year.Net profit rose 11.2 per cent, helped by a reduction in the corporate tax rate, compared to the tepid 0.4 per cent growth in the year-ago period. For the nine months to December 2019, the Nifty sample's effective tax rate fell to 26.6 per cent from 32.7 per cent a year ago."It appears that most of the Nifty earnings per share (EPS) growth in the first nine months of FY20 has come primarily due to the corporate tax cut announced in September 2019," Emkay Global Research said in a report. "With the asking rate for Q4FY20 and FY21 being high, we foresee further earnings cuts going forward."Other brokerages have turned bearish on India Inc's FY20 earnings growth given the slowing pace in the fiscal year so far."For FY20, our Nifty EPS estimate is revised down marginally to Rs 527 (from Rs 538), and we now expect 9 per cent profit growth for the Nifty, singularly led by Financials," Motilal Oswal Financial Services said in a report.
Companies using cognitive technologies for core business functions rather than just peripheral ones are helping drive most new growth at IBM Global Services, a senior executive said."The end-to-end transformation of mission critical activities is driving a lot of our growth around the world. In banking, it would be about the core payment solutions, or the supply chain in manufacturing," said Mark Foster, senior vice-president, IBM Services and Global Business Services.All companies were becoming technology and platform companies in their own right, as they figure out what business platforms they will compete on and the technology that will drive their businesses."We are helping build those new platforms and transform every process using some combination of artificial intelligence, blockchain, and enabled massively by cloud-based architectures," he said.In India, a similar transformation is under way, with demand coming from multiple business transformation requirements.Berger Paints in India has worked with IBM to create a virtual reality experience on its consumer apps to drive outreach and engagement. Users can look at multiple options in 3D, helping them make informed buying decisions. This helps reduce sales convergence, in addition to increasing brand engagement.The other change, said Foster, has been towards smaller engagements."It's about delivering value on more mission-critical and holistic solutions in shorter timeframes rather than a big transformation journey. That's the way clients are looking to partner," he said.In India, demand is also being driven by the shift towards automation."Industries are looking beyond their market to expand their portfolio and look at adjacencies and create new value streams and business models," said Kamal Singhani, Managing Partner, Global Business Services, IBM India/South Asia.The company is working with Sriram Transport Finance (STF), an NBFC with a strong presence in commercial vehicle financing, on its digital transformation exercise. With the segment under stress, STF was looking to enhance fee income and increase productivity of existing relationship executives, among other things.IBM helped it create a platform that would enable executives cross-sell and be more productive as well as target the allied needs of the client. This, in turn, would increase potential fee from customers and help disrupt the traditional financing industry.The software major had to make employees ready for the shift in technology, in order to help clients leverage the technology. IBM's services business employs 250,000 people.It is a massive amount of capability to harness, but that capability needs to evolve in terms of skills. "We have to be more granular in terms of how we build our capabilities in new areas and help them actively skill themselves. It's also about how teams can come together under new models," said Foster.
Tata Steel Europe is planning to cut 1,250 jobs as it faces "challenging circumstances" and "needs to urgently improve profitability", Chief Executive Officer Henrik Adam said in an internal memo seen by Reuters on Tuesday. "Our financial situation is serious and there's an urgent priority to improve the performance of the business and our cash position," Adams said in the memo. Besides the job cuts, which would be less than half of what the company had announced last year, Tata Steel said it will not replace employees who have retired or left the company. It had in November decided to cut 3,000 jobs across its European business. The company has outlined details of a transformation programme and continues to be in talks with its European works council to minimise job losses, according to the memo. "Although it's good news that we are able to minimise the impact on our current employees, we need to progress with speed to secure the future for the business," Adam said.
