The United States said Thursday it was considering deploying fresh forces to counter the strategic threat Iran poses in the Middle East, with an official saying some 5,000 to 7,000 troops could head to the region.
Testifying before Congress, John Rood, the under secretary of defense for policy, said that the United States was 'observing Iran's behavior with concern.'
'We're continuing to look at that threat picture and have the ability to dynamically adjust our force posture,' Rood told the Senate Armed Services Committee.
The troop deliberations follow several decisions since spring to beef up the U.S. presence in the Middle East because of a series of maritime attacks and bombings in Saudi Arabia that the U.S. and others have blamed on Iran.

The suspect in Friday's deadly mass shooting at Naval Air Station Pensacola was an aviation student from Saudi Arabia and authorities are now investigating if the shooting was terrorism-related.
US officials, who spoke on condition of anonymity to discuss an ongoing investigation, said the suspect was a second lieutenant attending the aviation school at the base.

France's Prime Minister Edouard Philippe told workers they might have to 'work a bit longer' under a proposed new pension scheme as the country prepared for a second day of strike chaos over the reforms.
He added that the government is 'very determined' to push ahead with these reforms, despite some 800,000 demonstrators taking part in marches and walkouts with paralysed transport networks across France.
Philippe said the government would work with trade unions to introduce a single points-based pension scheme that would require the French to 'work a bit longer' and replace dozens of more advantageous plans currently enjoyed by public sector workers.

Europeans will urge Iran to stop violating nuclear deal, but Tehran remains angered by sanctions imposed by Washington.
European powers will demand at talks on Friday that Iran stop violating their nuclear deal or risk renewed UN sanctions, but with Tehran angry over a lack of European protection from US sanctions, there appeared to be scant scope for compromise.
The afternoon meeting comes amid heightened friction between Iran and the West.
The Pentagon on Friday vehemently pushed back on reports that the United States may send 14,000 more troops to the Middle East to confront a growing Iranian threat but did not deny that a force increase is forthcoming.
"As the Department has stated repeatedly, we were never discussing or considering sending 14,000 additional troops to the Middle East," Defense Secretary Mark Esper said in a statement.

Republican lawmakers are blasting Democrats' decision to publish the records of Nunes' calls, as well as call records from John Solomon, a conservative columnist formerly at The Hill. Nunes said in a Fox News interview the inclusion of the phone records in the impeachment report is an infraction of his "civil rights" and promised to explore "whatever legal remedies I have."

Ahead of this week's NATO summit in London, fresh developments in the eastern Mediterranean Sea will likely add to a long list of tensions between Turkey and allied nations as the bloc celebrates its 70th anniversary.
On Nov. 27, Ankara signed an agreement with Libya's internationally recognized government denoting new maritime boundaries between the two nations. The area spanning from southwest Turkey to northeast Libya cuts across a zone currently claimed by Greece and Cyprus, where plans for a future gas pipeline are in the works to link eastern Mediterranean gas fields with European markets.
The agreement comes as Turkish ships continue gas exploration and drilling activities within Cyprus' territorial waters, actions Ankara claims are necessary to ensure gas revenues are shared between the Republic of Cyprus and the Turkish Republic of Northern Cyprus, which is recognized solely by Turkey. The latest move further escalates tensions between the nations, which hold conflicting claims over the development of eastern Mediterranean energy resources.
The Russians spend the highest share of their military budget on procurement and build much of the equipment in-house.
After a decade of heavy investment in modernizing its military, Russia, a country with an economy similar in size to Spain, now has an updated army, navy and air force that fuel President Vladimir Putin's ambitions of keeping the country's superpower status. The upgrade has been possible, experts say, by boosting in-house production levels of weapons and equipment, and choosing to spend a larger share of the budget on acquisitions.
The Russian military received increased funding beginning in 2011, which improved pay for employees, allowed for the purchasing of high quantities of new and more sophisticated equipment, and supported more training and exercises.

A shooting at Naval Air Station Pensacola in Florida early this morning left one person dead and several others injured before the gunman was killed by law enforcement officers.
A spokesperson for the Escambia County Sheriff's Office told Pensacola News Journal that shots have been fired on base at around 7am local time.
Just before 8am, the sheriff's office announced the shooter has been shot and killed by deputies.

Washington (CNN)A new satellite image obtained by CNN indicates North Korea may be preparing to resume testing engines used to power satellite launchers and intercontinental ballistic missiles at a site President Donald Trump previously claimed was dismantled after his Singapore summit with dictator Kim Jong Un this summer, according to experts who analyzed the photo.
The commercial satellite imagery, which was captured on Thursday by Planet Labs, shows new activity at Sohae Satellite Launching Station and the presence of a large shipping container at the facility's engine test stand, according Jeffrey Lewis, director of the East Asia Nonproliferation Program at the Middlebury Institute, which works in partnership with the imaging company.
The shipping container was not seen at the site before Thursday and its presence suggests the North Koreans are moving to resume tests engine tests at Sohae, Lewis told CNN.

(OSWIECIM, Poland) — German Chancellor Angela Merkel voiced a feeling of “deep shame” during her first-ever visit on Friday to the hallowed grounds of the former Nazi German death camp of Auschwitz-Birkenau, where Adolf Hitler’s regime murdered more than a million people.
Merkel noted that her visit comes amid rising anti-Semitism and historical revisionism and vowed that Germany would not tolerate anti-Semitism. She said Germany remains committed to remembering the crimes that it committed against Jews, Poles, Roma and Sinti, homosexuals and others. Speaking to a gathering that included former Auschwitz inmates, she said she felt “deep shame in the face of the barbaric crimes committed by Germans here.”
“Nothing can bring back the people who were murdered here. Nothing can reverse the unprecedented crimes committed here. These crimes are and will remain part of German history and this history must be told over and over again,” she said.
She called such responsibility a key element in German national identity today.
Merkel also brought a donation of 60 million euros ($66.6 million). The money will go to a fund to conserve the physical remnants of the site — the barracks, watchtowers and personal items like shoes and suitcases of those killed.
Together, those objects endure as evidence of German atrocities and as one of the world’s most recognizable symbols of humanity’s capacity for evil. But they also are deteriorating under the strain of time and mass tourism, prompting a long-term conservation effort.
Accompanied by Polish Prime Minister Mateusz Morawiecki, Merkel began by seeing a crematorium and walking under the gate with the notorious words “Arbeit Macht Frei.” That was a cynical phrase that meant “work will set you free,” when the truth was that inmates were subjected to either immediate execution, painful scientific experiments or forced labor.
Merkel and Morawiecki went next to the site of executions, where they bowed their heads before two wreaths bearing their nations’ colors. The stay lasting several hours also included a visit to the conservation laboratory, where old leather shoes were laid out on a table, and to a laying of candles at Birkenau, the part of the vast complex where Jews were subjected to mass murder in gas chambers.
The donation to the Auschwitz Foundation comes in addition to 60 million euros that Germany donated when the fund was launched a decade ago, according to the Auschwitz-Birkenau state museum.
That brings the total German donation to 120 million euros and makes Germany by far the most generous of 38 countries that have contributed. As with the earlier donation, half comes from the federal government and half from the German states, an acknowledgement of the German nation’s responsibility.
Since becoming chancellor in 2005, Merkel has paid her respects at other Nazi concentration camps, and she has been five times to Yad Vashem, Israel’s Holocaust museum and memorial.
Still, Poland’s Foreign Ministry called her visit “historic,” in an obvious acknowledgement of the unique status Auschwitz has in the world’s collective memory. The ministry also noted that it was just the third visit of an incumbent head of a German government.
Nazi German forces killed an estimated 1.1 million people at the Auschwitz-Birkenau complex during their occupation of Poland during World War II. Most of the victims were Jews transported from across Europe to be killed in gas chambers. But tens of thousands of others were killed there too, including Poles, Soviet prisoners of war and Roma, or Gypsies. The camp was liberated by the Soviet army on Jan. 27, 1945.
Yet another confab of world leaders came and went this week, long on headlines and short on substance, as NATO leaders gathered in London to celebrate NATO’s 70th anniversary. There were laughs. There were shrugs. There were storm-offs. The only thing there wasn’t much of was genuine cooperation.
Why It Matters:
NATO is facing some serious existential issues. To be fair, they’ve been facing them since the collapse of the Soviet Union, as the military alliance’s raison d’etre was to counter threats from Moscow. NATO’s purpose was no longer clear, but there was no immediate need to disband. And in the euphoria of those “end of history” days—supercharging the momentum behind multilateralism and international cooperation—it became a vehicle to bring more countries into the Western fold (NATO’s membership grew from 16 in 1989 to 29 members today). For more than two decades it was enough for NATO to plod along.
But then NATO began losing its luster, first slowly then suddenly. The arrival of Donald Trump on the international political scene was the most visible and direct challenge to NATO’s role in a 21st century world. For Trump, all international relationships are transactional, and in his eyes the U.S. brought a lot more to the table than the rest of the allies did—in his own words, “we’re the schmucks that are paying for the whole thing”. The U.S. does indeed spend the highest percentage of its GDP on military expenditure, though the self-imposed 2% of GDP on military expenditures figure he frequently cites (and which only eight NATO members currently meet) was always a voluntary target rather than a requirement of member states.
But as Trump began questioning the NATO alliance out in the open, the dam burst. Turkey’s Recep Tayyip Erdogan opted to purchase Russia’s S-400 anti-missile system back in 2017 after a spate of disagreements arose between Ankara and Washington, and took delivery of that system just this year, a move that shook NATO to its core—the decision of a long-standing member to purchase weapons systems from the alliance’s most notable antagonist (and one that jeopardized critical military technology) moved NATO out of the realm of indispensable security umbrella, making it eligible to be used as a political talking point. That helps explain in part France’s Emmanuel Macron jumping into the NATO-bashing fray as well, referring to the alliance as suffering “brain death” for not being more coordinated (a response to Trump’s unilateral decision to remove its troops in Syria to make way for a Turkish offensive against Kurds there) and lacking true leadership (the role played by the U.S.). It was a comment aimed at reviving a military alliance many consider moribund, yes, but also one spoken for a French (as well as European) domestic audience.
What Happens Next:
Nobody enjoyed this week’s NATO dysfunction more than Russia, who sees the divides between the alliance’s members and harbor serious hopes of taking advantage of them. But long term, NATO isn’t going anywhere; for all the breathless headlines and open consternation of world leaders, institutions—particularly ones of the national security variety—remain sticky. Trump will someday leave office; Erdogan will eventually leave, too. Europe isn’t going to build an alternative, and its geographic location between the Middle East and North Africa means that national security will remain a priority for the continent so long as it remains caught between two regions with no shortage of political and social unrest. Going forward, NATO will seem less relevant and capable, especially when/if they need to act together, but it’s not about to dumped into the trash heap of history.
A weaker NATO doesn’t spell the end of the West, but it is yet one more data point—and among the most significant ones—of our continuing descent into global geopolitical recession.

I’d argue that we should reassess the reality of what NATO is in the light of the commitment of the United States.”
The Key Number That Explains It:
Donald Trump doesn’t have that many fans among Europe’s current crop of political leaders… and yet his threats still managed to get them to raise their own military expenditures by about $130 billion over the last five years, proving that getting NATO to take action isn’t exactly a popularity contest. Unfortunately for Trump, winning domestic elections is another matter.
The One Thing to Say About It at a Dinner Party:
Getting NATO allies to cough up more money (and by extension, not to take America’s commitment to NATO for granted anymore) is one of Trump’s only undisputed foreign policy wins to date. Don’t think he hasn’t noticed; as impeachment and reelection bare down on him simultaneously, he may be inclined to go back to that particular watering hole and kick around NATO allies some more. NATO should brace for a tough year ahead.
(BAGHDAD) — Gunmen in cars opened fire Friday in Baghdad’s Khilani Square. leaving at least 15 people dead and 60 wounded, Iraqi security and medical officials said. At least two of the dead were policemen.
Protesters fearing for their lives ran from the plaza to nearby Tahrir Square and mosques to take cover. It wasn’t immediately clear who did the shooting.
The attack came as anti-government demonstrators occupied parts of Jumhuriya, Sinak and Ahar bridges in a standoff with security forces. All the bridges lead to or near the heavily-fortified Green Zone, the seat of Iraq’s government.
“We are under live fire now with electric power cut, the wounded and martyrs are here and the bullets were fired in Sinak Bridge,” said one protester, who did not give their name for fear of retaliation.
The attack came a day after a string of suspicious stabbing incidents targeting demonstrators left at least 13 wounded in Baghdad’s Tahrir Square, the epicenter of Iraq’s leaderless protest movement.
Those attacks by unknown perpetrators occurred as demonstrators supporting political parties and Iran-backed militias withdrew from the Square . The incidents Thursday fueled paranoia among protesters, who immediately implemented self security measures to uncover saboteurs within the square.
At least 400 people have died since the leaderless uprising shook Iraq on Oct. 1, with thousands of Iraqis taking to the streets in Baghdad and the predominantly Shiite southern Iraq decrying corruption, poor services, lack of jobs and calling for an end to the political system that was imposed after the 2003 U.S. invasion.
Security forces dispersed crowds with live fire, tear gas and sonic bombs, leading to fatalities. Pressure from the protests, now in its third month, lead to the resignation of Abdul-Mahdi last week following al-Sistani calling for parliament to withdraw its support for his government.
Earlier, Iraq’s highest Shiite religious authority called for the formation of a new government within the allotted deadline, and without foreign interference, as the clock ticks down on lawmakers to select a new premier following the resignation of Prime Minister Adel Abdul-Mahdi last week.
Thousands of anti-government protesters from across southern Iraq had joined demonstrators in Tahrir Square, the epicenter of the protest movement in the capital, hours after the sermon, according to security officials.
“We hope the head of the new government and it’s members are chosen within the constitutional deadline and according to the aspirations of the people and away from outside influence,” the Grand Ayatollah Ali al-Sistani said in his weekly Friday sermon in the holy city of Najaf. The sermon is always delivered by a representative.
He added that the Shiite religious establishment would not take part in the government formation process.
Parliament had 15 days since his stepping down was formally recognized by lawmakers last Sunday to name a new nominee, per the constitution.
Since the U.S. invasion of 2003, government formation in Iraq has been based on brokering consensus among political factions and their foreign allies, primarily the U.S. and Iran. President Barham Salih launched talks immediately after Abdul-Mahdi’s resignation by making rounds with different political blocs. Iranian Gen. Qassim Soleimani, the head of Iran’s elite Quds Force and the architect of its regional security apparatus, also came to Baghdad to meet with key officials.
Lawmakers made headway in passing a key reform bill to change the membership of Iraq’s controversial Independent High Electoral Commission, the body tasked with overseeing polls, in a session Thursday night. Anti-government protesters consider IHEC a corrupt and partisan institution and its commissioners working in favor of political parties. The new law seeks to select commissioners primarily from the judiciary.
Protesters are also calling for early elections and reforms to have a greater influence in electing their representatives.
Al-Sistani, Iraq’s most powerful religious figure who’s opinion holds sway over Iraqis, also said peaceful protesters should increase their ranks and push out saboteurs, while respecting the role of the “indispensable” security forces.
Following the sermon, thousands of protesters traveled to Baghdad from across southern Iraqi provinces and marched on Tahrir Square, including from Dhi Qar, Diwanieh, Karbala, Najaf, Babylon and Missan, security officials said, chanting the slogan “Sistani, we are his soldiers.”
Security officials requested anonymity in line with regulations.
The family of a Maltese journalist who was murdered in 2017 have called on the country’s Prime Minister Joseph Muscat to leave office immediately and be placed under investigation as new evidence emerges about Daphne Caruana Galizia’s death.
“Justice can only be achieved if people continue demanding it… and if Muscat leaves office and is placed under investigation,” Caruana Galizia’s sister Corinne Vella told TIME.
More than two years have passed since a bomb detonated under the driver’s seat of the journalist’s rental car in October 2017. The unsolved murder of Caruana Galizia, who set out writing about local politics and ended up uncovering corruption at the highest levels of her country’s government, has left Malta in a worsening political crisis.
On Wednesday, a taxi driver named Melvin Theuma told a court how Maltese businessman Yorgen Fenech had contacted him in 2017 to organize the murder, with the words “get on with it. I want to kill Daphne,” Times of Malta reports.
Fenech, who pleaded not guilty to charges of complicity in the journalist’s murder on Nov. 30, was named in leaked legal documents, known as the Panama Papers, that exposed details of offshore tax havens and unorthodox accounting. Caruana Galizia had been investigating Fenech’s companies before she was murdered.
The businessman is also linked with top ministers including the Prime Minister’s chief of staff, who Fenech accused in court on Thursday of leaking key information about the murder investigation to him. The aide, Keith Schembri, has denied any involvement in the murder.
The fresh allegations about Muscat’s senior ministers add more pressure on the prime minister to leave office. After government ministers were arrested in relation to the journalist’s murder and subsequent protests in Malta’s capital, Valletta, demanding he resign, Muscat announced on Dec. 1 that he would.
But while Muscat set a Jan.12 date for his resignation as leader of the Labour Party, he declined to give a date for the end of his premiership — saying only he will resign as Prime Minister in “the days after.”
Muscat’s decision to stay on has angered Caruana Galizia’s family. “Days after could be anything from a day to several years,” Vella tells TIME. “Muscat needs to get out of Office, out of the Party, and out of the Parliament. He should have nothing to do with the investigation, other than as a suspect.” On Dec. 2, the family filed a judicial request calling for Muscat himself to be investigated over the murder.
“If he doesn’t go willingly, his cabinet should remove him,” Vella added. “Malta has to see that its institutions can work.”
Sophie in’t Veld, the head of a European Parliament delegation that met with Muscat in Malta on Tuesday for a fact-finding mission also said that the Prime Minister should relinquish power immediately due to “serious errors of judgement.” The journalist’s family is urging European lawmakers to consider sanctions if he doesn’t.
“In politics it is about trust. It is about the integrity of office. We have made it very clear that there is a problem,” in’t Veld said on Tuesday. “This is not just between the prime minister and the Maltese people. It is between Malta and the European Union.”
The investigation into Caruana Galizia’s murder took a turn after the Nov. 20 arrest of Fenech, whom media reports have linked to payments to senior government officials. The investigation has drawn in Muscat’s chief of staff, Keith Schembri, and two ministers—Tourism Minister Konrad Mizzi and Economy Minister Chris Cardona.
Within hours of each other, all three promptly resigned as police said they would widen the scope of the investigation to determine who was behind the journalist’s murder; Cardona has since been reinstated. Fenech had proposed to give information about the three government officials and “others close to the Prime Minister” in exchange for immunity, but this request was rejected. On Nov. 30, Fenech was charged with complicity in the journalist’s murder and pleaded not guilty. All three officials, deny any wrongdoing.
Appearing in court on Thursday, Fenech testified that Schembri had leaked information to him, divulging that his phone had been tapped and warning him of police raids in advance, the Times of Malta reported. The leaked information, Fenech alleges, continued even after Fenech’s arrest; he accuses Schembri of sending a message, via their doctor, with a “script” on what to say to the police. Schembri has denied any wrongdoing.
In court on Wednesday, Theuma, who was granted immunity from prosecution in exchange for information about Fenech, accused the businessman of masterminding the attack and said he was invited to the government headquarters after agreeing to arrange the murder and given a tour by Schembri. The taxi driver told the court that he had been put on the government payroll and he received a paycheck for three or four months for doing nothing. “If you asked me, I wouldn’t know what my job was at the ministry, as I never went,” he said.
He also testified how he acted as a middleman in the murder, arranging payments to Vincent Muscat and brothers Alred and George Degiorgio, who stand accused of carrying out the attack.
“The fact that people have been arrested, it’s only just the beginning,” Vella says. “We will see justice when everybody involved in the murder faces justice, and when everyone Daphne exposed faces justice as well.”
For Vella, she said hasn’t had chance to grieve her sister’s death. “There hasn’t been time to process her death. There was no time to sit around feeling sorry for ourselves and grieve properly. There will be time for that, but the first thing we need is justice,” Vella says.
Her sister believes that Caruana Galizia’s legacy as a crusading journalist will live on. “In all the chaos and craziness that followed [her death], lots of people stepped up. Malta was crawling with journalists,” Vella says. “Daphne’s legacy is that so many people have found a voice. People are protesting and it’s wonderful to see – I hope it becomes permanent, it gives us a lot of strength.”
(SHADNAGAR, India) — Police on Friday fatally shot four men being held on suspicion of raping and killing a woman in southern India after investigators took them to the crime scene, drawing both praise and condemnation in a case that has sparked protests across the country.
The burned body of the woman—a 27-year-old veterinarian—was found last week by a passer-by near the city of Hyderabad, India’s tech hub, after she went missing the previous night.
At around 3 a.m. Friday, police took the suspects, who had not been formally charged with any crime, to the sites where the rape and killing are believed to have taken place and the spot in an underpass where the woman’s body was burned about half a kilometer (a third of a mile) away, said V.C. Sajjanar, the local police commissioner.
The police brought the suspects to help them locate evidence, including the victim’s phone, Sajjanar said at a news conference.
“The suspects seized some weapons from policemen who had taken them there and started firing,” Sajjanar said.
“Even though our officers maintained restraint and asked them to surrender, but without listening to us they continued to fire and continued to attack us,” Sajjanar said, adding that police returned fire, killing the suspects.
The woman’s death is the latest gruesome case of sexual violence against women to rile India and comes despite efforts to strengthen the penalties for such crimes. Some advocates say those efforts have failed to deter predators.
Hours after the police shootings, the crime scene in Shadnagar, a town in the state of Telangana about an hour southwest of Hyderabad, had the appearance of a fairground.
About 300 people gathered to celebrate the suspects’ deaths.
Some hugged officers and lifted them into the air, chanting “Long live police,” while others showered them with flowers.
Indians had rallied on the streets of Hyderabad, New Delhi and Mumbai and called on social media for swift justice in a country where sentencing is notoriously delayed by backlogged courts.
After the veterinarian’s killing, Swati Maliwal, the head of the Delhi Commission for Women, started an indefinite hunger strike, demanding that the perpetrators be hanged within six months.
Maliwal said Friday that police “had no choice but to shoot.”
She said she is continuing her fast to demand swift hangings in other sexual violence cases because she thinks capital punishment will act as a deterrent.
“Hang the rapists!” shouted some of the hundreds of Maliwal’s mainly women supporters who gathered Friday at the site of her strike, the mausoleum of Indian independence leader Mahatma Gandhi.
The Congress party and other opposition groups raised the police killings in Parliament, and demanded a probe into the incident.
The National Commission on Human Rights, an autonomous body within India’s Parliament, said it was sending a fact-finding mission to the crime scene.
“This type of justice is counterfeit,” said Kavita Krishnan, secretary of the All India Progressive Women’s Association.
“The killings are a ploy to shut down our demand of accountability from governments, judiciary and police, and dignity and justice for women. We demand a thorough investigation into this,” she said.
Maneka Gandhi, a lawmaker from India’s ruling Bharatiya Janata Party and a former Cabinet minister, accused police of taking the law into their own hands.
“They would’ve been hanged by court anyway. If you’re going to kill the accused before any due process of law has been followed, then what’s the point of having courts, law and police?” she said.
Avinash Kumar, executive director of Amnesty International India, echoed the sentiment in a statement, saying that “extrajudicial killings are not a solution to preventing rape.”
After the 2012 gang rape and killing of a 23-year-old student on a New Delhi bus, minimum sentences were raised in cases of sexual violence. The four men convicted in the case have appealed their sentences, which were death by hanging.

BENGALURU: Justice BN Srikrishna, one of the main architects of the landmark Personal Data Protection Bill, said he wants the final version of the legislation to be sent to a select committee of Parliament for a thorough review before it becomes law.This Bill, which will determine how global tech giants Amazon, Facebook, Alphabet's Google and others process, store and transfer Indian consumers' data, is based on the report of a committee headed by Srikrishna. It's expected to be introduced in Parliament on Monday, having been cleared by the Cabinet on December 4."I would prefer it goes to a select committee," Srikrishna told ET on Friday in an interview on the sidelines of Carnegie Global Technology Summit in Bengaluru. "It is too serious and too complicated an issue. It is better to give it to a select committee because what happens there is that they invite knowledgeable people, experts to present evidence and the committee assesses the whole thing."The government hasn't said whether the Bill will go to a select committee for review. It has made changes to data localisation provisions that were in the panel's draft.Protection Against SnoopingIt also added some new ones with respect to social media account verification and mandatory sharing of nonpersonal user data with the government.The bill proposes that all "critical" information related to individuals will be stored and processed only in India, while all "sensitive personal data" have to be stored in the country but can be processed outside subject to certain conditions, such as the permission of the individual concerned.The data localisation provisions will help local law enforcement agencies access information of individuals, ostensibly to investigate wrongdoing and curb crime. Privacy and freedom of expression activists have questioned this. Until now, government agencies had to rely on slow-moving mutual legal assistance treaties (MLAT) to obtain personal data stored on foreign soil.However, Srikrishna said that the bill will protect Indian citizens from unauthorised government snooping."That (surveillance) is happening today without the law. Today, they are twisting your hand. Today, can you say no to Central Bureau of Investigation (CBI) asking for your data? Tomorrow you can. If CBI is given an exemption to snoop, such a law will become unconstitutional," he said. "This Act overrides all other laws in the country."Srikrishna said the draft Personal Data Protection Bill had explicitly stated that no data should be collected unless it is authorised pursuant to law passed in the Parliament. Any such legislation has to be constitutionally valid and comply with the three-fold parameters set out in the Supreme Court's Privacy judgment of 2017.The government will need to declare a specific objective for collecting private data, the authority ordering this and what procedure it will follow, he said. Until the Parliament draws up such legislation, it can't collect private data as it will be a "fully unconstitutional and illegal act," Srikrishna said.When asked about the impending amendment to the Information Technology Act that may mandate traceability for encrypted messaging services, he said that if the government does not define the objective, authority and procedure, it would be unconstitutional.Srikrishna said the Indian government's plan to install a nationwide facial recognition system in an effort to catch criminals and find missing children may not be in consonance with the bill."It may create some kind of conflict with the data privacy law. If I am standing somewhere in the street, can they come and take my photograph? That is invasion of my right to privacy. Public safety is a mantra, a vague thing, a blank cheque. You have to say what kind of public safety," he said.
NEW DELHI | BENGALURU: September 30 every year is now a critical date in business calendars of ecommerce majors — that's the deadline for the likes of Amazon and Flipkart to ready their annual compliance reports as per FDI norms. Statutory auditors will compile these reports. However, the government has eased an earlier certification rule that required ecommerce firms to submit these reports to RBI. Sources said the change happened because the central bank had questioned the need for its participation in the process.As of now, the government reviews compliance on the basis of internal reports of ecommerce companies. Ecommerce FDI comes under the ambit of Section 15 of the Foreign Exchange Management Act (FEMA). FDI-funded marketplaces are only allowed to lend their platforms to third-party sellers and such entities are barred from holding any stock or selling own goods directly to customers. Rules also disallow ecommerce marketplaces from having equity in any seller and entering into exclusive selling pacts with any vendor."Ecommerce marketplace entity with FDI shall have to obtain and maintain a report of statutory auditor by 30th of September every year for the preceding financial year confirming compliance of the ecommerce guidelines," the government said in a notification issued on Thursday. 72409952 Press Note 2Last year, the Department for Promotion of Industry and Internal Trade (DPIIT) had issued Press Note 2 of 2018 that required ecommerce marketplace entities to "furnish a certificate along with a report of statutory auditor to Reserve Bank of India confirming compliance… by September 30 of every year"."This is in consonance with the government's policy of self-certification but the onus of the correctness of the details lies with the auditors," said DPIIT secretary Guruprasad Mohapatra."This is a reinstatement of last year's policy…while it does not mean extra cost to these companies, they will have to get reviews and third-party validation done by auditors," said Akash Gupt, partner at PwC."Amazon has a high bar for compliance and we continue to comply with all applicable laws," said an Amazon spokesperson. "Flipkart Marketplace is in full compliance of the governing FDI laws in the country and we are okay to maintain statutory auditor's report for the same as per the notification," said a Flipkart spokesperson.The department had also stipulated that the inventory of a vendor will be deemed to be controlled by the marketplace if more than 25% of the vendor's purchases are from the marketplace entity, including its wholesale unit. The marketplace entity or its group companies cannot have control over inventory under the FDI rules.Commerce and industry minister Piyush Goyal has repeatedly warned ecommerce companies of strict action if they don't halt predatory pricing on their platforms, flouting FDI rules. The issue also figured in a discussion Goyal had with Amazon India head Amit Agarwal on November 5.SINGLE-BRAND RETAILIn the same notification, the government said that in proposals involving foreign investment beyond 51%, sourcing of 30% of the value of goods procured, shall be done from India, preferably from MSMEs, village and cottage industries, artisans and craftsmen.Such entities operating through brick-and-mortar stores are also allowed retail trading through ecommerce."However, retail trading through ecommerce can also be undertaken prior to opening of brick-and-mortar stores, subject to the condition that the entity opens brick-and-mortar stores within two years from date of start of online retail," the government said.

NEW DELHI: Pollution protection has toppled fairness as the fastest-growing category in skincare, riding on consumer fears over hazardous levels of air toxicity in India's urban markets over the past two years, large firms operating in the space said, citing industry data.Anti-pollution facewashes, toners and face cleansers from brands such as Pond's, Amway and Lotus have grown 25-30% this year compared with fairness products, which are growing at 8-10%, albeit on a larger base. The country's top fairness creams include Fair & Lovely, Lotus Whiteglow, Nivea Natural Fairness and Garnier White Complete."Anti-pollution skincare products are now growing three times faster than the fairness range, as consumer demand for solution-based products is rapidly moving up," said Nitin Passi, chairman of Lotus Herbals, which sells premium pollution-protection products such as serums. "The category is growing all over the world, especially in geographies where air pollution is very high."Almost all the big companies are pushing products that list ingredients to protect the skin rather than just lightening it."Our anti-pollution skincare products at both the premium and affordable range are outperforming the other skincare regimes by at least 25%," said leading direct seller Amway India's chief executive Anshu Budhraja.Part of this is the backlash against the entrenched obsession with 'fair' skin, experts said."Promoting colour of a particular kind isn't a politically correct thing anymore and companies are increasingly acknowledging that now," said social commentator and brand consultant Harish Bijoor.Preference for Functional Benefits"In urban markets, consumer trends are surely shifting to functional benefits over just colour."While fairness has historically comprised half the Rs 7,000 crore skincare category, anti-pollution creams and formulations are rising in the high double digits compared with overall skincare which is growing at about 7%, two industry executives said, citing Nielsen data .Hindustan Unilever Ltd (HUL), India's biggest consumer goods maker, said the company sees strong traction for such products. NEW DELHI: Bajaj Auto on Friday introduced the Husqvarna premium motorcycle brand in India with the unveil of the all-new Vitpilen 250 and Svartpilen 250 models. Husqvarna is one of the oldest motorcycle brands in the world and has been in continuous production since 1903. Svartpilen and Vitpilen are bespoke Swedish motorcycles crafted to deliver high performance in a very aesthetic design, the company said in a statement. Bajaj Auto said it will launch Husqvarna in India as a part of its Probiking Business Unit that handles the company's premium motorcycle vertical. The Husqvarna Svartpilen and Vitpilen 250 will start retailing from February 2020 onwards. KTM showrooms will be upgraded to sell both KTM and Husqvarna high performance motorcycles, Bajaj Auto said. "The premium motorcycling segment has seen rapid growth in India in the last five years, growing almost by 20 per cent CAGR with two broad classes of motorcycles - sporty high performance machines and lifestyle bikes with limited performance," Bajaj Auto President (Probiking) Sumeet Narang, said. "The Husqvarna twins are meant for discerning motorcycle riders with an evolved taste, a strong appreciation for style and for those who don't want a compromise between performance and elegant design," he added. The index breached its crucial support of 11,950 and formed a big red body candle on the daily chart. Dalal Street witnessed breakdown from Head and Shoulder pattern on the hourly chart, which doesn't bode well for the bulls. On the weekly scale, Nifty formed a Bearish Engulfing pattern and a sustainable move below 11,888 may lead to a correction towards 11,800 and then 11,700. On the flipside, immediate hurdle is placed at 12,050 and 12,100 levels. On the monthly options front, maximum Put open interest was at 12,000 followed by 11,500 strike, while maximum Call OI was at 12,000 followed by 12,500 strike. We have seen Call writing at 12,000 followed by 12,100 strike while Put writing was seen at 11,500 followed by 11,800 strike. Option data suggests a shift in lower trading range between 11,700 and 12,100. India VIX fell down by 4.62 per cent to 13.64 level. In line with the broader market, Bank Nifty corrected sharply and continued to make lower lows throughout the session. The bank index formed a bearish candle on the daily chart. We witnessed a Dark Cloud Cover pattern on the weekly scale. In the week gone by, it failed to cross penultimate week's high and breached its crucial support of 31,500 to confirm a Double Top pattern on the hourly chart. Now, till Bank Nifty remains below 31,500–31,600, we may see a corrective move towards its next support for Bank Nifty is at 31,000 and 30,800. Nifty futures fell 0.82 per cent to 11,949 Builtup of long positions were seen in Bharti Infratel, Kotak Mahindra Bank and Berger Paints while shorts were seen in Dish TV, RBL Bank, NCC, PFC and LIC Housing Finance. For midcaps and smallcaps, the valuation looks attractive, but for them to do well, the transmission mechanism has to resume, the money needs to flow and credit needs to grow. We are just waiting for the animal spirits to kick up, says Rana B Gupta, MD, Indian Equities, Manulife AMC. Excerpts from an interview with ETNOW. Was RBI maintaining the status quo on rates entirely unprecedented in light of the rising inflation? Could there be some countercyclical measures on the anvil?With regards to RBI's decision, we were a little surprised. We do note that inflation has moved up due to food and vegetable prices; but in our view, that is largely cyclical and can stay for the next three to four months, but more important is growth. RBI in their own projections cut growth rate by 100 bps. They still kept rates unchanged and that was a bit of a surprise. Having said that, we believe the liquidity situation in India has improved quite a bit. The wholesale rates have started falling. Also, RBI has already cut rates by 135 bps, whereas the lending rates have declined by only about 40-50 bps. A whole lot of catchup can happen, the lending rates can fall. In fact, liquidity is easing and so the wholesale rates are falling. Going forward, we expect deposit and lending rates to fall too. Coming back to RBI, from here, till about late March, there is scope to reduce rates further because growth at 4.5% is quite moderate. What is your view on some of the banks and financials?The banks and the financials could be in a sweet spot because just drawing from the previous answers what we were discussing, liquidity is good; also rates are falling, but the transmission has not yet happened. For transmission to happen, we would require some risk appetite pick up which can happen for many reasons; one of them could be also policy signals, so that animal spirit needs to be revived. We think that with time that will happen and if there is a base case, we continue to remain bullish on the private sector banks and that is more of a structural call. Also, whatever has gone on in the Indian financial sector for the last one year, has led to private sector banks gaining both deposit and loan market shares. Their pricing power is back, their credit costs will fall. They appear to be in a sweet spot. Cyclically, one should also add that if our view on rates getting lower and liquidity getting better and risk appetite coming back in the next one or two quarters plays out, then after remaining on the sidelines on non banks for more than a year, it is time to re-evaluate them, particularly the good quality ones with asset quality. How is the disconnect continuing between the midcaps as well as the largecaps and then within the Nifty as well. Just 10-15 odd stocks are doing the heavy lifting. Is this the time to buy into the mid and smallcaps given that they have just recovered 15% from their lows?First of all, we look at stocks on a bottom up basis and not so much on the market capitalisation basis. Having said that, we do think that, it is a fact that the markets have got quite skewed. The reason why they have got skewed is because of this consolidation that has played out. In most of the industries, the large companies gathered more market share and their earnings and profitability rose and so did the stock price. For midcaps and smallcaps, the valuation looks attractive, but for them to do well, the transmission mechanism has to resume, the money needs to flow, the credit needs to grow. Once credit grows, the midcaps and the smallcap companies will have the necessary resources to achieve whatever they want. Their valuations are attractive. We are just waiting for the animal spirits to kick up and the transmission mechanism to resume. Is that going to be little pushed back a bit because you do not know how the US China situation is going to pan out? Also, volumes dry up in the year-end. The markets may get in a bit of a corrective zone in the next couple of months?It is quite possible. Honestly, I do not have a view for a couple of months. In fact, our base case is that for that to happen, it may take up to a quarter or may be even slightly more. If we compare this year to last year , global developments are actually far better than what it was. Even six-nine months or a year ago, we had tremendous uncertainty on global trade war, Brexit and China was not giving any stimulus. Most importantly, the central banks including the US Fed were on a tightening mode. Once credit grows, the midcaps and the smallcap companies will have the necessary resources to achieve whatever they want. But today, the trade war uncertainty has come down. Our view is that trade war should see a pause. Looks like the Brexit will be not as hard as people thought it would be. China has already made some tax cuts and most importantly, the central banks are on easing mode. They have cut rates, they have added liquidity and they have given up guidance that rates are going to remain for a longer period. The global liquidity scenario has turned benign and this should play out in about a quarter or so. Where else, would you look for opportunity?Apart from the banks, logically taking that step forward, one should be looking at interest rate sensitive sectors also. That would be real estate. In our view given the price stagnation that we have seen in real estate and the falling rates, the affordability has improved. At the same time, the inventory is now getting a drawdown. For someone with a slightly medium to longer term perspective, that is one good segment to look at . Ancillary segments like building materials can do well too. Apart from that, we still play that consolidation theme that we have referred to. We have already covered consolidation in private banks. We have also seen consolidation and some bit of pricing power returning in organised retail and telecom. Coming to telecom, are you hopeful that the government is going to push back the AGR dues payment deadline? Are you more hopeful that with the tariff hikes kicking in, we will have a much better P&L of the incumbents?May be a bit of both. The telecom tariff hikes will bring in better P&L to the incumbents. In fact, our analysis shows that the tariff needs to go up a bit more for them to pay their dues as well as do capex. We have now seen an inflection point where the industry revenues are growing and you would appreciate that this is a fixed cost industry. The incremental revenues straight away flow to the bottom line and our cash flows improve. If this continues, we would see a scenario whereby if the government is supportive of relaxing some of the payment deadlines, they should be able to pay back their dues and also do the capex that is required. That should be the turning point for the sector.
NEW DELHI: Chinese firm One-Plus, the leading premium smartphone maker in India, has started exporting 5G smartphones on a pilot basis from the country, a development that aids India's initiatives to boost local production and exports. This comes at a time when India is lagging many other competitors in deploying the next generation technology.OnePlus, which is among the first off the block in launching 5G devices in global markets, is also testing 5G capabilities for carriers in the US and Europe, besides Indian carriers, at its research and development centre in Hyderabad."India is fast emerging as a regional HQ for OnePlus' expansion into global markets within five years," said Vikas Agarwal, head of operations in India for OnePlus. "As part of the business focus in India for the coming years, OnePlus is building India as a global export hub for the brand and is already manufacturing 5G devices and exporting to overseas markets, such as North America."72409818 The company has co-invested with Chinese rival Oppo to set up manufacturing facilities in Noida to make 5G devices.Both the smartphone makers are part of China's BBK Electronics group."We are currently sharing some common investments with Oppo on the manufacturing front," said Agarwal.Oppo, which also makes 4G devices for OnePlus, declined to comment.India is still far off from commercial 5G deployments, with 5G trials yet to begin and spectrum yet to be auctioned. In a recent report, Swedish equipment maker Ericsson said that 5G subscriptions in India will be available only in 2022, against its previous estimate of 2020. India's telecom industry body COAI doesn't expect commercial 5G roll-outs for another five years at least, due to exorbitant base prices, insufficient spectrum and unavailability of newer bands.In contrast, leading communications service providers in Asia, Australia, Europe, West Asia and North America switched on their 5G networks earlier this year. South Korea has already seen a big 5G uptake since its April 2019 launch. China's launch of 5G in late October led to an update of the estimated 5G subscriptions for year-end 2019 to 13 million from 10 million.Faisal Kawoosa, co-founder at research firm TechArc, said that OnePlus' move to make 5G devices in India and export them – following Nokia's move to make 5G gear and export from India – was happening at an appropriate time in global 5G ecosystem. "This reinforces the commitment of a brand like OnePlus as to how important India is as a destination on their global map of operations, and not just any end user market," he said.OnePlus, which leads the premium segment in India with 35% share as of September, considers India a crucial market for testing of future technologies, including 5G, machine learning and artificial intelligence.On the 5G front, the company has set up a 5G simulator in its research and development centre in Hyderabad, where it is also exploring 5G enabled cloud computing solutions."We are also running test trials with leading ecosystem players and network partners including Airtel and Reliance Jio, and actively investing in building 5G network simulators at the Indian R&D centre as part of these testing initiatives," said Ramagopal Reddy, vice president, R&D Centre at OnePlus.The centre is also building 5G specific product customisations, not just for Indian devices but also for other markets, such as North America and Europe.

In an action-packed season, top recruiters such as DE Shaw, Oracle, Ola, Microsoft, Flipkart, PwC and even Masayoshi Son's Softbank are upping their hiring numbers from the campuses this year as they are looking at young engineers to digitise and automate solutions and processes.For instance, DE Shaw India is making 30% more offers to students (about 140) from the engineering colleges for internships and full-time roles this year compared with last."Technology is in our DNA.
