WASHINGTON — Weeks before the whistleblower's complaint became public, the CIA's top lawyer made what she considered to be a criminal referral to the Justice Department about the whistleblower's allegations that President Donald Trump abused his office in pressuring the Ukrainian president, U.S. officials familiar with the matter tell NBC News.
The move by the CIA's general counsel, Trump appointee Courtney Simmons Elwood, meant she and other senior officials had concluded a potential crime had been committed, raising more questions about why the Justice Department later declined to open an investigation.
The phone call that Elwood considered to be a criminal referral is in addition to the referral later received as a letter from the Inspector General for the Intelligence Community regarding the whistleblower complaint.

WASHINGTON — A second intelligence official who was alarmed by President Trump's dealings with Ukraine is weighing whether to file his own formal whistle-blower complaint and testify to Congress, according to two people briefed on the matter.
The official has more direct information about the events than the first whistle-blower, whose complaint that Mr. Trump was using his power to get Ukraine to investigate his political rivals touched off an impeachment inquiry. The second official is among those interviewed by the intelligence community inspector general to corroborate the allegations of the original whistle-blower, one of the people said.

Microsoft says hackers linked to the Iranian government have targeted a U.S. presidential campaign, as well as government officials, media targets and prominent ex-patriate Iranians.
The company declined to identify the campaign, citing privacy concerns.
Corporate vice president for security Tom Burt wrote in a blog post Friday that owners of four accounts that were successfully breached have been notified.
He said those accounts that were compromised were not related to U.S. campaigns or officials.
He says the attacks by a group Microsoft calls Phosphorous occurred during a 30-day period in August and September.

The din of chickens and geese and a bucolic mural of cows belie the fact that the students are in one of a vast network of camps in Xinjiang, a region that is home to more than 10 million Muslim Uighurs.
Around 10 percent of the Uighur population of Xinjiang is locked up, according to the U.S. government and human rights organizations. The Chinese Communist Party maintains these centers are a crucial part of its effort to counter terror, extremism and separatism.

Hong Kong leader Carrie Lam on Friday invoked emergency powers and banned face masks, saying the order goes into effect Saturday.
Consequences for breaking the ban include up to one year in jail and a fine of 25,000 Hong Kong dollars ($3,187). Violators must be prosecuted within a year of the date on which the prohibition was broken, according to a copy of the ban.
In a press conference, Lam said the face mask ban was necessary because "almost all protesters who carry out vandalism and violence covered their face."
"The purpose was to hide their identity and evade the law and they have become more and more daring," Lam said.
As China paraded some of its most powerful weaponry during celebrations marking the Communist state's 70th anniversary on Tuesday, the United States Navy tested its newest piece of firepower in the Pacific.
In the waters off Guam, the USS Gabrielle Giffords fired off a Naval Strike Missile (NSM), a sea-skimming cruise missile that is difficult to spot on radar, and can maneuver to avoid enemy defenses.
The NSM, along with a variety of other weapons, were fired at a surplus US Navy frigate, the former USS Ford, which was towed to the Pacific to act as a target in an exercises called SINKEX.
The Giffords is the first US Navy ship to deploy with the Naval Strike Missile, and analysts say it helps even the equation in the Pacific, where China has been increasing its missile arsenal in terms of quality and quantity.

WASHINGTON (Reuters) - Iran has not drawn back to a less threatening military posture in the region following the Sept. 14 attack on Saudi Arabia, the top U.S. admiral in the Middle East told Reuters, suggesting persistent concern despite a lull in violence.
"I don't believe that they're drawing back at all," Vice Admiral Jim Malloy, commander of the U.S. Navy's Bahrain-based Fifth Fleet, said in an interview.
The United States, Saudi Arabia, Britain, France and Germany have publicly blamed the attack on Iran, which denies involvement in the strike on the world's biggest crude oil-processing facility. The Iran-aligned Houthi militant group in Yemen has claimed responsibility.
Hong Kong has entered a second day of protest against a government ban on the wearing of facial coverings—an emergency measure intended to curb four months of anti-government unrest that has met with a disastrous reception.
On Saturday afternoon, hundreds began marching through downtown Hong Kong chanting “Fight for freedom! Stand with Hong Kong!” and “I have the right to wear a mask.” Marchers occupied major streets and most wore facial coverings in defiance of the ban, which applies to all public gatherings and renders violators liable to a year in jail.
Along Chater Road, beside the Mandarin Oriental Hotel, protesters unfurled massive banners reading “I Want Glory for Hong Kong” and “Murderous Hong Kong Police.” Protests also broke out in the tourist district on the Kowloon peninsula and in the northern town of Sheung Shui, where the shuttered storefronts of businesses with mainland Chinese connections were attacked and vandalized. Police were nowhere to be seen.
Thirty-one people were injured, three of them seriously, in overnight protests against the anti-mask measure. An undercover police officer was attacked with petrol bombs and momentarily set alight, authorities said, adding that protesters unsuccessfully tried to snatch his gun. Local media reported that a 14-year-old boy suffered a gunshot wound to the leg.
Barring intermittent services to the airport, the entire train network remained suspended today after multiple stations, facilities, and a train were attacked by anti-government protesters. Banks, supermarkets, shopping malls and many stores remain closed after a night of destruction that saw fires lit and shopfronts smashed.
Government facilities such as libraries, museums, and performance venues are also shuttered. Some Twitter users reported a run on ATMs, saying they were running out of cash. Panic buying took place at the few grocery stores that were open, with shoppers queuing as long as two and a half hours for staples.
Protesters also smashed scores of traffic lights overnight, causing disruptions to morning motorists. Businesses were urged to “make flexible work arrangements for staff” because of the conditions.
In a taped video message broadcast Saturday afternoon in Cantonese, Hong Kong’s beleaguered top official, Carrie Lam, decried what she called “extremely horrifying violence.” She said “the radical behavior of the masked protestors was shocking. The extent of the damage was reckless and unprecedented and, quite simply, enraged everyone.”
Sounding considerably less conciliatory than she has in recent addresses, she said: “The rioters’ extremist behavior brought a very dark night upon Hong Kong, and caused society to be half paralyzed. Everybody is worried, concerned and scared. The government has the strongest determination to stop the violence.”
Lam ended her address with an appeal to the Hong Kong public “to end the violence in accordance with the law, to condemn the violence together and distance themselves from the rioters.”
The mask ban came into effect at midnight under the colonial-era Emergency Regulations Ordinance after the High Court refused to grant an injunction against it brought by two activists.
Protesters see the measure as the start of a broader crackdown on their fledgling democracy movement and Lam has not ruled out invoking more emergency powers, describing the situation as “fluid and evolving.”
The Secretary for Justice, Teresa Cheng, refused to say if there were plans for martial law but emphasized that the government was considering all legal means at its disposal to defuse the crisis, Hong Kong’s government-funded broadcaster reported.
The ongoing political crisis was sparked by a now withdrawn extradition bill, which would have allowed the rendition of fugitives to mainland China for the first time. Opposition to the bill quickly grew into a democratic rebellion against the unrepresentative, Beijing-backed government. Many protesters are also calling for self-determination or independence for the former British possession, which was retroceded to China in 1997 after 156 years of colonial rule.

(WATERLOO, Iowa) — An Iowa high school science teacher has been placed on administrative leave after he made what appeared to be a threatening social media comment about 16-year-old climate activist Greta Thunberg.
The Waterloo Community School District said Friday in an emailed statement that the teacher, Matt Baish, has been placed on administrative leave pending an investigation.
Baish’s removal followed a Facebook comment he purportedly posted about Thunberg’s planned appearance Friday in Iowa City for a student-led climate strike demonstration, asking “Who’s all going?” In response, a user named Matt Baish wrote, “Dont have my sniper rifle.”
West High School’s website lists Baish as a science teacher at the school. There was no answer Friday at a phone listing for Baish.
(CAPE CANAVERAL, Fla.) — The first all-female spacewalk is back on, six months after a suit-sizing flap led to an embarrassing cancellation.
NASA announced Friday that the International Space Station’s two women will pair up for a spacewalk later this month. Astronauts Christina Koch and the newly arrived Jessica Meir will venture out Oct. 21 to plug in new, upgraded batteries for the solar power system. It will be the fourth of five spacewalks for battery work.
Koch was supposed to do a spacewalk with another female crewmate in March. But NASA had to scrap the plan just a few days in advance because there wasn’t enough time to get a second medium-size spacesuit ready. The second medium was put together on board in June.
NASA’s deputy chief astronaut Megan McArthur told reporters the all-female spacewalk will be a milestone. But she noted that women are so integrated at all levels at NASA now that they don’t tend to dwell on gender. “I’m sure that they’ll sit back and reflect on it, as we all will. We will all celebrate that,” McArthur said.
Koch and Meir, a marine biologist who arrived at the orbiting lab this week, are both members of NASA’s Astronaut Class of 2013, the first and only one with an even split between men and women. They’re also both making their first spaceflights.
Koch, an electrical engineer, is more than 200 days into an approximately 300-day mission, which will set a record for the longest single spaceflight by a woman.
“In the past, women haven’t always been at the table,” Koch said during a televised interview earlier this week. “And it’s wonderful to be contributing to the human spaceflight program at a time when all contributions are being accepted, when everyone has a role, and that can lead, in turn, to increased chance for success.”
Since the world’s first spacewalk in 1965, only 14 women have done them, versus 213 men, according to NASA. Expect more women spacewalking together on the horizon, though. “It turns out that over the next couple years, we’re having a lot of medium suit people fly,” said NASA’s space station program manager, Kirk Shireman.
Koch will serve as the lead spacewalker for an excursion on Sunday with Andrew Morgan, her U.S. male crewmate. There are 11 spacewalks coming up in the next few months — 10 U.S. and one Russian. Only one is two women.
(WASHINGTON) — Microsoft said Friday that hackers linked to the Iranian government targeted an undisclosed U.S. presidential campaign, as well as government officials, media targets and prominent expatriate Iranians.
Overall, the hackers attempted to penetrate 241 accounts — four successfully — though none of those penetrated was associated with presidential campaigns or current or past U.S. officials, Microsoft said. A company spokeswoman declined to identify those targeted, citing customer privacy.
The announcement is the latest sign that foreign governments are looking for ways to potentially disrupt the 2020 presidential election. U.S. intelligence officials have sounded the alarm about the risks for months.
Russia’s hacking of the Democratic National Committee and the Clinton campaign, as well as the subsequent leaks of emails during the 2016 election roiled the DNC, hurt the Clinton campaign and was a focal point in special counsel Robert Mueller’s probe.
Foreign hackers have long targeted U.S. government and politicians, generally with little notice. But the disruption caused by Russia’s attack has heightened awareness and prompted fears that other nations will try to follow Russia’s example. Iran in particular could have a stake in the outcome of the U.S. election after President Donald Trump withdrew the United States from a nuclear agreement and stepped up sanctions against the country.
The U.S. Department of Homeland Security said it was working with Microsoft to “assess and mitigate impacts.” Chris Krebs, director of the department’s Cybersecurity and Infrastructure Security Agency, said much of the activity is likely “run-of-the-mill” foreign intelligence service work.
But, “Microsoft’s claims that a presidential campaign was targeted is yet more evidence that our adversaries are looking to undermine our democratic institutions,” Krebs said.
In a blogpost released Friday, Microsoft’s Tom Burt, corporate vice president for customer security and trust, said that owners of four accounts that were compromised by the hackers have been notified. The company would not identify those accounts.
The attacks by a group Microsoft calls Phosphorous occurred during a 30-day period between August and September.
Burt said the Iranian hackers used password reset and account recovery features to try to take over accounts. For example, they gathered phone numbers belonging to targets to help with a password reset. In other cases, they tried to get into secondary email accounts that might be linked to the Microsoft account to gain access via a verification email.
The hackers researched their targets, making more than 2,700 attempts to identify emails belonging to a specific Microsoft customer. A spokeswoman declined to provide more details.
The company has previously taken legal steps to combat Iran-linked hackers, suing them in federal court in Washington D.C., so Microsoft could take control of websites Phosphorous used to conduct hacking operations and to stop attacks.
In July, Microsoft announced that it had detected more than 740 infiltration attempts by nation-state actors in the past year targeting U.S.-based political parties, campaigns and other democracy-focused organizations including think tanks and other nonprofits.
The company declined to name or further characterize the targets or the actors. It said at the time that such targeting had similarly occurred in the early stages of the 2016 and 2018 elections.
Last year, Microsoft said it had detected attempts to infiltrate the networks of U.S. senatorial candidates and think tanks.
(PARIS) — New York-based pop artist Jeff Koons unveiled his long-awaited, giant sculpture titled “Bouquet of Tulips” in Paris on Friday, commemorating the victims of terror attacks that rocked France in 2015 and 2016. The 12.6-meter (41-foot) sculpture, fashioned from polychromed bronze, stainless steel, and aluminum, portrays a hand clasping a bouquet of balloon-like tulips.
At an inauguration ceremony attended by some families of the November 2015 Paris terror attacks, Koons called the flowers “a symbol that life moves forward.” He said the “inflatable flowers represent loss, rebirth, and the vitality of the human spirit.”
“I did, as a citizen in New-York, experience 9/11 and the depression that hung over the city and it really took years for the city to be able to come to life again”, Koons said.
Patricia Correia, whose daughter was killed in the Bataclan concert hall attack, thanked Koons for his tribute. “It’s a very strong testament between the two countries and for me it represents the colors of life, the roots which are here and continue growing despite all the tragic events we went through,” she told the AP.
Controversy over the placement of the sculpture stalled its installation for years after Koons announced the gift in November 2016. It was finally placed in the gardens of the Champs-Elysees — between the Petit Palais and the Concorde plaza.
Calling the work “a gift from the heart,” Paris Mayor Anne Hidalgo described vibrant debate, particularly over art, as a hallmark of Parisian identity.”Nothing can be small in Paris,” she said. “Everything is big in Paris —emotions, controversies, and the traces that art leaves in our lives.”
Private French and American donors covered the costs of constructing and installing the sculpture.

Why It Matters:
As journalists face increasing danger worldwide in a polarized political climate—fueled by a fractured media landscape where everyone is able to cocoon themselves within their preferred viewpoints and vilify all others—the Khashoggi killing stands out as the most brazen contemporary attempt to silence a prominent government critic and to blunt further dissent. It’s also a criminal act that came complete with Turkish intelligence recordings, leading the US intelligence community to determine that Saudi Crown Prince Mohammed bin Salman (MbS) ordered the murder.
But despite the evidence, the Saudis are back in good international standing, and it didn’t even take that long. At last year’s Future Investment Initiative conference (informally dubbed “Davos in the Desert”, much to the World Economic Forum’s chagrin) that took place less than a month after the killing, many international CEOs opted not to show up out of PR concerns but still sent their number 2’s, and business has continued as usual. While there were some awkward moments at the first G20 summit in Buenos Aires following the murder, by the time of this year’s G20 in Osaka, MbS had been welcomed back into the fold. For supporters of press freedom and human rights, that’s equal parts disturbing and disheartening. For most, it’s the world we live in.
What Happens Next:
While Saudi Arabia’s government relationships and business interests have remained largely intact over the last year, the country’s reputation—and the reputation of MbS, once vaunted as a new kind of Middle East leader—has taken a hit, and has led to criticism from US lawmakers from both sides of the aisle. That helps explain why MbS recently told 60 Minutes, when asked point-blank if he ordered the killing of his most high-profile critic: “Absolutely not. This was a heinous crime. (ZHYTOMYR, Ukraine) — Ukraine’s Prosecutor General said on Friday that his office is reviewing all the cases that were closed by his predecessors, including several related to the owner of a gas company where former Vice President Joe Biden’s son sat on the board.
Ruslan Ryaboshapka’s comments came amid an impeachment inquiry against U.S. President Donald Trump that relates to a call he made to the Ukrainian president asking him to investigate the Democratic presidential candidate and his son’s work in Ukraine.
Ryaboshapka told reporters in Kyiv that prosecutors are auditing all the cases that were closed or dismissed by former prosecutors, including several related to Mykola Zlochevsky, owner of the gas company Burisma that hired Hunter Biden in 2014, at the same time his father was leading the Obama administration’s diplomatic dealings with Kyiv.
Though the timing raised concerns among anti-corruption advocates, there has been no evidence of wrongdoing by either the former vice president or his son.
“We are now reviewing all the cases that were closed or split into several parts or were investigated before, in order to be able to rule to reverse those cases where illegal procedural steps were taken,” Ryaboshapka said.
Asked by The Associated Press about Trump’s comment Thursday that the U.S. has an “absolute right” to ask foreign leaders to investigate corruption cases, Zelenskiy said that Ukraine is “open” and that all the cases under investigation are “transparent.”
The Prosecutor General’s Office later said that among the cases they are reviewing, there are 15 where Zlochevsky is mentioned. None of the Zlochevsky-related cases has been revived yet, they said.
They did not specify how many, if any, were related to Hunter Biden’s work at Burisma.
Ryaboshapka was mentioned in the July 25 call between Trump and Ukrainian President Volodymyr Zelenskiy, who assured Trump that Ryaboshapka was “his man” and that he would resume investigations into Burisma.
The prosecutor general insisted on Friday that he did not feel any pressure over the Burisma case.
“Not a single foreign or Ukrainian official or politician has called me or tried to influence my decisions regarding specific criminal cases,” he said.
A whistleblower last month revealed that Trump in a phone call asked Zelenskiy to resume the probe into Joe Biden and his son. The July 25 call has since triggered an impeachment inquiry against Trump.
WASHINGTON — Top U.S. diplomats encouraged Ukraine’s newly elected president to conduct an investigation linked to Joe Biden’s family in return for a high-profile visit to Washington with President Donald Trump. It soon escalated into what one feared was a “crazy” swap that risked vital U.S. military aid.
That’s according to a cache of text messages released late Thursday by House investigators following a 10-hour interview with one of the diplomats, Kurt Volker, who stepped down as special envoy to Ukraine amid the Democrats’ impeachment inquiry.
The pages lay out the raw contours of a potential quid-pro-quo exchange — Trump gets his political investigation of a top Democratic rival in return for some price to be paid by the new Ukraine leader — now at the heart of the House investigation.
The text messages convey a distinct campaign among the three diplomats, who — apparently against some of their stated better judgment — appear to be trying to help Ukraine reset its relationship with Trump by pushing his interest in investigating his Democratic rival and the 2016 election.
Volker, in a text message on the morning of a planned July 25 phone call between Trump and Ukraine President Volodymyr Zelenskiy, wrote: “Heard from White House — Assuming President Z convinces trump he will investigate / “get to the bottom of what happened” in 2016, we will nail down date for visit to Washington.”
An adviser to the Ukrainian president appeared to go along with the proposal, which entailed investigating Burisma, a Ukrainian gas company where Joe Biden’s son Hunter served on the board.
“Phone call went well,” wrote Andrey Yermak in a text to Volker later that day after the two presidents spoke. Yermak suggested several dates when Trump and Zerenskiy could meet in September.
But all that planning started to unravel when Zelenskiy’s aide tried to lock in a date for the Trump meeting before putting out the statement on the investigations.
“Once we have a date we will call for a press briefing, announcing upcoming visit and outlining vision for the reboot of US-UKRAINE relationship , including among other things Burisma and election meddling in investigations,” Yermak wrote two weeks later.
“Sounds great!” texted Volker.
Volker and the two other diplomats _ William “Bill” Taylor, the charge d’affaires at the U.S. embassy in Ukraine, and Gordon Sondland, the U.S. ambassador to the European Union _ discussed the statement Zelenskiy would issue in support of the investigation. As the negotiations progressed, Sondland said Trump “really wants the deliverable.”
Then, Trump put a hold on $250 million in military assistance to Ukraine, which was depending on the funds as part of its defense against Russia.
“Need to talk with you,” Yermak wrote to Volker.
Taylor, the seasoned top diplomat in the Ukrainian embassy, conveyed his concerns and questioned whether the money was being withheld until Ukraine agreed to Trump’s demand.
“Are we now saying that security assistance and WH meeting are conditioned on investigations?” he wrote.
“This is my nightmare scenario,” Taylor texted his colleagues days later. Taylor said that by withholding the Ukrainian assistance, “we have already shaken their faith in us.”
House Democrats launched the impeachment inquiry over the Ukraine matter after a government whistleblower disclosed Trump’s call with Zelenskiy and the push to have a foreign government interfere in U.S. elections by digging up dirt on Biden.
As a Democratic front-runner, Biden could be Trump’s opponent in the 2020 presidential election. Trump and his lawyer Rudy Giuliani have tried, without evidence, to implicate Biden and his son Hunter in the kind of corruption that has long plagued Ukraine.
Hunter Biden served on the board of Burisma at the same time his father was leading the Obama administration’s diplomatic dealings with Kyiv. Though the timing raised concerns among anti-corruption advocates, there has been no evidence of wrongdoing by either the former vice president or his son.
Trump and Giuliani have also promoted an alternative theory of 2016 election interference, which puts Ukraine, not Russia, at the center, at odds with the 2017 findings of the U.S. intelligence community and special counsel Robert Mueller’s 2019 report.
Trump has said his call with Zelenskiy was “perfect” and portrays the impeachment inquiry as a sham.
The text messages released Thursday show that within a month of the call, Trump has canceled the visit with Zelenskiy, sending the diplomats into an effort to salvage a meeting with Vice President Mike Pence or possibly Secretary of State Mike Pompeo.
What followed was the scramble, and finger-pointing, to apparently fix what had been launched.
Taylor told Sondland he was “counting on you to be right,” and Sondland snapped back, “Bill, I never said I was right.”
Sondland early on had texted that he wanted to get the conversation started with Ukraine “irrespective of the pretext” because he was “worried about the alternative.” Now, he was saying, they have identified the best path forward, and “let’s hope it works.”
Taylor then texted, “As I said on the phone, I think it’s crazy to withhold security assistance for help with a political campaign.”
After a more than four-hour pause, Sondland texted Taylor that he was incorrect, and wrote that Trump “has been crystal clear, no quid pro quos of any kind.”
He also wrote, “I suggest we stop the back and forth by text.”
In releasing the exchanges Thursday, the Democratic committee chairmen said they are “still only a subset of the full body of the materials” provided by Volker, which they hope to make public later.

By Deepak SharmaFrom a fleet of Rolls Royce Phantoms in India to the luxury business jet Falcon 2000, the high-flying Wadhawans, arrested in the multi-crore PMC Bank scam, owned the most fabulous machines the world of hijinks has ever seen.Now the ongoing investigation into the scam hints that the huge real estate empire built by the Wadhawans also had a vital contribution to and connection with the now disgraced Chairman of Punjab and Maharshtra Co-operative (PMC) Bank, Waryam Singh.On Friday, as the Enforcement Directorate(ED) gathered details of the bank fraud from the Mumbai Police, Rakesh Wadhawan and his son Sarang (Sunny) Wadhawan, promoters of Housing Development and Infrastructure Limited (HDIL), were questioned on a couple of 'shady' companies, including Privilege Airways Pvt Ltd which owns the DA 2000 Falcon jet manufactured by French company Dassault, and Broadcast Initiative Pvt Limited which was virtually run by Waryam Singh, the controversial head of PMC Bank who obliged Wadhawans in the Rs 4,335 crore loan fraud.Records reveal that Privilege Airways was formed by Rakesh Wadhawan on February 16, 2006, ostensibly to oblige politicians and celebrities.Waryam Singh, a conduit between politicians and Rakesh Wadhawan, was a frequent flier on the same Falcon 2000. Waryam Singh, a Director in Privilege Power and Infrastructure Limited, owned by Rakesh Wadhawan, had facilitated a dialogue between several state governments and HDIL to set up multi-crore power projects out of Maharashtra.Sources said that after establishing Privilege Airways and Power Infrastructure, the Wadhawans eyed the setting up of a satellite news channel with an objective to make a strong footprint in the corridors of power in Delhi.A senior IPS officer of Uttar Pradesh cadre and Waryam Singh played a key role in achieving this objective for HDIL.According to a former editor of a news channel owned by the Wadhawans, "It was Waryam Singh who prompted Wadhawan to takeover Broadcast Intiatiaves Ltd CN, the company which owned a Hindi (national) news channel run by Bollywood producers Adhikari brothers. The sole aim of setting up the news channel was to liaison with the people in power."The former editor-level telly journalist said that Waryam Singh finally pressured a journalist working in the political bureau of Live India to fix his appointments with Central ministers.Records of the Ministry of Corporate Affairs reveal that Waryam Singh was appointed as the Director of Broadcast Initiatives Limited on September 27, 2010, which ran the Live India Channel from Mandir Marg, New Delhi.Earlier, Mi-Marathi, a regional news channel, was re-launched from Mumbai for which a separate company Mi-Marathi Media Limited was established. I watched 'Super 30' last night on Hotstar on my 60-inch smart TV and trust me I did not miss watching it in the cinema hall," said a top film producer. "In fact, the experience was much better as I was in the comfort of my living room. I think I should have released some of my own films directly on the video streaming services… could have saved money spent on marketing and got a much wider audience." The producer has released around 30 movies, out of which 10 were hits, he says.He's not the only one. A lot of producers feel that faster broadband, cheaper smart TV sets and proliferation of video streaming services will have an impact on the film industry in general and multiplexes in particular.Though it is just the beginning, but some of the questions being raised in the board room of the studios and multiplexes are on the business models and what next.Will multiplexes lose footfalls? Will OTT cannibalize or compliment the multiplex business? Will multiplexes have to redraw their business plans? Is direct to OTT release a viable business plan for a filmmaker?WHY RELEASE DIRECTLY ON OTT?Established industry norms are undoubtedly being challenged. With limited theatrical window and the likes of Netflix, MX Player (owned by BCCL, which also owns ET), Prime Video, Hotstar, and 30 other overthe-top (OTT) video streaming services vying for consumers attention, filmmakers, who were finding it hard to get release dates and screens have got new distribution platform and revenue streams.The problem of finding release date can be judged by the fact that a total of 1,776 films were released in 2018, an average of 34 films per week. If one considers only Hindi films, the number was 238, or over four films a week. There are only 9,600 cinema screens, of which multiplexes account for just over 3,000 screens. But because multiplex accounts for close to 60% of box-office revenue, these chains have control over the release window and decide when to pull out films.Hence, for many small and low-budget films, which grow through word-of-mouth promotions, it is becoming more viable to release them directly on the OTT platforms. For instance, Karan Johar's 'Lust Stories', Ronnie Screwvala's 'Love Per Square Foot', Yoodlee Films' (Saregama India) 'Brij Mohan Amar Rahe' are some of the films which were directly released on to Netflix.ECONOMIC LOGIC FOR SMALLER FILMSEven for a small budget film with a cost of production of under Rs 10 crore, the marketing, promotions and distribution costs have gone up to almost another Rs 15-20 crore. If the film is released in multiplexes, the box office revenue constitutes almost 55-60% of a film's total earnings, But a producer's share is only around 45% of the net box office revenues. Thus, even to breakeven, a typical small film has to recover over Rs 50 crore at the box office.But, instead, if the filmmaker can get the cost of production and some premium over and above for exclusive rights from an OTT service, it will make sense for him to have a direct to OTT release, which may also give wider audience reach.So no wonder that Screwvala (RSVP) has another six movies lined up, out of which four will be released on Netflix, while Johar's digital content studio Dharmatic Entertainment has signed exclusive output deal with Netflix for all its films and series. Yoodlee's entire business model is based on OTT.Screwvala feels OTT will "disrupt" both the economics as well as audience consumption patterns forever. "The rhetoric that audiences will always look at going to the theatres to be a family outing will not make sense," he said giving example of restaurants, where delivery services like Swiggy and Zomato have disrupted the business models. "Many restaurants have had to shut down and most make of their money only on home delivery. The same uberisation of content will also happen," he argued. 71448009 SO IS THERE AN IMMINENT THREAT FOR MULTIPLEXES?The answer could be a "resounding YES" or a "big NO" or a meek "too early to say", depending on who is answering."There is enough passion and love for movies, enough fondness for the cinema experience and there is enough content to be enjoyed on the giant screens," said Alok Tandon, CEO, Inox Leisure. "...if the industry's performance in FY19 is anything to go by, this situation is only getting better, with best ever revenues, footfalls, rollouts and introduction of new technologies."Multiplex executives feel entertainment will not just co-exist but flourish in the country. Kamal Gianchandni, CEO, PVR Pictures, said that cinema as a platform has existed for many years and has competed with many forms – VHS, DTH, PPV, VCD etc and survived."Last financial year was the best in the last 10 years for PVR on all metrics, be it occupancy, footfalls, revenue or operating profits. The OTT players were fairly aggressive on marketing and in spite of that cinema chains had a fabulous year. It clearly shows that cinemas and streaming platforms are not just co-existing but prospering," Gianchandnai said.Shariq Patel, CEO of ZEE Studios, echoed the sentiment by adding that he doesn't see multiplexes or cinema chains going out of business. "If that had to happen, it would have happened a long time back with the advent of VCR. We have been hearing about death of cinemas ever since home entertainment started."But experts also feel that multiplexes will have to react to the OTT threat and introduce new consumer offerings and enhance their customer experience."What it will mean is that multiplex chains will have to start coming up with janta theatre as they penetrate further in smaller markets. That's the business model they will have to cater to. Spectacular movies big on special effects will drive people to theatres, while for normal drama and high concept films, they will be equally comfortable or prefer to watch at home," said one industry player requesting anonymity.Multiplex chains like PVR, Inox and Cinepolis have been working towards taking the experience element to a new level by developing experience-driven entertainment centres. The focus has been on multiple formats like IMAX, 4DX, ScreenX as well exhaustive F&B concepts. However, many experts feel that the plexes will also have to work on their cost for a price sensitive market like India.Ashish Pherwani, Partner and Head, Advisory, Media and Entertainment at EY India, said that film release windows will keep evolving with the spread of technology. "Customer segmentation is key, and given it's the age of the democratised consumer, ample content will need to be available on every platform at different prices."OTT: A COMPETITION OR COMPLEMENT?While some see OTT as a substitute, it is equally true that OTT is also driving people to the multiplexes by creating more hunger for content. "With such powerful mediums driving growth, we are heading towards the Golden Period of Indian cinema, once again," Johar said.For example, availability of 'John Wick' I & II on OTT platforms drove audiences to the theatres when the third chapter of Keanu Reeve-starrer hit the screens earlier this year."John Wick 3 did six times more box office business than John Wick 2. Many people discovered earlier films on streaming platforms and it helped. So there is a positive cycle between streaming platforms and cinemas as far as India goes," Gianchandani said.OTT players have created a new set of stars and their edgier content has found purchase with the younger audience. In such a changing milieu, it's easier for films like 'Kabir Singh', 'Article 15', 'Badhaai Ho', 'Raazi', and 'Uri: The Surgical Strike' to succeed in multiplexes."If we look at the box office numbers for the well loved and highest grossing movies this year , there is a definite increase and high concept movies are breaking out in theatres like never before. However, what we see is that there aren't too many average performing movies, theatrical performance is getting polarised like never before.. we see streaming services offering great content options and that's great for the consumer. As an industry we need to put out very compelling content which lends itself for cinema viewing, for the consumer to go out to the theatres," Said Amrita Pandey, CEO of Junglee Pictures, owned by the Times Group.UNDER SCREENED MARKETIndian film industry's biggest challenge has been the dichotomy of under penetration of screens and low occupancy rate. With 8 screens per million population, India is by far one of the most under screened nations in the world so there is still room to grow. India has 30-35 million frequent moviegoers and another 70-75 million who watch movies occasionally."As more cinemas get built, this number will go up. The industry took 20 years to build 3,000 multiplex screens, another 10 years we all will continue to build more. The number should reach 10,000 screens by then and this OTT Vs multiplex debate is premature," Gianchandani said.So while the definitive verdict is not out there yet, Karan Johar, owner of Dharma Productions, sums up by saying that films are and will always remain part of India's culture."We love going to cinema I think we will continue to go to the cinema screens. It is not an either OTT or multiplex market. Both are going to grow," said Johar.
Venkatesh KiniLast month, while trekking the Himalayas, I saw a tea shop at 14,000 ft. The setting was stunning. There was a stream on one side, lush greenery on the other, and a spectacular mountain in the background. But even here, to my disappointment, a pile of empty food wrappers and beverage bottles ruined the scenery — proof of how far plastic waste and pollution have pervaded India and the rest of the world. If you look at it objectively, India is enriching other countries by buying their crude oil and ruining its own environment by converting it into plastic waste. It is time to find a better way. India has put off the ban on single-use plastic items, an announcement that Prime Minister Narendra Modi was earlier scheduled to make on October 2. This is unfortunate, as it would have put India at the forefront of regulations to solve plastic pollution, well ahead of even the EU. It seems that industry lobbies have been successful in pointing out all the ways a plastic ban would 'harm the economy'. The fact remains that single-use plastic ban must be implemented and made to succeed by having local authorities with good training and effective supervision enforce a prohibition. The pending ban, however, can only be the beginning, since along with single-use plastic usage, many widely littered items of plastic are also permitted. Here, industry should step up to show leadership. It can create a golden opportunity for India to lead the world in innovations to solve plastic pollution. India Inc must embrace solutions rather than lobbying against regulations, since polluters will find their business and reputation under threat if they do not clean up their act. The good news is that there are hundreds of solutions and alternatives to single-use plastics that are ready now, or in the pipeline. Many have been developed by startups led by environmentally focused entrepreneurs — ecopreneurs. Some are being incubated in large progressive companies. All of them will need investments of time, effort and money to be scaled up. This requires visionary leadership in corporations, patient capital from investors, and collaborative efforts between competitors within industries. Plastic Money The plastic circular economy touches a wide swathe of industries. This includes the petrochemical sector that produces the raw materials, processors that produce the plastics, converters who create finished products, brand-owners who use plastics in their packaging and, finally, the entire recycling and waste management industry. There are innovations transforming all these sectors, upending old business models and raising hopes of a future where plastic pollution can be solved. Some examples of upstream innovations are bioplastics made from algae, waste agricultural and food residues, using bacteria or mushrooms as micro-converters. Some bioplastics like PHAs (polyhydroxyalkanoates) are soil- and marine-safe — that is, they safely degrade in the environment within weeks or months, leaving no harmful residues. Some startups have already launched biodegradable straws made from PHA in other countries. India has a long history of using natural materials for packaging. The paan is a mouth-freshener and digestive in an edible package made from betel leaves. My favourite meals are those eaten using banana leaf plates. A new breed of Indian entrepreneurs is applying technology to create edible and biodegradable disposable cutlery and utensils. There is a worldwide market for these solutions. The best solutions are ones that eliminate packaging completely. A great example is the emergence of water dispensers and 'water ATMs' around the country. Thanks to new filtration technologies, Internet of Things (IoT) and other advancements, Indian entrepreneurs have created solutions that can replace packaged plastic bottled water in most locations. This alone can reduce millions of tonnes of plastic waste. Where packaging cannot be eliminated, the next best option is reusability. Many of you will remember drinking soft drinks from glass bottles that were returned to the shopkeeper. These returnable glass bottles were replaced to a large extent by plastic because of convenience. GoI should provide incentives to bring them back and help reduce plastic waste even more. Finally, where single-use plastic cannot be avoided, a plethora of tech nologies can help recover and sort the waste. Examples are smart bins, sorting machines, reverse vending machines and smart packaging technologies that make it easier to separate different materials. Once sorted, there are many options to recover value from waste plastics, ranging from chemical recycling that produces virgin quality polymers, to 'waste-to-energy' solutions that produce fuels. Apart from that, waste plastics can also be converted into clothes, shoes, furniture, building materials and even roads. Plastic Surgery With all these solutions in the pipeline, Indian industry need not worry about plastic bans. Instead, they should become part of the solution rather than perpetuate the problem. And since plastic is made from crude oil, reducing India's dependence on the material will help reduce its import bill. NEW DELHI: The Cabinet has approved a new process of strategic disinvestment with a view to expediting privatisation of select PSUs, officials said on Friday.The Union Cabinet headed by Prime Minister Narendra Modi at its meeting on Thursday evening approved the new policy under which the Department of Investment and Public Asset Management (DIPAM) under the Ministry of Finance has been made the nodal department for the strategic stake sale.This was done with a view to streamlining and speeding up the process, reducing the role of administrative ministries which often used to place hurdles in the path of major stake sales, officials said.While presently PSUs for strategic sale are identified by NITI Aayog, the tweak in policy has now brought DIPAM into the picture. DIPAM and NITI Aayog will now jointly identify PSUs for strategic disinvestment, they said.Also, DIPAM secretary would now co-chair the inter-minister group on disinvestment, along with the secretary of administrative ministries concerned.The change comes within a week of a group of secretaries agreeing for sale of government's entire 53.29 per cent stake in Bharat Petroleum Corp Ltd and its 63.75 per cent stake in Shipping Corporation of India (SCI), 30 per cent in Concor, 100 per cent NEEPCO and 75 per cent in THDC.Officials said strategic sale may involve two-stage bidding beginning with an expression of interest (EoI) or a preliminary intent showing bid, and a final financial bid. Pre-bid meetings with likely bidders and roadshows to attract potential investors will form part of the process to provide clarity on every aspect of the stake sale.Also, data centre will be set up for bidders to look for information on the PSUs up for sale, they added.Officials said the idea is to complete the stake sale within a timeframe, say 4-5 months.The government has set a target of mobalising Rs 1.05 lakh crore from disinvestment proceeds and achieving this has become more critical after it doled out Rs 1.45 lakh crore stimulus by way of a cut in corporate tax.Disinvestment proceeds will be critical for the government to stick to its target of keeping fiscal deficit at 3.3 per cent of the GDP in the current fiscal year ending March 31, 2020.
By Deepak SharmaFrom a fleet of Rolls Royce Phantoms in India to the luxury business jet Falcon 2000, the high-flying Wadhawans, arrested in the multi-crore PMC Bank scam, owned the most fabulous machines the world of hijinks has ever seen.Now the ongoing investigation into the scam hints that the huge real estate empire built by the Wadhawans also had a vital contribution to and connection with the now disgraced Chairman of Punjab and Maharshtra Co-operative (PMC) Bank, Waryam Singh.On Friday, as the Enforcement Directorate(ED) gathered details of the bank fraud from the Mumbai Police, Rakesh Wadhawan and his son Sarang (Sunny) Wadhawan, promoters of Housing Development and Infrastructure Limited (HDIL), were questioned on a couple of 'shady' companies, including Privilege Airways Pvt Ltd which owns the DA 2000 Falcon jet manufactured by French company Dassault, and Broadcast Initiative Pvt Limited which was virtually run by Waryam Singh, the controversial head of PMC Bank who obliged Wadhawans in the Rs 4,335 crore loan fraud.Records reveal that Privilege Airways was formed by Rakesh Wadhawan on February 16, 2006, ostensibly to oblige politicians and celebrities.Waryam Singh, a conduit between politicians and Rakesh Wadhawan, was a frequent flier on the same Falcon 2000. Waryam Singh, a Director in Privilege Power and Infrastructure Limited, owned by Rakesh Wadhawan, had facilitated a dialogue between several state governments and HDIL to set up multi-crore power projects out of Maharashtra.Sources said that after establishing Privilege Airways and Power Infrastructure, the Wadhawans eyed the setting up of a satellite news channel with an objective to make a strong footprint in the corridors of power in Delhi.A senior IPS officer of Uttar Pradesh cadre and Waryam Singh played a key role in achieving this objective for HDIL.According to a former editor of a news channel owned by the Wadhawans, "It was Waryam Singh who prompted Wadhawan to takeover Broadcast Intiatiaves Ltd CN, the company which owned a Hindi (national) news channel run by Bollywood producers Adhikari brothers. The sole aim of setting up the news channel was to liaison with the people in power."The former editor-level telly journalist said that Waryam Singh finally pressured a journalist working in the political bureau of Live India to fix his appointments with Central ministers.Records of the Ministry of Corporate Affairs reveal that Waryam Singh was appointed as the Director of Broadcast Initiatives Limited on September 27, 2010, which ran the Live India Channel from Mandir Marg, New Delhi.Earlier, Mi-Marathi, a regional news channel, was re-launched from Mumbai for which a separate company Mi-Marathi Media Limited was established. MUMBAI: Budget carrier GoAir said on Friday it will induct one aircraft every month as part of its aggressive fleet and network expansion plans.Announcing the induction of two new A320neos, GoAir managing director Jeh Wadia, in a release, said the new planes will help it launch flight services to Singapore and Aizwal besides catering to the seasonal demand.The delivery of the two aircraft, one from the European aviation major Airbus' Hamburg facility and other from its Toulouse plant, was taken in one single day, which is a record of sorts for any airline, he said."The induction of twin aircraft in the GoAir fleet is in sync with our strategy of aggressive growth and expansion of our network. Our plan is to add at least one aircraft on average every month," Wadia said.The airline plans to start operation to its eighth international and 25th domestic destination--Singapore and Aizwal, subject to regulatory approvals, he said.Industrialist Nusli Wadia-promoted no-frills GoAir have placed an order with Airbus for 144 narrow-body planes, in two tranches.In June 2011, the airline placed an order for 72 new A320neo aircraft valued at about Rs 32,400 crore on the list price.Then in January 2017, the airline firmed an order for another 72 A320neos worth Rs 52,000 crore.GoAir is looking to fly 100 million passengers in the next two years, Wadia said adding the airline has doubled its fleet to 53 at present from 27 two years ago.The number of daily flights has also grown by 41 per cent to over 325 as compared to 230 daily services in the same period last year, he said.
There has to be a counter cycle fiscal push in terms of stimulating demand from the consumer side. Until and unless that happens, the growth revival could take that much longer, says SK Ghosh, Group Chief Economic Advisor, SBI, talking on the RBI credit policy. Excerpts from an interview with ETNOW. Being the group chief economic advisor to one of the largest banks in the country, what has been your own takeaway from the monetary policy and the takeaways from the governor's commentary?These rate cut of 25 bps were a little bit lower than our expectations of larger rate cut, but having said that, the good thing is that the policy has clearly emphasised and communicated that there will be future rate cuts depending on the inflation trajectory. So possibly, there will be more rate cuts in December. But I sincerely believe that beyond a point of time, these rates cuts are unlikely to work because we are in a situation when demand has been a significant laggard and if you look into the resource flow to the commercial sector in the first half of last year and this year (1st of April to September), this year this number is down from Rs 7.5 lakh crore last year to less than Rs 1lakh crore this year. That means the credit growth in spite of the successive rate cuts by the RBI just refuses to pick up and this is an indication that currently the problem lies elsewhere. The transmission will continue because the central bank has kept the liquidity in a surplus mode and it has promised to keep it for an extended period. But my sense is that even as the RBI continues to cut rates, it still will be difficult to give a fillip to demand side as the household sector stands leveraged and only a countercyclical policy could help at the current stage. The second thing is that given the current growth conundrums, there could be downsides to the 6.1% growth projections because in the second quarter, high frequency indicators are not promising. In fact, they are indicating that growth could actually slow down even further in the second quarter. But it could still be a little bit higher than Q1 because of the base effect. So, the growth rate is unlikely to be at 6.1% and inflation could pick up marginally, but it would still remain at a comfortable level. At the end of the day, we will continue with rate cuts but I am not sure how far that is going to help stimulate demand when the problem lies elsewhere in terms of slow income growth.Would you agree that both the RBI and the government need to be lambasted for not doing enough? The government has given the tax cuts to the wrong kind of companies, RBI also has not addressed the basic issue, which is real estate. Would you see real estate as the crux of the problem?Both real estate and automobile sectors are doing badly and the problem in the real estate sector arises from the meltdown in the NBFC sector. Funds are not flowing to the real estate sector. In order to solve the real estate sector problem in one go, it is going to be very difficult given the fact that the sector has gone through a lot of upheavals in the last two to three years. The number of inventories which are still unsold has declined from the peak levels but it is still at very high level and the problem is that the NBFC sector is not lending to the commercial sector. So that is point number one. The second point is that in terms of government policy, there is a lot of pressure on the fiscal because all the markets -- the bond market, the equity market and the forex market -- have different expectations. The equity market will be very happy if there is a fiscal push; the bond market will be very nervous, while the exchange market could go either way.Satisfying all the markets in one stroke is very difficult. But I would maintain that the steps which the government has taken in terms of reviving corporate investment will not pay back in the current year but possibly it will pay back in the next fiscal year and that is point number one. From that point of view, do not expect growth to go up dramatically in the next couple of months. Growth can only be at that level. It could be even lower than 6.1%, but my only solace from the measures which the government and the RBI have taken is that it is going to lay the foundation of a stronger growth not in the current fiscal but possibly in the next fiscal. I still believe that too much has been read into this fiscal push and other things. So yes, fiscal push in a country like India will always remain an issue because there is always a credibility issue with the fiscal given that there has been loan waivers. There has to be a counter cycle fiscal push in terms of stimulating demand from the consumer side. Until and unless that happens, the growth revival could take that much longer.

With echoes of Mario Draghi's "whatever it takes" vow, Das said he'll remain accommodative for "as long as it is necessary" to revive growth. And he also pointed to the global shift to easier policy.A soft jobs report Friday could seal the case for Federal Reserve Chairman Jerome Powell to cut again on Oct. 30. And speculation is heating up that Bank of Japan Governor Haruhiko Kuroda will need to push his key rate deeper into negative territory -- if for no other reason but to avoid an untimely strengthening of the yen. As for incoming European Central Bank President Christine Lagarde, the prospect of a no-deal Brexit may add to reasons to ease more. 71444300 With virtually all the world's major central banks easing (China is somewhat of an exception) and pointing at each others' shifts as reasons to act, the race to the bottom risks blunting the policy impact.Sure, lower borrowing costs may help spur the economy if there's enough demand for credit, and repaying existing debts becomes cheaper, freeing up cash for spending. But the currency channel -- the weakening you'd normally expect if a country was alone in cutting -- is negated."If everyone is easing, there is no exchange-rate channel," Lowe himself said in June.The spanning-the-globe easing is also driving down bond yields, running the risk of creating inflated asset values and the related stability risks that Lowe and others have been warning about.At least the blame will fall on many shoulders if the race to the bottom ends badly.
SINGAPORE: India is emerging as the testing and acquisition playground for global consumer technology companies, especially the so-called FAANGs, according to a veteran Internet analyst.RBC Capital Markets' Mark Mahaney, who calls himself Wall Street's "oldest Internet analyst" after covering the sector for more than two decades, said India is now more popular than markets like China because it has the same growth dynamics but with fewer regulations.As one of the largest economies and most populous countries in the world, India has turned into a testing ground for companies such as Facebook, which has used it to beta-test a payments feature for WhatsApp. Netflix rolled out a mobile plan in India at Rs 199 ($2.80), much cheaper than what it charges for a basic plan elsewhere, and has created original content to capture more market share."India does have regulations but it doesn't seem to be as protectionist as China," said Mahaney. India has been considering a new law that would require personal data to be stored locally, which could impair the operations of the Internet giants but Mahaney remains confident they can still penetrate the market.Besides organic growth, acquisitions are another strategy for these companies in India, especially since they are facing more scrutiny back home and in western Europe. "There's an opportunity to build growth" in Asia, particularly in India, Mahaney said.Amazon.com has already tried its hand at deals in the South Asian nation by attempting to acquire Indian ecommerce pioneer Flipkart Online Services, before it was snapped up by Walmart last year.Facebook, Netflix, Amazon and Alphabet can all win big in India, said Mahaney, who has a buy rating on the stocks. "India is less than 5% of Amazon's total revenues but it has the potential" to get to that level within five years, Mahaney said.
