Pastry chef Claire Saffitz attempts to explain what it's like to be the internet's crush

Posted: 13 Jul 2019 07:53 AM PDT

TwitterFacebook

"Claire Saffitz is who I pray to every night before bed," an Instagram user commented under a post from the Bon Appétit themed meme account, meme_appetit.

The 32-year-old pastry chef turned TV show host is an unconventional YouTuber, but fans revere her as the queen of relatable content. In each episode of her YouTube show, Gourmet Makes, enthralled viewers watch Saffitz reverse engineer beloved junk foods, from trash snacks like Cheetos to more refined candies like Ferrero Rocher. She doesn't know what she's going to make before each shoot begins, and spends days figuring out textures, tastes, and shapes. By the third day, she tends to be on the verge of a tempered chocolate-induced breakdown.  Read more...

A number of men foolishly think they could score against Serena Williams in tennis

TwitterFacebook

In today's special tennis-themed edition of "Are men OK, really?" we have a poll in which a number of men greater than zero think they could score a point against Serena Williams in a game of tennis.

One in eight, to be specific. The poll was conducted by YouGov, which asked 1,732 individuals whether or not they thought they could score a point in a tennis match against Serena Williams. Of those surveyed, 12 percent of the men responded with "I think I could."

The actual question was phrased as such: "Do you think if you were playing your very best tennis, you could win a point off Serena Williams?" Read more...

There's a glaring gender imbalance in auto repair, but women want to change that

This post is part of Mashable's ongoing series The Women Fixing STEM, which highlights trailblazing women in science, tech, engineering, and math, as well as initiatives and organizations working to close the industries' gender gaps.

Natalie Flores was seven months pregnant when she got a flat on a desolate stretch of highway. It wasn’t the worst thing that could happen on the road, but when the tow truck driver said there'd be a three-hour wait, she broke down and cried. All she could do was wait for the roadside help before heading on to visit her parents.

"I would be terrified if anything went wrong with my car” — or even if a light went on on the dash — she said in a recent phone call. So, a bit after her flat tire ordeal, she decided to do something about it. She went through her car's owner’s manual to figure out how to change a tire step by step, and then did it on on her own. “Anytime I worked on my vehicle after that felt good," she said. Netflix's 'Point Blank' is a waste of two beloved Marvel stars

Posted: 12 Jul 2019 03:42 PM PDT

TwitterFacebook

The following is a spoiler-free review of Netflix's Point Blank.

Point Blank has way more going for it than it has any right to.

A remake of the 2010 French film of the same name, this action flick features the talents of top-tier actors Anthony Mackie, Frank Grillo, Marcia Gay Harden, Teyonah Parris, and Boris McGiver. Plus some pretty satisfying gore, a bitchin' PT Cruiser, a fun little twist, a handful of tantalizing cliffhangers, and an excellent application of Grandmaster Flash and the Furious Five's "The Message."

But for the most part, Point Blank is forgettable — a fact that feels not only like a letdown for viewers, but a disappointment for leads Mackie and Grillo. Read more...

Facebook got hit with $5 billion fine, but it's what comes next that matters most

Posted: 12 Jul 2019 02:39 PM PDT

TwitterFacebook

The Federal Trade Commission has voted to fine Facebook $5 billion as the result of its long-running investigation into the social network's privacy violations, The Wall Street Journal reported.

The settlement, which has not yet been finalized, according to the report, comes after a lengthy investigation into the company's privacy practices that kicked off last March following the Cambridge Analytica scandal.

Five billion will set a record for the largest such fine ever imposed on a tech company. (Google previously held the record for a $22.5 million fine it received in 2012.) But a multibillion-dollar fine alone will have little impact on the company, which took in more than $15 billion in revenue last quarter alone. Read more...

Let Amazon sell you some books about wealth inequality and climate change

Prime Day, the day Amazon is set to make $2 billion as we shoppers seize deals on electronics filled with mined minerals or accessories formed through melted down plastic, is upon us.

To glom on, succubus like, to the frenzy of Prime Day — but with a subversive twist! — I thought it would be cute to suggest you read some books about the way money, power, shortsightedness, and greed fueled the success of companies like Amazon and their billionaire bosses, at the expense of our wallets, planet, and collective future.

Alas, forgive me.

Searching for books about the topics of waste reduction, climate change, and income inequality, and being immediately served links to buy from the very company that is perpetuating waste production, climate change, and income inequality, invited a certain amount of reflection, and a shameful feeling of hypocrisy.  Read more...

Snapchat's plan to reinvent TV is picking up steam. The company, which hasn't always had an easy relationship with high-profile users, just announced a new lineup of original "Creator Shows" that will star influencers and celebs, including Arnold Schwarzenegger, Serena Williams, and Kevin Hart.

Now, the company is testing a new feature that might make it easier to binge-watch: a dedicated section for shows separate from the main Discover page and other publisher content.

Right now, Snapchat's shows are integrated in the app's Discover section. With the test, which was recently spotted by Mashable in the app, an additional swipe over from the Discover page brings up a hidden "Shows" section.  Read more...

Jon Stewart returns to Capitol Hill to fight for 9/11 first responders funding

Posted: 12 Jul 2019 10:13 AM PDT

Jon Stewart is back on Capitol Hill to support the reauthorization of the 9/11 Victims Compensation Fund.

The comedian and former The Daily Show host made headlines back in June when he gave a powerful speech before Congress urging them to extend funding for 9/11 first responders and calling out inaction

Following the emotional speech, the House Judiciary Committee unanimously voted to reauthorize the bill, and it was put up for a full House vote.

In honor of the House vote, which takes place today, Stewart visited Capitol Hill to show his support. He made another speech before a group that included House Speaker, Nancy Pelosi, saying, "This is necessary, it is urgent and it is morally right. And not only that, you have a program that works." The answer is easy: not having the ability to stream your favorite content. Like at all.

It's usually the case while traveling that you suddenly lose access to your favorite shows and movies because of geo restrictions. Every country has unique content agreements and royalty laws, so what is available in your home country may not be available for streaming in your chosen destination.

Pentagon Is In A Race To Secure A Supply Of Rare Earths In The Event That China Decides To Curb Exports

Reuters: Exclusive: Pentagon races to track U.S. rare earths output amid China trade dispute

The Pentagon is rapidly assessing the United States' rare earths capability in a race to secure stable supply of the specialized material amid the country's trade conflict with China, which controls the rare earths industry, according to a government document seen by Reuters.

The push comes weeks after China threatened to curb exports to the United States of rare earths, a group of 17 minerals used to build fighter jets, tanks and a range of consumer electronics.

The Pentagon wants miners to describe plans to develop U.S. rare earths mines and processing facilities, and asked manufacturers to detail their needs for the minerals, according to the document, which is dated June 27.

Responses are required by July 31, a short time frame that underscores the Pentagon's urgency. The U.S. government's fiscal year ends in September.

Is Ukraine President Zelensky About To Break His Campaign Promises?

Posted: 12 Jul 2019 09:30 PM PDT

Ukraine President Volodymr Zelensky, Reuters

Nicolai N. Petro, National Interest: Will Nationalism Poison Ukraine's New President?

Volodymr Zelensky's election win was a result of Ukraine's pent-up demand for normalcy with Russia. But now it looks like Ukraine's new president is succumbing to nationalist pressure.

Ever since Volodymyr Zelensky's upset victory in April, Ukrainians have been wondering whether their newly elected president will take new approaches to resolve the conflict with Russia. His thumping victory over Petro Poroshenko, who tried to dismiss all of his opponents as puppets of Russian Vladimir Putin puppets, uncovered a strong, untapped desire to end the Russophobia that has been porminant with over the past five years. During that time, the Poroshenko and other senior government officials routinely referred to Ukrainians who wanted better relations with Russia as a "fifth column."

WNU Editor: The above post by Nicolai N. Petro is my must read post for today. Volodymr Zelensky won in a massive landslide on the promise of ending the war, getting rid of all the anti-Russian laws that were passed by former President Poroshenko and his parliament, and a return to normal relations with Russia. If he breaks these promises .... and it looks like he is .... the consequences will be the following. (1) Not only an intensification of the war in the eastern part of the country, but a conflict that will spread to the rest of eastern Ukraine and the southern part of the country where Ukrainian-Russians dominate. (2) In the past five years millions of young Ukrainians have left the country and/or planning to do so. Breaking these promises will only accelerate this migration. (3) If Ukraine hopes to achieve any level of prosperity, they must work with Russia. Persecuting and discriminating the Ukrainian-Russian population is not going to earn President Zelensky any friends in Russia, and definitely not in the Kremlin. Bottom line .... President Zelensky has 4-6 months to deliver on his promises. If he breaks them, the anger that will be directed at him and his government will be enormous.

Reuters: Hezbollah leader says U.S. seeking to talk

BEIRUT (Reuters) - The leader of Hezbollah said on Friday that Washington was seeking to open channels of communication despite ramping up sanctions against the Iran-backed movement's officials.

U.S. President Donald "Trump's administration is seeking to open channels of communication to Hezbollah in Lebanon through mediators. ... These are the American pragmatists," Sayyed Hassan Nasrallah said in an interview with Hezbollah's al-Manar TV without elaborating.

There was no immediate comment from the U.S. State Department on the assertion.

New sanctions this week marked the first time the United States has targeted lawmakers of the heavily-armed Shi'ite Hezbollah, which is part of Lebanon's coalition government.

Tom Rogan, Washington Examiner: Britain is expecting to fight Iran in the Persian Gulf

Britain is deploying another Royal Navy warship to the Persian Gulf, and it's a grave signal.

But the warship now on its way, HMS Duncan, is a Type-45 destroyer. That reflects Britain's increasing expectation of a firefight with Iranian forces. We can say this with confidence for two reasons.

First, because the Royal Navy's Type-45 or Daring-class vessels are far more powerful than the Type-23 destroyer, HMS Montrose, which HMS Duncan is moving to support. The most capable air-defense destroyers in the world, the Daring-class are designed to operate against simultaneous swarms of attack aircraft, drones, and missiles.

Reuters: Hezbollah cut down its forces in Syria: Nasrallah

BEIRUT (Reuters) - Iran-backed Hezbollah has reduced its forces in Syria as fighting died down though it still has fighters all over the country, its leader said on Friday.

The heavily armed Lebanese Shi'ite movement has played a vital role in the war next door, helping Syrian President Bashar al-Assad reclaim much of the country.

"There are no regions in Syria that we have fully emptied out, but there is no need for the numbers to stay the same," Sayyed Hassan Nasrallah said in an interview with Hezbollah's al-Manar TV.

"We have reduced the forces based on the needs of the current situation."

U.S. Intelligence Community Pushes Back On The Department Of Justice's Russia-Gate Investigation

Politico: 'This wasn't just a briefing': Pompeo grilled CIA analysts on Russia findings

The DOJ is now reviewing those same findings after Mike Pompeo found no wrongdoing in how the agency concluded Russia wanted to help Trump in 2016.

Attorney General Bill Barr has ordered an investigation into whether the CIA was correct to determine that Russian President Vladimir Putin wanted to boost Donald Trump during the 2016 election.

But that question has already been asked and answered at the CIA's highest levels — by Mike Pompeo, a Trump loyalist, according to three people familiar with the matter.

Just after Pompeo took over as CIA director in 2017, he conducted a personal review of the CIA's findings, grilling analysts on their conclusions in a challenging and at times combative interview, these people said. He ultimately found no evidence of any wrongdoing, or that the analysts had been under political pressure to produce their findings.

WNU Editor: Here is another report quoting anonymous sources within the intelligence community who are pushing back on a Department of Justice investigation on how did they make their determination that the Kremlin made a decision to assist candidate Trump to win the election. Here is an easy prediction. Their push-back is going to fail. This blog has stated numerous times that because of the severity of the accusations and its impact on the Presidency for the past two and a half years, a full disclosure on every aspect of this case should be made public. I find it astounding that aside from some evidence that a Russian troll farm spent around $100,000 on Facebook, no other evidence has been presented. Should we take the intel community's word for it? Considering its impact and the lingering cloud that hangs over President Trump's head. My answer is no.

If Venezuela Falls Will Cuba Be Next?

US News and World Report: If Venezuela Falls, So Does Cuba, Experts Say

With Venezuela dealing with one of the worst economic crises in its history, economists warn that Cuba's dependency on its Latin American ally will have dire consequences.

The economic crisis in Venezuela has turned millions of its citizens into refugees who are fleeing the country's hyperinflation and shortages in food and medicine. Now, it is having other spillover effects by dragging down an already ailing Cuban economy, two regional economists say.

A plunge in aid from Venezuela, along with a hardened trade embargo by the United States, has brought Cuba to its worst economic crisis since the post-Soviet depression in the 1990s, Carmelo Mesa-Lago, professor emeritus of economics and Latin American Studies at the University of Pittsburgh, and Pavel Vidal Alejandro, associate professor economics at the Pontifical Xavierian University in Cali, Colombia, write in their report.

WNU Editor: The Cuban government will not fall. There are still too many people in Cuba who believe in the system, and coupled with their pride will not be open for change. The Cuban security apparatus is also something to be feared. They are brutal and extremely effective, and will crush dissent and opposition when it appears. Venezuela is a different story. The economy has collapsed, and it is now a failed state. And while there is still strong support for Chavismo and all of its wretched policies, with each passing month of misery and suffering that support rots away. Venezuela also has a history and culture of political change, and calls for change are now deafening.

Iran Orders 'Foreign Powers' To Leave The Strait Of Hormuz

Business Insider: Iran orders 'foreign powers' to leave the Strait of Hormuz, and says the West is playing a 'dangerous game' over Gibraltar tanker seizure

* Many of the latest escalations between Iran and the West have been taking place in the Strait of Hormuz, a narrow waterway that sees $1.2 billion worth of the world's oil flow through it every day.
* On Wednesday, three Iranian gunboats harassed a British oil tanker in the strait, the UK said.
* Iran's foreign ministry spokesman warned on Friday: "Foreign powers should leave the region."
* Iran has threatened to disrupt maritime traffic in the strait multiple times in the past, as doing so could decrease the world's oil supply and send prices shooting up.
* The spokesman also lashed out at Britain was playing a "dangerous game" by seizing an Iranian oil tanker in Gibraltar last week.
Nuclear-deal tensions between Iran and the West also remain unresolved.

Iran has told "foreign powers" to leave its surrounding regions and warned that the rapidly-escalating tensions between Tehran and the West are "a dangerous game."

"Foreign powers should leave the region because Iran and other regional countries are capable of securing the regional security," Iranian foreign ministry spokesman Abbas Mousavi told the state-run IRNA news agency on Friday, according to Reuters.

It is not clear what "the region" entails specifically, or who the "other regional countries" are.

Chinese And Vietnamese Coastguard Vessels In Stand-Off Over Chinese Survey Ship Mission

SCMP: China and Vietnam in stand-off over Chinese survey ship mission to disputed reef in South China Sea

* Coastguard vessels eye each other across Vanguard Bank
* Haiyang Dizhi entered waters near reef to carry out seismic survey operation

Chinese and Vietnamese coastguard vessels have been involved in a week-long confrontation over a reef in the South China Sea, risking the biggest clash between the two nations in five years.

The stand-off may trigger a wave of anti-China sentiment in Vietnam not seen since 2014, when a Chinese oil rig arrived off the disputed Paracel Islands.

Six heavily armed coastguards vessels – two Chinese and four Vietnamese – have been eyeing each other in patrols around Vanguard Bank in the Spratly group of islands since last week. About a dozen vessels were reported in the vicinity by marine tracking websites on Thursday.

The stand-off emerged despite a pledge in May by Chinese and Vietnamese defence ministers to settle maritime disputes by negotiation.

Beijing said on Friday it will issue sanctions against the US companies involved in the latest arms sale to Taiwan, as tensions between China and the United States continue to rise.

The foreign ministry said in a brief statement that the move by Washington had violated China's territorial sovereignty and national security.

"To protect our national interest, China will impose sanctions on the US companies involved in the arms sale," ministry spokesman Geng Shuang was quoted as saying.

Taiwanese President Tsai Ing-wen Arrives In The U.S.

Epoch Times/Reuters: Taiwan President Arrives in US After Warning of Threat From Mainland China

NEW YORK—Taiwanese President Tsai Ing-wen arrived in the United States on July 11 on a trip that has angered Beijing, warning that democracy must be defended and that the island faced threats from "overseas forces," in a veiled reference to China.

China's ruling Chinese Communist Party (CCP), which claims self-ruled and democratic Taiwan as its own and views it as a wayward province, had called on the United States not to allow Tsai to transit there on her overseas tour.

"I want to reiterate that Taiwan is not, and will never, be intimidated," Tsai told a reception in New York for representatives of Taipei's 17 remaining diplomatic allies, almost all small Central American, Caribbean, or Pacific nations.

BBC: Threat level raised to 'critical' for UK ships in Iranian waters

The UK has raised the threat to British shipping in Iranian waters in the Gulf to the highest level - where the risk of attack is "critical".

The step was taken on Tuesday, amid growing tensions in the region.

On Wednesday, Iranian boats tried to impede a British oil tanker in the region - before being driven off by a Royal Navy ship, the MoD said.

Iran had threatened to retaliate for the seizure of one of its own tankers, but denied any attempted seizure.

The Department for Transport said it regularly provided security advice to UK ships in high-risk areas.

Gen. Mark Milley

CNN: China will be US military's 'primary challenge' for decades, says top general

China will remain the "primary challenge" to the United States military for as long as a century, warned President Donald Trump's nominee for chairman of the Joint Chiefs of Staff on Thursday.

China had learned from watching the US go to war in the Middle East, and was using those lessons to advance the development of its own military, said current Army Chief of Staff General Mark Milley at his confirmation hearing before the Senate Armed Services Committee.

"China went to school on us," Milley said, responding to a question from Democratic Sen. Tim Kaine of Virginia.

"They watched us very closely in the First Gulf War, the Second Gulf War. They watched our capabilities. And in many many ways, they have mimicked those, and they have adopted many of the doctrines and organizations."

Russian-made S-400 anti-aircraft missile systems were delivered to Turkey on Friday after Washington warned they would face sanctions for the purchase.

Russian Defense Companies Are Facing A Credit Crunch

TASS: Russia's defense companies "starving" as they serve financial institutions, says Deputy PM

Yuri Borisov expressed hope that the next meeting of the defense commission in September 2019 would focus on the issue of loans for defense contractors

YEKATERINBURG, July 8. /TASS/. Russia's defense contractors are forced to be on a tight budget due to the heavy debt burden, Deputy Prime Minister Yuri Borisov said at the Innoprom international industrial exhibition on Monday.

"The industrial sector that manufactures products is starving as it services financial institutions that produce nothing and are only meant to ensure the process of manufacturing process management and product introduction. Meanwhile, they (financial institutions) have profit multi-fold higher than manufacturers," he emphasized.

"We have repeatedly asked President to clean the loan portfolio. Various mechanisms may be used," Deputy PM added.

Novak Djokovic Wins Longest Point Ever Recorded at Wimbledon

Posted: 12 Jul 2019 02:49 PM PDT

(WIMBLEDON, England) — Going by the number of strokes, it was the longest point ever recorded at Wimbledon. And for Novak Djokovic, it went a long way toward putting him into another final at the All England Club.

After exchanging dozens of strokes during the third set of his semifinal match against Roberto Bautista Agut on Friday, Djokovic finally smacked a backhand down the line with the 45th shot of the rally to save a break point. The defending champion held serve to make it 5-2 and went on to win the match 6-2, 4-6, 6-3, 6-2.

According to official statistics, the 45-stroke rally was the longest at Wimbledon since they started tracking point lengths in 2005. But for Djokovic, the important part was the impact it had on what was a very closely-fought duel up until that stage.

“At one stage of the match, it could have gone (a) different way. Was very close in the third set,” said Djokovic, who faces Roger Federer in Sunday’s final as he goes for a fifth Wimbledon title. “Couple of very long games when I broke his serve and he had some break points, a very long rally. I managed to make a winner down the line with a backhand. Obviously winning that game was crucial for me. It gave me more confidence and relief so I could swing more freely in the next games.”

Aside from the number of strokes, the point itself was perhaps not that memorable. For much of it, both players seemed content with just hitting the ball back over the net and waiting for the other to make a mistake. The last 18 strokes were all crosscourt backhands, with the players remaining in more or less the same position until Djokovic finally switched it up with his shot straight down the line.

That was at 30-40, and Bautista Agut had missed a previous break point as well at 15-40, which he said made him a bit more cautious on his second opportunity.

“I had an easy forehand (on the first break point). I went too much for it,” the Spaniard said. “Then the next point I wanted to play — I didn’t want to take a risk on the point, to play long, to play a good rally. Was maybe one of the best points of the match.”

The previous Wimbledon record was 42 strokes, set in a 2006 match between Jarkko Nieminen and Dmitry Tursunov. The women’s record is 39, set in a 2007 match between Nathalie Dechy and Elena Dementieva. Rallies on grass are usually shorter than on clay or hard courts.

Finance secy just told India Inc way around tax on dividends

Posted:

Finance Secretary Subhash Chandra Garg on Friday ruled out any change in the dividend distribution tax, but expressed flexibility that grandfathering tax on buybacks can be discussed with the revenue department. The key changes in Budget's taxation-related measures affecting the deal market include the extension of buy-back tax-related provision to listed entities. This provision was earlier introduced as an anti-abuse measure to check the practice by unlisted companies to distribute accumulated profits through the buyback route rather than the dividend declaration route, thereby evading dividend distribution tax (DDT)."There is no change in Dividend Distribution Tax, there is no plan to change it. I am not in a position to say on grandfathering buyback tax, but can discuss it with the revenue department," said Finance Secretary Subhash Chandra Garg at a CII event on Budget discussion. In the Budget, the government taxed the buyback route to check dividend distribution tax evaders. But Garg offered ways to get out of the tax on buybacks."Dividend distribution Tax is going to stay. There is no plan to change. But there is a way if you invest in REIts and InVits (REITs, or real estate investment trusts, or infrastructure investment trusts), there is a way to save from this tax. If it is investment-oriented, then you have a way to be away from DDT ", Garg said.Finance Minister Nirmala Sitharaman has proposed closing the buyback route used by corporates to avoid paying taxes. Earlier, corporates preferred using the buyback route after the government levied a dividend distribution tax of 10 per cent in 2007, which was further hiked by a similar quantum in 2016.In the last three years, more than 170 companies, mainly in the IT sector, have bought back shares worth Rs 1.33 lakh crore. A number of IT sector companies, including Infosys, Wipro, and Tata Consultancy Service, have in the recent past announced big buybacks.Finance Minister Nirmala Sitharaman has now plugged this loophole by taxing buybacks at the rate of 20 per cent, similar to those applicable on unlisted companies.Taxation of dividends: Dividends paid by a domestic company are subject to Dividend Distribution Tax (DDT) at 15% of the aggregate dividend declared, distributed or paid. The DDT payable is required to be grossed up. The effective rate is 20.3576%, including a 12% surcharge and a 3% education cess.Garg said the domestic market is crowded due to government borrowings, so, private sector is unable to borrow. If government even borrows 10% from abroad, it will free Rs 70,000 crore for private companies. He further said a 5 trillion dollar economy is achievable if the economy grows at 8% per annum and with 4% inflation, 12% nominal growth rate, 1-1.5% depreciation of the rupee vis-a-vis dollar value and the growth is doable and pragmatic.Stressing the continuation of fiscal deficit path of 3.3% , the secretary said the government has opened up many sectors such as insurance and has also raised FPI limits of 24% subject to sectoral caps. The 5 trillion dollar investment path will be led by private sector, he said .To attract more global investment, the government will consider further opening up of foreign direct investment in aviation, media, animation, and the insurance sector in consultation with stakeholders.

Baby talc nightmare comes back to haunt J&J

Posted:

By Jef FeeleyThe US Justice Department is pursuing a criminal investigation into whether Johnson & Johnson lied to the public about the possible cancer risks of its talcum powder, people with knowledge of the matter said. The criminal probe, which hasn't been reported previously, coincides with a regulatory investigation and civil claims by thousands of cancer patients that J&J's Baby Powder talc was responsible for their illness. Now, a grand jury in Washington is examining documents related to what company officials knew about any carcinogens in their products, the people said.Baby Powder accounts for only a tiny fraction of J&J's annual revenue, but it's been a core brand for the company for more than a century. Questions about the product's safety have led to more than 14,000 lawsuits from consumers asserting that the company's talc products caused their ovarian cancer or mesothelioma, a rare form of the disease linked to asbestos exposure.J&J disclosed in February that it had received subpoenas, but little was known then about the investigation behind them, including whether the matter was civil or criminal."We have been fully cooperating with the previously disclosed DOJ investigation and will continue to do so," said J&J spokeswoman Kim Montagnino. "Johnson's Baby Powder does not contain asbestos or cause cancer, as supported by decades of independent clinical evidence."The Justice Department didn't immediately respond to requests for comment.Shares of J&J declined as much as 5.1% on Friday, sliding to $132.97, the biggest intraday decline in more than a month, for a loss of about $19 billion in market value.Internal MemosJ&J, the world's largest maker of health care products, has said safety tests of its Baby Powder over many decades have shown no presence of asbestos. But some of the lawsuits have turned up internal memos as far back as the 1960s and '70s that contain warnings from company scientists that asbestos detected in J&J's talc was a "severe health hazard" that could pose a legal risk for the company.Justice Department prosecutors, FBI agents and Securities and Exchange Commission regulators are almost surely looking at whether J&J officials' public denials that their talc-based products ever contained asbestos were truthful, legal experts said. SEC spokeswoman Judy Burns declined to comment.Nearly a dozen juries have concluded J&J knew that some of their Baby Powder and former Shower-to-Shower products had at least trace amounts of asbestos and failed to disclose that to consumers. Over the past three years, jurors have awarded a total of more than $5 billion to people who blame the powders for their cancers. The company has said it has set aside money for legal costs related to talc claims but hasn't said how much. Bloomberg Intelligence estimates that civil settlements could cost J&J as much as $15 billion overall. J&J says it has no liability because the products are safe.Shares of J&J plunged as much as 17% in December -- erasing billions in value -- after news reports about memos appearing to show that J&J executives knew the products were contaminated with the asbestos as early as the 1970s.Document RequestsThe February document requests from the Justice Department, the SEC and the top Democrat on the Senate Committee on Health, Education, Labor and Pensions sought information about the company's knowledge of asbestos in its talc-based products. J&J said it would be "cooperating with these government inquiries and will be producing documents in response."The grand jury was impaneled after the Justice Department's fraud unit started an investigation. Investigators are probably looking for more internal communications that might conflict with the company's public statements, said Henry Klingeman, a former federal prosecutor now in private practice in New Jersey."Since J&J is a public company, they are probably looking at whether their statements amounted to fraudulent statements to consumers and regulators," Klingeman said in an interview. "I'd also think they'd be looking at whether they violated securities-fraud laws."The grand jury inquiry is likely to influence any talks between J&J and plaintiffs over resolving their claims out of court, said Peter Henning, a law professor at Wayne State University in Detroit."This will make it more difficult for Johnson & Johnson to settle the civil cases as long as there is a continuing criminal investigation, which may require employees to testify before a federal grand jury," Henning said. "Civil plaintiffs may not want to settle until they know better whether criminal charges will be filed, which they can use to aid their cases."Investor SuitsIn addition to the consumers' suits, some J&J investors have accused the company of defrauding them, arguing in lawsuits that J&J failed to disclose that its powder was tainted and that the company's shares were artificially inflated as a result.Jacob Frenkel, a former SEC trial lawyer now in private practice in Washington, said there's no timeline for grand-jury investigations and no certainty it will result in charges. "This could be a high-profile government investigation that goes nowhere," he said. "Regardless of the outcome, the timetable for such investigations can measure in years, not months," he added.Baby powder is mostly talc, a mineral used to keep skin dry and as an astringent to prevent diaper rash. It's also used in consumer products such as makeup, paint and dietary supplements. But geological formations that contain talc also yield asbestos, a mineral once used in products such as building insulation.Scientists have found strong links between asbestos and mesothelioma, while plaintiffs' lawyers claim that studies have also shown a link between talc and ovarian cancer. In court filings, J&J has disputed both contentions.Indemnity AgreementJ&J sold the rights to its Shower-to-Shower talcum powder to Valeant Pharmaceuticals International Inc. in 2012. Valeant, which changed its name to Bausch Health Cos last year, has an indemnity agreement with J&J covering asbestos suits tied to the powder.Juries in states such as Missouri, California and New Jersey have ruled for some of the plaintiffs since suits started going to trial in 2016. However, some of those verdicts have been thrown out by judges and others are on appeal. Some other cases have resulted in hung juries or outright wins for J&J.Most of the ovarian cancer cases, along with investors' suits, have been consolidated before a federal judge in New Jersey for pretrial information exchanges and test trials. The first trials of those cases haven't yet been set.

S-400 missile system: All you should know

Posted:

Turkey on Friday received the first deliveries of Russia's S-400 missile defence systems despite Washington threatening the NATO member with sanctions over the controversial deal. The delivery marks a new high in warming ties between Ankara and Moscow. Here is what you need to know about Russia's most modern anti-aircraft defence system. The Russian army began using the S-400, designed to intercept and shoot down any threat from the sky, in 2007.According to its producer, the state-owned Almaz-Antey company, it has a range of 400 kilometres (250 miles) and can be deployed within just five minutes. It consists of several vehicles: a command centre, various mobile radar stations and up to 12 launch vehicles that each carry four missiles.Dozens of S-400s have already been deployed throughout Russia, from the country's most western point in the Kaliningrad exclave to its far eastern corners.Four S-400s are also stationed in Crimea, the Black Sea peninsula annexed by Russia from Ukraine in 2014.Two have been deployed to Syria, where Moscow intervened militarily on the side of the Damascus regime, to protect Russia's airbase in Hmeimim and the Tartus naval facility.China was the first country to buy the weapon from Russia, ordering several S-400s for an estimated $3 billion. Deliveries began in April 2018 and the first tests took place at the end of June 2019. Few other details of the missile deal were made public.India bought five S-400 systems for $5.2 billion. Their delivery is due to begin at the end of next year.Around a dozen other countries -- including Iraq, Qatar and Saudi Arabia -- have shown interest in the S-400, in some cases as a means of putting pressure on the US to lower prices on its weapons systems. The S-400 is one of the most modern air defence systems in the world, and comes at a lower price than its US competitor, the Patriot.Washington has made clear it opposes Turkey purchasing the S-400. It gave Ankara until July 31 to give up the deal, threatening to remove Turkey from its F-35 fighter jet programme. The US and NATO have said the S-400 is incompatible with equipment used by other members of the alliance.Moscow has been able to use the S-400 as a political weapon: by selling the system to Turkey, it sows discord between Ankara and its NATO allies, whose ties are already strained.Russia plans to launch the S-500, the successor of the S-400, in the 2020s. Moscow has said it will be able to reach low orbit and target satellites.

India-US trade talks end without major progress

Posted:

NEW DELHI: US and Indian trade negotiators ended talks on Friday without making major progress on a range of disputes over tariffs and other protectionist measures imposed by both sides that are straining bilateral ties, according to officials with knowledge of the discussions. Many of the toughest questions on agricultural commodities, e-commerce, and steel and aluminum, have been put off until Indian Commerce and Industry Minister Piyush Goyal goes to Washington for talks with United States Trade Representative Robert Lighthizer next month. The dates for that trip are yet to be settled."No breakthrough," said one of the senior Indian officials involved in the talks in New Delhi, which lasted a little over three hours. He declined to make any further comment. Two other Indian officials said they hoped that some of the issues will be resolved when Goyal goes to Washington.Friday's talks were more about understanding each other's positions in various disputes, they said.In a short statement issued late on Friday, the Indian government said the countries agreed to continue their discussions for "addressing mutual trade concerns".The two sides resumed talks after US President Donald Trump and Prime Minister Narendra Modi met on the sidelines of the G20 summit in June and agreed to seek to deepen the two countries' relationship.Trump said at that summit that there would be a "very big trade deal" with India, though he set no timeline, and has only this week used Twitter to attack what he calls high Indian tariffs on American goods as "no longer acceptable".TIT-FOR-TAT MOVESThe US sought the rollback of Indian tariffs imposed on some agricultural products, such as almonds, when the two sides met on Friday, said one of the Indian government sources. Those tariffs were imposed in response to the Trump administration's decision to remove trade privileges from Indian products under the Generalized System of Preferences. India has asked for those privileges, effectively zero tariffs on a range of Indian products entering the United States, to be reinstated.India did not commit to any changes to foreign investment rules for foreign e-commerce firms such as Walmart's Flipkart and Amazon, one of the Indian sources said. The rules have forced the two American companies to rework their business strategies for India.Walmart told the US government privately in January that India's new investment rules for e-commerce were regressive and had the potential to hurt trade ties, Reuters reported on Thursday. One concern now among Indian policymakers is that the Trump administration may push for a free trade agreement with India that could dent India's competitiveness, lead to a flurry of imports and hurt Modi's "Make in India" plan.In a recent meeting, Foreign Minister Subrahmanyam Jaishankar told trade ministry officials that "Trump is clearly preparing for a larger game, a larger opening", according to one of the officials aware of the discussions.

RBI's reports never mentioned possible IL&FS crisis: Arvind Subramanian

Posted:

NEW DELHI: Former CEA Arvind Subramanian Friday criticised the RBI for its regulatory failures, saying its Financial Stability Reports never mentioned about the possible liquidity crisis in the IL&FS, one of the largest NBFC in the country.Subramanian further said that India's biggest challenge at the moment is twin balance sheet problem."While RBI is one of the best institution, we have. We had some massive failures like Infrastructure Leasing & Financial Services (IL&FS). If I am not wrong, if you go back, and see Financial Stability Reports of last 4-5 years, I don't think IL&FS was specifically mentioned as a possible problem, something to be watched out for," he said at an event here.Recently, Subramanian was in news for claiming that India has been overestimating its GDP by 2.5 per cent between 2011-12 and 2016-17.Subramanian, a visiting lecturer in Public Policy at the Harvard University, was the CEA in finance ministry from October 2014 to June 2018.The cash-strapped IL&FS group is sitting on a debt of about Rs 94,000 crore.Several group companies have defaulted on the payment of interests on loans. The problems at the diversified IL&FS group, that has been going in for many years, came to light when it defaulted on debt repayments last year. The IL&FS crisis had contagious effect on the NBFC (Non-banking financial company) sector as liquidity started drying up for them.Finance Minister Nirmala Sitharaman in the Budget proposed steps to help the crisis-ridden sector.

Tata Steel, JSW draw water sustainability strategies

KOLKATA: With several cities facing water crisis, companies such as Tata Steel and JSW are focusing on sustainability of water, a critical resource for steel majors apart from iron-ore and coal."Our water sustainability strategy for future- readiness is to continue investing in sewage treatment plant (STP), and creating new rain water harvesting (RWH) structures at various locations to improve the groundwater table," Tata Steel said in its latest annual report.A 25 millions of litres per day (MLD) tertiary treatment plant was commissioned at its Bara STP to convert sewage water of the Jamshedpur township into process water for reuse in steel manufacturing."This will help us to reduce our fresh water consumption by 18 per cent in the future," the company said. The steel maker also said 29 million litres of RWH structures were added at the Joda east iron ore mine in the last fiscal."Water is a critical resource used as a coolant in the steelmaking process. Currently, over 3m3 of freshwater is required per tonne of crude steel produced," Tata Steel said in the report.Another steel major, JSW Steel, is creating infrastructure for recycling water and implementing technology to lower fresh water intake. It is building a 500m3/day STP and new technology at the steel melting shop in Vijaynagar for reduced fresh water consumption and rainwater harvesting at the Dolvi plant, the company said.

Pharma sector to post double-digit revenue growth in Q1: Analysts

Posted:

Mumbai: India's top drug companies are likely to end a period of slow growth, with analysts predicting a double-digit revenue expansion for the just-ended quarter.A report by brokerage firm Jefferies predicts Indian pharma companies to report 15 per cent growth in revenue in the April-June quarter, the fastest in the past three years, while ratings firm Icra forecasts their revenue to expand 11-13 per cent in fiscal year 2020. They estimate the companies to have benefited from exclusive drug launches, new approvals and, for some, a recovery in India business. On the profitability side, Jefferies predicts a 10 per cent year-on-year profit growth after tax.Market cap of leading Indian drug makers like Sun Pharmaceutical Industries and Dr Reddy's has collectively seen a $1 billion reduction in the past two years, as companies battle stringent regulatory actions from authorities in the US, along with price erosion and tepid drug launches in its most profitable market. But things might be finally turning for better for drug makers, despite underlying challenges.Jefferies said it expects the US business to be a mixed bag, with some companies faring better than the others over their exclusive drug launches. Domestic growth, it said, would "likely moderate across companies".Sun Pharma, which had seen a slowdown in the last two years due to regulatory action, is expected to post a recovery on the back of its increased drug filings and a possible ramp up of specialty drug Ilumya. Cipla, which has been trying to make its mark in the US market, is expected to report a 16 per cent revenue increase with the launch of the generic version of hormone drug Sensipar.Icra, which tracked 21 drug companies, said moderation in pricing pressure, new launches, consolidation benefits and currency benefit would support their US growth."For the US market, companies witnessed positive growth momentum at 21.3 per cent Q4FY2019 and 10.7 per cent FY2019 Vs -13.1 per cent in FY2018," said Gaurav Jain, the vice-president of corporate ratings at Icra. The firm expects the base business growth for the Indian pharma industry to remain at 11-13 per cent in FY2020 and the credit metrics of leading companies to remain stable in view of future growth prospects in regulated markets and relatively strong balance sheets. "The capital structure and coverage indicators are expected to remain strong despite pressure on profitability and a marginal rise in debt levels given inorganic investments. The key sensitivity to Icra's view remains productivity of R&D expenditure, increasing competition in the US generics space and operational risk related to increased level of due diligence by regulatory agencies," it said.
