WASHINGTON - The leader of the House of Representatives committee weighing articles of impeachment against President Donald Trump contended Sunday that there is a "rock solid case" against the U.S. leader.
Congressman Jerrold Nadler declared on CNN that Trump would be found guilty in "three minutes flat" if he were facing charges before a criminal court jury that he abused his office by soliciting Ukraine to investigate one of his chief 2020 Democratic presidential challengers, former Vice President Joe Biden.
Nadler said if Trump "had any exculpatory evidence," he would be making it known rather than rejecting participation, as the White House has, before the Democratic-controlled House Judiciary Committee's consideration of impeachment allegations against the Republican president.
An investigation by the Justice Department's internal watchdog is expected to find that the FBI's Russia probe was valid but flawed, The Associated Press reported Sunday.
Inspector General Michael Horowitz's report, which is scheduled to be released on Monday, is anticipated to counter President Trump's claims that the FBI investigation into Russian election interference and his 2016 campaign's alleged connections to Moscow was unfounded, according to the AP.

Mexico had asked the US not to label cartels as terrorist groups due to concerns over sovereignty. The issue came to the fore after nine US-Mexican citizens were killed by cartel members in early November.

The decision came in response to a request from Mexican President Andres Manuel Lopez Obrador, whose government said the terrorism label would infringe on its sovereignty.

WASHINGTON, Dec. 5 (UPI) -- The chances that China will invade Taiwan have increased, but the risk might be too great, two experts said at a conference in Washington, D.C.
"As each day, week, month and year pass over the course of the next decade, there will be increasing pressure within Zhongnanhai to use force," James Fanell, former U.S. Pacific Fleet director of intelligence and information operations, said at a Center for Strategic and International Studies conference. Zhongnanhia is the headquarters of the Communist Party of China.
But Tim Heath, a senior international defense researcher at the RAND Corp., said at the conference Wednesday that China knows using military force could strengthen alliances trying to dampen Chinese growth as a global leader.
An independent international audit of Bolivia's disputed election in October has detailed "deliberate" and "malicious" efforts to rig the vote in favour of then-President Evo Morales.
The Organization of American States (OAS) said the measures included hidden servers and falsified signatures.
Mr Morales fled to Mexico after the army urged him to quit. He has not commented on the report.
The interim president has pledged new elections but no date has yet been set.

WASHINGTON — A group of elite Russian military intelligence officers, including some of those who planned the poisoning of a defector in Britain, have been operating out of picturesque villages in the French Alps, Western intelligence officials tell NBC News.
Confirming a report in France's Le Monde daily that could have been ripped from the pages of a John le Carré spy novel, the officials said European and American intelligence agencies had been tracking up to 15 members of the Russian military intelligence agency known as the GRU who had lived for a time in France. Le Monde published what it said were the names of the officers, some of which had already been published by Bellingcat, an open source investigative group.
Le Monde reported that among the Russians who stayed in France's Haute-Savoie department in the Alps were Alexander Petrov and Ruslan Boshirov — the alleged cover names of the two GRU agents accused of carrying out the attack on Skripal. French officials told the newspaper they considered the area to have been the unit's rear base for covert operations in Europe.
The US has resumed talks with the Taliban in Qatar, a US source said, in a renewed bid to end the long war in Afghanistan. It comes months after the US president abruptly halted diplomatic engagement with the insurgents.
US talks with the Taliban were resurrected in the Qatari capital on Saturday, according to reports.
"The US rejoined talks today in Doha. The focus of discussion will be reduction of violence that leads to intra-Afghan negotiations and a ceasefire," a US source told the AFP news agency on Saturday.

A Russian television network has given a rare glimpse into one of three carefully guarded briefcases that Moscow could use to trigger nuclear strikes.
The case, which has a personalised key code, a flash card and is under constant supervision, is said to remotely control Russia's nuclear arsenal.
It allows president Vladimir Putin to give the order to launch a nuclear weapon by sending a permission code to the Strategic Missile Forces. The cases can also warn Putin and two other high-ranked officials who carry them of any early signs of a nuclear attack.
The U.S. military believes that an unarmed American drone reported lost near Libya's capital last month was in fact shot down by Russian air defenses and it is demanding the return of the aircraft's wreckage, U.S. Africa Command says.

BAGHDAD (Reuters) - A rocket fired from a drone targeted the home of populist Iraqi cleric Moqtada al-Sadr on Saturday, lawmakers from his Saeroon party said, following one of the capital's bloodiest nights in recent weeks.
The drone attack, which caused little damage and left no casualties, followed a deadly attack by armed men near Baghdad's main protest site on Friday night, which left at least 23 dead, police and medical sources said.
Nearly 130 others were wounded by gunfire and stabbings targeting anti-government protesters at the Sinak bridge near Tahrir Square, the sources said. The death toll includes three members of the police.
(BEIJING) — People who were at vocational training centers in China’s far west Xinjiang have all ”graduated” and are living happy lives, an official said Monday. But Uighurs and other predominantly Muslim ethnic minorities from the region say their family members continue to be arbitrarily detained in camps and prisons.
Shohrat Zakir, Xinjiang’s Uighur governor, made the remarks during a press briefing as part of a strident propaganda campaign launched following U.S. Congress’ approval last week of the Uighur Human Rights Policy Act.
“When the lives of people of all ethnic groups in Xinjiang were seriously threatened by terrorism, the U.S. turned a deaf ear,” Zakir said at a press briefing. “On the contrary, now that Xinjiang society is steadily developing and people of all ethnicities are living and working in peace, the U.S. feels uneasy, and attacks and smears Xinjiang.”
The U.S. legislation condemns the mass detentions of an estimated more than 1 million Uighurs, Kazakhs and others. It also raises possible sanctions against Chinese government officials deemed responsible for human rights abuses in Xinjiang.
Former detainees and their relatives have told The Associated Press that the centers for “re-education” were essentially prisons where they were forced to renounce Islam and express gratitude to the ruling Communist Party. They were subject to indoctrination and torture, the detainees said.
While Chinese authorities have described the detentions as a form of vocational training, classified documents recently leaked to a consortium of news organizations revealed a deliberate strategy to lock up ethnic minorities even though they had not committed any crimes.
Xu Hairong, the Communist Party chief of Urumqi city, Xinjiang’s capital, did not dispute the documents’ authenticity. He said, however, that there was no such thing as “detention camps.”
“The reports by The New York Times, the International Consortium of Investigative Journalists and other foreign media organizations are purely malicious attempts to smear and discredit Xinjiang’s vocational education centers and its counter-terrorism and de-radicalization efforts,” Xu said.
Officials have repeatedly declined to say how many people are in the centers but insist the figure is far less than 1 million. Zakir said Monday the number is “dynamic.”
All those in the centers who were studying Mandarin Chinese, law, vocational skills and deradicalization have “graduated” and found stable employment, Zakir said, adding that others such as village officials, farmers and unemployed high school graduates continue to enroll on a rolling basis in programs that allow them to “come and go freely.”
Some ex-detainees have told AP they were forced to sign job contracts and barred from leaving factory grounds during weekdays, working long hours for low pay. Many Uighurs abroad also say their relatives are in prison, not camps, after being sentenced on vague charges of extremism.
Monday’s briefing was the latest in a slew of public rebuttals from the Chinese government in response to the U.S. Uighur human rights bill, which Beijing has called a violation of international law and interference in China’s internal affairs. The legislation further muddied U.S.-China ties, which were already strained over trade and pro-democracy demonstrations in Hong Kong.
During the briefing, officials played a clip from a documentary released last Friday by CGTN, the international branch of state broadcaster CCTV. The documentary, called “Fighting Terrorism in Xinjiang,” showed old footage of terrorist attacks over the last decade, including bombings and stabbings such as the knife attack that killed 31 people outside a railway station in southern Kunming city in 2014.

(WELLINGTON, New Zealand) — A New Zealand volcanic island erupted Monday in a tower of ash and steam while dozens of tourists were exploring the moon-like surface, killing five people and leaving many more missing.
The site was still too dangerous hours later for police and rescuers to search for the missing.
Police Deputy Commissioner John Tims said the number of those who remained missing was in the double digits but he couldn’t confirm an exact number. He said there were fewer than 50 people on the island when it erupted and 23 had been taken off, including the five dead.
Tims said experts had told them the island remained unstable but search and rescue teams wanted to get back as quickly as they could. He said there had been no contact with any of those who were missing.
He said both New Zealanders and overseas tourists were among those who were dead, missing or injured. He said most of the 18 who survived were injured and some had suffered severe burns.
Some of those involved were guests from the Royal Caribbean International cruise ship Ovation of the Seas.
“A number of our guests were touring the island today,” the company said. “We will offer all possible assistance to our guests and local authorities. Please keep all those affected in your prayers.”
The cruise ship, which had left from Sydney last week, was scheduled to sail to the capital Wellington on Monday night but the company said it would instead remain in the Tauranga port overnight until it learned more on the situation.
“My god,” wrote Michael Schade on Twitter as he posted video of the eruption. “My family and I had gotten off it 20 minutes before, were waiting at our boat about to leave when we saw it. Boat ride home tending to people our boat rescued was indescribable.”
His video showed a wall of ash and steam around the island and a helicopter badly damaged and covered in ash. He said one woman was badly injured but seemed “strong” by the end.
Prime Minister Jacinda Ardern said she was traveling to the region late Monday. She said the incident was “very significant.”
“All our thoughts are with those affected,” she said.
Brad Scott, a volcanologist with research group GNS Science, said the eruption sent a plume of steam and ash about 12,000 feet (3,660 meters) into the air. He said it had also affected the whole of the White Island crater floor.
The GeoNet agency, which monitors volcanoes and earthquakes in New Zealand, at first raised its alert level to four, on a scale where five represents a major eruption. It later dropped the alert level back down to three. Scott said that was because the eruption wasn’t sustained beyond the initial blast.
White Island sits about 50 kilometers (30 miles) offshore from mainland New Zealand. Already people are questioning why tourists were still able to visit the island after scientists recently noted an uptick in volcanic activity.
GeoNet raised the alert level on White Island from one to two on Nov. 18, noting an increase in the amount of sulfur dioxide gas, which originates from magma deep in the volcano. It also said at the time that over the previous weeks, the volcanic tremor had increased from weak to moderate strength.
Scott said the alert level was often raised and then later dropped again without any eruption. He said there hadn’t been any major incidents with tourists visiting the island in the past, although there had been some close calls.
Scott said it was not for him to say whether the island was safe enough to host tourists immediately before Monday’s eruption.
Ardern said the focus remained on the search and rescue mission for now and questions about whether tourists should be visiting would be addressed later.
“In the scheme of things, for volcanic eruptions, it is not large,” said Ken Gledhill from GeoNet. “But if you were close to that, it is not good.”
White Island is northeast of the town of Tauranga on North Island, one of New Zealand’s two main islands. Police were asking people to avoid areas on the North Island that were close to the eruption, including the Whakatane Heads and Muriwai Drive areas.
GeoNet said White Island is New Zealand’s most active cone volcano and about 70% of the volcano is under the sea.
Twelve people were killed on the island in 1914 when it was being mined for sulfur. Part of a crater wall collapsed and a landslide destroyed the miners’ village and the mine itself.
The remains of buildings from another mining enterprise in the 1920s are now a tourist attraction, according to GeoNet.
The island became a private scenic reserve in 1953, and daily tours allow more than 10,000 people to visit the volcano every year.
The island is also known by the indigenous Maori name Whakaari.
Two senior leaders of an American business organization in Hong Kong were denied entry to neighboring Macau over the weekend amid heightened tensions between the U.S. and China.
The president of the American Chamber of Commerce in Hong Kong, Tara Joseph, and the group’s chair, Robert Grieves, were separately denied entry into the Chinese-ruled territory on Saturday.
Neither Grieves nor Joseph was given a reason for being turned away.
“We are puzzled as to why this happened, given this was simply a social occasion to celebrate AmCham Macau’s annual gathering,” an AmCham spokesperson said in a statement.
Both Joseph and Grieves were en route to Macau to attend AmCham’s annual ball, which the Chief Executive of Macau and the U.S. Consul General in Macau and Hong Kong were expected to attend.
Their refused entry comes at a time of escalating fiction between Washington and Beijing. The world’s first and second largest economies are trying to end their bruising trade war, while also clashing over the ongoing political unrest in Hong Kong.
In November, President Donald Trump signed the Hong Kong Human Rights and Democracy Act in support of the pro-democracy protests that have gripped the financial hub since early June. The legislation will require the State Department to annually assess whether Hong Kong retains sufficient political autonomy from Beijing to merit favorable trading terms with the U.S.
In retaliation, China banned U.S. Navy visits to Hong Kong and slapped sanctions on several U.S.-based NGOs. Beijing perceives the protest movement as the result of meddling by foreign governments, including the U.S.
“We hope that this is just an over reaction to current events and that international business can constructively forge ahead,” AmCham said in the statement.
The AmCham leaders were made to sign statements saying they had “voluntarily agreed not to pursue entry into Macau,” before they were sent back to Hong Kong, the statement adds.
With Hong Kong in the midst its worst political crisis in decades, Beijing has proffered Macau as a successful example of the so-called “one country, two systems” model that governs both Special Administrative Regions.
Macau has been quick to clamp down on any shows of solidarity for its neighboring enclave. Officials in Macau have denied requests for demonstrations and have reportedly detained several people showing support for the Hong Kong protesters.
Chinese President Xi Jinping is expected to visit Macau next week for celebrations marking the twentieth anniversary of the former colony’s handover from Portugal.
What started off as Hong Kong’s summer of protest has now reached the six-month mark, a reflection of the lack of political compromise on both sides. On June 9, a million people (according to the organizer’s estimate) peacefully took to the streets, decrying what they saw as China’s encroachment on the semi-autonomous enclave’s cherished liberties. Since then, the protests have become considerably smaller but more violent. They also show no signs of abating.
As the movement hits its half-year anniversary, here are five things to know about it.
A controversial extradition bill that triggered the protests was withdrawn in October
A divisive bill that would have allowed suspects to be extradited to mainland China for the first time was formally withdrawn on Oct. 23. The move was seen as a victory by protestors, who feared the bill would be used by Beijing to round up dissidents and critics in the territory. But most saw the withdrawal as coming too late. A key protest slogan, “five demands, not one less,” reflects the broadening of the movement beyond the extradition bill controversy. The additional demands include calls for a directly elected leader of Hong Kong and an investigation into police handling of the protests.
Protestors and authorities have dramatically escalated the use of force
Teargas-filled streets, petrol bombs and arson have become the norm at protests. According to official figures, more than 6,000 protestors — a significant number below the age of 18 — have been arrested on charges ranging from criminal damage to participating in a riot. Police have fired around 16,000 rounds of tear gas and 10,000 rubber bullets. Three protestors have been shot with live rounds, including a 21-year-old critically injured last month. A street cleaner reportedly filming violent protestors died after being struck in the head by a brick, and a man was set on fire during an argument with protestors. Around 480 police officers have also been injured, including one slashed in the neck with a box cutter and another shot in the thigh with a bow and arrow. The government has time and again condemned the use of force and asked citizens to “say no” to violence, but extremists have refused to switch tactics. Peaceful campaigners have also failed to disown the violent behavior of radicals.
The government’s invocation of emergency laws led to questions over judicial independence
In October, the government activated an emergency ordinance to outlaw the wearing of face masks. The move sparked a night of severe clashes as hard line protestors took to the streets in response, furious that Hong Kong’s top official had bypassed legislators to invoke the law. Last month, the city’s highest court ruled the mask ban unconstitutional. In response, Beijing condemned the verdict, countering that only the National People’s Congress — China’s legislature — had the right to decide on what was constitutional or otherwise for Hong Kong. The saga raised questions about the future of judicial independence in the territory, reinforcing protesters’ fears that Beijing was eroding its freedoms.
The U.S. passed an act supporting human rights in Hong Kong
Protestors have incessantly appealed to foreign governments to support the city’s movement, believing they are unable to counter Beijing, the world’s largest authoritarian regime, on their own. Prominent activist Joshua Wong led a delegation to the White House in September to advocate the passing of the Hong Kong Human Rights and Democracy Act, which Trump signed into law last month. The legislation requires the State Department to annually assess whether Hong Kong retains sufficient political autonomy to continue to qualify for favorable trading terms with Washington, and also stipulates that Chinese or Hong Kong officials deemed responsible for violating human rights could face sanctions. Protestors, who have waved flags of other countries at marches, have also demonstrated outside the U.K. consulate calling for their former colonial power to “help” Hong Kong.
Beijing is making its presence increasingly known
While Beijing has acted with relative restraint, taking no concrete action beyond condemning the violence and reminding the city that it can intervene at any time, it has increasingly made its presence known. In August, a Hong Kong citizen who works at the U.K. consulate was detained in neighboring Shenzhen, for a “legal violation.” Last month, the detainee said he was tortured by Chinese authorities and pressed for information about the city’s protests. Meanwhile, in a deft PR stunt that may have been a warning to radicals, soldiers from the Chinese garrison emerged from their barracks last month to clear roadblocks and debris left by protestors. “We volunteered! Stopping violence and ending chaos is our responsibility,” one soldier reportedly said, quoting a phrase used by President Xi Jinping. Some soldiers wore basketball shirts bearing the name of a crack anti-terrorism unit.
(PARIS) — France braced for even worse transportation woes when the new work week begins Monday due to nationwide strikes over the government’s redesign of the national retirement system. French President Emmanuel Macron convened top officials to strategize for the high-stakes week ahead.
Sunday saw more travel chaos as the strikes entered their fourth day, with most French trains at a standstill. Fourteen of Paris’ subway lines were closed, with only two lines — using automated trains with no drivers — functioning. International train routes also suffered disruptions.
Monday will be an even bigger test of the strike movement’s strength and of commuters’ and tourists’ patience. Unions are calling for more people to join the strike Monday. Many employees worked from home or took a day off when the strikes began last week, but that’s not sustainable if the strikes drag on.
Warning of safety risks, the SNCF national train network and the Paris transit authority RATP warned travelers to stay away from train stations Monday instead of packing platforms for the few trains still running.
“On Dec. 9, stay home or find another means of locomotion,” SNCF warned travelers.
Facing a challenging week ahead, French Prime Minister Edouard Philippe met Sunday afternoon and evening with government ministers involved in the pension reform, and later met with Macron.
Macron, a centrist former investment banker, argues that the retirement overhaul will make a convoluted, out-dated pension system more fair and financially sustainable, uniting 42 different plans into one. The government says it won’t change the official retirement age of 62, but the new plan is expected to include financial conditions to encourage people to work longer as lifespans lengthen.
Unions see the reforms as an attack on worker rights and fear that people will have to work longer for smaller pensions. Some French workers can now retire in their 50s.
The new retirement plan will affect all French workers but the strikes involve primarily public sector workers, including train drivers, teachers and hospital employees.
New nationwide protests are scheduled Tuesday and the prime minister will release details of the new retirement plan on Wednesday.
Yellow vest activists joined the protests Saturday, adding retirement reform to their list of economic grievances in protests around the country. Police fired tear gas on rowdy protesters at largely peaceful marches through Paris and the western city of Nantes.
TALLINN, Estonia (AP) — A 34-year-old transport minister and lawmaker has been tapped to become Finland’s youngest prime minister ever and its third female government leader.
Finland’s ruling Social Democratic Party council voted 32-29 late Sunday to name Sanna Marin over rival Antti Lindtman to take over the government’s top post from incumbent Antti Rinne.
Having emerged as Finland’s largest party in the April election, the Social Democrats can appoint one of their own to the post of prime minister in the Nordic nation of 5.5 million.
Marin has been the party’s vice chairwoman, a lawmaker since 2015 and served as until this week as the minster for transport and communications. According to Finland’s biggest newspaper Helsingin Sanomat and the Ilta-Sanomat tabloid, Marin will become the world’s youngest sitting prime minister.
Finland currently holds the European Union’s rotating presidency until the end of the year. Lawmakers are likely to approve the appointment of Marin and her new government quickly so she can represent Finland at the Dec. 12-13 EU leaders’ summit in Brussels.
Rinne stepped down Tuesday after a key coalition partner, the Center Party, withdrew its support, citing lack of trust. The Center Party also criticized Rinne’s leadership skills prior to a two-week strike by the country’s state-owned postal service Posti in November that spread to other industries, including the national flag carrier Finnair.
Rinne’s resignation prompted the formal resignation of a coalition of the Social Democrats and the Center Party and three junior partners: the Greens, the Left Alliance and the Swedish People’s Party of Finland.
On Sunday, Social Democrats and the four other coalition parties said they are committed to the government program agreed upon after the April election and will continue in Marin’s new government. The new government will still have a comfortable majority of 117 seats at the 200-seat Eduskunta, or Parliament.
Social Democrats said Sunday they’re seeking to have Rinne, a former trade union leader, become the parliament’s vice speaker. He also plans to stay on as the Social Democrats’ chairman until a party congress next summer.
(BERLIN) — Six people have been arrested after an off-duty firefighter was killed in an altercation between two couples and a group of young men in the southern German city of Augsburg, authorities said Sunday.
The couples had just left a Christmas market late Friday when they ran into the seven-strong group and an argument started, according to police. One of the young men hit the 49-year-old victim in the head and he fell to the ground. He died at the scene.
A 50-year-old man who was with him was hit in the face and seriously injured. Their wives were not attacked.
The youths fled. Dozens of Augsburg firefighters held a vigil Sunday for their colleague and German Interior Minister Horst Seehofer voiced his dismay at the killing.
Bavaria’s state Interior Ministry then announced the arrest of the suspected main culprit and an alleged accomplice. Both were 17 and born in Augsburg; the first had German and unspecified other citizenships and the second was a citizen of an unidentified southern European country.
The ministry said surveillance cameras enabled investigators to identify the suspects.
Later Sunday, police said four more suspects had been arrested, the German news agency dpa reported. No details were immediately given on those suspects.
(RIYADH, Saudi Arabia) — Women in Saudi Arabia will no longer need to use separate entrances from men or sit behind partitions at restaurants in the latest measure announced by the government that upends a major hallmark of conservative restrictions that had been in place for decades.
The decision, which essentially erodes one of the most visible gender segregation restrictions in place, was quietly announced Sunday in a lengthy and technically worded statement by the Municipal and Rural Affairs Ministry.
While some restaurants and cafes in the coastal city of Jiddah and Riyadh’s upscale hotels had already been allowing unrelated men and women to sit freely, the move codifies what has been a sensitive issue in the past among traditional Saudis who view gender segregation as a religious requirement. Despite that, neighboring Muslim countries do not have similar rules.
Restaurants and cafes in Saudi Arabia, including major Western chains like Starbucks, are currently segregated by “family” sections allocated for women who are out on their own or who are accompanied by male relatives, and “singles” sections for just men. Many also have separate entrances for women and partitions or rooms for families where women are not visible to single men. In smaller restaurants or cafes with no space for segregation, women are not allowed in.
Reflecting the sensitive nature of this most recent move, the decision to end requirements of segregation in restaurants was announced in a statement published by the state-run Saudi Press Agency. The statement listed a number of newly-approved technical requirements for buildings, schools, stores and sports centers , among others.
The statement noted that the long list of published decisions was aimed at attracting investments and creating greater business opportunities.
Among the regulations announced was “removing a requirement by restaurants to have an entrance for single men and (another) for families.”
Couched between a new regulation about the length of a building’s facade and allowing kitchens on upper floors to operate was another critical announcement stating that restaurants no longer need to “specify private spaces”— an apparent reference to partitions.
Across Saudi Arabia, the norm has been that unrelated men and women are not permitted to mix in public. Government-run schools and most public universities remain segregated, as are most Saudi weddings.
In recent years, however, Saudi Crown Prince Mohammed bin Salman has pushed for sweeping social reforms ,with women and men now able to attend concerts and movie theaters that were once banned. He also curtailed the powers of the country’s religious police, who had been enforcers of conservative social norms, like gender segregation in public.
Two years ago, women for the first time were allowed to attend sports events in stadiums in the so-called “family” sections. Young girls in recent years have also been allowed access to physical education and sports in school, a right that only boys had been afforded.
In August, the kingdom lifted a controversial ban on travel by allowing all citizens — women and men alike — to apply for a passport and travel freely, ending a long-standing guardianship policy that had controlled women’s freedom of movement.
The new rules remove restrictions that had been in place, but do not state that restaurants or cafes have to end segregated entrances or seated areas. Many families in conservative swaths of the country, where women cover their hair and face in public, may prefer eating only at restaurants with segregated spaces.

(KYIV, Ukraine) — Ukraine and the International Monetary Fund have reached agreement on a new $5.5 billion program to boost the country’s growth and economic reforms.
The agreement, which still must be approved by the fund’s management, was reached in a Saturday telephone call between Ukrainian President Volodymyr Zelensky and IMF managing director Kristalina Georgieva.
Details of how the money would be used over the plan’s three years weren’t given.
Zelenskiy, who was elected in April on a platform focusing on economic reforms and fighting corruption, said in a statement that the program will accelerate growth.
(SEOUL, South Korea) — North Korea said Sunday that it carried out a “very important test” at its long-range rocket launch site that it reportedly rebuilt after having partially dismantled it at the start of denuclearization talks with the United States last year.
The announcement comes amid dimming prospects for a resumption of negotiations, with the North threatening to seek “a new way” if it fails to get major U.S. concessions by year’s end. North Korea has said its resumption of nuclear and long-range missile tests depends on the United States.
Saturday’s test at the Sohae Satellite Launching Ground will have “an important effect on changing the strategic position of (North Korea) once again in the near future,” an unidentified spokesman from the North’s Academy of National Defense Science said in a statement, carried by the country’s official Korean Central News Agency.
North Korea didn’t say what the test included. Kim Dong-yub, an analyst at Seoul’s Institute for Far Eastern Studies, said that North Korea likely tested for the first time a solid-fuel engine for an intercontinental ballistic missile.
The use of solid fuel increases a weapon’s mobility and reduces the amount of launch preparation time. The long-range rockets that North Korea used in either ICBM launches or satellite liftoffs in recent years all used liquid propellants.
CNN reported Friday that a new satellite image indicated North Korea may be preparing to resume testing engines used to power satellite launchers and intercontinental ballistic missiles at the site.
Seoul’s Defense Ministry said in a brief statement later Sunday that South Korea and the United States are closely monitoring activities at the Sohae site and other key North Korean areas.
On Saturday, President Donald Trump and South Korean President Moon Jae-in discussed developments related to North Korea, and the two leaders committed to continuing close communication, the White House said in a statement. Moon’s office also released a similar statement, saying the two leaders had a 30-minute phone conversation at Trump’s request.
The North Korean test “is meant to improve military capabilities and to shore up domestic pride and legitimacy,” said Leif-Eric Easley, a professor at Ewha University in Seoul. “With the activity at Sohae, Pyongyang is also trying to raise international concerns that it may intensify provocations and walk away from denuclearization talks next year.”
The Sohae launching center in Tongchang-ri, a seaside region in western North Korea, is where the North has carried out banned satellite launches in recent years, resulting in worldwide condemnation and U.N. sanctions over claims that they were disguised tests of long-range missile technology.
North Korea has said its satellite launches are part of its peaceful space development program. But many outside experts say ballistic missiles and rockets used in satellite launches share similar bodies, engines and other technology. None of North Korea’s three intercontinental ballistic missile tests in 2017 was conducted at the Sohae site, but observers said the site was used to test engines for ICBMs.
After his first summit with North Korean leader Kim Jong Un in Singapore in June last year, Trump said Kim told him that North Korea was “already destroying a major missile engine testing site” in addition to committing to “complete denuclearization” of the Korean Peninsula.
Satellite imagery later showed the North dismantling a rocket engine-testing stand and other facilities at the Sohae site. Last March, South Korea’s spy agency and some U.S. experts said that North Korea was restoring the facilities, raising doubts about whether it was committed to denuclearization.
U.S.-North Korea diplomacy has largely remained deadlocked since the second summit between Trump and Kim in Vietnam in February due to disputes over how much sanctions relief the North must get in return for dismantling its key nuclear complex — a limited disarmament step.
North Korea has since warned that the U.S. must abandon hostile policies and come out with new acceptable proposals by the end of this year or it would take an unspecified new path. In recent months, North Korea has performed a slew of short-range missile and other weapons launches and hinted at lifting its moratorium on nuclear and long-range missiles.
North Korea said the results of Saturday’s test were submitted to the Central Committee of the ruling Workers’ Party. The North said last week that the Central Committee will hold a meeting in late December to discuss unspecified “crucial issues” in line with “the changed situation at home and abroad.”
At the United Nations, a statement released by North Korea’s U.N. ambassador, Kim Song, said Saturday that denuclearization had “already gone out of the negotiation table.”
The statement accused the Trump administration of persistently pursuing a “hostile policy” toward the country “in its attempt to stifle it.” The statement was a response to Wednesday’s condemnation by six European countries of North Korea’s 13 ballistic missile launches since May.
The North Korean diplomat accused the Europeans — France, Germany, Britain, Belgium, Poland and Estonia — of playing “the role of pet dog of the United States in recent months.”
“We regard their behavior as nothing more than a despicable act of intentionally flattering the United States,” the ambassador said.

NEW DELHI: Millions of organised sector employees may soon have the option of reducing their provident fund contribution — currently at 12% of basic salary — and therefore increase their takehome pay. Labour ministry officials said this provision is part of the Social Security Code Bill, 2019, approved by the Cabinet and expected to be tabled in Parliament this week.The rationale for allowing lower employee PF contribution is that higher take-home pay may boost consumption, which has been falling, dragging growth down. The Bill, however, retains employers' PF contribution at 12%. Details on how low employees' PF contribution can be brought down will be worked out after the passage of the Bill, officials said.Also, as per the Bill, fixed-term contract workers will be eligible for gratuity on a pro rata basis. Currently, workers are not entitled to gratuity before completing five years of continuous service, as prescribed in the Payment of Gratuity Act, 1972.The labour ministry has also done away with its earlier proposal to give subscribers of the Employees' Provident Fund Organisation an option to switch to the National Pension System vis-à-vis the Employee Pension Scheme under EPFO. It said the current arrangement provides multiple benefits such as higher rate of return and exempt-exempt-exempt status to funds invested in EPFO.Social Security Fund ProposedThe ministry also decided to retain the existing autonomy of EPFO and Employees' State Insurance Corporation (ESIC), rejecting the proposal to corporatise them. 72432095 The Bill proposes setting up a social security fund using corpus available under corporate social responsibility. This fund will provide welfare benefits such as pension, medical cover, and death and disablement benefits to all workers, including gig workers."We have dropped all controversial proposals and kept our focus intact on the welfare of workers as well as improving the ease of doing business in India through amalgamation of existing laws under the Social Security Code," a senior government official told ET on the condition of anonymity.As per the Bill, all establishments employing at least 10 workers will have to provide multiple benefits to employees under ESIC, while it would be mandatory for all workers employed in hazardous sectors. Companies with less than 10 workers can voluntarily opt to provide benefits under the ESIC scheme to their workers.The Social Security Code subsumes eight central labour laws. They are the Employees' Compensation Act, 1923, Employees' State Insurance Act, 1948; Employees' Provident Funds and Miscellaneous Provisions Act, 1952; Maternity Benefit Act, 1961; Payment of Gratuity Act, 1972; Cine Workers Welfare Fund Act, 1981; Building and Other Construction Workers Cess Act, 1996; and Unorganised Workers' Social Security Act, 2008.As part of its reform initiatives, the labour ministry has decided to amalgamate 44 labour laws into four codes — on wages, industrial relations, social security and safety, and health and working conditions.The Social Security Code is the last of the four labour codes that have been approved by the Cabinet.The labour code on wages was approved by Parliament in August while the code on occupational safety, health and working conditions has been referred to the parliamentary standing committee on labour. NEW DELHI: Ace stock market investor and Fortis' largest individual shareholder Rakesh Jhunjhunwala has endorsed Malaysian company IHH Healthcare's Rs. 4,000-crore investment in the hospital chain after a recent Supreme Court ruling placed the deal under a cloud.While voicing shareholders' concerns over delays in IHH's planned open offer for Fortis, Jhunjhunwala emphasised the deal was "fair" and that IHH should complete the open offer that has been pending for a year."Malvinder and Shivinder had nothing to do with Fortis when IHH invested in the company. IHH was chosen after a fair bidding process," Jhunjhunwala said while responding to questions around the delay in IHH's open offer to Fortis' shareholders.The apex court has ordered that status quo be maintained on IHH's 31% shareholding in Fortis, which it formally acquired on November 13 last year while holding the Singh brothers guilty of contempt of court in an ongoing dispute involving them and Japanese drug maker Daiichi Sankyo.IHH has been unable to proceed with its open offer to acquire a further 26% stake from minority shareholders of Fortis as a result of the status quo. "IHH was chosen by an independent board and approved by the shareholders.No shares were purchased from Malvinder and Shivinder. All the money came into Fortis," Jhunjhunwala said, stressing that several parties were given an offer to bid for the company. "The open offer should be completed as per Sebi norms," he demanded. The apex court on November 15 held the Singhs guilty of "wilfully" disobeying its orders. The court noted that the Singh's shareholding in Fortis had vanished into "thin air" despite their assurances to the court that they would maintain a certain level of shareholding in Fortis to cover any sum required to fulfil Daiichi Sankyo's claims if the latter won the dispute. 72431854 The Singhs owned half a per cent in Fortis by the time the IHH deal happened. The Singh's have attributed the drop in their shareholding to a ruling on February 15 last year, where court lifted restriction on sale of encumbered Fortis shares, allowing financial creditors to whom such shares were pledged to sell them and recover dues. Jhunjhunwala owns a 1.6% stake in Fortis Healthcare in his individual capacity as per latest available stock exchange filings.The Supreme Court has simultaneously directed the registration of a contempt petition against Fortis terming the transfer of funds from Fortis to purchase units of Singapore-listed RHT Health Trust (RHT) "dubious and clandestine." The apex court noted that the Singh's "were at one time the biggest unit holders in the trust." RHT's units were acquired with the funds infused by IHH into Fortis. "The company's financial performance is improving every day," Jhunjhunwala said when posed with questions on the merits of the RHT deal.RHT was floated seven years ago as an offshore vehicle where assets and infrastructure of Fortis were carved out and parked in to the Singapore-registered entity. Fortis had been paying hospital services fee of Rs 1 crore daily to RHT before the units were bought out, according to sources.The Singh brothers in their individual capacity and through an arm of Fortis owned nearly 29% of RHT as of June 30, 2017. Fortis has maintained that to its knowledge the Singh's did not own any units in RHT when the deal to buy out the trust took place. Daiichi has been fighting to enforce a Rs. 3,500-crore arbitiration award that they won against the Singh brothers at a tribunal in Singapore over their acquisition of Ranbaxy, a company previously controlled by the Singhs.Daiichi has claimed the Singh brothers concealed critical information about the company from them at the time of its sale. The Singhs deny any wrongdoing.
The economic slowdown in India became worse in the second quarter of 2019 and the GDP growth rate fell to 4.5%—the lowest in the last 26 quarters (see chart). More bad news followed: the expected economic recovery was not going to happen anytime soon. Most economic indicators like industrial production, merchandise exports, bank credit, freight movement, electricity production, among others, are pointing to weak growth in the first months of the third quarter. Since this could mean lower growth rate in the third quarter, economists are busy cutting their growth projection for 2019-20. "Growth could weaken further to around 4% in the third quarter of 2019-20, which will mark a trough. However, despite the efforts, the slowdown is likely to extend to the medium term. "Due to several structural issues faced by the Indian economy, growth rate is expected remain moderate—around 4-5%—in the short to medium term", says Santosh Kamath, MD & CIO – India Fixed Income, Franklin Templeton. 'Debt aversion' among businesses is one of the main reasons for this. Most businessmen are leaning towards avoiding debt altogether. Even Mukesh Ambani wants to make Reliance Industries debt free in 18 months. Though good for the long term health of the economy, the ongoing clean-up of the financial sector and massive deleveraging drive by companies will continue to put pressure on medium term growth rates. Fall in nominal GDP growth rate is another worry. Nominal GDP growth rate is real GDP plus inflation and this matrix is very important for stock market investors because the aggregate corporate growth usually mirrors nominal GDP growth rates.Valuation another concernWhile the broader market has reacted to growth concerns, benchmark indices like the Sensex and Nifty are still quoting close to all-time highs, pushed up by a few stocks. Valuation parameters of these indices are also at high levels now. "Though not in the overvaluation zone, their valuation now is above average. In other words, the current market valuation is not supported by the current economic fundamentals," says Kaushlendra Sengar, Founder and CEO, Advisorymandi.com.Don't avoid mid & small capsThough mid and small caps usually underperform during slow growth periods because industry leaders get stronger during such periods, there is no need to avoid these segments altogether this time. This is because some of the mid-cap stocks are sector leaders (they are midcaps because these sectors are small) and therefore, they should be able to do well even during bad times. In addition to a stable US economy (their main market), companies from the IT and pharma segments will also benefit from the rupee depreciation triggered by domestic slowdown," says Sengar. Even among good sectors, investors need to be selective. They should avoid highly valued stocks because the market is now chasing growth at any cost.The entire pharma industry can be treated as a defensive bet now because their valuation has been down for the last 4-5 years due to their US FDA related woes. However, Cipla continues do well in the US market and its US revenues grew by 26% y-o-y during the second quarter. Another advantage of Cipla is its strong domestic base. Around 40% of its revenues come from India and since people are not going to stop taking medicines during economic slowdown, domestic pharma players are also treated as a good defensive bet. After a dip in the first quarter, domestic sales picked up in the second quarter and the same grew by 29% q-o-q and 6% y-o-y. In addition to the 22% exposure to the North American market, Cipla's export pie is also diversified to Europe, South Africa, Sub Saharan region, emerging markets from other regions, etc.Pharma industry can be a defensive betDomestic woes will not affect pharmaceutical companies like Cipla. 72413696 Unlike pharma, IT is mostly a global play. We decided to pick Infosys because the same is still quoting at a discount to the sector market leader TCS. However, its valuation is expected to improve because several research houses have started upgrading the stock. "We upgrade Infosys to 'buy' based on better visibility on growth, stable margin trajectory and the recent stock underperformance," says a recent HDFC Sec report. Infosys is now focusing more on large deals and the same is yielding results—large deals grew by 77% in the first half of 2019-20. Since Infosys is now growing faster than the sector average, its valuation gap with TCS should come down further.Organised retailersWhile normal retailers and small traders are suffering from the slowdown, triggered mostly by the NBFC-driven liquidity crisis, organised retailers are reporting good revenue growth. The economy-wide shift from unorganised to organised due to the implementation of GST is helping them. More importantly, most of the listed players have come of age now. "The systems and processes of organised retail players are established now, helping them to report faster growth and they did the same in the second quarter," says Kumar.Though growth is not an issue, exorbitant valuation is the biggest problem with listed retail chains and many are quoting at PEs well above 100. However, Future Retail is still quoting at a PE of 23.22 against the industry average PE of 98.33. Future Retail always used to quote at low valuations because it is not one of the fancied retail players like D-Mart or Trent. However, things are expected to improve at Future Retail due to the strategic tie-up with and a small stake purchase by Amazon. Future Retail's new strategy of growth with profitability and deleveraging of balance sheet should also result in better valuation ratios. In addition to the cost savings initiatives, Future Retail also plans to shut down unprofitable small stores.Real estate playersThough the real estate sector is still facing problems and waiting for the implementation of the government's bailout package, listed players continue to do well. In other words, the strength of strong and organised players are getting amplified by the ongoing turmoil in the real estate market. For example, aggregate housing sales value and absorption of listed players have moved up by 5% and 9% respectively q-o-q. Small time builders winding operations or selling out to bigger players is the main reason for this. "Even the most conservative industry estimates indicate a staggering number of developers in top cities who have been either been wiped off the map or have merged with organised developers," says Anuj Puri, Chairman, Anarock Property Consultants.Organised real estate players will fare wellPhoenix is expected to report better growth in coming years. 72413697 As organised retailers are expected to do well in coming years, the best real estate player to bet on now is Phoenix Mills, one of India's largest mall owners and operators. Phoenix is expected to report better growth in coming years because some of its mall projects are expected to get completed in the next 2-3 years. While its Lucknow mall is expected to be operational in 2019-20, the remaining four are expected to be fully operational between 2020-21 and 2022-23.Corporate facing banksRetail-facing banks like HDFC Bank, Kotak Mahindra Bank, etc. will continue to do well even during periods of turmoil. However, analysts are more bullish on corporate facing banks now for three reasons. First, the valuations of corporate facing banks are much lower. Second, they are mostly out of the NPA related problem, which was plaguing them for the last 3-4 years. Third, the business opportunity is also increasing for them. "Through aggressive lending, NBFCs weaned away the SME segments from corporate banks in the past and these banks are now regaining market share due to the pains of NBFCs," says Kumar.Federal Bank is a good example of a mid-cap bank with improving fundamentals and reasonable valuations. First, its shift to retail book is playing out well and its retail loan growth was placed at 25% in the second quarter of 2019-20, mostly because of increased contribution from low risk housing and gold loans. Asset quality improvement is also visible and its 30% y-o-y increase in other income during the second quarter was because of recovery from written off accounts. "Given Federal Bank's largely steady watch-list and healthy capital adequacy ratio coupled with low valuations, we are positive on the stock," says a recent Axis Securities report. Federal Bank's price to book ratio is placed at 1.22 times, compared to the industry average of 1.60 times now.
NEW DELHI: Bharti Telecom, a promoter of Bharti Airtel, has sought government nod for the infusion of Rs 4,900 crore investment from Singapore-based Singtel and other foreign entities, a move that would make the country's oldest private telecom operator a foreign entity.The fund infusion will enhance foreign stakeholding in Bharti Telecom to over 50 per cent that will make it a foreign-owned entity, an official source aware of the development told PTI. Sunil Bharti Mittal and his family own around 52 per cent stake in Bharti Telecom, at present.Bharti Telecom holds around 41 per cent stake in Bharti Airtel while foreign promoter entities hold 21.46 per cent stake in the telecom firm. Public shareholders have around 37 per cent stake in the company."Bharti Telecom has applied for infusion of Rs 4,900 crore in the company which includes investments from Singtel and some other foreign investors. With this Bharti Telecom will become a foreign entity as majority stake will be held by overseas investors. DoT is expected to approve this investment this month," the source said. The Department of Telecom had earlier this year rejected Bharti Airtel's FDI application as the company had not provided clarity on the foreign investor.Total foreign shareholding is 43 per cent in Bharti Airtel, at present. With promoter firm Bharti Telecom becoming a foreign entity, foreign shareholding in the company will cross 84 per cent, the source said. Bharti Airtel has already been in discussion with Singtel and other entities for fund infusion.The company in August had informed stock exchanges that Bharti Telecom in order to retire some debt may seek equity from its existing promoter group which may include overseas entity and Singtel in proportionate to its holding.Bharti Airtel has said that even a marginal increase in foreign equity would take the foreign investment in Bharti Telecom above 50 per cent making it a foreign owned entity.Bharti Airtel has already applied to raise FDI limit to 100 per cent in the company.Bharti Airtel board last week approved a proposal to raise USD 3 billion through QIP, stake sale and debt papers as the company owes AGR dues of Rs 43,000 crore to the government.The company will launch one or more QIPs or offer for sale of equity shares or a combination of similar offers to raise USD 2 billion. Rest USD 1 billion will be raised through debentures and bonds.
BENGALURU | NEW DELHI: The government will likely give companies up to two years to be fully compliant with the proposals in the Data Protection Bill after it is passed in Parliament and becomes law, official sources told ET.The industry is of the view that since the Bill is modelled on the European Union's General Data Protection Regulation (GDPR), large companies, including global Internet giants and Indian information technology companies, may not have to put too much efforts to tweak their systems to comply with the proposed Indian law. "Some time — around two years — will be given to the companies to be compliant with the law," said a top government official, adding that the government would soon decide on the exact timeline for the implementation of the Bill.EU's GDPR was notified in May 2016 and gave companies and public bodies until May 2018 to adjust their business practices according to the legislation. "Let's assume the Bill gets passed within 24 hours. The draft Bill has provisions that within six months the Data Protection Authority has to be established and 12 months thereafter various sections can be bought into effect… all in one go or bit by bit, depending on the government. So, you have 18 months for reorienting your thinking, reorienting your software, rejigging the business practices," Justice BN Srikrishna, one of the main architects of the Bill, told ET.A committee led by the retired Supreme Court judge had in July 2018 submitted the draft Bill to the government, which held wide public and inter-ministerial consultations on the proposals before tweaking the Bill and getting it approved by the Union Cabinet last week.Aruna Sundararajan, one of the members of the Bill's drafting panel and former telecom and IT secretary, told ET that companies would be given lead time to implement the law but they needed to get their act together quickly."Once the Bill is passed and notified, it will be implemented in a calibrated manner. The companies will get a lead time, but they will have to get their act together quickly as there is enough precedent set with GDPR. They are not starting on a blank slate and have to fast forward," she said.However, domestic companies and startups may have to completely overhaul their systems to meet the proposed regulations. The Bill seeks to give the ownership of the data in the hands of the people and is based on the consent architecture. It means organisations, big and small, will have to seek the individual's consent before collecting any personal data and will have to clearly notify them of the purpose of its use. Data fiduciaries will have to delete the data in a stipulated time and users will have the option to revoke their consent at any time. Data localisation provisions on sensitive and critical personal data mean all the data of Indian users stored around the world will have to bring back to India, adding significant costs to businesses."Indian startups will have to significantly restructure the way they capture data, store data and have set up the consent mechanism," said Rameesh Kailasam, the chief executive at IndiaTech.org, a domestic lobby body that counts Ola, PolicyBazaar and MakeMyTrip among its members. "They will also need manpower who understands the law and rules. There is also a cost element involved and they may have to budget for storage and compliance cost."However, Data Security Council of India CEO Rama Vedashree said while Indian startups might face additional cost burden, the real challenge would be for the government and big firms. "The real challenge is with government agencies and state government departments and large technology organisations who deal with so much user data. Startups will have additional cost burden but the implementation of privacy provisions, not a challenge," said Vedashree, who was also a member of the Srikrishna committee.
NEW DELHI: Indians dismayed by the year-end surge in international airfares aren't cancelling holiday travel plans — they are just not going too far away. Most are opting for domestic and short-haul overseas destinations, according to online travel agencies and operators.There's been a 15-20% jump in advance bookings for destinations such as Goa, Udaipur and Jaipur from the year earlier as an increase in winter schedule capacity has resulted in a decline in some domestic fares. Advance bookings for international destinations like Singapore, Colombo, Bangkok, Dubai, Mauritius and Malaysia are up 10-12%. Meanwhile, operators said homestays and villas have gained in popularity over top hotels this holiday season with travellers looking to save on costs.Goa, Dubai, Udaipur, Jaipur, Bangkok, Singapore and Kuala Lumpur are the top trending holiday destinations, according to ixigo, while locales such as Dubai, Bangkok, Singapore, Kuala Lumpur and Colombo are receiving maximum bookings on Paytm Travel."With Christmas and New Year vacations right around the corner, we have witnessed a 15-20% jump in advance bookings for domestic destinations," said Aloke Bajpai, cofounder, ixigo. "An increase in capacity for the winter schedule has resulted in a 20% decline in domestic airfares. This has encouraged families, couples and millennials to opt for short domestic getaways over international vacations this year."Fares on key routes to the US and Europe are up almost threefold following the grounding of Jet Airways, which was the second-largest international carrier from India until it stopped flying in April, ET had reported on December 3. Compared with this, average fares to short-haul international destinations are up just 10-12%, according to ixigo. Some routes are actually cheaper — average one-way fares to destinations such as Dubai and Kuala Lumpur are down to Rs 16,695 and Rs 11,381, from Rs 16,818 and Rs 15,163, respectively, at the same time last year."We have seen an uptick in demand for short-haul international destinations such as Thailand, Singapore, Malaysia, Bali and Dubai," said Sabina Chopra, cofounder and COO, corporate travel and head of industry relations at Yatra-.com. "Compared to last year, there is a 63% growth in booking enquires for domestic destinations including Goa, Kerala, Coorg, Pondicherry and Orchha.
The sharp polarisation across market segments has been visible for a while now. Frontline indices have breached all-time highs even as mid- and smallcap indices have seen sharp corrections. This divergent performance has prompted calls for shifting allocation towards midand small-cap stocks. But how should investors play this space?The earlier valuation premium of midand small-cap indices relative to large caps has eroded completely. While the BSE Sensex is trading at a price to book value (PB) of 2.95, the BSE 150 Midcap index and BSE 250 Smallcap index are trading at 2.32 and 1.71 respectively. With large-cap valuations out of the comfort zone, experts say the valuation differential has turned riskreward in favour of mid and small-caps. "Over the long-term, the performance of small-, mid-cap vis-a-vis large-caps typically converges. So, the headwind of small, mid-cap underperforming should go away in due course," Prashant Jain, ED and CIO, HDFC Mutual Fund, said at a recent event. However, the risk-reward dynamics between mid-caps and small-caps are quite different. According to some, small-caps offer a better opportunity now. ICICI Securities analysts Vinod Karki and Siddharth Gupta point out in a report that the risk spread has risen sharply for small and micro caps, whereas risk spreads for mid-caps (relative to large-caps) continue to be low. Risk spread is defined as the difference in trailing earnings yield between two types of stocks (such as mid-caps over large-caps). The comparatively higher risk spread for small-caps over large-caps makes this segment more attractive than mid-caps. "Sell-off since January 2018 has ensured the significant relative outperformance of small-caps has disappeared while mid-caps have held on to some of the outperformance," the report states.Experts recommend playing the smallcap space by taking the SIP route through mutual funds. Given the limited information available on smaller businesses, picking stocks directly in this space is akin to throwing darts in the dark. Besides, returns from small-cap funds are highly volatile and come through sporadically. As per new rules, small-cap funds can pick stocks ranked beyond the top 250 in terms of market capitalisation for their core portfolio, comprising 65% of the fund corpus. This has opened up a wider hunting ground for small-cap funds, as several erstwhile mid-caps now qualify for inclusion in the portfolio.Small-cap fund managers can now create a more hygienic portfolio and not compromise on quality. "Fund managers in this space can invest in more proven names across sectors and not be compelled to dabble in lower quality names," says Taher Badshah, CIO–Equities, Invesco Mutual Fund. "The investable universe of midcaps is much narrower than small-caps. At this juncture, we prefer SIP in small-cap funds for long term wealth creation," says Shah. Over the past year, there have been several fund launches in this space. For now, investors should stick with funds with a proven track record. It is advisable to keep allocation towards small-caps limited to 15-20% of the portfolio.Even when investing through mutual funds, investors should come into this segment with the right perspective. The risk in betting on smaller companies is more pronounced, particularly in the midst of a slowdown. This segment comprises relatively weaker business models with higher mortality rate that may not withstand high turbulence. Fundamentals of smaller businesses can weaken further if economic activity contracts and liquidity becomes scarce. However, within this segment, some companies are in a position to hold strong owing to being in niche businesses with a sizeable market share. "Exceptions do exist where relatively small companies enjoy a dominant position in small but rapidly rising sectors," say Karki and Gupta. They prefer non-commodity stocks that offer earnings yield yield greater than or equal to bond yield, stable earnings outlook, return on equity greater than 13%, low financial leverage, positive free cash flow and preferably be linked to the domestic economic recovery.

BENGALURU | NEW DELHI: The government will likely give companies up to two years to be fully compliant with the proposals in the Data Protection Bill after it is passed in Parliament and becomes law, official sources told ET.The industry is of the view that since the Bill is modelled on the European Union's General Data Protection Regulation (GDPR), large companies, including global Internet giants and Indian information technology companies, may not have to put too much efforts to tweak their systems to comply with the proposed Indian law. "Some time — around two years — will be given to the companies to be compliant with the law," said a top government official, adding that the government would soon decide on the exact timeline for the implementation of the Bill.EU's GDPR was notified in May 2016 and gave companies and public bodies until May 2018 to adjust their business practices according to the legislation. "Let's assume the Bill gets passed within 24 hours. The draft Bill has provisions that within six months the Data Protection Authority has to be established and 12 months thereafter various sections can be bought into effect… all in one go or bit by bit, depending on the government. So, you have 18 months for reorienting your thinking, reorienting your software, rejigging the business practices," Justice BN Srikrishna, one of the main architects of the Bill, told ET.A committee led by the retired Supreme Court judge had in July 2018 submitted the draft Bill to the government, which held wide public and inter-ministerial consultations on the proposals before tweaking the Bill and getting it approved by the Union Cabinet last week.Aruna Sundararajan, one of the members of the Bill's drafting panel and former telecom and IT secretary, told ET that companies would be given lead time to implement the law but they needed to get their act together quickly."Once the Bill is passed and notified, it will be implemented in a calibrated manner. The companies will get a lead time, but they will have to get their act together quickly as there is enough precedent set with GDPR. They are not starting on a blank slate and have to fast forward," she said.However, domestic companies and startups may have to completely overhaul their systems to meet the proposed regulations. The Bill seeks to give the ownership of the data in the hands of the people and is based on the consent architecture. It means organisations, big and small, will have to seek the individual's consent before collecting any personal data and will have to clearly notify them of the purpose of its use. Data fiduciaries will have to delete the data in a stipulated time and users will have the option to revoke their consent at any time. Data localisation provisions on sensitive and critical personal data mean all the data of Indian users stored around the world will have to bring back to India, adding significant costs to businesses."Indian startups will have to significantly restructure the way they capture data, store data and have set up the consent mechanism," said Rameesh Kailasam, the chief executive at IndiaTech.org, a domestic lobby body that counts Ola, PolicyBazaar and MakeMyTrip among its members. "They will also need manpower who understands the law and rules. There is also a cost element involved and they may have to budget for storage and compliance cost."However, Data Security Council of India CEO Rama Vedashree said while Indian startups might face additional cost burden, the real challenge would be for the government and big firms. "The real challenge is with government agencies and state government departments and large technology organisations who deal with so much user data. Startups will have additional cost burden but the implementation of privacy provisions, not a challenge," said Vedashree, who was also a member of the Srikrishna committee.
