Mexican President Andrés Manuel López Obrador is preparing himself for a showdown with the United States over Joaquín 'El Chapo' Guzmán's fortune.
El Chapo was sentenced to life in jail at a New York City court this week by a federal judge who also ordered him to pay US authorities $12.6 billion - the figure he is estimated to have earned from drug trafficking as the head of the Sinaloa Cartel.
But on Thursday, López Obrador argued that the funds should be returned to El Chapo's home country of Mexico.
He also demanded that the US return the assets they had already seized from the gang leader. The US government estimates El Chapo's fortune at $14 billion.

President Donald Trump said Friday that the Islamic Republicn of Iran has endangered itself by seizing a pair of British oil tankers in the Persian Gulf.
'Iran is showing their true colors,' he told reporters on the South Lawn of the White House has he departed for a weekend in New Jersey.

Iran's Revolutionary Guards claim to have seized a British oil tanker, the Stena Impero, which suddenly veered off course and headed into Iranian waters.
The ship's owners issued a statement saying it had been "approached by unidentified small crafts and a helicopter during transit of the Strait of Hormuz while the vessel was in international waters."
"We are presently unable to contact the vessel which is now heading north towards Iran," the owners, Stena Bulk, and the ship's managers, Northern Marine, said in the statement.

Trade with China totalled US$2.7 billion in 2018, down 48.2 per cent from a year earlier, according to a report from the Korea Trade-Investment Promotion Agency on Friday.

Iran's Revolutionary Guard Corps released footage which it says disproves the US claim of shooting down an Iranian drone over the Strait of Hormuz, showing the video was transmitted after the alleged time it was destroyed.
The elite military unit published the footage on Friday and it was aired and commented on live on the state TV channel Press TV. The video appears to depict American warship USS Boxer sailing through the strait in the early hours of July 19, according to the timestamp shown.

Drone, the catch-all term for uncrewed flying vehicle, descends from a far more specific bit of jargon, once used exclusively to refer to aerial targets. Few aircraft are built for the express purpose of being destroyed, but targets are, and that more casual attitude towards the destruction of aerial robots has expanded to include the whole category of modern uncrewed apparatus. All of this is to say: through some means, forces on board a U.S. Navy vessel had an interaction with a drone, and likely sent it into the sea.

(LONDON) — Britain’s foreign secretary said Iranian authorities seized two vessels Friday in the Strait of Hormuz, actions signaling an escalation in the strategic waterway that has become a flashpoint in tensions between Tehran and the West.
Foreign Secretary Jeremy Hunt said one of the seized ships was British-flagged and the other sailed under Liberia’s flag. The crews members comprise a range of nationalities but are not believed to include British citizens, he said.
“These seizures are unacceptable,” Hunt said entering an emergency government meeting to discuss securing the release of the two vessels and their crews. “It is essential that freedom of navigation is maintained and that all ships can move safely and freely in the region.”
Details of what took place remained sketchy. Iran said earlier Friday that it had seized a British oil tanker in the Strait of Hormuz,
The tanker Stena Impero was taken to an Iranian port because it was not complying with “international maritime laws and regulations,” Iran’s Revolutionary Guard declared.
A statement from Stena Bulk, which owns the tanker, said it was unable to contact the ship after it was approached by unidentified vessels and a helicopter in the Strait of Hormuz.
The company said the tanker, with 23 crew members aboard, was in international waters when it was approached but subsequently appeared to be heading toward Iran.
U.K. Chamber of Shipping chief executive Bob Sanguinetti said the seizure represented an escalation in tensions in the Persian Gulf and made it clear more protection for merchant vessels was urgently needed.
He claimed the action is “in violation of international regulations which protect ships and their crews as they go about their legitimate business in international waters.”
The British government should do “whatever is necessary” to ensure the safe and swift return of the ship’s crew, Sanguinetti said.
The incident came just two days after Washington claimed that a U.S. warship downed an Iranian drone in the Strait. Iran denied that it lost an aircraft in the area.
On June 20, Iran shot down an American drone in the same waterway, and Trump came close to retaliating but called off an airstrike at the last moment.
Tensions in the region have been growing since the Trump administration withdrew a year ago from Iran’s 2015 nuclear deal with world powers. After the withdrawal, the U.S. imposed harsh sanctions, including on Tehran’s oil trade, that have sent the Iranian economy into a tailspin.
Iran’s government has desperately tried to get out of the chokehold, appealing to the other partners in the deal, particularly Europe, to pressure the U.S. to lift the bruising sanctions. Europe wants to maintain the nuclear deal, but has not been able to address Iranian demands, particularly concerning the sale of oil, without violating U.S. sanctions.
On Friday, Iran and the United States emphatically disagreed over Washington’s claim that a U.S. warship downed an Iranian drone in the Strait of Hormuz. American officials said they used electronic jamming to bring down the unmanned aircraft, while Iran said it simply didn’t happen.
Neither side provided evidence to prove its claim.
At the White House, President Donald Trump said flatly of the Iranian drone: “We shot it down.” But Pentagon and other officials have said repeatedly that the USS Boxer, a Navy ship in the Strait of Hormuz, actually jammed the drone’s signal, causing it to crash, and did not fire a missile. The officials spoke on condition of anonymity to discuss sensitive technology.
Trump’s national security adviser, John Bolton, said, “There is no question this was an Iranian drone, and the USS Boxer took it out as the president announced yesterday because it posed a threat to the ship and its crew. It’s entirely the right thing to do.”
In Tehran, the Iranian military said all its drones had returned safely to their bases and denied there was any confrontation with the USS Boxer, an amphibious assault ship.
“We have not lost any drone in the Strait of Hormuz nor anywhere else,” tweeted Deputy Foreign Minister Abbas Araghchi.
Iran’s Revolutionary Guard on its website Friday said the drone recorded three hours of video of the USS Boxer and five other vessels Thursday beginning when the ships first entered the Strait of Hormuz. There was no immediate explanation as to how the video was evidence that no Iranian drone was destroyed.
The strategically vital Strait of Hormuz is at the mouth of the Persian Gulf and serves as the passageway for one-fifth of all global crude exports.
Trump on Thursday said the USS Boxer took action after the Iranian drone closed to within 1,000 yards of the warship and ignored commands to stay away. The president accused Iran of “provocative and hostile” action and said the U.S. acted in self-defense.
The Revolutionary Guard said its forces continue to monitor all movements by foreigners — especially “the terrorist forces” of the U.S. and the British in the Strait and the Gulf.
After Trump pulled the U.S. out of the Iran nuclear deal with world powers last year and imposed economic sanctions against Tehran, the Iranians have pushed back on the military front in recent weeks, with Washington accusing Tehran of threatening American forces and interests in the region.
Iran’s foreign minister, Mohammad Javad Zarif, suggested in New York as he arrived for a meeting at the United Nations that Iran could immediately ratify an agreement to allow broader checks of its nuclear facilities by U.N. inspectors if the U.S. dropped its sanctions.
China urged Washington to consider the offer, calling it “a positive signal that Iran is willing to seek a compromise solution.”
The Pentagon said Thursday’s incident happened in international waters while the Boxer was entering the Gulf. The Boxer is among several U.S. Navy ships in the area, including the USS Abraham Lincoln, an aircraft carrier that has been operating in the North Arabian Sea for weeks in response to rising tensions.
The Iranians and Americans have had close encounters in the Strait of Hormuz in the past, and it is not unprecedented for Iran to fly a drone near a U.S. warship.
Zarif blamed Washington for the escalation and accused the Trump administration of “trying to starve our people” and “deplete our treasury” through sanctions.
Europe has a new president! Sort of. Germany’s former defense minister Ursula Von der Leyen became the new president-elect of the European Commission (EC) this week following a close vote in the European Parliament.
Why It Matters:
Whoever leads the European Commission—the EU’s executive arm—is the most powerful person in the day-to-day affairs of the European Union and oversees 32,000 EU bureaucrats. Traditionally, the role of the European Commission (made up of Commissioners from each one of the 28 member states; 27 once Britain gets on with Brexit) is to propose new legislation and policies that are then voted on by the European Parliament (more on that below) and to implement those policies in areas reserved to the EU (as opposed to national governments); it also speaks for the EU in international negotiations. The President of the EC decides which Commissioners get which policy portfolios, and generally drives the EC’s policy agenda; he/she also represents the EU in major international meetings like the G7 and G20. Von der Leyen, who is a close ally of Angela Merkel’s and a member of the center-right Christian Democratic Union (CDU) party back in Germany, is the first woman to ever hold the post.
But her victory came at a cost. One of the key concessions Von der Leyen made to get reluctant members of European Parliament (MEPs) on board was giving them the “right of the initiative”, i.e. assurances that the Commission would act on whatever resolutions were passed by the European parliament. Up until this week, it was only the Commission that could propose laws and MEPs would have to vote whether to approve of them or not. In a bid to get more MEPs to back her, Von der Leyen also offered to put Europe on a path to carbon neutrality by 2050 and to discuss the introduction of a minimum wage (among other pledges).
Why was it necessary for Von der Leyen to offer so many concessions to secure the post? Because her nomination didn’t come from the European Parliament as has been expected by MEPs, but rather as a compromise from the leaders of the major European countries in a backroom deal (the same deal that resulted in Christine Lagarde heading up the European Central Bank). That institutional clash made her election difficult, as did the fractious political landscape of Europe.
European politics are much messier than traditional left-right politics (though that plays a big role, too); it’s also about integration vs. Euro-skepticism, Eastern Europe vs. Western Europe, core Europe vs. periphery Europe, pro-climate change action vs. anti, and so on. And while European leaders—notably France’s Emmanuel Macron and Germany’s Merkel—were able to strike a deal that secured a majority among MEP members (however slight), the roundabout way that Von der Leyen (a committed Europhile who supports more European integration and reforms, and even a European army) was elected will provide more fodder for anti-EU politicians across the continent railing against unaccountable bureaucrats back in Brussels.
What Happens Next:
Von der Leyen is a clear sign that at the EU level, things aren’t changing much. Her policy priorities will be similar to her predecessor’s, and her general orientation is similarly very pro-Europe. Populists remain at the political margins (at least in Brussels), and don’t agree on much of anything amongst themselves to pose an immediate threat to the pro-European establishment on the EU-wide level. Europe isn’t in danger of falling apart. But an EC helmed by Von der Leyen doesn’t change the fact that the EU is becoming less important on the global stage. To be fair though, Von der Leyen is the symptom, not the cause, of that reality.

As for Merkel, the elevation of Von der Leyen as the compromise choice came at the cost of her initial proposal to install a Socialist candidate at the head of the Commission… which infuriated her Socialist coalition partners back home in Germany and adds even more pressure to her already-straining coalition.

As millions of people prepare for sweltering heatwaves in the U.S. Midwest and East Coast, scientists say July will likely be the hottest July on record, following the hottest June on record. These types of heatwaves are expected to become more frequent throughout the world as global warming continues, say scientists.
The National Oceanic and Atmospheric Administration (NOAA) reports the average global temperature for June was 1.71 degrees Fahrenheit above the 20th century average of 59.9 degrees. NOAA also reported record-breaking decreases in sea ice coverage in the Arctic and Antarctica.
“Our climate is warming,” Ahira Sánchez-Lugo, a climatologist at NOAA, tells TIME. “We have a new normal, we are in a new warmer climate. Just in the 21st century, we’ve set a new global world temperature record five times.”
Robert Rohde, lead scientist at Berkeley Earth, tells TIME that July is also likely to be the hottest July on record, as global temperatures continue to trend towards increasing heat.
Regionally, hot June temperatures broke records in Europe, Africa and South America, and it was the hottest first half of the year for Alaska, Madagascar, New Zealand, Mexico, western Canada and eastern Asia.
Overall between January through June, the temperature averaged out to 1.71 degrees above the 20th century average of 55.3, tying with 2017 as the hottest year so far.
Rohde says this trend can be attributed to human emissions of greenhouse gases. “This trend will continue until humans find a way to change their behavior and stop modifying the atmosphere,” Rohde says.
He points out that while the trend continues upward, the world may not see consistently warmer temperatures. “It doesn’t happen continuously,” he says. “There are fluctuations, we don’t have a new hottest year every year or a new hottest month every month, but as we move forward we expect to set many records over time.”
“Our extremes will change,” she says. “Drought is expected to become more intense and more frequent, heatwaves too, and all of this has consequences. Drought can impact the quality of water, the quantity of water, crops, food might get more expensive if there’s a drought.”
As temperatures continue to increase globally due to greenhouse gas emissions, the world will begin to see fewer cool days, according to Rohde.
“These conditions will start to put stress on social, economic and technical systems designed for the historical climate,” he adds. For example, agricultural systems that depend on a certain amount of rainfall that gradually starts to decrease while temperatures gradually increase.
Sánchez-Lugo says we have already seen examples of climate change effecting parts of the U.S., pointing to above average rainfall in the U.S. Midwest in June that prevented the planting and growing of crops.
“This year there were pastures that were not even planted with corn because it was so wet,” she says.
In the longterm, climate change threatens ice melting in the Arctic and Antarctic, increasing sea levels, which is already occurring. In Antarctica, sea ice coverage was 8.5% below the 1981-2010 average, the difference of 62,000 square miles, the smallest Antarctic record for June. And in the Arctic, sea ice coverage was 10.5% below average, the second-smallest on record for June.
Where have people been impacted by severe heat?
In Europe, Austria, Germany and Hungary had the warmest June on record, but heat also increased in Switzerland and France, which saw its hottest day in history on June 28 — 113 degrees Fahrenheit.
Heatwaves in Europe can be especially dangerous for elderly people in regions that are not used to high temperatures, says Piers Forster, professor of climate physics at the Priestley International Centre for Climate at the University of Leeds.
“Particularly in Europe, when heatwaves occur it can be especially damaging to harvests,” he adds. “Crops can be heavily effected, and of course you create a lot more susceptibility to wildfires, that can burn down homes and that also creates worse air pollution as well.”
The entire continents of South America and Africa and parts of Alaska saw saw the warmest June on record. In Alaska, infrastructure damage has been caused by permafrost melting due to temperature rising.
Now much of the U.S. prepares for a weekend heatwave expected to reach 100 degrees Fahrenheit. Extreme heat is the most fatal weather hazard in the U.S., according to the National Weather Service, even more deadly than hurricanes and floods.
What can be done to change the rising temperature trend?
Sánchez-Lugo, Rodhe and Forster agree the world needs to halt the the emission of greenhouse gasses in order to end the global rise in temperature.
Forster says temperatures are expected to increase globally even if greenhouse gases are reduced. “So to prevent them from going up, we have to reduce our emission of greenhouse gases all the way to zero.”
179 countries have signed onto the Paris Climate Agreement to reduce greenhouse gas emissions globally with the goal of keeping the global temperature rise below 2 degrees Celsius, or 3.6 degrees Fahrenheit, above preindustrial levels. But the U.S. announced its intention to withdraw from the agreement in 2017.
Still, Forster is optimistic. “Countries around the world are taking it really seriously,” he says. “The thing is you have to get every country in the world to do it and you have to get every part of the economy interested. So that’s where the challenge is but I would say that humanity always rises to these challenges, so I’m personally quite optimistic.”
(WASHINGTON) — Iran and the United States emphatically disagreed Friday over Washington’s claim that a U.S. warship downed an Iranian drone near the Persian Gulf. American officials said they used electronic jamming to bring down the unmanned aircraft, while Iran said it simply didn’t happen.
Neither side provided evidence to prove its claim.
At the White House on Friday, President Donald Trump said flatly of the Iranian drone: “We shot it down.”
But Pentagon and other officials have said repeatedly that the USS Boxer, a Navy ship in the Strait of Hormuz, actually jammed the drone’s signal, causing it to crash, and did not fire a missile. The officials spoke on condition of anonymity to discuss sensitive technology.
Trump’s national security adviser, John Bolton, said, “There is no question this was an Iranian drone, and the USS Boxer took it out as the president announced yesterday because it posed a threat to the ship and its crew. It’s entirely the right thing to do.”
In Tehran, the Iranian military said all its drones had returned safely to their bases and denied there was any confrontation with the USS Boxer, an amphibious assault ship.
“We have not lost any drone in the Strait of Hormuz nor anywhere else,” tweeted Deputy Foreign Minister Abbas Araghchi.
Iran’s Revolutionary Guard on its website Friday said the drone recorded three hours of video of the USS Boxer and five other vessels Thursday beginning when the ships first entered the Strait of Hormuz. There was no immediate explanation as to how the video was evidence that no Iranian drone was destroyed.
The strategically vital Strait of Hormuz is at the mouth of the Persian Gulf and serves as the passageway for one-fifth of all global crude exports, and oil prices ticked upward Friday on the news.
On June 20, Iran shot down an American drone in the same waterway, and Trump came close to retaliating but called off an airstrike at the last moment.
Trump on Thursday said the USS Boxer took action after the Iranian drone closed to within 1,000 yards of the warship and ignored commands to stay away. The president accused Iran of “provocative and hostile” action and said the U.S. acted in self-defense.
The Revolutionary Guard said its forces continue to monitor all movements by foreigners — especially “the terrorist forces” of the U.S. and the British in the Strait and the Gulf.
After Trump pulled the U.S. out of the Iran nuclear deal with world powers last year and imposed economic sanctions against Tehran, the Iranians have pushed back on the military front in recent weeks, with Washington accusing Tehran of threatening American forces and interests in the region.
Iran’s foreign minister, Mohammad Javad Zarif, suggested in New York as he arrived for a meeting at the United Nations that Iran could immediately ratify an agreement to allow broader checks of its nuclear facilities by U.N. inspectors if the U.S. dropped its sanctions.
China urged Washington to consider the offer, calling it “a positive signal that Iran is willing to seek a compromise solution.”
The Pentagon said Thursday’s incident happened in international waters while the Boxer was entering the Gulf. The Boxer is among several U.S. Navy ships in the area, including the USS Abraham Lincoln, an aircraft carrier that has been operating in the North Arabian Sea for weeks in response to rising tensions.
The Iranians and Americans have had close encounters in the Strait of Hormuz in the past, and it is not unprecedented for Iran to fly a drone near a U.S. warship.
Zarif blamed Washington for the escalation and accused the Trump administration of “trying to starve our people” and “deplete our treasury” through sanctions.

The government is also issuing a $7 million reward for information leading to the capture of the operative, Salman Rauf Salman.
The action by the Treasury Department falls on the 25th anniversary of an attack Salman is said to have coordinated on a Jewish center in Buenos Aires, Argentina. The attack killed 85 people and wounded hundreds of others. The Treasury Department’s action freezes all assets that Salman has within U.S. jurisdiction. Treasury says Salman is also accused of planning other terror attacks abroad from a base in Lebanon.
On Thursday, Argentina’s government branded Hezbollah a terrorist organization and froze its assets.
(ATHENS, Greece) — A strong earthquake centered northwest of Athens shook Greece on Friday, causing frightened residents to run into the capital’s streets and damaging several buildings. Authorities said four people were hospitalized with injuries, none of them serious.
The Athens Institute of Geodynamics gave the earthquake that struck at 2:13 p.m. local time (1113 GMT) a preliminary magnitude of 5.1. The U.S. Geological Survey reported a magnitude of 5.3.
Firefighters checked for people trapped in elevators amid power outages after the brief but jolting quake.
In central Athens, the Acropolis Museum was evacuated and closed for the rest of the day as a precaution, but the city’s ancient monuments remained open.
Police patrols and helicopters were deployed to inspect areas close to the earthquake’s epicenter near the town of Magoula. The patrols were scheduled to continue overnight as many local residents were expected to sleep outdoors waiting for aftershocks to subside.
Greek government spokesman Stelios Petsas said an abandoned building collapsed in western Athens and several other abandoned buildings elsewhere in the city had serious damage.
“I urge members of the public to remains calm. In Greece, we are well-acquainted with earthquakes,” he said.
The most powerful quake to hit the Greek capital in the last 20 years came in 1999, when a temblor of magnitude 6.0 caused extensive damage and killed more than 140 people.
After Friday’s quake, fire brigades reported receiving dozens of calls about people trapped in elevators. The shaking was caught on live cameras in the studios of state broadcaster ERT.
Gerasimos Papadopoulos, the senior seismologist at the Geodynamics Institute, said it was felt across southern Greece.
“It had a very shallow depth and that’s why it was felt so strongly,” he said, adding that the earthquake had been followed by a normal pattern of aftershocks.
The question has been dismissed as pure fantasy by those on both sides of the Brexit debate in the past. But according to a new report by the BBC’s Newsnight program, rebel lawmakers have drawn up a plan to ask Britain’s constitutional head of state to take the most drastic step of her 67-year reign, wading into U.K. politics for the first time ever in order to stop a so-called “no deal” Brexit.
The news comes as Britain prepares itself for a new Prime Minister, expected to be former Foreign Secretary Boris Johnson. Some lawmakers are now concerned that Johnson—who is in favor of a hard break with the European Union—will try to push through a “no deal” Brexit, where the U.K. leaves the political and economic bloc without an agreement for trade and commerce to continue. A majority of lawmakers in Parliament are against a “no deal” Brexit, but Johnson has refused to rule out overruling parliament via prorogation, or effectively locking the chamber’s doors so no vote can take place.
To prevent this, the BBC reports, these unnamed lawmakers would invite the Queen to travel to the next E.U. summit in place of Johnson, in defiance of precedent and constitutional norms. There, under the plan, the Queen would ask other E.U. leaders to delay the U.K.’s departure, foiling Johnson’s plan to leave with or without a deal on the current deadline of Oct. 31.
But there’s a sizeable hitch: no monarch has so directly involved themselves in the country’s politics since 1707, when Queen Anne refused royal assent to a bill. Like her ancestors, the Queen is bound by convention to be entirely neutral in the running of the country. Although she meets with the Prime Minister regularly, she does not vote and has never publicly intervened or ventured opinions on political matters.
So while technically possible it would be nothing short of a constitutional overhaul if this plan were to go ahead — and outside of the realms of plausibility, according to one leading expert.
“This idea that the Queen could be asked to go on a mission to some European summit is completely wacky,“ Robert Hazell, a professor of Government and the Constitution at University College London, tells TIME. “E.U. summits are heads of government meetings. They are not meetings of heads of state. The Queen of Denmark is not going to be there. The King of Sweden is not going to be there. The Queen would be a very very odd one out if she attended as a representative of the British government.”
But if the next Prime Minister decides to prorogue parliament, the Queen would be involved one way or another. The legislative body can only be prorogued if the Prime Minister asks the Queen to do so and she accepts. Under extreme circumstances, the Queen would be within her constitutionally-mandated limits to say no.
And if the Prime Minister has no majority—so, for example, if lawmakers stage a vote of no confidence in response—the Queen can refuse to follow his or her advice. “The Prime Minister’s advice is only binding on the Queen when the Prime Minister commands the confidence of Parliament,” Hazell says.
These constitutional questions are still hypothetical, but they may not be for much longer. A majority in parliament has vowed to stand in the way of a no-deal Brexit. And yet Johnson has said the U.K. will leave the E.U. on Oct.31, “do or die.” One side will have to back down, whether Queen Elizabeth is involved or not.
(COPENHAGEN, Denmark) — U.S. rapper A$AP Rocky should be held for another week in pre-trial detention to allow police to finish investigating a June 30 fight in downtown Stockholm, a prosecutor said Friday.
Daniel Suneson has asked Stockholm’s District Court to hold A$AP Rocky — the stage name of Rakim Mayers — until July 25. A ruling is expected later Friday.
Suneson said police “have worked intensively” with the preliminary investigation but need more time to complete their probe.
On July 5, Mayers who was in Sweden to perform at a music festival, and his body guards were ordered held for two weeks after being detained two days earlier. Videos published on social media, show a person being violently thrown onto the ground by Mayers. It was not clear who else was involved. A defense lawyer has said it was self-defense.
The platinum-selling, Grammy-nominated artist has seen many celebrities such as Kim Kardashian West, her husband Kanye West and Justin Bieber come to his support since his arrest.
Soon after the news of his arrest broke, the movement #JusticeForRocky pushed for the rapper’s release. A petition calling for his release has also garnered half a million signatures. IL&FS directors had tried to keep many ratings in "private", push rating officials to softens ratings, even influenced them to change the language in rating rational and occasionally inflated numbers in fishing for better ratings. The 105-page Grant Thornton (GT) report accessed by ET details out anomalies, issues of professional compromises and corporate governance surrounding the CRAs who rated IL&FS in the last ten years.The role of five CRAs- CARE, Icra, India Ratings , Brickwork and CRISIL have been reviewed by GT which assigned a total of 429 ratings during the period between 2011 and 2019.Various enforcement agencies like the Enforcement Directorate and the Serious Fraud Investigation Office (SFIO) are probing the books of IL&FS and its subsidiary. The development comes close to the heels of the CARE Ratings, MD & CEO, Rajesh Mokashi and Managing Director and Group CEO of ICRA Naresh Takkar sent on leave after anonymous complaint received by Sebi. EFFORTS TO KEEP THE RATINGS `PRIVATE'A Grant Thornton report has observed strategies applied by IL&FS former key employees to avoid a downgrade in credit ratings. In cases if the favorable ratings were not obtained, the former employees of IL&FS were paying huge sums to keep ratings private.An email dated 30 January 2018 was sent by Mic Kang -representative of Moodys to Dilip Bhatia providing him with the rating letter for ITNL. This was further shared by Dilip Bhatia with the KMPs for IL&FS, where he suggested that rating from Moodys should be kept in private domain and requested Anita Ferreira to check the cost for the same. Based on the trail email, it was noted that by paying additional $68000 (Rs 47 lakhs) to Moodys ratings can be kept in private domain."The draft report commissioned by the IL&FS Board on credit rating agencies is wrong with respect to Moody's," said Moody's spokesperson in an email. "To be clear, Moody's has never requested, accepted or in any way agreed to receive an additional fee in exchange for keeping a rating in the "private domain," as the draft report inaccurately claims. The fee for any particular rating is the same regardless of whether the rating is public or private, and ongoing monitoring of the rating is subject to a separate annual fee."Moody's is in the process of alerting the company to the inaccuracies relating to Moody's in the draft report and expect the report to be corrected accordingly.The report says that given the liquidity stress in ITNL, it is unusual to note that significant amount $68000 was offered to Moodys to keep the ratings of ITNL in private domain. This amount was paid over and above $91,000 upfront fees paid for rating with one year validity.In 2013, a mail was sent by Ajay Menon to Sujoy Das informing him that an investor of commercial papers had requested ITNL to get credit ratings from Brickworks. Further, in the trail email Sujoy Das informs Arun Saha about the proposal of Ajay Menon and states that ratings will be kept private if highest short-term rating is not given by Brickworks.INFLATE FORECAST An email communication between the erstwhile IFIN director and a senior employee at ITNL indicates that inflated projections were submitted to CRISIL in order to get good ratings. "...In an email dated December 17, 2010, it appears that Menon was informing Karunakaran Ramchand (erstwhile director of ITNL) about the projected profit after tax (PAT) for FY-2010–2011 would be approximately Rs.240 crores. However, the same was indicated as Rs. 325crs for the purpose of rating from CRISIL,"the report states. "Thus, the email appears to indicate that inflated/better projections were submitted to CRISIL in order to get good ratings,"it adds.IL&FS TOP BRASS TRIED TO DELAY, SOFTEN, `EDIT' RATING, RATIONALE The report opines that if the then key employees of IL&FS became aware that ratings were not going to be favorable, they then either delayed the process of rating surveillance or delayed the publication of the rating on the public domain. In certain cases 'intentionally incorrect or incomplete information' was being provided to the CRAs s to avoid rating downgrade;In another instance, the report states, "..We identified an email dated December 3,2014 which sent by Sujoy Das to Sushil Khandelwal in which he appears to suggest that the conclusion of the rating rationale provided by the India Ratings should be softened/less harsh. Further,he also suggests the wording for the conclusions should be "may result in a negative outlook or downgrade". Our public domain searches indicated that the ratings had the exact same wording as suggested by SujoyDas," the report states. Thus,it indicates that IL&FS may have been able to potentially influence the wordings/rationale of India Ratings, its concludes. RATING SHOPPINGCiting how the alleged accused IFIN directors used pressure to get favourable ratings, the GT report cites an email dated August 12, 2008 sent by Arun Saha to Ravi Parthasarathy, "...where it was noted that ICRA committee had decided to not issue "AAA" rating for the debt instruments of IFIN. This step was ICRA was not agreeable to Ramesh Bawa. Further, in the trail email Parthasarathy suggests that they can approach CARE, FITCH as well as CRISIL for the ratings instead of ICRA. Thus, the email trail suggest that key former employees of IL&FS used to approach other rating agencies if they did not get the desired ratings," the communication reads. MCA MULLING ON A FRAMEWORK FOR CRAs. Sources says the ministry of corporate affairs (MCA) may write to the regulators to tighten the framework so as to regulate the CRAs. Credit rating agencies are jointly regulated by both Sebi and RBI as these firms rate bank loans and NBFCs, which constitute 70 per cent of their business.

by Abhimanyu George JainThe continuing saga of Kulbhushan Jadhav has reached a conclusion of sorts with Wednesday's judgment from the International Court of Justice (ICJ). Indian officials, experts and Twitterati are united in hailing the decision as a great victory for India.But a closer look at the judgment reveals a more complicated picture. India's case against Pakistan at the ICJ was based on the Vienna Convention on Consular Relations of 1963 (Vienna Convention). Upon arrest and before trial, Jadhav had the right to communicate with the Indian consulate in Pakistan and to request legal assistance. And the Indian consulate had a parallel right to be informed of Jadhav's arrest and to communicate with him. India's case at the ICJ was that Pakistan had breached these obligations under the Vienna Convention.The ICJ agreed with India. It upheld its jurisdiction over the dispute, dismissed Pakistan's objections and counter-allegations, and found that Pakistan had breached its obligations under the Vienna Convention.Most importantly, the ICJ directed Pakistan to review Jadhav's sentence and conviction and extended the stay on Jadhav's impending execution. Thus, commentators are not entirely wrong in their proclamations of victory – a majority of the issues at stake were decided in favour of India. This decision was not unexpected. The ICJ has previously been confronted with very similar facts and legal issues in two cases--the LaGrand case between Germany and the US and the Avena case between Mexico and the US-- and has reached very similar conclusion.The problem is that this is a largely pyrrhic victory. India's end goal was Jadhav's release. Or, failing that, annulment of the decision of the military court that had convicted Jadhav, quashing of the confession which the conviction was based on, and retrial in a civilian court with greater transparency and procedural safeguards. In this, India was unsuccessful.The rights that were at the heart of India's case were the procedural rights of consular access and notification under the Vienna Convention. The appropriate remedy for breaches of these rights, as correctly noted by the ICJ, is the provision of those rights and the reversal of any injustice occasioned by their denial. This is consistent with its decisions in LaGrand and Avena, and this is what the ICJ provided when it directed Pakistan to "provide, by means of its own choosing, effective review and reconsideration of the conviction and sentence of Mr. Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Vienna Convention."The problem with this is that Pakistan retains the discretion to decide how to review Jadhav's conviction and to secure his Vienna Convention rights. In theory, Pakistan could provide consular access, repeat the trial procedure, reach the same result, and then argue that it had fulfilled its obligations under the judgment.In that situation, India's options will be limited. The only legal one would be to go back to the ICJ and argue that the review did not meet the standards mandated by it. One cannot predict how the ICJ will respond in that situation, but the scope of its scrutiny will inevitably be limited.Mexico tried this strategy in the Avena case and met with limited success. The problem is that, in this case, the jurisdiction of the ICJ is restricted to assessing compliance with consular rights under the Vienna Convention.It cannot undertake a broader inquiry into the fairness of the trial.India tried to make the quality of the Pakistani legal system an issue in the Jadhav case, but met with limited success (as did Mexico when it tried the same strategy in Avena).Consequently, the ICJ decision is a decidedly mixed bag. This is best reflected, perhaps, in the fact that Pakistan has also welcomed the judgment as vindication of its position.In closing, however, it is important to acknowledge one very positive aspect of the judgment – the successful strategic invocation of the jurisdiction of the ICJ by India. The Indian government must be lauded for its decision to involve the ICJ in this case. Pakistan's efforts to sensationalise its arrest and conviction of Jadhav as an Indian spy and terrorist would undoubtedly have harmed Indian interests. The vindication of India's case by the ICJ brings into question the veracity of Pakistan's claims as to Jadhav's antecedents.Taking the case to the ICJ was a clever and effective way to undermine Pakistan's narrative. The Indian government has frequently been criticised for its shortcomings in relation to the development and strategic invocation of public international law. NEW DELHI: A consortium led by Brookfield Asset Management has agreed to acquire Reliance Industries' Reliance Jio lnfratel unit in a multi-stage deal, which would see it first investing Rs 25,215 crore in an infrastructure trust that owns 51% of the telecom tower company.Once the transactions are closed, the Canadian alternative assets manager and its partners would own 100% of India's largest telecom tower company with 170,000 towers through Tower Infrastructure Trust. The proceeds will allow Mukesh Ambani-controlled RIL reduce debt at its telecom unit, Reliance Jio Infocomm, and free up cash to take on rivals Bharti Airtel and Vodafone Idea."This is the single largest foreign investment in an Indian infrastructure vehicle," RIL said.TOWER, FIBRE BIZ SPUN OFF EARLIER THIS YEARThe oil-to-telecom conglomerate said talks were ongoing also to monetise the group's fibre assets, Jio Digital Fibre, under a similar deal structure, but did not name any potential investors. "It has been powered by deep consumer insights on the eating patterns of the average Indian consumer and the fact that today consumers are look for healthier and tastier snacking options."The total salty snacks market in India is estimated at Rs 29,000 crore, with an annual growth of 24%. NEW DELHI: A consortium led by Brookfield Asset Management has agreed to acquire Reliance Industries' Reliance Jio lnfratel unit in a multi-stage deal, which would see it first investing Rs 25,215 crore in an infrastructure trust that owns 51% of the telecom tower company.Once the transactions are closed, the Canadian alternative assets manager and its partners would own 100% of India's largest telecom tower company with 170,000 towers through Tower Infrastructure Trust. The proceeds will allow Mukesh Ambani-controlled RIL reduce debt at its telecom unit, Reliance Jio Infocomm, and free up cash to take on rivals Bharti Airtel and Vodafone Idea."This is the single largest foreign investment in an Indian infrastructure vehicle," RIL said.TOWER, FIBRE BIZ SPUN OFF EARLIER THIS YEARThe oil-to-telecom conglomerate said talks were ongoing also to monetise the group's fibre assets, Jio Digital Fibre, under a similar deal structure, but did not name any potential investors. There is an extremely good opportunity to buy in the next 10-12 weeks through SIP in select midcaps and large caps, says Sanjiv Bhasin, Executive Vice President, IIFL Securities. Excerpts from an interview with ETNOW. What should one do with the midcaps that are cracking?The fear is overdone. Market is very despondent and that has more to do with some of the FIIs exiting because of the tax. A large part of the imponderables are on the positive side and we are calling it the 12-week factor, from here till middle of October. October onwards we are very bullish on the market and we think that in this fear, you should do a SIP for the next 10-12 weeks in select midcaps and select largecaps, because we think midcaps maybe on the way to the bottom. This is a very good selloff in the broader market and the largecaps. It tells you that inherently over ownership or the exit of some of the FIIs are giving you an opportunity. The cement numbers are a clear indicator for an economy and it says the economy is only going to get better from here. So, there is an extremely good opportunity to buy in the next 10-12 weeks through a SIP in select midcaps and large caps. Though the sentiment has turned really sour currently and we have been getting some really dire predictions on liquidity, growth, no one is seeing the light around the corner. We are now hearing an outlook which is a little bit more long term -- four to six quarters -- as opposed to a pick up as early as the festive season or the end of the year? Would you disagree?It is overdone and it is always the screen which tells you. When I was in Mumbai for many years, the best saying was what a Guajarati bhai told me: Bhav bhagwan che. Bhav is what is telling you that the fear is there. That fear is overblown and I am not saying that there is not macro weakness, but look at the cost of money on the bond yields, look at the rupee and global liquidity. It is just a matter of time, maybe once this expiry is over, you should start to see very good inflows from FIIs. Wait for the government to start to act on more consumption-led themes. They have already given you a wicket on some of the NBFCs and the recapitalisation of PSBs. Going ahead, they have a good opportunity of instigating growth through a lot of other measures. We are being opposite. We think these 11,400 on the Nifty is an ideal place to start a SIP in both the Nifty, Bank Nifty and select stocks both on largecaps and midcaps. After October, you will be very happy that you did this because fear is generally the best time to be contrarian and start to buy. What is your view on Reliance?Reliance will give a slightly weaker number on the net and we have to see how the GRMs are. But do not miss the wood for the trees. Yesterday, they announced $1 billion capex in the gas basin of KG which is telling you they are putting their money where their mouth is -- whether it is technology in the shape of Jio and the other businesses which are online. They are taking on Netflix in OTT. And on the energy side on gas. In fact, for gas, this participation in new pipeline in partnership with GAIL should see a lot of flows from overseas and Reliance is one of the key players there. Any fall over here is a very good opportunity. In fact, Reliance, ITC, UltraTech Cement, ICICI Bank and Sun are five names which we are suggesting to very actively have a large SIP for the next 12 weeks. By the end of the year, you will be much happier that you bought this fear and Reliance would be one of the constituents. We think Reliance by the end of the year and maybe March 2020 should be closer to Rs 1,450-1,500.

So why did APL Apollo group acquire Best Steel Logistics and rename it as Apollo Tricoat Tubes? This was all planned a few years ago, when Rahul Gupta (promoter's son) had joined Best Steel Logistics.The company had the land (Malur) and other infrastructure available in proximity to APL Apollo's plant in Hosur and Bengaluru. Hence, this provided the company an opportunity to leverage on APL Apollo's supply chain. The new visionary promoter owns majority of the company as on date.What are Tricoat Tubes?Tricoat is a product that provides corrosion resistance through triple coating. Apollo Tricoat is the first product of its kind to give a combination of three different coating i.e. zinc, paint and polymer clear coat unlike the competitive products that either give paint finish or zinc finish.If Sanjay Gupta could transform Bihar Tubes (renamed later as APL Apollo), an absolute 'nil margin, no hope converter' business, into a Rs 7,000 crore company from Rs 200 crore in 12 years, then imagine what he could do with a premium product that is manufactured by only a few players in the world.He understands how to lay the foundation with great brains, knows marketing and branding to the core, is aware of the market that pays a premium to ethical companies with corporate governance, has the best auditor in place, believes in being debt free and is someone who aims do a 20 per cent-plus ROIC.He seems to be one of those promoters who are committed to building wealth for his stakeholders. He has been there, seen it and done it all. He will just replicate everything in Apollo Tricoat.Common sense is the most uncommon thing in equity market. The company ended FY19 with hardly any sales to talk about. The numbers should not be taken into context as the company has changed hands with new promoters coming in last year and they did stop the old steel trading business.The new promoter has got a habit of under-promising future numbers and over-delivering, which the market participants absolutely adore. For instance, they had pointed at a capacity of 50,000 MTPA for ILG, but commercialised 75,000 MTPA in March 2019. Then again they had guided for additional 50,000 MTPA by H1FY20 for value-added products, but they are expected to come up with 75,000 MTPA to achieve an annual target of 150k MTPA.This facility is near Bangalore, which will cater to the needs of pan-India clients. Apollo Tricoat is one of the pioneers in India to launch inline galvanised pipes, designer galvanised pipes, hybrid pipes (ILG + PVC) and narrow sections. The products seem to be very niche, requiring much technological knowledge.The new inline galvanised (ILG) pipes find their application in several sectors and are cost effective. Apollo currently has some warehouses which will continue to chip in with some revenues, but that's not the bigger part of the story. We are not even considering the current revenues or current profits.They are hell bent on making a huge dent on the "tricot pipe segment" and aim to attain the leadership position in no time. The Ebitda margins are well north of 14-15 per cent. Internally, the company targets to scale it to around Rs 1,000 crore within 2-3 years.Asset turnover at peak capacity is 6-7 times. Hence, currently an investment of Rs 175 crore can result in a turnover of Rs 1,000-1,200 crore.With APL Apollo's strong financial support and rich distribution, we feel the targets are well within reach. Kudos to the brainchild of Sanjay Gupta. Unless APL Apollo plans to merge it, there is not much of a risk to this story.P.S: This gentleman after creating massive wealth in APL Apollo did the same with a company called Amulya Leasing, a defunct NBFC, which he reverse-merged into his company to build Apollo Pipes, which has been a multibagger in last three years. NEW DELHI: The government said select business process outsourcing (BPO) services will qualify as exports and therefore won't be subject to goods and services tax (GST), marking a substantial relief for the country's $167 billion IT and ITeS (information technology-enabled services) sector.The clarification comes after intense lobbying by the IT industry. The BPO sector was in turmoil since the Appellate Authority for Advance Ruling (AAAR) in Maharashtra held that back-office support services didn't qualify as "export of service" and were in the nature of arranging or facilitating supply of goods or services between overseas companies and customers. It said these fell in the category of intermediary services and were liable to 18% GST.The circular issued by Central Board of Indirect Taxes and Customs on Friday clarified that unless there is a clear facilitation of services, BPO services will not be considered intermediary in nature as long as the provision of service is on its own account. An intermediary facilitates or arranges supply of goods and services. "The clarification will help in settling most of the frivolous objections regarding export of services in case of intermediary services," said Bipin Sapra, partner, EY.70301306 COULD SPARK NEW ROW: EXPERTSExports don't face tax in the country as they are consumed outside. Back-office services enjoyed this benefit even in the erstwhile service tax regime. India has more than 500 global in-house delivery centres, employing over 350,000 people. An 18% levy on these services will derail the cost dynamics of the back-office model that operates on thin margins and faces competition from other low-cost jurisdictions such as the Philippines.The circular has clarified the applicability of GST in various scenarios related to an ITeS supplier located in India working for and on behalf of a client located abroad. An ITeS company supplying back-end services won't be categorised as an intermediary if providing the services on its own account, in light of the definition of the term "intermediary" under GST law, the circular said.However, a supplier of backend support services such as order placements, delivery and logistical support, obtaining governmental clearances, transportation of goods, post-sales support etc. will be considered an intermediary and hence subject to GST.In case a company provides back-end services on its own account along with arranging or facilitating supply of various support services on behalf of the client located abroad, it's offering two sets of services — ITeS services and support services. In such cases, whether the supplier would qualify as an intermediary or not will depend on the facts of each case and taking into account the principal supplier, the circular said.AAAR had in February upheld an Authority for Advance Rulings (AAR) decision treating back-office support services to overseas customers as intermediary services in a case involving Vservglobal Pvt Ltd. This meant that the services were considered to be supplied in India and not treated as exports, leading to denial of refunds and raising the prospect of a spate of litigation.However, tax experts said the latest circular could spark a new row by classifying one category of BPO — post-sale support services — as intermediary services, making them liable to tax."The clarification that even 'post-sale' support services shall be treated as in the nature of 'intermediary' may trigger a new controversy, as the general understanding has been the only 'pre-sales' activities are covered in this category, both under GST as well as erstwhile service tax law," said Pratik Jain, national indirect tax leader, PwC.This aspect should perhaps be reconsidered in consultation with industry, Jain added."There is some fear that authorities may start issuing notices to all back-office support providers in light of the scope discussed in scenario 2 of the said circular," said Harpreet Singh, partner, KPMG.
