IL&FS Crisis: Accounts cannot be declared NPA without NCLAT nod

New Delhi: No bank or financial institution can declare the accounts of debt-ridden IL&FS and its group companies as non-performing assets (NPAs) without NCLAT's permission, the appellate tribunal said today.

A two-member National Company Law Appellate Tribunal (NCLAT) bench, headed by Chairman Justice S J Mukhopadhaya, said that this is done in the interest of IL&FS debt resolution plan.

"No IL&FS or its subsidiaries' account to be declared NPA by any financial institution without approval from NCLAT," the appellate tribunal said. The tribunal's direction came during the hearing over the government's plan for the resolution of IL&FS group companies.

During the last hearing on February 11, NCLAT had allowed 22 companies of IL&FS group, which were classified in the green category based on their financial health, to service their debt obligations.

Besides, it had also approved the appointment of former Supreme Court judge Justice D K Jain to supervise the resolution process of crisis-hit IL&FS and its group companies.

The appellate tribunal also lifted the moratorium and allowed 133 IL&FS firms incorporated outside India to continue with the resolution process. IL&FS group companies are classified into three groups – Green, Amber and Red based on their respective financial positions.

The companies falling under green category will continue to meet their payment obligation. While the companies which can not meet their obligations but can meet only operational payment obligations to senior secured financial creditors are classified as amber.

The red category includes those entities which cannot meet their payment obligations towards even senior secured financial creditors.

RRB expected to release Group D 2019 result by February 28, check at rrbcdg.gov.in

Railway Recruitment Board is likely to declare the Group D exam result by this week. According to a report in TimesNow, Railway Board has confirmed that they will be releasing the Group D results by end of February i.e., Feb 27 or 28. The results will be available on official RRB site, rrbcdg.gov.in. The result will also be available at RRB regional sites like Mumbai, Secunderabad, Patna, Allahabad, and many others. For Mumbai region, the Group D results will be out on rrbmumbai.gov.in.

Qualified candidates will be eligible for the PET exam and document verification process. There are total 62,907 vacancies available with RRB for the Group D recruitment. European Union asks Pakistan to take ‘clear and sustained’ actions against terrorists

Islamabad: The EU has asked Pakistan to take "clear and sustained" actions targeting not only all UN-listed transnational terrorist groups but also individuals claiming responsibility for attacks in the wake of the Pulwama terror strike. The statement came amid heightened tension between the two nuclear-armed arch-rivals after the February 14 suicide attack by Pakistan-based Jaish-e-Mohammad that killed at least 40 CRPF soldiers in Jammu and Kashmir's Pulwama district.

Federica Mogherini, High Representative of the EU for Foreign Affairs and Security Policy and Vice President of the EU Commission, urged Pakistan and India to urgently "de-escalate" the tension which has built up after the attack. She spoke to Foreign Minister Shah Mahmood Qureshi on Sunday and discussed the current situation, a delegation of the European Union (EU) said in a statement here.

The EU is also in contact with India, it said. Mogherini also highlighted the need to "continue addressing terrorism including clear and sustained actions targeting not only all United Nations-listed transnational terrorist groups but also individuals claiming responsibility for such attacks" the statement said.

She said the EU's policy has always been to promote a dialogue between Pakistan and India to sort out differences. After the attack, which was claimed by the UN-proscribed JeM, India launched a major diplomatic offensive against Islamabad after the attack and highlighted Pakistan's role in using terrorism as an instrument of state policy.

India asked Pakistan to take immediate and verifiable action against terrorists and terror groups operating from territories under its control. New Delhi also announced the withdrawal of the Most Favoured Nation status for Pakistan and hiked the customs duty by 200 per cent on goods originating from Pakistan.

India to get 5G technology by 2021 despite certain hurdles: Nokia

Barcelona: Finnish telecom gear maker Nokia said the ban on certain vendors being discussed in and around Europe will not delay its 5G rollout plan.

The company's CEO Rajeev Suri said that after leading markets like the US, South Korea, China, emerging markets including India, Latin America, and certain developed markets will see roll out of the next generation technology by 2021, where million of trade secrets will flow on the network; and security will be a top priority for businesses.

Addressing concerns over certain vendors being held back, and 5G rollout being stalled leading to increased cost, Suri said, "Bluntly, the fact just do not support the claim. After all, 5G is an ecosystem. It is not a copyright".

There have been reports that the ban on Chinese vendor Huawei may lead to rise in cost of 5G services and delay roll out of network.

Certain countries have blocked purchase of 5G equipment from Huawei. According to third party reports, the Chinese firm has taken lead over its rival in getting highest number of patents that will be required for 5G services, and cited attempt to block purchase if its equipment due to global politics rather than security concerns.

"No single company decides how and when it (5G) develops; and its deployment is not dependent on any one company. It certainly seems sounds illogical to me to suggest that Nokia can meet requirements of the US, but cannot meet needs of European countries," Suri said here on Sunday.

According to Nokia, 5G is expected to deliver 25 times faster speed of 1 gigabit per second compared to 4G.

Suri said that according to Nokia Bell lab study, countries like India which have seen skirmishes with China, haven't taken stand to ban Huawei, but allowed the company to take part in 5G trials.

Indian telecom operators are purchasing equipments from all vendors active in the market — a strategy that Suri said leads to increase in price. "Multi-vendor idea is a bad idea," Suri said, adding that purchase from single vendor can lower cost of ownership by 30 per cent and enhance network rollout rate by 45 per cent.

"Let us be clear, cheaper is not always better. Better is better. When it comes to network security, better really matters," he asserted.

He said security will be top priority when 5G services are rolled out. "This is one area like ethics where we cannot compromise… Many enterprises will rely on operators for providing network for critical functions. Essential trade secrets will flow over those networks," Suri said.

According to Nokia Bell lab study, business opportunity for telecom from 5G technology is expected to double from USD 500 billion to USD 1 trillion by 2028, and it will enable productivity growth to historical levels.

"Between 2028-33, similar gains will be seen in the US as experienced in 1950s in the range of 30-35 per cent. Not just the United States, China and India could see similar productivity gains," Suri said.

He added that Internet of Things technology will be a critical factor to drive growth in 5G business.

IIT-Bombay student from Thane arrested for filming people bathing

Thane: A 34-year-old man pursuing higher education from the prestigious Indian Institute of Technology-Bombay was Saturday arrested for allegedly filming people bathing, police said.

Thane-resident Avinash Kumar Yadav has been charged under section 354 (any man who watches, or captures the image of a woman engaging in a private act in circumstances where she would usually have the expectation of not being observed) of the Indian Penal Code.

"A woman filed a complain that she found a mobile phone on the bathroom window while she was bathing on Friday night. She alerted her husband who confiscated the phone. The couple saw the accused fleeing from the place," a Kapurbawdi police station official said. "The accused was nabbed by other residents. The mobile phone had clips of men and women, mostly residents of the same building, bathing," he added.

Ujjain: Kathak exponent of Banaras and Kudau Singh Gharana Khushboo Panchal from Ujjain added a new chapter to the history of traditional dance with her blind folded perfomance. Khushboo is renowned for creative dance which differentiates her from other artists, but this she took her creativity to new heights.

She performed her in demand Shiv Stuti during International Performing Arts Festival held at Hyderabad. She then staged a 30 minute performance which was dedicated to character of famous epic Mahabharata Gandhari. Khushboo re-lived the character Gandhari on stage with her blind folded performance which explained the major parts of Gandhari's life.

She dedicated two months on practice, and directly performed at new stage. Such experience is challenging as well deeply appreciable. Her solo performance is said to be the first in traditional dance history and as per Khushboo, whatever she performed here or at any show is just a shadow of her guru Dr Poonam Vyas.

She dedicated this performance to her guru and said that it was not possible for her to perform without teachings and guidance of Dr Vyas, her supervision, blessings and motivation are the key to achieve such Goals.

North Korea ‘could be great power’ without nuclear weapons: Donald Trump

Washington: North Korea could become one of the world's "great economic powers" if it relinquishes its nuclear weapons, US President Donald Trump has said on the eve of his departure for Vietnam for a second summit with North Korean leader Kim Jong-un.

Trump's comments came hours after Secretary of State Mike Pompeo said Pyongyang remains a nuclear threat. Trump will meet North Korean leader Kim Jong-un for the second time on the 27-28 February in Hanoi, Vietnam. "We both expect a continuation of the progress made at first summit in Singapore," Trump tweeted, referencing the meeting between the two leaders in Singapore last June.

Trump and Kim had their historic first meeting in Singapore last June, wherein they agreed on denuclearisation of North Korea. North Korea has long insisted it will not give up its nuclear arsenal unless the US removes its troops from South Korea. "…I tell Chairman Kim, he has a chance to have a country that is so vibrant, economically. Maybe one of the most in the world. He's got a location that's unbelievable. As a real-estate person, I've always done very well with location. But he's right between China, Russia, and then on the other side, South Korea. So they can't touch each other unless they go through North Korea," Trump told a meeting of Governor's at the White House.

"And I think it can be, really, one of the great — one of the great financial and economic countries anywhere in the world.  So I tell him that.  I said, 'But you can't do that if you're going to keep nuclear. If you do nuclear, that can't ever happen'," Trump said. Trump reiterated that he is having a great relationship with Kim. Trump said he was "not in a rush" to denuclearise North Korea.

"We see eye to eye, I believe.  But you'll be seeing it more and more over the next couple of days, one way or the other. What's going to happen?  I can't tell you. I think eventually it would, but I can't tell you.  And I'm not in a rush. I don't want to rush anybody.  I just don't want testing.  As long as there's no testing, we're happy," he said. Trump said he has "done really something, very special" with respect to North Korea.

(Nifty 10825, UP 33 points): Benchmark indices continue to be in the green after anxious early trades.

Nifty hovering just above 10,800 mark, now nearing its major hurdle zone of 10861 (200 DMA). All technical eyes wait anxiously whether it gets breached.

Advance to decline ratio of 30:19 is marginally tilted towards gains, slightly stronger wind may take the markets along with it to fly like a kite.

At the time of writing, all Benchmark stock indices at US, Europe and Asian markets are seen spreading the green. That seems to keep the Indian Markets cheered.

Among sectoral indices, all the indices are waving green signal except Public Sector Banks, lagging behind by 0.54%. Maximum gain visible in NSE Auto, NSE Pharma, NSE Private Banks which are up 0.94%, 0.72%, 0.67% respectively.

Looking at above sectoral picture, looks like money is moving from PSB stocks to Private banking stocks.

The market breadth, indicating the overall health of the market is positive.

The NSE 150 Mid-Cap index is up 0.36% at 5,943. The NSE Small-Cap 100 index is up 0.54% at 5,910.

INDIA VIX index representing volatility is up at 15.59 (+0.95%).

On the Positive side: UPL at 847 (+2.38%), DR Reddy at 2687 (+1.8%), Sun Pharma at 438.25 (+1.80%) holding the Nifty in green,

Souring the mood: ADANIPORTS at 327 (-7.68%), Infratel at 304.65 (-2.85%) & BPCL at 339.75 (-1.29%).

Reality stocks have done well after the GST Council on Sunday cut tax rates on under-construction flats to 5 per cent and affordable homes to 1 per cent, effective April 1.

RCOM witnessed a fresh spell of selling (down 7%) after Axis Trustee said more shares of Reliance Communications have been pledged with it, taking the total shares with it to 9.18%.

Shares of IIFL Holdings and Motilal Oswal Financial Services (MOFSL) traded with negative bias in response to the adverse SEBI order on the two companies' commodity derivatives subsidiaries.

IIFL Holdings shares slumped nearly 3% while Motilal Oswal shares fell over 2.5% on the BSE.

This decision is welcome and quite positive as it comes at a time when NBFCs are facing liquidity issue, and most importantly, the capital will help banks to be out of PCA norms so that lending can pick up and increase market share of public sector banks specially the recent banks which have exited PCA.

If you recollect, the government in December 2018 had infused Rs 28,615 crore into seven public sector.

The negative catalysts in favor of bears:

1. Bears can hang on their hopes as rising crude oil prices are the negative catalysts for our markets.

2. Bears can also hang on their hopes on overall economic activity in the eurozone which has slowed more sharply as eurozone manufacturing enters first downturn since Mid-2013. You can blame it to trade frictions and uncertainty about the severity of China's economic slowdown.

3. The minutes from the Federal Reserve's January policy meeting signaled that the economic outlook is increasingly uncertain.

4. The border tension which has been gripping our stock markets since last Thursday on wake of terrorist attack in Pulwana, Kashmir.

Long story short: The bears' case crumbles above Nifty 10821 mark.
