* The U-2 spy plane has flown continuously for the intelligence community and U.S. military for 64 years. * As the times have changed and technology improves, the suits have gotten better at keeping pilots comfortable and alive. * One company, the David Clark Company, has been the sole manufacturer of the suits since the 1960s.
The U.S. Air Force is continuing to improve the pressurized flight suit used by U-2 spy plane pilots, 64 years after the airplane's first flight. The service is using emerging tech, including 3D printing, to make the suits lighter, more comfortable, and most importantly, safer than ever before.
The U-2 spy plane first flew on August 1st, 1955. The black jet's ability to climb to extremely high altitudes and collect intelligence on adversaries and potential adversaries has kept it in Air Force service longer than any other aircraft. The airplane flies so high that pilots are required to wear a pressurized flight suit. Although the cockpit is normally pressurized, a sudden loss of pressurization could endanger a mission—and the pilot's life—so pilots wear full body suits that resemble the astronaut suits.

At least 26 members of Afghanistan's security forces were killed in a new wave of Taliban attacks in northern Afghanistan, local officials said on January 1.

In northern Kunduz Province, at least 10 Afghan officers were killed and four others wounded in an attack on a police checkpoint in the district of Dashti Archi late on December 31, the head of the provincial council Mohammad Yusouf Ayubi said.
In Balkh Province, the Taliban killed nine police officers in an attack on their checkpoint. The fate of four other policemen who were at the checkpoint was unknown, said Mohammad Afzel Hadid, head of the provincial council.

Mexico's president, Andrés Manuel López Obrador, closed out 2019 with a parting shot at his predecessors, saying the imprisoned drug kingpin Joaquín "El Chapo" Guzmán Loera had once wielded the same power as the country's president.
In a video message from the southern city of Palenque on Wednesday, López Obrador recounted his administration's successes in its first year and highlighted its challenges foremost surging violence.
He claimed without offering any evidence that he had already done away with the high-level corruption that was rampant in previous governments, but said it was crucial to draw a bright line between criminal elements and authorities so that the two sides do not mingle as they had in the past.

US President Donald Trump may use a trip to China to try to nudge Beijing into committing to changes in its economic model, according to observers.
And while a visit might help to ease trade frictions, they said Beijing would be bracing for the US leader to push for more concessions from China. Trump on Tuesday said a partial US-China trade pact – the so-called phase-one deal – would be signed on January 15, and he would also then travel to China for more talks.
"The ceremony will take place at the White House. High-level representatives of China will be present," Trump tweeted. "At a later date I will be going to Beijing where talks will begin on Phase Two!"
There was no mention of Trump's tweet in Chinese state media on Wednesday.

Sen. Bob Menendez (N.J.), the ranking Democrat on the Senate Foreign Relations Committee, is calling for the Trump administration to give Congress an explanation for the security failure at the U.S. Embassy in Baghdad after protesters stormed it on Tuesday.
Menendez condemned the attack in a statement in which he said that the U.S. is prioritizing ensuring American diplomats and personnel are safe. He also requested Iraq assist in protecting the U.S. personnel in the region.
"I call on all Iraqis, including the government and security forces, to continue our partnership with American security forces and diplomatic personnel to restore security and order," he wrote.

The US Marines and embassy security responded quickly, and no serious casualties were reported. US military reinforcements in Baghdad came in quickly to aid the embassy, followed by US soldiers from Kuwait. All within hours after the first altercation. Hundreds of additional US forces were assembled in the U.S. and sent to the Middle East within 12 hours. From my vantage point everyone responded quickly and professionally. If there is a security failure it is within the Green Zone itself, and that is an Iraqi responsibility. It is clear to me that Iraqi forces turned a blind eye that permitted these protesters to show up, and that a discussion on how to prevent this from happening again in the future will need to be done.

Defense Secretary Mark Esper said Tuesday that 750 U.S. soldiers will deploy "immediately" to the Middle East after violent protests at the U.S. Embassy in Iraq.
In a series of tweets, Esper said that more U.S. forces stand ready to deploy to the region.

Taiwan’s military chief and seven others have died after a helicopter carrying high-level defense officials crash-landed Thursday morning in a mountainous region south of capital Taipei.
The Ministry of National Defense (MND) reported the casualties during an afternoon news conference. Taiwan’s chief of general staff, Shen Yi-ming, is among the dead. Five people survived the accident.
Taiwan’s official broadcaster Central News Agency also confirmed the death of Shen.
The 62-year-old took office as the top chief last year. He had earlier served as the 22nd Air Force commander of the Air Force and Deputy Minister of Defense, and has undergone military training in France and the U.S.
“I would like to extend my deepest condolences to the families of the victims,” Taiwan President Tsai Ing-wen wrote on Facebook. She added that Shen is an “outstanding general” and that his death is saddening.
The tragedy comes at a tense time for the self-ruled island, which is claimed by China. On Tuesday, the Taiwanese parliament passed an anti-infiltration law to combat perceived threats to the island’s democratic independence from mainland China as the island gears up for a presidential vote on Jan. 11.
The incumbent, Tsai, is running on the promise of upholding the territory’s sovereignty and maintaining a distance from the mainland. Beijing has said that it would not rule out using force against the island.
The Taiwanese UH-60M Black Hawk helicopter took off just before 8 a.m. and last made contact at 8:07 a.m., according to a defense ministry news conference. Taiwan air force commander-in-chief Hsiung Hou-chi said the helicopter went down in the hilly district of Wulai, and that the crash was caused by mechanical or environmental factors, which were yet to be clarified. Two rescue helicopters and 91 personnel were dispatched to the scene.
“Some of the people (on board) are still inside trapped, some have gotten out,” Hsiung said. “But as for the details, we still need the further report from the search and rescue team on the scene.”
The exact cause of the crash and conditions of the five who survived is not known.
According to the defense ministry, the helicopter was on a routine mission to visit soldiers stationed in Yilan, a county in the territory’s northeast, ahead of the Chinese New Year.
(TOKYO) — Japanese prosecutors raided the Tokyo home of former Nissan Chairman Carlos Ghosn after he skipped bail before a trial on financial misconduct charges and left for Lebanon.
Tokyo prosecutors and police did not immediately comment Thursday. Japanese media reported and showed photos of the raid.
Government offices are closed this week for the New Year’s holidays.
It is unclear how Ghosn avoided the tight surveillance he was under in Japan and showed up in Lebanon.
Ghosn said Tuesday in a statement that he left for Lebanon because he thought the Japanese judicial system was unjust, and he wanted to avoid “political persecution.”
He said he would talk to reporters next week.
Japan does not have an extradition treaty with Lebanon.
Lebanon has said Ghosn entered the country legally, and there was no reason to take action against him.
His lawyers in Japan said they had no knowledge of the escape and they had all his passports. Ghosn has French, Lebanese and Brazilian citizenship.
Japanese public broadcaster NHK TV, without identifying sources, reported Thursday that Ghosn had two French passports.
Earlier Japanese reports said there were no official records in Japan of Ghosn’s departure, but a private jet had left from a regional airport to Turkey.
Ghosn, who was charged with under-reporting his future compensation and breach of trust, has repeatedly asserted his innocence, saying authorities trumped up charges to prevent a possible fuller merger between Nissan Motor Co. and alliance partner Renault SA.
His 1.5 billion yen ($14 million) bail that Ghosn posted on two separate instances to get out of detention is being revoked.
(PERTH, Australia) — Thousands of tourists fled Australia’s wildfire-ravaged eastern coast Thursday ahead of worsening conditions as the military started to evacuate people trapped on the shore further south.
Cooler weather since Tuesday has aided firefighting and allowed people to replenish supplies. Vehicles formed long lines at gas stations and supermarkets, and traffic was gridlocked as highways reopened. But fire conditions were expected to deteriorate Saturday as high temperatures and strong winds return.
“There is every potential that the conditions on Saturday will be as bad or worse than we saw (on Tuesday),” New South Wales Rural Fire Service Deputy Commissioner Rob Rogers said.
Authorities said 381 homes had been destroyed on the New South Wales southern coast this week and at least eight people have died this week in the state and neighboring Victoria, Australia’s two most-populous states, where more than 200 fires are currently burning.
New South Wales authorities in the morning ordered tourists to leave a 250-kilometer (155-mile) zone along the picturesque south coast. State Transport Minister Andrew Constance said it is the “largest mass relocation of people out of the region that we’ve ever seen.”
In Victoria, where 68 homes have burned this week, the military was helping thousands of people who fled to the shore as a wildfire threatened their homes Tuesday in the coastal town of Mallacoota. Food, water, fuel and medical expertise were being delivered and about 500 people were going to be evacuated from the town by a naval ship.
“We think around 3,000 tourists and 1,000 locals are there. Not all of those will want to leave, not all can get on the vessel at one time,” Victoria Premier Daniel Andrews told the Australian Broadcasting Corporation.
The early and devastating start to Australia’s summer wildfires has led authorities to rate this season the worst on record. About 5 million hectares (12.35 million acres) of land have burned, with at least 17 people dead and more than 1,300 homes destroyed.
Prime Minster Scott Morrison said the crisis was likely to last for months. “It (fires) will continue to go on until we can get some decent rain that can deal with some of the fires that have been burning for many, many months,” Morrison told reporters on Thursday.
Smoke from the wildfires caused the air quality in the national capital, Canberra, to be the world’s worst and was blowing into New Zealand.
Indonesian authorities re-opened the Halim Perdanakusuma airport in Jakarta for limited operations, as the death toll rises from the city’s worst flooding in almost seven years.
At least 16 people have died from the New Year’s Day flooding, with half of the victims in Jakarta, according to the disaster mitigation agency. Heavy monsoon rains had lashed the Indonesian capital and nearby cities since New Year’s Eve, and the weather agency expects the adverse weather to last until next week.
State-run airport operator PT Angkasa Pura II allowed the use of 30 meters of the 45-meter-width runway starting Wednesday afternoon at Halim Perdanakusuma, the city’s second-biggest airport. For now, the facility only caters to Airbus A320 and Boeing 737 planes, according to Polana B. Pramesti, the Transport Ministry’s director-general of civil aviation.
Located in East Jakarta, Halim Perdanakusuma supports the main Soekarno-Hatta international airport and hosts flights for PT Garuda Indonesia’s low cost carrier Citilink and private airline PT Lion Mentari Airlines.

As many as 45 flights from the Lion Air group were diverted and rerouted, while 29 flights were canceled on Jan. 1, the airline said in a statement.

(BAGHDAD) — Iran-backed militiamen withdrew from the U.S. Embassy compound in Baghdad on Wednesday after two days of clashes with American security forces, but U.S.-Iran tensions remain high and could spill over into further violence.
The withdrawal followed calls from the government and senior militia leaders. It ended a two-day crisis marked by the breach of the largest and one of the most heavily fortified U.S. diplomatic missions in the world.
The attack and its volatile aftermath prompted the Pentagon to send hundreds of additional troops to the Middle East and U.S. Secretary of State Mike Pompeo to delay a European and Central Asian trip.
In an orchestrated assault, hundreds of militiamen and their supporters broke into the embassy compound, destroying a reception area, smashing windows and spraying graffiti on walls to protest U.S. airstrikes against an Iran-backed militia over the weekend that killed 25 fighters.
The U.S. blamed the militia for a rocket attack on an Iraqi military base in the northern city of Kirkuk last week that killed a U.S. contractor.
The protesters set up a tent camp overnight and on Wednesday set fire to the reception area and hurled stones at U.S. Marines guarding the compound, who responded with tear gas. There were no injuries on either side and no American staff were evacuated from the compound.
The Popular Mobilization Forces, an umbrella group of state-allied militias — many backed by Iran — called on its supporters to withdraw in response to an appeal by the Iraqi government, saying “your message has been received.”
By late afternoon the tents had been taken down and the protesters relocated to the opposite side of the Tigris River, outside the so-called Green Zone housing government offices and foreign embassies. U.S. Apache helicopters circled overhead.
“After achieving the intended aim, we pulled out from this place triumphantly,” said Fadhil al-Gezzi, a militia supporter. “We rubbed America’s nose in the dirt.” Trump has vowed to exact a “big price” for an attack he blamed squarely on Iran.
Kataeb Hezbollah, the Iran-backed militia targeted by the U.S. airstrikes, initially refused to leave but later bowed to demands to disperse. The militia is separate from the Hezbollah militant group in Lebanon, though both are backed by Iran.
“We don’t care about these planes that are flying over the heads of the picketers. Neither do we care about the news that America will bring Marines,” said Mohammed Mohy, a spokesman for Kataeb Hezbollah. “On the contrary, this shows a psychological defeat and a big mental breakdown that the American administration is suffering from,” he said, before withdrawing from the area.
The violence came as Iran and its allies across the region have faced unprecedented mass protests in recent months and heavy U.S. sanctions have cratered Iran’s economy.
Iraq has been gripped by anti-government protests since October fueled by anger at widespread corruption and economic mismanagement, as well as Iran’s heavy influence over the country’s affairs. Those protesters were not involved in the embassy attack.
The Pentagon sent an infantry battalion of about 750 soldiers to the Middle East. A U.S. official familiar with the decision said they would go to Kuwait. Pompeo postponed a trip that was scheduled to start in Ukraine late Thursday so that he can monitor developments in Iraq and “ensure the safety and security of Americans in the Middle East,” said State Department spokeswoman Morgan Ortagus.
Iran denied involvement in the attack on the embassy. Supreme Leader Ayatollah Ali Khamenei was quoted by media as saying that “if the Islamic Republic makes a decision to confront any country, it will do it directly.”
Iran later summoned the Swiss charge d’affaires, who represents American interests in Tehran, to protest what it said was war-mongering by U.S. officials.
Public consular operations at the embassy were suspended and future appointments cancelled, it said in a statement.
Tensions have steadily risen since Trump withdrew the U.S. from Iran’s 2015 nuclear deal with world powers and embarked on a campaign of maximum pressure through economic sanctions. Iran has responded by abandoning some of its commitments under the deal.
U.S. officials have blamed Iran for the sabotage of oil tankers in the Persian Gulf and a drone attack on Saudi oil facilities in September that caused a spike in world oil prices. But the Trump administration has not responded with direct military action, apparently fearing a wider conflict.
The U.S. has sent more than 14,000 additional troops to the Gulf region since May in response to concerns about Iranian aggression. At the time of the attack, the U.S. had about 5,200 troops in Iraq, mainly to train Iraqi forces and help them combat Islamic State extremists.
The U.S. and Iran have vied for influence over Iraq since the 2003 U.S.-led invasion that toppled Saddam Hussein. Iran has close ties to Iraq’s Shiite majority and major political factions, and its influence has steadily grown since then.
Iran helped to mobilize tens of thousands of mostly Shiite militiamen to battle the Islamic State group when it stormed across northern and western Iraq in 2014 as the armed forces collapsed. The U.S. and Iran both provided vital aid to Iraqi forces, who eventually declared victory over the extremists in December 2017.
The political influence of the Popular Mobilization Forces has risen in recent years, and their allies dominate the parliament and the government. That has made them the target of the anti-government protesters, who have attacked Iranian diplomatic missions and the local headquarters of parties affiliated with the militias across southern Iraq.
They have also set up a sprawling protest camp in central Baghdad, and for weeks have been trying to enter the Green Zone. Iraqi security forces have beaten them back with tear gas and live ammunition, killing hundreds.
The militiamen and their supporters, however, were able to quickly enter the Green Zone and mass in front of the embassy, with little if any resistance from authorities.
Iraq’s government vehemently condemned the airstrikes on the militia, saying it violated national sovereignty. But Iran and its allies might have also seen the attack as a way of diverting attention from the anti-government protests.
“Iran has been trying to provoke the U.S. into helping it solve its Iraq problem,” said the Crisis Group, an international think tank. “The Trump administration, by responding to the attacks in Kirkuk and elsewhere with airstrikes, has obliged.”
The former head of Nissan Motor Co. and Renault SA, who was awaiting the first of two trials in Tokyo, somehow evaded almost round-the-clock manned and video surveillance and heavy restrictions on his freedom of movement to flee to Lebanon.
From there, Ghosn released an email Tuesday decrying the “injustice and political persecution” of the Japanese judicial system. The 65-year-old faced charges of financial misconduct and raiding corporate resources for personal gain, allegations he denies.
Soon after he resurfaced, the internet lit up with unconfirmed reports and theories of how Ghosn, now an international fugitive, pulled off an escape befitting a Hollywood thriller — one that will be very hard for Japanese authorities to live down. There are still more questions than answers.
In one speculative account, which cited no sources, Lebanese television station MTV reported that Ghosn smuggled himself out of Japan in a large musical instrument box after a Christmas band visited his residence in Tokyo. He was then shipped out of the country and later entered Lebanon from Turkey on a private plane.
Ghosn’s getaway followed weeks of planning, the Wall Street Journal reported, citing unidentified people familiar with the matter. A team of accomplices assembled last weekend to carry out his exfiltration, and his wife, Carole, played a major role in the operation, the newspaper said.
Ghosn was taken from his court-monitored residence in Tokyo onto a private jet, bound for Turkey, from where he continued on to Lebanon, landing there early Monday morning, it said.
A detailed report in the French daily Le Monde, citing unidentified sources, similarly reported that Carole Ghosn organized the escape with the help of her brothers and their contacts in Turkey, and that her husband entered Lebanon with an ID card. He may have decided to flee because of new information Japanese authorities could have obtained from a Swiss bank and from offshore centers including Dubai, the newspaper reported.
The Lebanese newspaper Annahar, by contrast, reported that Ghosn entered the country with a French passport. The former industry heavyweight has Lebanese, French and Brazilian citizenship, though all his passports had been taken from him. Meanwhile, a report that Ghosn met with Lebanese President Michel Aoun was denied by an official at the presidency.
French newspaper Les Echos said Ghosn may have left Japan under a false identity with a forged passport, after boarding a private plane from a smaller airport where he was less likely to be recognized.
The U.K.’s Guardian said Lebanon officials were instructed by political leaders to ignore arrival formalities for Ghosn at the Beirut airport, citing a senior figure in the country’s ruling class that the newspaper didn’t identify.
The French foreign ministry, for its part, said it doesn’t know how Ghosn pulled off the caper. Lebanon’s foreign ministry said in a statement that Ghosn entered the country legally and it was unaware how he fled Japan and arrived in Beirut.
The Asahi newspaper in Japan suggested Ghosn may have flown out of Kansai Airport near Osaka, citing records from the Ministry of Transport that indicated a private jet left Japan for Istanbul in the evening of Dec. 29. On social media, would-be sleuths also posted private-jet flight information on aircraft that left for Istanbul the same day that Ghosn may have left the country.
A long-range Bombardier Inc. business jet left Kansai airport on Sunday night, arriving Monday morning in Istanbul, the Journal report said, citing flight-tracking data. A smaller jet left the airport for Beirut just over half an hour later, it said.
Ghosn’s vanishing act has trended on Twitter and inspired a fair amount of word play, as in “Ghosn with the Wind” and “Ghosn, Ghosn Gone.” Tesla Inc.’s Elon Musk also chimed in, tweeting “Carlos Gone.”
It wasn’t just casual tweeters alone. Masahisa Sato, a ruling party lawmaker in Japan, questioned in a tweet whether Ghosn was helped by another country in leaving Japan, and called Ghosn’s actions illegal.
Japan’s foreign ministry said by email Wednesday they are looking into the matter and can’t offer a comment.
In Japan, Ghosn’s escape dominated the front pages of domestic newspapers on New Year’s Day. Articles reported on speculation of how Ghosn was able to escape, the difficulty of extradition from Lebanon, and that his trial — set to begin in April — was unlikely to occur.
The Sankei newspaper, citing unnamed top officials in the prosecutor’s office, reported on anger and frustration there. Those in the office told the paper that Ghosn had made a mockery of Japan’s justice system, blamed the courts and Ghosn’s lawyers for him being out on bail, saying it was obvious he would escape.
Ghosn is expected to give a press conference from Lebanon in his new home after the holidays. In the meantime, red-faced Japanese law enforcement and customs officials have some explaining to do.

(PERTH, Australia) — Australia deployed military ships and aircraft Wednesday to help communities ravaged by apocalyptic wildfires that have left at least 17 people dead nationwide and sent thousands of residents and holidaymakers fleeing to the shoreline.
Navy ships and military aircraft were bringing water, food and fuel to towns where supplies were depleted and roads were cut off by the fires. Authorities confirmed three bodies were found Wednesday at Lake Conjola on the south coast of New South Wales, bringing the death toll in the state to 15.
More than 175 homes have been destroyed in the region.
Some 4,000 people in the coastal town of Mallacoota fled to the shore as winds pushed a fire toward their homes under a sky darkened by smoke and turned blood-red by flames. Stranded residents and vacationers slept in their cars, and gas stations and surf clubs transformed into evacuation areas. Dozens of homes burned before winds changed direction late Tuesday, sparing the rest of the town.
Victoria Emergency Commissioner Andrew Crisp told reporters the Australian Defence Force was moving naval assets to Mallacoota on a supply mission that would last two weeks and helicopters would also fly in more firefighters since roads were inaccessible.
“I think that was our biggest threat in terms of what are we doing with the children if we need to go in the water to protect ourselves given the fact that they are only 1, 3 and 5,” tourist Kai Kirschbaum told ABC Australia. “If you’re a good swimmer it doesn’t really matter if you have to be in the water for a longer time, but doing that with three kids that would have been, I think, a nightmare.”
Conditions cooled Wednesday, but the fire danger remained very high across the state, where four people are missing.
“We have three months of hot weather to come. We do have a dynamic and a dangerous fire situation across the state,” Crisp said.
In the New South Wales town of Conjola Park, 89 properties were confirmed destroyed and cars were melted by Tuesday’s fires. More than 100 fires were still burning in the state Wednesday, though none were at an emergency level. Seven people have died this week, including a volunteer firefighter, a man found in a burnt-out car and a father and son who died in their house.
Firefighting crews took advantage of easing conditions on Wednesday to restore power to critical infrastructure and conduct some back burning, before conditions were expected to deteriorate Saturday as high temperatures and strong winds return.
“There is every potential that the conditions on Saturday will be as bad or worse than we saw yesterday,” New South Wales Rural Fire Service Deputy Commissioner Rob Rogers said.

Pope Francis has apologized for angrily slapping the hand of a woman who was holding on to him and pulling him toward her as he walked through the Vatican City‘s Nativity scene on New Year’s Eve.
The following day, the pontiff apologized for the interaction while giving his annual New Year’s well wishes to the public in St. Peter’s Square. “I say ‘excuse me’ for the bad example,” he said in unscripted remarks, adding that “so many times we lose patience. Me, too.”
Video of the incident went viral on social media, and shows the Pope walking through a crowd of Catholic pilgrims on New Year’s Eve. As he tried to walk away from one group, a woman can be seen grabbing his hand and yanking him closer to her. As he tried to pull away from her, she would not let go. The Pope, who appeared frustrated, then slapped her on the hand and frowned as he walked away.
The following day, Pope Francis spoke out against violence toward women during his New Year’s Day homily in St. Peter’s Basilica, equating it to profaning God, according to the Associated Press.
He noted that “many times women’s bodies are sacrificed on the profane altar of advertisements, of profit, of pornography,” and lamented that women are ”continually offended, beaten, raped, forced into prostitution” and forced to have abortions — a procedure the Catholic Church is against.
The Pope also said he hoped that in the new year women worldwide would take on more leadership roles.“If we want a better world, that is a house of peace and not a courtyard of war, may the dignity of every woman be at the heart of it. Women are givers and mediators of peace, and should be fully associated with decision-making processes.”
Women are not able to become priests in the Catholic Church. The pontiff did not say how roles for women might be specifically expanded in the church in the coming year.
(MEXICO CITY) — At least 16 inmates in a central Mexico prison were killed and five more were wounded in a riot that closed out a violent 2019 for the country, authorities said.
Zacatecas state security secretary Ismael Camberos Hernández told local press that authorities confiscated four guns that they believe were introduced to the Cieneguillas state prison during prison visits Tuesday. He said the prison had been searched for weapons on Saturday and Sunday and no guns were found.
The melee broke out around 2:30 p.m. Tuesday and the prison was brought under control by 5 p.m., according to a statement from the state security agency.
Fifteen of the victims died at the prison and one died later at a hospital.
One prisoner was detained with a gun still in his possession and the other three were found inside the prison, the statement said. Camberos said not all of the victims died from gunshot wounds. Some were stabbed and others beaten with objects.
No guards or police were wounded, Camberos said.

And what he says produces plenty of arguments, too.Meet National Company Law Appellate Tribunal chairman Justice Sudhansu Jyoti Mukhopadhaya (69), who headed the bench that delivered the judgment reinstating Cyrus Mistry as chairman of Tata Sons.As the Tatas get ready to appeal in the SC against Justice Mukhopadhaya's order, the ex-Supreme Court judge is in the news again. He has been here before. Sometime back, the SC overturned another of NCLAT's headline-making orders that had put financial and operational creditors at par when distributing proceeds from a bankruptcy sale.Justice Mukhopadhaya though is unruffled — and he quotes Rabindranath Tagore to make his case. The judge, who has delivered over 1,800 judgments, quoted these lines from a Bengali verse by Tagore: "Roth bhaabe aami deb, poth bhaabe aami, murti bhaabe aami deb, haanse antarjaami (The Lord's chariot, the path on which it is driven, and the idols, they all think they are to be worshipped, and God is amused)." And then Justice Mukhopadhaya explains: "A judge is like a saint, he can't give, neither can he take. This is judgeship… what is to happen, has to happen. It is Almighty who decides." It's not "individuals" but "cases" that matter, Justice Mukhopadhaya says, when asked about heavyweight litigants who appear before him. Is any case special? "No, not at all. Every case is important to me, every case is sensitive to me. Case dekhna hai, not the person. I have handled cases like fodder scam, where a sitting chief minister's name figured," Justice Mukhopadhaya says when ET asks whether the high stakes in the Tata-Mistry case weighed on his mind.He is naturally unwilling to go into specifics of the case. But he does point to Chapter 16, Sections 241 and 242 of the Company's Act that deal with "oppression and mismanagement". Companies need to work on corporate governance to avoid internal strife spilling over to courts and tribunals, the NCLAT chairman says. 73063528 On the Insolvency and Bankruptcy Code (IBC) Justice Mukhopadhaya says, the "IBC is for resolution. The idea is to avoid liquidation. It is not for money claims, not for filing suits, not adversarial…", but "it is forward-looking". "Remember, if corporates survive, employment will be generated. Bankers, financial institutions will survive. Small businesses, poor and farmers — everyone will benefit," he says.Justice Mukhopadhaya took over as NCLAT chief in 2016. His earlier stint in the Supreme Court also saw drama. He was part of the bench that ruled that any MP or MLA will lose House membership immediately upon being sentenced to two or more years in jail for any crime. The judgment dramatically overturned Section 8(4) of the Representation of the People Act. And it affected politicians as important as Lalu Prasad.He was also part of the two-judge Supreme Court bench that controversially upheld the constitutionality of Indian Penal Code's Section 377, which criminalised homosexuality. I do crack jokes. I may show my anger, but not for the actual purpose of the anger," he says. NEW DELHI: India could look at a calibrated increase in the goods and services tax rates to shield consumers from sudden price shocks, apart from minimising exemptions, as it seeks to lift tax revenue collections. A panel of officials on revenue augmentation, comprising officials from the states and the Centre, is reviewing the current rate structure.There is a view that rate increases can be carried out in a benign manner, either through small increases in lower rates or by moving some items to a higher bracket in tranches."There is a need to re-look at the structure. How you do it is another issue," said a government official. "You can do it in a calibrated manner to avoid sudden shocks. This is one option."About 150 items that are exempt from GST are likely to get a close look. There are over 260 items currently in the 5% slab.Processed items cannot be in the lowest slab or the exempt category because it also leads to problems of input tax credits for them and erodes their competitiveness, said the official. GST collections have averaged Rs 1,00,646 crore so far in the current financial year, short of about Rs1.12 lakh crore a month needed to meet the budget target. 73063343 The panel's suggestions are likely to be examined by the GST Council, the apex decision-making body for the tax, at its next meeting. The GST Council secretariat had asked the states on November 27 to suggest ways to boost revenue, including rate rationalisation and reducing exemptions.States such as Punjab suggested slabs of 10% and 20%, with a third rate of 25% for sin and luxury goods. Others such as West Bengal and Delhi do not back significant changes at the current juncture, especially pertaining to rate increases.Currently, GST has seven rate categories – exempt, 0.25%, 3%, 5%, 12%, 18% and 28%.The officers panel is also looking at how to minimise exemptions in both goods and services and raise the revenue-neutral rate – that single rate of GST at which there is no loss of tax. This was estimated at 15.5% when GST was rolled out on July1, 2017.The panel had presented a paper at the previous meeting of the council, but was asked to look into issues in more detail and come back with a more comprehensive report.It had suggested restructuring slabs, increasing rates on some goods to correct inverted duty structures, including on mobile phones, and revisiting rates on items that had seen a reduction to 18% from 28%.Some businesses have asked to be moved from the exempt category or 5% tax bracket without input tax credit to the higher 12% rate where they can adjust tax paid on inputs against final liability.The panel had highlighted an over Rs 63,000 crore shortfall in compensation cess in the current financial year, which, with moderate revenue growth, is a key challenge. Tax experts said given the current economic scenario, large-scale changes seem difficult."However, the government may want to explore merging the 5% and 12% slabs into a single rate of say, 8 or 9%. Alternatively, the 12% and 18% slabs may be merged into a single rate of 15% or 16%," said Pratik Jain, indirect taxes leader at PwC.Jain said there is a need to have a long-term plan on GST rates and start working towards it, rather than changing them frequently. There is little evidence to suggest that rate increases would necessarily result in revenue augmentation, he added.

Reliance Communications' (RCom) committee of creditors (CoC) will meet on Thursday to consider bids of Reliance Jio , Bharti Airtel , Varde Partners and UVARCL.According to people aware , the CoC is expected is expected to seek extension of deadline for the completion of the asset sale process . The bankrupt telco RCom and its units are under the reins of resolution professional (RP) -Deloitte and the resolution process is slated to be completed by January 10. "But, now COC will seek extension of deadline till February end," said a person aware of the development . ET had reported earlier that the CoC overseeing the bankruptcy resolution of Reliance Communications (RCom) expects to raise at least Rs 14,000 crore from the sale of the telco's assets, including spectrum, fibre and towers, based on bids received.At that level, the haircut would be about 70% for financial lenders that have filed claims of Rs49,000 crore against RCom and its units Reliance Telecom and Reliance Infratel.Assets up for sale include airwaves in the 850 MHz band in 14 of India's 22 telecom circles, about 43,000 telecom towers, some fibre and data centres. The spectrum is the most valuable asset. The bankruptcy court had, in a separate insolvency proceeding for Aircel, ruled that the CoC can sell airwaves, rejecting a telecom department plea. The government wanted the spectrum to be returned to it due to unpaid dues, saying it was the owner of the airwaves, and not the telcos. The Department of Telecommunications (DoT) is expected to challenge the National Company Law Tribunal (NCLT) order soon.Bharti Airtel has made the highest bid of Rs 9,000 crore and has offered upfront payment but wants all the assets and not parts of it, said the people cited above. However, the CoC feels it will get better value by selling the assets separately.Private equity fund Varde Partners and UV Asset Reconstruction Company Ltd (UVARCL) have said they will pick up the assets as a going concern and repay lenders as and when they manage to sell towers, fibre and spectrum to other buyers later.At the time of its bankruptcy filing, RCom had debt of Rs 46,000 crore, making it one of India's largest insolvencies. As many as 53 financial creditors, including local and foreign banks, nonbanking finance companies and funds, have claimed Rs 57,382 crore as dues from the company, out of which Rs 49,224 crore has been accepted by the resolution professional.Top Indian financial lenders include State Bank of India with a verified exposure of over Rs 4,800 crore followed by Bank of Baroda (Rs 2,500 crore), Syndicate Bank (Rs 1,225 crore) and Punjab National Bank (Rs 1,127 crore). Top overseas lenders include China Development Bank (Rs 9,900 crore), Exim Bank of China (over Rs 3,356 crore) and Standard Chartered Bank (Mumbai and London, Rs 2,100 crore).Besides banks, operational creditors such as tower companies, equipment vendors and DoT have claimed nearly Rs 30,000 crore in dues, of which over Rs 21,000 crore has been verified. By contrast, in the case of Aircel, the resolution plan has earmarked just about Rs 16.5 crore for hundreds of operational creditors, which had claimed about Rs 20,000 crore in dues.

MUMBAI: Bank lending to India's micro, small and medium enterprises (MSMEs) shrank from a year earlier as well as the beginning of FY20, despite measures by the government to boost credit flow to these businesses as lenders turned cautious due to slowing economic growth.The contraction in gross credit flow to the sector could be on the back of risk-averse lending by top banks as slowing consumption and stalling manufacturing growth have rubbed off on many of these businesses and raised likelihood of defaults, bankers and industry experts told ET.Gross loans to MSME sector fell 3.43% to Rs 4.65 lakh crore in November from Rs 4.81 lakh crore in March, as per RBI data. The drop was 0.5% from November 2018.While loans to micro and small businesses shrank 3.4% since the beginning of FY20 against a contraction of 2.7% in the same timeframe last year, advances to medium-sized firms contracted 3.6% as against growth of 1.4% during March-November 2018. Between November 2018 and 2019, gross loans to micro and small industries fell 0.1% and medium-sized units contracted 2.4%, compared with growth of 1.1% and 11%, respectively, a year earlier."In an environment of slowdown, where the overall credit growth of the industry is waning, most banks increase scrutiny standards while giving loans, especially to the corporate sector," said a banker requesting anonymity. "There have been several instances of promoters of these smaller companies trying to leverage more than what was on the block to get quick access to working capital. Banks are now becoming more prudent while lending to them." 73063380 The shrinking credit pie comes even after finance minister Nirmala Sitharaman made revival of MSMEs a priority in recent policies. The sector's contribution to GDP is estimated to be 30% and these small businesses are instrumental in generating employment. Throughout last year, the government instructed banks to disburse working capital loans to these businesses through new schemes and channels such as festive season loan melas, the PSB59 loan portal and older ones including Pradhan Mantri MUDRA Yojana and TREDS-based bill discounting platforms. "Banks lend with the concept of risk returns. If a particular credit is not commercially viable, then banks won't disburse it despite the broader directions they may have been given," said Prakash Agarwal, head of banking and financial ratings at India Ratings.'RISK AVERSION NEW GUIDING PRINCIPLE'"With risk aversion being the new guiding principle of the Indian banking industry, banks have started to reduce working capital limits, increase risk premium — thereby charging effective interest of over 16% — and insist on additional security when these SMEs are not even generating positive Ebitda," said Sridhar Ramachandran, CIO of IndiaNivesh Renaissance Fund. "Even large public-sector banks, once the backbone of economic development and now rightly concerned about nonperforming assets, are avoiding lending to companies that are less than investment grade."The Reserve Bank of India has warned banks about mounting defaults in accounts structured under the government's MUDRA scheme, signifying risks associated with such loans."The MUDRA is a case in point… while such a massive push would have lifted many beneficiaries out of poverty, there has been some concern at the growing level of non-performing assets among these borrowers," RBI deputy governor MK Jain said at a recent industry event. "Banks need to focus on repayment capacity at the appraisal stage and monitor the loans through the lifecycle much more closely." The Micro Units Development & Refinance Agency Ltd (MUDRA) was set up by the government to develop and refinance micro-enterprises by supporting finance institutions that lend to such businesses engaged in manufacturing, trading and service activities.
As Calendar 2019 ended, we saw the market end near the high point of the year. Despite a negative ending on the last trading session of the year, Nifty50 ended the year with strong gains of 11.53 per cent on a yearly basis.That said, the year has left us with so much to read on the long-term charts and offered many cues that suggest the year 2020 may become one of capped gains. 73057411 The above is the long-term 20-year monthly chart of the Nifty50 index. As evident, since the beginning of 2018 and all through 2019, the index marked incremental highs. However, these highs on the frontline index have come with a continued bearish divergence on the RSI. The bearish divergence has occurred as Nifty marked higher levels, while the RSI did not remain in sync and made lower tops instead. This pattern is yet to be resolved.Additionally, despite the 11.53% of gain in Nifty, this gain has remained limited to contributions from just five stocks: Reliance, ICICI Bank, HDFC, HDFC Bank and Kotak Bank, which added over 85% of the total gains.Another vital thing to note from a technical perspective is that there has been less and less of contribution from the broader market in last two years, even as the frontline index gained. 73057420 Nifty500 represents the broader market, which represents over 95% of the total free-float market cap. As seen in the above chart, when it hit its high, the rise in the market was secular. The secular participation was reflected through the RS Line, which compares the performance of Nifty500 index against that of Nifty50.The rising nature of this line until 2018 shows the broader market performed far better than Nifty50 and the gains were secular in nature. However, since the beginning of 2018 and through the entire 2019, whenever Nifty500 revisited its peak, the RS Line, which compares the two indices, has continued to see a secular decline. This indicated lesser and lesser participation of the broader market, even as only Nifty50 gained, that too, thanks to gains in just five stocks. 73057430 73057432 Even during 2019, while Nifty50 gained 11.53 per cent, the Midcap Index lost 4.42 per cent and the Smallcap index 9.91 per cent.Nifty's monthly charts continued to show a bearish divergence and this pattern is not yet resolved. Also, the occurrence of a Spinning Top on the candles pointed to the likely exhaustion of the up-move. What made matters worse was that the broader market breadth remained dismal, and that's why the absence of participation in the up-move of the broader market will become a cause of concern going ahead.In the current technical setup, Nifty needs to resolve the negative divergence against the lead indicators. The market for participatory notes is expected to shrink more as the Securities and Exchange Board of India (Sebi) has further liberalised the rules for FPI participation, said Sriram Krishnan, managing director, global transaction banking for Deutsche Bank India, in an interview with Pavan Burugula. Easing of investment limits and merger of NRI and FPI investment routes are key demands of FPIs currently, he added. Edited excerpts:What changes are foreign portfolio investors (FPIs) expecting in terms of regulations and taxes?FPIs would like to see the end of capital gains tax. Also, looking at what China has done recently by removing all investment limits, if we follow suit, then India can get included in the global bond indices, which will trigger inflows from large funds that track such indices. This can be quite significant. In terms of regulations, NRIs have for long been asking for a level-playing field, and would like to see the merger of the NRI regime with the FPI regime. The finance minister has, in fact, announced this in the Union Budget.How does India score in terms of ease of entry norms for FPIs compared to the other emerging markets?Having said this, we believe Sebi's recent changes are path-breaking. The entire FPI universe now comprises of just two categories, and almost 75-80% fall under Category I. For those investors wanting to set up as Category I, all that is required is a simple application form and a few documents. So this time, the liberalisation has produced a very meaningful result. From the point of portfolio investment flows, what we have seen in calendar year 2019 is significantly better than 2018, which saw net outflows of over $11 billion. The announcements by the finance minister have since helped, and FPIs have invested over $6 billion in the past two months, and the improving global liquidity is expected to help further. What is the future of participatory notes?As an access product, while participatory notes have a place on the shelf, as a percentage of overall foreign portfolio investments, their share has come down from about 20% in December 2009 to just 2.3% in October 2019. Perhaps the key reason for their past popularity was around the cost and the difficulty level in setting up as FPI. Over the years, progressive market-entry liberalisation has led to a decline in P-note issuances. Operating cost for FPIs has also gone down with greater efficiencies being introduced in the market. Also, with certain rule changes, for example, prohibition of issuance of ODIs (offshore derivative instruments) referencing derivatives without a one-toone hedge, the relevance of P-notes for Indian security markets is expected to further reduce over time. We can certainly expect the recent transformative changes to further encourage direct entry.
NEW DELHI: There was 54 per cent increase in data breaches in 2019 as compared to 2018 and 2020 will see significant rise in the number of mobile-focused malware and banking Trojans, a new report has predicted.With 5G and Internet of Things (IoT) devices arriving on the horizon, data speed will increase but the speed of cyber attacks would also rise, said the report from leading accounting and consulting firm Grant Thornton."Threat actors are expected to deploy advanced Artificial Intelligence (AI)-led attacks to boost the speed and impact of their campaigns. IoT will throw new challenges to data security," said the report titled 'Cyber Trends in 2019 and Predictions for 2020'."Cyber attacks are on the rise and will continue to rise. It's not a matter of if but a matter of when. A framework-driven approach with continuous monitoring will help companies mature their cybersecurity posture and address incidents proactively," said Akshay Garkel, Partner, Cybersecurity & IT Risk Advisory, Grant Thornton India LLP.According to the report, cybersecurity incidents including cyber bullying have skyrocketed by more than six times from the last year and data analytics will be critical to predict crime patterns and to reduce cybercrimes.The report expects the number of smartphone users in India to reach 673 million this year."Ninety-five per cent of cybersecurity breaches are expected to arise due to human error. Human-centric security continues to be a major concern and requires people-centric solutions as well as technology," the findings showed.In 2019, 4.3 billion estimated records were breached as 34 per cent of reported cybersecurity breaches involved internal actors."Every 14 seconds, a ransomware attack was carried out on companies in 2019 while 71 per cent of reported breaches were financially motivated," the report said.

The increment and bonus percentages have increased by 1 per cent points across levels compared to last year, with most impact at top management level," Kumar said.Shine.com CEO Zairus Master said reskilling will be a priority for existing employees in 2020.He noted that to address this skills shortage, recruiters are shifting their focus to hiring professionals with the ability to adapt to changing roles in flexible organisational structures.Further, he said the coming year will also witness a renewed focus on data literacy.
