* Nancy Pelosi is unlikely to agree to Trump's demand for 'inquiry vote' * Senior Caucus member says they can't rule out 'cold feet' but they are confident * A simple majority is required to pass vote and Democrats have a majority of 18 * There hasn't been an official head count but 227 have already supported inquiry
House Democrats believe they have the necessary 217 votes to pass articles of impeachment against Donald Trump even before the hearings or investigation conclude.
A senior member of the Caucus said it is unlikely House Speaker Nancy Pelosi will agree to the President's demand for an 'inquiry vote'.
The source said there hasn't been an official count of the vote to impeach, they believe the numbers are there based on the 227 votes already recorded for an inquiry.
It's an insult to real whistleblowers to use the term with the Ukrainegate protagonist
Start with the initial headline, in the story the Washington Post "broke" on September 18th:
TRUMP'S COMMUNICATIONS WITH FOREIGN LEADER ARE PART OF WHISTLEBLOWER COMPLAINT THAT SPURRED STANDOFF BETWEEN SPY CHIEF AND CONGRESS, FORMER OFFICIALS SAY
The unnamed person at the center of this story sure didn't sound like a whistleblower. Our intelligence community wouldn't wipe its ass with a real whistleblower.
Americans who've blown the whistle over serious offenses by the federal government either spend the rest of their lives overseas, like Edward Snowden, end up in jail, like Chelsea Manning, get arrested and ruined financially, like former NSA official Thomas Drake, have their homes raided by FBI like disabled NSA vet William Binney, or get charged with espionage like ex-CIA exposer-of-torture John Kiriakou. It's an insult to all of these people, and the suffering they've weathered, to frame the ballcarrier in the Beltway's latest partisan power contest as a whistleblower.
WASHINGTON - House Democrats are weighing extraordinary steps to secure testimony from a whistleblower whose complaint prompted an impeachment inquiry, masking his identity to prevent President Donald Trump's congressional allies from exposing the individual, according to three officials familiar with the deliberations.
The steps under consideration include having the whistleblower testify from a remote location and obscuring the individual's appearance and voice, these officials said.
The efforts reflect the deepening distrust between Democrats running the impeachment inquiry of Trump and their GOP colleagues they see as fully invested in defending a president who has attacked the whistleblower's credibility and demanded absolute loyalty from Republicans.
WNU Editor: This impeachment inquiry is being held behind closed doors, and now this?!?!?!? Masking the identity of the whistleblower by having him placed in a remote location while also changing his appearance and voice when he delivers his testimony. But it gets worse. Much worse. House Democrats also want to bar GOP lawmakers from questioning the whistleblower and only allow staffers to question him outside of the Capitol. This is what I call a kangaroo court.
Boris Johnson would veto the EU's seven-year budget and send a Eurosceptic commissioner to Brussels to "disrupt" the bloc's workings if he were forced into a Brexit delay, under plans being discussed by ministers.
Senior Government figures are considering a series of proposals to "sabotage" the EU's structures if Brussels refuses to agree a new deal or let Mr Johnson deliver Brexit without one.
Two Cabinet ministers told this newspaper that they were among those backing a more "aggressive" approach towards Brussels.
WNU Editor: Vetoing budgets. Appointing officials to make Brussels dysfunctional. I can easily see how the UK can create an intolerable situation within the EU itself. Kind of brilliant when you think about it. But if that happens the push to replace him as PM will intensify .... Boris Johnson preparing to 'squat' as Prime Minster to ensure Brexit (NYPost).
* Iranian minister on Sunday said the state-owned company had pulled out of US$5 billion South Pars field deal * It comes after six Chinese companies and five executives were sanctioned by the US for transporting oil out of Iran
A Chinese oil giant appears to be the latest company to bow to US sanctions on Iran, with Tehran saying that the state-owned China National Petroleum Corp (CNPC) was no longer part of a US$5 billion deal to develop a gas field in the country.
The withdrawal – not confirmed by CNPC but noted by Iranian Minister of Petroleum Bijan Zangeneh in official media on Sunday – comes as the United States has been seeking to cut off investment and cash flowing into Iran's energy sector, part of an economic pressure campaign that China has criticised and resisted.
The Chinese oil firm's move to pull out of the natural gas field project also comes as the US and China are due to hold another round of trade talks later this week, and experts say it shows Beijing – long a stalwart economic partner of Iran – is feeling the pressure from Washington.
WNU Editor: There were other reasons for this Chinese withdrawal. The Iranian regime's threats against other oil exporters to China like Saudi Arabia. Instability in Iran itself. Better opportunities elsewhere. Bottom line. China did their calculations and concluded that this is a bad deal.

German Chancellor Angela Merkel's government has declared that Iran's call to obliterate the State of Israel is not an expression of antisemitism.

The Post had specifically asked if Salami's statements were antisemitic.
On crowded stage, 6 leaders exchange attacks and sharp one-liners in only official English-language debate
The six main federal party leaders battled it out in the English language debate in Gatineau, Que., Monday night, exchanging answers and accusations as they looked to bust out from the pack in the final two weeks of the campaign.
The only English debate with all six party leaders saw the discussion range across five topics including: affordability and economic insecurity, environment and energy, Indigenous issues, leadership in Canada and on the world stage and polarization around human rights and immigration.
On the first topic of the evening, leadership, Conservative Leader Andrew Scheer came out swinging for the fences, ignoring the theme to instead launch a heated attack on Liberal Leader Justin Trudeau who he called a "fraud" who does not deserve to be prime minister.
WNU Editor: None of the issues that concern me were seriously brought up in tonight's debate (i.e. government deficits/help for businesses and entrepreneurs/lowering my taxes). I also found the debate format to be dysfunctional. And why five women moderators but no men? As to who stood out in the debate. The main stream media is saying that it was a draw. I do not see it that way. Of the two main candidates, Conservative leader Andrew Scheer and Liberal leader Justin Trudeau, Andrew Scheer did not appeal to me, and Justin Trudeau appealed to me even less. And as for the other four leaders on the stage, to me they were irrelevant.
Trump's latest move has officials scrambling to understand the implications as Turkish forces gather near the Syrian border
Kurdish forces in Syria have said the fate of tens of thousands of suspected Islamic State fighters and their families is uncertain, after US forces began a sudden withdrawal from the country, abandoning their former ally on the eve of a widely-anticipated Turkish invasion.
The effects of the shock retreat continued to reverberate through the region on Monday as Turkish forces massed near the border with the Kurdish stronghold of north-eastern Syria.
Trump said he would "totally destroy and obliterate" Turkey's economy if it took action in Syria that he considered "off-limits" following his decision on Sunday to pull out U.S. forces from northeastern Syria.
The U.S. withdrawal will leave Kurdish-led forces in Syria that have long allied with Washington vulnerable to a planned incursion by the Turkish military which brands them terrorists.
ISTANBUL/BEIRUT (Reuters) - A looming Turkish incursion into northern Syria is set to reshape the map of the Syrian conflict once again, dealing a blow to Kurdish-led forces that have battled Islamic State while widening Turkey's territorial control at the border.
This would be Turkey's third such incursion since 2016. Motivated largely by the aim of containing Syrian Kurdish power, Turkey already has troops on the ground across an arc of northwestern Syria, the last stronghold of anti-Damascus rebels.
WNU Editor: Personally, I think this is a bad move. And giving more power and influence to someone like Erdogan makes me feel queasy. But there are no good options on this one, and it appears that Erdogan had made the decision to send in the military whether the U.S. approved or not. On a side note. It is funny to see the same people who told us that Trump was going to get us into endless wars now complaining that he's not starting one here.
When every policy choice was terrible, finding the least bad one became the only way forward.
"You're shitting me, right?" I asked Denis McDonough. He was the White House chief of staff, and he was standing in my office doorway on an evening in late August 2013.
"No, I'm serious," he said. "I was just on my nightly walk with the president, and he thinks we should pause and first go to Congress."
I was stunned. President Barack Obama had suddenly decided not to order missile strikes on Syria immediately, as planned, but first to get congressional approval for U.S. military action in response to Syria's horrific use of chemical weapons. Denis said a small group of us would soon gather in the Oval Office to discuss this further with the president. As national security adviser for less than two months, I'd already chaired several National Security Council principals-committee meetings on our response to Syria's violation of the president's so-called red line on the use of chemical weapons. Nearly 2,000 people, including many children, had been killed by the Syrian regime in a sarin-gas attack on the Ghouta region. At that point, almost all the NSC principals believed we needed to act militarily to demonstrate to Syrian President Bashar al-Assad that he could not violate international law by using deadly gas against civilians without paying a price.

WASHINGTON (Reuters) - The United States expects Turkey to take responsibility of captive Islamic State fighters, a senior State Department official said on Monday, if Ankara's planned incursion into northeast Syria seizes areas where the detained militants are held.
The official said as of now, U.S. allied Kurdish militia was still going to be in control of the detention facilities. "If they (Turks) come into an area with obvious prisons and the SDF withdraws from those security positions around those prisons, we expect the Turks to take them over," he said in a briefing.
WASHINGTON ― Allies and critics of U.S. President Donald Trump on Capitol Hill offered a harsh rebuke to the commander in chief Monday in response to his decision to suddenly withdraw U.S. troops from northeastern Syria, essentially clearing the path for a Turkish military invasion of the region.
"This impulsive decision by the president has undone all the gains we've made, thrown the region into further chaos; Iran is licking its chops, and if I'm an ISIS fighter, I've got a second lease on life," Sen. Lindsey Graham, R-S.C., said during an appearance on "Fox & Friends," using an acronym for the Islamic State group.
"To those who think ISIS has been defeated, you will soon see; and to Turkey, you have destroyed the relationship, what little you had, with the U.S. Congress, and I will do everything I can to sanction Turkey's military and their economy if they step one foot into Syria."
Attack against the US allies comes after Washington announced pullback of its troops from region
Turkey's air force launched an offensive against Kurdish targets in north-east Syria, the Syrian Arab News Agency (SANA) reported late Monday, followed by the US's earlier announcement not to intervene in the region.
This report comes in light of a tumultuous day stirred in Washington after US President Donald Trump ordered a withdrawal of American forces from Syria, acquiescing to his Turkish counterpart's request on Sunday.
WNU Editor: These air strikes were launched just after the few U.S. troops that were near the border withdrew this morning. As to what is my take on this Turkish operation. I do not think President Erdogan has an appreciation on the mess that he is stepping into .... U.S. official says planned Turkish incursion into Syria 'very bad idea' (Reuters). As for the U.S. decision to withdraw. I do not think they had any choice. It was withdraw or face a military confrontation against a NATO ally that has a lot of firepower in the region.
US troops have begun withdrawing from positions in northern Syria, paving the way for a Turkish operation against Kurdish fighters in the border area.
Kurdish-led forces have until now been a key US ally in Syria, where they helped defeat the Islamic State group, but Turkey regards them as terrorists.
The main Kurdish-led group called the surprise US move a "stab in the back".
But President Donald Trump defended the withdrawal, saying it was time "to get out of these ridiculous Endless Wars".
WNU Editor: The White House has been telling everyone since the beginning of the year that the U.S. was going to withdraw from Syria, This announcement today should not surprise anyone. The Syrian Kurds are also not going to wage war against the Turkish army. In fact the Syrian Kurds have been withdrawing from the Turkish border for the past month .... President Trump on Monday said it is time to remove the United States from "ridiculous Endless Wars" after he decided to pull back American troops from northern Syria amid an impending Turkish military operation there.
"The Kurds fought with us, but were paid massive amounts of money and equipment to do so. They have been fighting Turkey for decades. I held off this fight for … almost 3 years, but it is time for us to get out of these ridiculous Endless Wars, many of them tribal, and bring our soldiers home," Trump tweeted.
"WE WILL FIGHT WHERE IT IS TO OUR BENEFIT, AND ONLY FIGHT TO WIN," the president added.

Donald Trump's Republican allies condemned his decision to pull U.S. troops out of northern Syria on Monday, calling it a dangerous move that will hurt American interests and could doom hundreds of thousands of Kurds to a Turkish genocide.
The president responded by warning the Turks not to test his 'great and unmatched wisdom' and threatening to 'destroy' the country's economy if they did anything 'off limits' - an apparent reference to the possibility of a Turkish invasion of Kurdish territory in Syria.
South Carolina Republican Sen. Lindsey Graham, one of Trump's closest friends in Congress, blasted him in a tweet, calling the move 'a stain on America's honor' and 'a disaster in the making.'
The United States said it was pulling troops from northeast Syria, in a major shift which clears the way for a Turkish military offensive against Kurdish-led forces and hands Turkey responsibility for thousands of Islamic State group captives.
The US withdrew troops from two observation posts on the border, at Tel Abyad and Ras al-Ain, and informed the commander of the Kurdish-led Syrian Democratic Forces (SDF) that the United States would not defend the SDF from an imminent Turkish offensive, a US official said Monday.

America's largest military shipbuilding company has been accused of falsifying tests and certifications on stealth coatings of its submarines "that put American lives at risk," according to a complaint filed in federal court last month.
Huntington Ingalls Industries, which spun-off from Northrop Grumman in 2011, "knowingly and/or recklessly" filed falsified records with the Navy claiming it had correctly applied a coating, called a Special Hull Treatment, to Virginia-class attack submarines which would allow the vessels to elude enemy sonar, the Sept. 26 complaint alleges.
WNU Editor: Huntington Ingalls Industries is America's largest military shipbuilding company. These accusations are very serious, and if true, damaging to both the company and it puts at risk the U.S. submarine fleet.
New construction materials made of composites could make military vehicles—and even soldiers—invisible to radar, sonar, and even the naked eye.
* Metamaterials are composite materials designed to manipulate light, radar, and sonar waves. * Objects made of metamaterials could render themselves invisible to most types of sensors—including the human eye. * Metamaterials are difficult to make and still a ways from mass production.
The development of new so-called metamaterials could lead to dramatic advances in military technology, particularly the ability to hide from sensors—even the human eye. Metamaterials, engineered composites designed to manipulate the electromagnetic spectrum, could lead to "invisible" tanks and armored vehicles, submarines undetectable by sonar, and weapons with improved seekers and guidance systems.
The big caveat though is that metamaterials are currently pretty difficult to manufacture and are still years away from full-scale production.

(BEIJING) — China’s chief trade envoy is going to Washington on Thursday for talks aimed at ending the tariff war between the world’s two largest economies.
The Ministry of Commerce said Tuesday that Vice Premier Liu He will lead a delegation that will include China’s commerce minister and central bank governor and industry, technology and agriculture regulators.
The two governments have made conciliatory gestures ahead of the talks including lifting or postponing punitive tariffs. But there has been no sign of progress toward settling their core disputes over Beijing’s trade surplus and technology ambitions.
The two sides have raised import duties on billions of dollars of each other’s goods, fueling fears their dispute might tip the global economy into recession.
(COLOMBO, Sri Lanka) — Sri Lankan President Maithripala Sirisena has decided not to seek reelection next month after failing to fulfill many of the promises of his first term.
A record 35 candidates filed nominations Monday for the Nov. 16 election, with former defense chief Gotabaya Rajapaksa considered the favorite.
Rajapaksa, who served as defense chief under his brother, former strongman President Mahinda Rajapaksa, is popular for his part in ending the government’s long civil war against ethnic minority Tamil rebels a decade ago.
He has been accused of condoning rape, torture and the shadowy disappearances of critics, but is considered a hero among ethnic majority Sinhalese for his role in defeating the Tamil Tiger rebels.
Sirisena, who would have had difficulty beating Gotabaya Rajapaksa, did not pay a deposit by a Sunday deadline, making him ineligible to file a nomination.
Rajapaksa represents a party that broke away from Sirisena’s party and has the loyalty of a majority of its members.
The end of Sirisena’s presidency is marked by unfulfilled expectations of good governance, ethnic harmony and economic progress.
Sirisena pledged to abolish a powerful executive presidential system within 100 days of coming to power, change the constitution to allow power sharing with minority Tamils and investigate alleged abuses committed during the final stages of fighting between the government and Tamil rebels.
He also promised to take action against the Rajapaksa family, whom he accused of corruption and abuse of power.
Sirisena’s election in 2015 elevated Sri Lanka’s status in the international community, which had shunned the country during the Rajapaksa administration over its human rights record.
His alliance with current Prime Minister Ranil Wickremesinghe, whose party Sirisena had worked against throughout his political career, was seen as a new kind of political culture and something that other countries could emulate.
But Sirisena took over the leadership of his previous party, the Sri Lanka Freedom Party, which Rajapaksa had led, against the wishes of his partners. As a result, many former members of the Rajapaksa government accused of corruption who opposed the policies of the Sirisena-Wickremesinghe alliance joined the Cabinet and began to have a bigger say in the government.
Instead of abolishing the presidential system, Sirisena only diluted its powers. Under pressure from the Rajapaksa camp he announced that he would not allow any government soldiers to be punished for alleged war abuses, despite having promised the U.N. Human Rights Council to investigate and prosecute suspects.
His party delayed presenting its views on a new constitution to share power with Tamils, and the process has now stagnated in Parliament. The administration also failed to punish members of the Rajapaksa family for alleged wrongdoing.
In the meantime, Rajapaksa formed a breakaway party and with his popularity from ending the civil war won over a majority of Sirisena’s supporters, weakening the Sri Lanka Freedom Party.
His relationship with Wickremesinghe also turned sour with a tussle for power and exploded last year when Sirisena sacked Wickremesinghe and appointed Mahinda Rajapaksa in his place, seemingly in the hope of securing his support for reelection.
A court decision restored Wickremesinghe, and Rajapaksa has not given Sirisena the expected support and instead fielded his brother as a presidential candidate.
Sirisena’s failure to prevent suicide bomb attacks on Easter Sunday triggered public anger against him. The suicide blasts, blamed on two local groups inspired by the Islamic State group, killed more than 260 people at three churches and three hotels.
Sirisena’s presidency, however, has probably been the best for freedom of the media and speech. Trade union and student activism have been at their peak.
“We elected Maithripala Sirisena with so much hope, and now feel so cheated by him,” said Nalaka Gunawardene, a media analyst.
“He missed a historic chance to heal our divided society and instead deepened its polarization,” he said. “He did end the Rajapaksa era authoritarianism and restored our freedoms, but these alone cannot redeem him.”
Though Sirisena’s political future looks bleak, he is holding talks with the Rajapaksas in the hope of gaining a political position in exchange for the votes of his supporters.
He told a recent public meeting that his focus is not on the presidency, but on being a force in a powerful government.
The 35 candidates for the presidency are the most ever in Sri Lanka, after 22 candidates in 2010.
Rajapaksa said after filing his nomination that he is confident of winning.
His main rival is Sajith Premadasa from the governing coalition. He is a son of former President Ranasinghe Premadasa, who was assassinated in 1993 by the Tamil Tiger rebels.
“We are extremely confident that the vast majority of the Sri Lankans of all ethnic backgrounds irrespective of cast and creed will support this monumental, path-breaking program that will make our country prosperous,” Premadasa said. “We shall embark on a democratic political program ensuring that the rights of all citizens are protected.”
Also among the candidates are two Buddhist monks, four people from the predominantly Buddhist country’s Muslim minority and two Tamils. There is one female candidate.
It is likely that the Muslim and Tamil candidates will attract protest votes against the main parties, which are led by ethnic Sinhalese.
Tamils are displeased that Sirisena’s government failed to deliver on promised power-sharing arrangements and answers to families whose relatives went missing in the civil war.
Muslims are unhappy that the government failed to stop the persecution of Muslims after the Easter Sunday bombings.
News broke Monday morning that a group of businessmen touting close ties to President Trump and his personal lawyer, Rudy Giuliani, spent last spring maneuvering to install new management at the top of Naftogaz, Ukraine’s state-owned gas company.
The news came on the heels of revelations that Trump and his allies spent much of this year pushing Ukrainian officials to investigate former Vice President Joe Biden, one of Trump’s likely opponents in his reelection bid, triggering a complicated impeachment inquiry.
So what is Naftogaz, why is it important, and where does it fit in this larger impeachment story?
The short answer is that Naftogaz, as a key transporter of natural gas from Russia to the European Union, is at the center of both legitimate U.S. policy goals in Ukraine and allegations of a pressure campaign exacted by businessmen tied to the Trump Administration.
Geography explains the importance of Naftogaz and the reasons why Ukraine has been a focal point of U.S. international energy policy. Ukraine sits right between Russia and the European Union and plays a key role moving Russian natural gas to eastern Europe where it is used for electricity, heating and other purposes. In total, the EU receives 40% of its natural gas from Russia (though not all of it comes via Ukraine).
That supply comes with strings. Russia has used the energy source as a political weapon, occasionally shutting off the gas to threaten and intimidate Ukraine and EU countries. The state-owned Russian firm Gazprom has also targeted Naftogaz directly, withholding billions of dollars in payment in defiance of court rulings. (The relationship between Gazprom, Naftogaz and the EU is currently under negotiation as the contract between Russia and the Ukraine expires in January).
In an interview last year, Naftogaz CEO Andriy Kobolyev told me that Russia was “trying to destroy Ukraine” using “military and financial” methods, including by withholding payment. “The Gazprom behavior is partly dictated by Russia’s desire to dismantle the Ukrainian state,” he said.
It’s in part this behavior that has given the Trump Administration an opening to market U.S. energy products overseas, arguing that U.S. companies are better trading partners than Russian ones. Liquified natural gas has been the most significant focus of this push. In recent years, U.S. natural gas production has reached record levels — some 92.8 billion cubic feet per day in August, enough to power the U.S. and then some — as a fracking boom opened up vast new areas to oil and gas drilling.
“The United States finds ourself in this very unique position,” Energy Secretary Rick Perry said at a press conference in Lithuania Tuesday. “We’ve been able to develop and to share [our] resources with a with a world that has substantial energy needs.”
And, while previous administrations have focused on achieving “energy independence,” Trump has described his strategy as “energy dominance.” Perry, in turn, has served as the administration’s chief cheerleader for American natural gas, traveling across eastern Europe to promote the product.
“U.S. gas is going to be competitive with anybody in the world,” Perry said in Lithuania. “Who do you want to buy your gas from: a country who has a record of cutting that gas off from time to time to meet their political needs or from the United States?”
European countries have been receptive to U.S. natural gas with a handful of countries including Spain and the Netherlands importing it from the U.S. In Russia’s backyard, Poland took its first delivery of U.S. LNG, short for liquified natural gas, this year and Lithuania is building infrastructure for that purpose now.
Experts note that the American product still struggles to compete with the low cost of Russian natural gas. “U.S. gas can be a factor,” says Richard Kauzlarich, director of the Center for Energy Science and Policy at George Mason University and a former U.S. ambassador to Azerbaijan. “Assuming the price is right.”
But the Oct. 7 report from the AP suggests that a group of American businessmen wanted to interfere in the market and took the Ukraine LNG lobbying push further. The businessmen — Lev Parnas, Igor Fruman and Harry Sargeant III — allegedly tried to replace Kobolyev as the CEO of Naftogaz and planned to broker a deal to sell their own natural gas to the company.
The AP reports that Perry advocated to fire and replace the entire membership of Naftogaz’s advisory board. Perry said Monday that the suggestion that he demanded particular people join the board was a “dreamed up story” and said that he “gave recommendations at the request of the Ukrainian government.”
Trump, for his part, has furthered questions about the role natural gas and its chief promoter in the administration has played in the Ukraine saga. Over the weekend, Trump tried to pass the blame for the now infamous phone call in which he asked the president of Ukraine to “do us a favor” of investigating Biden: he suggested that it was Perry who’d told him to make the call.
According to an Axios report, Trump explained Perry’s demand on a phone call for GOP House members. It was, he added, “something about an LNG plant.”
U.K. officials are asking that diplomatic immunity be waived after the wife of a U.S. diplomat fled England following an August car crash that killed a 19-year-old on his motorcycle.
Northamptonshire Police Superintendent Sarah Johnson confirmed in a statement released on Saturday that a 42-year-old American woman — who is a suspect in a car crash that killed Harry Dunn on Aug. 27 — left the county, even after telling authorities she had no plans to do so.
“Northamptonshire Police followed all of its usual procedures following the incident, including liaising closely with the suspect, who engaged fully with us at the time and had previously confirmed to us that she had no plans to leave the country in the near future,” Johnson said in the statement. “Due process was also followed in seeking the necessary documentation to allow for the arrest and formal interview of the suspect, and the force is now exploring all opportunities through diplomatic channels to ensure that the investigation continues to progress.”
The suspect, who Northamptonshire Police have identified as the wife of a U.S. diplomat, has not been named by the U.S. Embassy, citing privacy and security concerns.
“Harry Dunn’s family deserves justice and in order to achieve this, a full and thorough investigation, with the assistance of all parties involved, needs to take place,” Johnson added.
What happened in the crash
Police said in an August statement that Dunn’s motorbike was hit head-on by a Volvo after exiting the Royal Air Force Croughton air station in Northamptonshire, England, around 8:30 p.m. on Aug. 27. The suspect was driving on the wrong side of the road, Northamptonshire police said.
Dunn died later at the nearby John Radcliffe Hospital in Oxford, England, police said.
The debate over diplomatic immunity
Nick Adderley, Chief Constable for Northamptonshire Police, tweeted Sunday that as the wife of a U.S. diplomat, the suspect is entitled to diplomatic immunity. Adderley added he and Steven Mold, Northamptonshire Police Fire and Crime Commissioner have written “in the strongest terms” to the U.S. Embassy to urge them to waive immunity “in order to allow the justice process to take place.”
The short answer is yes. Both @Stephen_Mold and I have written, in the strongest terms, to the US Embassy urging them to apply the diplomatic immunity waiver in order to allow the justice process to take place. https://t.co/OKmRXLhJhO
But U.K. officials may be facing an uphill battle. A State Department official told TIME in a statement that diplomatic immunity is “rarely waived.”
“We express our deepest sympathies and offer condolences to the family of the deceased in this tragic traffic accident,” the department said in a statement. “Any questions regarding a waiver of the immunity with regard to our diplomats and their family members overseas in a case like this receive intense attention at senior levels and are considered carefully given the global impact such decisions carry; immunity is rarely waived. The U.S. Embassy has been and will continue to be in close contact with British officials.”
According to the 1961 Vienna Convention on Diplomatic Relations, foreign diplomats and their family members are given certain protections that allow them to avoid arrest for almost any crime unless the diplomat’s home country decides to waive immunity.
Matt Zierler, Associate Professor of International Relations at Michigan State University, told TIME diplomatic immunity is considered a “cornerstone of diplomacy.”
“For the most part diplomats, especially the highest-ranking officials, have complete immunity over what they do and usually it extends to families, ” he tells TIME. “That’s embedded into international law because really, its the cornerstone of diplomacy. It’s one of those reciprocal actions that states grant each other in order to allow diplomacy to take place.”
Zierler says he does not believe the U.S. will waive immunity for the suspect in Dunn’s death.
“We tend to have a broad expansive nature of diplomatic immunity because the U.S. would rather have a system that works smoothly, even in a case where an individual may have gotten caught violating the law,” he says. “The larger purpose of keeping diplomacy open and trusting when we send diplomats and their families elsewhere is that they will be free from detention from another country. And the reciprocal, we do the same for diplomats in the United States.”
Even British Prime Minister Boris Johnson, often considered an ally of President Donald Trump, has weighed in. In an interview with the BBC on Monday Johnson said that he does not believe diplomatic immunity is being properly applied in this situation. Johnson said he hopes that the wife of the diplomat will return to the U.K. and “engage properly with the processes of law as they are carried out in this country.”
Johnson added he has raised the issue with the American ambassador in the U.K. and if the issue is not resolved he will personally raise it with the White House.
What Harry Dunn’s family has said
Dunn is described as motorbike enthusiast who “lived his short life to the fullest” in a GoFundMe page called “Justice 4 Harry” that was started by a family friend.
“Harry was bubbly and outgoing and from the age of 7, he shared a passion for riding motorbikes with his Gramps and step-dad,” the fundraiser said. “That passion eventually grew to become his main interest in life and Harry lived for riding spending all his wages on fuel for his bike. He loved to get out on the road and explore the countryside…the family take enormous comfort from the fact that his riding at the time of the collision was not to blame for the accident.”
Dunn’s mother Charlotte Charles told Sky News that she is “utterly broken,” following the accident and that she and her family want justice. “We don’t know how we can start to grieve for him,” she said in the Sky News interview. “We have nothing. No justice. We have nothing to put our minds at rest that she’s even remorseful.”
Harry’s father, Tim Dunn, told Sky News he can’t understand how the suspect is “living with herself” after fleeing.
“We’re disgusted, appalled, how she could be having this cloak wrapped around her,” he said. “I’m angry that someone could do this and then get on a plane and go.”
Late Sunday night, the Trump administration announced that it was pulling American troops from key positions near the Syria-Turkey border and explicitly permitting the Turkish government to conduct military operations against the Kurdish allies who were indispensable in defeating the ISIS caliphate. This decision represents not just a moral betrayal of men and women who fought and bled by our side in the battle against the world’s most powerful jihadist army, it represents a strategic blunder that is likely to cost American lives for years to come.
To understand the reason for the additional strategic risk, one has to understand the nature of the successful American military operation against ISIS. Unlike American offensives during much of the Iraq War — when hundreds (and sometimes thousands) of American troops would conduct complex and costly urban military operations with minimal effective help from Iraqi allies — during the fight against ISIS, our allies have largely born the burden of ground combat. Yes, they’ve enjoyed the indispensable support of American artillery and air power, and small groups of American soldiers have rendered aid and engaged in direct combat as well, but our allies have been going house-to-house and have paid a terrible price. By some estimates, as many as 11,000 Kurds have lost their lives in the fight against ISIS — a staggering death toll borne by a relatively small population.
The result — from an American perspective — has been one of the most successful military operations in a generation. The ISIS caliphate, which once dominated a nation-state sized region covering much of northern Syria and northern Iraq, is now in ruins. ISIS isn’t entirely defeated, but it’s a shadow of its former strength. And the cost in American lives has been a small fraction of the cost incurred in even a single battle of the Iraq War. For example, America suffered almost 700 casualties (82 killed) during the Second Battle of Fallujah. The nation has suffered far fewer casualties during the entire fight against ISIS, stretching from June 2014 until the present day.
But if the allied bargain with America is that our local allies bleed and then we abandon them to death and military catastrophe when we weary of the alliance, who will ally with us again? Moreover, as we know from recent history, terrorists often thrive not just in chaos but especially in the power vacuums created by unwise American withdrawals. Thus, the Trump administration is creating the worst possible dynamic — it’s undercutting allies at the very same time that it’s creating conditions that may require us to ask for their help again.
Indeed, to understand the true magnitude of the betrayal, there are now multiple reports that the Trump administration — in an effort to de-escalate tensions between the Turks and the Kurds — had previously asked our Kurdish allies to dismantle defensive fortifications along the border, rendering them more vulnerable to Turkish invasion. Now our allies will have to reallocate forces, rebuild fortifications, and — in many cases — leave the field in the ongoing fight against ISIS remnants.
In a string of tweets, President Trump sought to justify his decision by declaring that he had been elected to extricate America from “ridiculous, endless wars,” but Trump’s withdrawal does not end the war. It grants our enemies a much-needed respite. ISIS has never ended its fight against America. It’s been weakened, and in some areas it has been routed, but it has not asked for peace. It does not seek peace.
By potentially further destabilizing northern Iraq, Trump not only puts our Kurdish allies at profound risk, he also creates conditions that could lead to a total loss of allied control over the tens of thousands of ISIS detainees held by the Kurds. In his statement, Trump announced that Turkey would be “responsible” for “all ISIS fighters captured in the area over the past two years.” This is a fantasy. The far more likely outcome is that ISIS fighters and ISIS operatives will assume increasing control over the relevant facilities, and there will be a likely loss of containment.
It is absolutely true that the United States faces a formidable challenge in Syria. ISIS has not been entirely defeated, there is a long-running simmering conflict between Turkey and Kurdish forces, and there is still no final peace settlement in the Syrian civil war. Resolving those challenges requires a combination of military resolve and deft diplomacy. There are no easy answers.
But Trump’s action represents the opposite of resolve. It represents an attempt to short-cut a difficult process with a precipitous, impulsive decision that will cost American credibility now and could well cost American lives later. He then compounded that impulsiveness with a bizarre tweet on Monday. Trump said, “[i]f Turkey “does anything that I, in my great and unmatched wisdom, consider to be off-limits, I will totally destroy and obliterate the Economy of Turkey (I’ve done it before!)”
Yet that’s not a policy change. It’s an act of face-saving bluster with no definable practical meaning.
In fact, Trump’s decision is so poor, so impulsive, that it’s created a rare moment of agreement in divided Washington. Republican Senator (and staunch Trump ally) Lindsey Graham has announced that he’s working with Democratic Senator Chris Van Hollen to “introduce bipartisan sanctions against Turkey if they invade Syria and will call for their suspension from NATO if they attack Kurdish forces who assisted the U.S. in the destruction of the ISIS Caliphate.”
This is a start, but it’s only a start. Checking the Trump administration’s foolish impulsiveness will require real bipartisan resolve. How long can that last when Trump attacks his GOP critics? But wisdom must prevail. Americans are weary of the so-called “forever war.” If so, they should unite against a foolish move that will extend and worsen the very conflict they seek to end.
(BERLIN) — Activists with the Extinction Rebellion movement blocked roads and staged demonstrations in big cities around the globe Monday, part of a wide-ranging series of protests demanding much more urgent action against climate change.
Demonstrators stopped traffic in European cities including Berlin, London, Paris and Amsterdam. In New York, activists smeared themselves — and emblems of Wall Street — in fake blood and lay in the street.
In some cities, activists chained themselves to vehicles or pitched tent camps and vowed not to budge.
“You might come from a variety of different groups, but we all stand against a system that’s destroying the planet and mankind, and we’re looking to change that because we can’t just have little changes, we want a real big change,” said Pierrick Jalby, a 28-year-old nurse from eastern France who joined the demonstration in Paris. “We don’t want reforms, in fact, we want a revolution.”
Members of Extinction Rebellion, a loose-knit movement also known as XR that started last year in Britain, have staged a series of flashy protests this year to demand action on manmade climate change, often featuring marchers in white masks and red costumes and copious amounts of fake blood.
In Berlin on Monday, around 1,000 people blocked the Grosser Stern, a traffic circle in the middle of the German capital’s Tiergarten park dominated by the landmark Victory Column. That protest began before dawn. Another 300 people blocked Berlin’s central Potsdamer Platz, placing couches, tables, chairs and flowerpots on the road.
Over the weekend, demonstrators had set up a tent camp outside German Chancellor Angela Merkel’s office to prepare for the protests, reflecting dissatisfaction with a climate policy package drawn up last month by her government.
Merkel’s chief of staff, Helge Braun, criticized the group’s tactics.
“We all share an interest in climate protection, and the Paris climate targets are our standard in this,” he told ZDF television. “If you demonstrate against or for that, that is OK. But if you announce dangerous interventions in road traffic or things like this, of course that is just not on.”
He dismissed the idea of declaring a “climate emergency,” saying that the German constitution doesn’t provide for such a thing and it wouldn’t translate into “concrete action.”
Around 1,000 protesters blocked the area around Chatelet in central Paris and vowed to stay at least the night in the makeshift camp they had pitched. Some were seated, some chained to a barrel.
Demonstrators playing steel drums marched through central London as they kicked off two weeks of activities designed to disrupt the city.
London police said some 135 climate activists had been arrested. Extinction Rebellion said protesters were arrested as they blocked Victoria Embankment, outside the Ministry of Defense.
Among those arrested was 81-year-old Sarah Lasenby, a retired social worker from Oxford.
“It is imperative the government should take serious actions and put pressure on other states and global powers to radically reduce the use of fossil fuels,” she said.
In New York City, protesters doused a famous statue of a charging bull near Wall Street with fake blood. One protester waving a green flag climbed on top of the bull. Other activists splashed with red dye staged a “die-in” in front of the New York Stock Exchange — lying down as if dead while tourists gawked.
Afterward, a few participants were seen mopping the fake blood off the ground.
“The blood of the world is here,” said Justin Becker, an organizer who made a link between the fossil fuel industry and the financial interests of Wall Street. “A lot of blood has been spilled by the decisions of the powerful and the status quo and the toxic system that we live in.”
In Amsterdam, hundreds of demonstrators blocked a major road outside the Rijksmuseum, one of the city’s most popular tourist attractions, and set up tents. The protest went ahead despite a city ban on activists gathering on the road. The protesters ignored police calls for them to move to a nearby square.
In Spain, a few dozen activists briefly chained themselves to each other and to an elevated road over a major artery in the Madrid, snarling traffic during the morning rush hour. The National Police said 33 activists were taken to their premises and three were arrested for resisting orders by anti-riot officers.
A few hundred other protesters camped out in 40 tents at the gates of Spain’s Ministry of Ecological Transition.
Those at the Berlin protests included activist Carola Rackete, best known as the German captain of a humanitarian rescue ship who was arrested for docking in an Italian port without authorization this year to disembark migrants rescued at sea.
“We must stay here and rebel until the government proclaims an ecological emergency and acts accordingly,” Rackete said.
Founded in Britain last year, Extinction Rebellion now has chapters in some 50 countries. The group said the protests Monday were taking place in 60 cities worldwide in countries including Turkey, Canada, South Africa, Mexico and elsewhere.

(BEIJING) — The NBA put out one statement reacting to Houston Rockets general manager Daryl Morey’s tweet in support of the Hong Kong protest movement.
Depending on which language it was read in, the league’s words had very different meaning.
A politically charged disagreement over Morey’s tweet that showed support for Hong Kong anti-government protesters got an additional wrinkle when the NBA posted a statement Monday on Weibo — a Twitter-like microblogging site used in China — saying the league was “extremely disappointed” by what it called an “inappropriate” comment. The same post said the NBA’s stance was that Morey’s view “severely hurt the feelings of Chinese fans.”
Thing is, the league never actually said those words.
NBA spokesman Mike Bass’ statement, which had only one version and was delivered in English, began like this: “We recognize that the views expressed by Houston Rockets General Manager Daryl Morey have deeply offended many of our friends and fans in China, which is regrettable.”
It continued, but never said “extremely disappointed,” ”inappropriate” or “severely hurt the feelings” of anyone.
“There should be no discrepancy on the statement issued last night,” Bass said Monday. “We have seen various interpretations of the translation of the Mandarin version, but our statement in English is the league’s official statement.”
The “hurt feelings” phrase is commonly used by Chinese authorities to describe perceived gaffes by foreign parties. Similar phrasing was used by Mercedes-Benz in February 2018 when it had to apologize for quoting the Tibetan spiritual leader, the Dalai Lama, in a social media post. The auto company apologized for “wrong information” that “hurt the feelings of Chinese people.”
Morey tweeted a now-deleted image that read “Fight for Freedom. Stand with Hong Kong,” in reference to four months of pro-democracy demonstrations in the semiautonomous Chinese territory, which has been mired in escalating violence between protesters and law enforcement.
As a result of the tweet, the Chinese Basketball Association — whose president is Yao Ming, the former Rockets center — said Sunday it was suspending its relationship with the team, and Chinese media giant Tencent and Chinese state television said they would no longer be broadcasting Rockets games.
Fallout continued Monday when two NBA G League games between Houston’s affiliate and Dallas’ affiliate, scheduled to be played this month in China, were canceled.
Scott Kennedy, a Senior Adviser and Trustee Chair in Chinese Business and Economics at the Center for Strategic and International Studies in Washington, said nuance can be extremely important when converting English to Mandarin and vice versa.
“As U.S.-China relations deteriorate and both sides sort of move into this nationalistic crouch, the difficulty of speaking to broad audiences in both the United States and China without offending at least one of them is extremely difficult,” Kennedy said. “Sometimes when you try to use nuance, what you do is mollify one side while upsetting the other. And so a turn of a phrase in one language or another is potentially going to get some party in one of the countries extremely upset.”
The divergent language in the NBA’s Chinese Weibo statement appears to be an effort to assuage people in China who have expressed outrage over Morey’s initial tweet, though Monday’s post appeared to be insufficient for many on Weibo. Commenters accused Morey of supporting Hong Kong independence and called on Chinese basketball fans to boycott the NBA.
Morey’s tweet prompted a wave of censure from Chinese companies.
A search Monday for Houston Rockets merchandise on Chinese e-commerce platform Taobao turned up zero results. Li-Ning, a major Chinese sporting goods brand, said in a statement Sunday it was suspending cooperation with the Rockets because of Morey’s “mistaken remarks.” Hupu, a sports news website, has likewise suspended all coverage of the Rockets and locked the section of its website previously dedicated to the team.
Meanwhile, some U.S. lawmakers and even Democratic presidential candidate Julian Castro have condemned the NBA for succumbing to Chinese censorship. The NBA has allowed and even encouraged its players and coaches to be outspoken on social and political issues in the United States, which makes this move stand out.
House Minority Leader Kevin McCarthy, R-Calif., lashed out at the NBA for its response and accused the league of bowing to China in order to protect economic interests. McCarthy tweeted that “the NBA seems more worried about losing business than standing up for freedom. Shameful.”
A former British colony, Hong Kong was returned to China in 1997 under the framework of “one country, two systems,” which promises the territory certain democratic freedoms not afforded to the mainland. Some anti-government protesters in recent months have violently expressed their opposition to the ruling Communist Party.
(TOKYO) — Japanese authorities said they rescued all of about 60 North Korean fishermen whose boat collided with a Japanese patrol vessel and sank Monday in an area crowded with poachers.
Coast guard officials earlier said that only about 20 North Korean crewmembers were thrown into the sea after their steel boat collided with a Japanese Fisheries Agency inspection boat in Japan’s exclusive economic zone off the country’s northern coast. Officials later said they rescued far more than first thought. No one was missing.
The North Korean boat sank about half an hour after the collision in the Yamatotai area, known as rich grounds for squid fishing northwest of the Noto Peninsula.
The North Korean boat had made an unauthorized entry into Japan’s exclusive economic zone and the collision occurred just as the Japanese patrol boat was warning it to move out, Fisheries Agency official Satoshi Kuwahara told reporters. He said officials were investigating whether the North Korean ship was actually conducting illegal fishing, and how the two ships collided.
Agricultural, Forestry and Fisheries Minister Taku Eto said the North Korean boat suddenly changed course before crashing into the Japanese ship and sinking, Kyodo News agency reported.
The coast guard’s regional office in Niigata said officials handed the fishermen to another North Korean boat in the area after notifying The North’s rescue coordination center to arrange their way home. It said the North Korean crewmembers had no life-threatening conditions. Fisheries Agency officials said the Japanese patrol ship had no major damage and was able to move on its own.
The two countries also have disputes over Japan’s 1910-1945 colonial rule of the Korean Peninsula, as well as North Korea’s nuclear and missile development and the North’s abduction of Japanese citizens in the 1970s and 1980s.
During Monday’s parliamentary session, Prime Minister Shinzo Abe pledged to thoroughly investigate Monday’s incident. “We will resolutely respond to prevent poaching by foreign fishing boats in the Japanese exclusive economic zone,” he said.
Japan has stepped up patrols in the area in recent years as North Korean squid poaching has surged. This year, ships from Japan’s Fisheries Agency and coast guard have been patrolling in the area since May, Kuwahara said.
Experts say the increase in North Korean squid poaching is due to the country’s campaign to boost fish harvests. With Russia also stepping up its patrols against poaching, desperate North Korean fishermen under pressure to meet their quota have opted to head to Japanese economic waters, increasing the risk of clashes with Japanese patrol boats, Satoru Miyamoto, a Seigakuin University professor and expert on North Korean politics, diplomacy and military issues, told Japan’s NHK public television.
Japanese fisheries patrols have issued nearly 500 expulsion orders to poachers between May and August this year, most of them from North Korea, according to the Fisheries Agency. It said Japan last year made 5,315 such orders to foreign fishing boats in the area, many of them North Korean. Poachers also come from China, Russia and South Korea.
In June, Japan’s coast guard pushed more than 300 North Korean boats back in the same waters where Monday’s incident occurred. Japan also said an armed North Korean fishing boat aimed a gun at and threatened a Japanese patrol ship in August.
The North Korean poachers are believed to be related to an influx of “ghost boats” that have washed onto Japan’s northern coast, fisheries officials have said.
Bill Gates told an audience at the University of Cambridge on Monday that global malnutrition will be solved and malaria will be virtually eliminated by 2040 if world leaders choose to fund scientific innovation.
Speaking at the Cambridge Union in England, the Microsoft co-founder said: “I’m lucky that my work gives me a view of all the amazing discoveries in the works right now. That’s why I’m able to predict the future.”
Gates was named the 2019 recipient of the Professor Hawking Fellowship, founded by the Cambridge Union Society in 2017 in honor of Stephen Hawking’s contribution to the university.
Quoting a question Stephen Hawking asked in his final book, Brief Answers to the Big Questions, Gates asked the audience, “How do we shape the future?”
The billionaire philanthropist is trying to shape the future by tackling global health issues and inequality at the Bill and Melinda Gates Foundation. On Monday, he predicted scientists will solve malnutrition and significantly reduce the number of nutrition-related deaths globally in the next 20 years. “By solving malnutrition, we can fix one of the biggest contributors to inequity,” he said.
Malnutrition contributes to about half of deaths in children under the age of five, according to theWorld Health Organisation (WHO).
But he said another key component to solving malnutrition is understanding the role bacteria plays. In a healthy body, “good bacteria” protects us from infection and is essential for digestion — if your body’s bacteria is not up to scratch, it can lead to severe cases of malnutrition, Gates added.
In the last few years, scientists have made breakthroughs in understanding how the gut becomes less effective due to abnormalities in microbiomes, or bacteria, and how to change it — including the development of probiotics. According to Gates, with more innovation and research, scientists will be able to solve malnutrition in 20 years by creating “next-generation probiotic pills that contain ideal combinations of bacteria — even ones that are tailored to your specific gut.”
“If we can figure nutrition out — and I believe we will within the next two decades — we’ll save millions of lives and improve even more,” he said.
Solving malnutrition and other diseases will mark a shift toward focusing on improving lives rather than just saving lives, according to Gates. “It seems like a subtle difference, but it has a huge impact on how you approach healthcare. Within two decades, I believe every country on earth will be able to focus not just on keeping you alive, but healthy as well.”
Gates also spoke about malaria, a key area of focus for the Foundation. Malaria kills 435,000 people around the world each year. He predicted that malaria will be virtually eliminated by 2040, but drugs won’t be enough to do this. “The key to stopping malaria is vector control — and for malaria, the vector is mosquitoes.”
For Gates, a potential solution lies in gene editing, which allows scientists to solely target mosquitoes carrying malaria. “Inserting a gene that prevents these bad mosquitoes from reproducing would buy us time to cure all the people in an area of malaria. Then we could let the mosquito population return without the parasite,” he said.
Gates said investing in health innovations is the key to improving global health, closing the gap between health inequities and reducing poverty worldwide.
“The world is at a critical moment for global health… Nations are deciding right now whether those investments are worth making.”
“The future is ours to shape — if we choose to make innovation a priority,” he continued. “Improvements in health are fundamental to lifting people out of poverty. When you improve health, people are more productive.”
“And when more children survive to adulthood, families decide to have fewer children, which can lead to a burst of economic growth.”
(BANGKOK) — A herd of wild elephants was swept away by raging waters in a national park in Thailand, drowning six, while rangers helped steer two of the animals out of a deep ravine.
Staff at Khao Yai National Park discovered the two struggling elephants and the carcasses after dawn Saturday near the Haew Narok waterfall, also known as the Ravine of Hell. The two elephants were trying to reach a dead calf, park officials said.
Park rangers helped lead the two elephants from the ravine and said they will monitor their condition throughout the week. The waterfall was closed off to visitors while officials remove the carcasses.
“The two elephants right now are taking a rest. They are exhausted from trying to cross the stream,” said Chanaya Kanchanasaka, a veterinarian at the park, located 120 kilometers (74 miles) northeast of Bangkok.
The ravines usually fill up with gushing water during the rainy season. In 1992, eight elephants died after falling into the water.
The park is home to about 300 wild elephants and is part of Dong Phayayen-Khao Yai Forest Complex, a UNESCO World Heritage site.

NEW DELHI: After slugging it out in the cut-throat smartphone market, Chinese companies Xiaomi, One-Plus and Motorola-Lenovo are now competing in the smart television segment with ultra-budget and premium models.Sector watchers say these firms are strategically placed to capitalise on the brand recall among consumers and to leverage their distribution and online channels, along with their existing manufacturing facilities."As content consumption increases, every company wants to grab the maximum screen time of users, more so since TV is the second largest category after smartphones which has the most viewership," said Tarun Pathak, research director at Counterpoint Research. He was referring to the advent of high-quality streaming services such as Netflix, Hotstar and Amazon Prime which have emerged as a key factor in favour of handset manufacturers, as well as in pushing sales of large-screen smart TVs."With almost similar supply chain, the barriers to entry in the segment are low for handset brands," said Pathak. 71485630 Smartphone makers have already begun to taste success in the new segment. Market leader Xiaomi has taken the pole position in the online smart TV segment within a few quarters of its entry while newer players, One-Plus and Motorola-Lenovo, are attempting to gain a foothold amid competition from older brands such as Samsung, LG and Sony."It is a natural extension for us… it's technologically easier for smartphone players to get into smart TVs," said Prashanth Mani, managing director of Lenovo Business Group and Motorola Mobility. The government's recent move to remove import duty of 5% on open cell LCD (liquid crystal display) television panels, which account for 70% of the cost of assembling televisions in India, has also created an opportunity that smartphone makers want to capitalise on."TV is the next big opportunity as smart homes and connected devices ecosystem will grow rapidly in 5G era," said Vikas Agarwal, India head for OnePlus, which launched its premium smart TVs in India last month.Smartphone assembly requires high-precision touch panels, efficient power management and a near SLR camera experience, which makes the process a complex exercise. Smart TV, in comparison, is an adjacent diversification and an easier one on the research and development complexity scale, with far fewer components, said analysts. They also pointed to the higher margins in the smart TV segment, compared to the low single-digit margins offered by smartphones, as several players have priced their phones equal to or less than the manufacturing cost."For smartphone brands, TV represents a whole new equation and avenue to maximise their revenue potential," said Prabhu Ram, head of the intelligence group at Cybermedia Research.International Data Corporation (IDC) India estimates the smart TV segment in India to be about 40% of the total TV shipments, which grew 55% on-year in the April-June quarter this year. This is set to expand as more players enter the market."Increased availability of electricity than a decade ago, far cheaper data tariffs, easy finance options and competitively priced models have also propelled the market opportunity," said Mani.
Mumbai: Mauritius and Cayman Islands, which serve as key offshore bases for foreign investors trading on Indian stock exchanges, have again come under the glare of the Indian capital market regulator.A new rule announced by the Securities and Exchange Board of India (Sebi) a fortnight ago will severely impact foreign funds from jurisdictions that do not belong to the 39-member club of Financial Action Task Force. The FATF is an inter-governmental policymaking body that was established at the 1989 Paris summit of G7 amid mounting concerns over money laundering.Financial centres such as Mauritius, Cayman Islands and Cyprus are not FATF members.Sebi's decision will not go down well with Mauritius, which may see a flight of funds and businesses to Singapore — a FATF member country which, like Mauritius, has a tax treaty with India.India had assured Mauritius that it would not be considered a 'high-risk country'. With the recent notification, however, Sebi has indirectly brought in rules on high-risk jurisdictions.71486079 Can Neither Issue Nor Subscribe to PNsAccording to the Sebi notification, only foreign portfolio investors (FPIs) located in FATF countries or managed by an entity based in a FATF jurisdiction will be allowed to deal in participatory notes (PNs). PNs are offshore derivative instruments with Indian stocks, futures and options as underliers."This will impact many public equity funds and hedge funds. A broader universe of Mauritius and Cayman Islands-based funds may tend to get covered under category-II FPIs. While category-II FPIs have now been barred from accessing P-Notes, guidelines are awaited on what KYC (know your client) rules will be imposed," said Richie Sancheti, head (investment funds) at the law firm Nishith Desai Associates. As per Sebi regulations, category-I funds include sovereign wealth funds, pension and endowment funds, and funds from FATF member countries. Funds from non-FATF countries come under category II.Unless managed by an entity based in a FATF member country, funds from Mauritius and Cayman Islands — which account for 15-20 per cent of foreign portfolio investments in India — can neither issue nor subscribe to PNs.Sebi's operating guidelines, expected soon, will indicate whether there would be other restrictions as well on funds from non-FATF countries. This relates to the extent to which non-FATF funds will be required to disclose their beneficial ownership; whether these funds would be recognised as 'institutional investors' that are allowed to invest in public security offerings and current contracts; and whether these funds would be impacted by tax on indirect transfers. The new FPI regulation — based on the HR Khan committee's recommendations — says that "regulated funds" have to be either from FATF member countries or else in case of unregulated funds the investment manager has to be from FATF member countries.'MOST COMMONLY USED JURISDICTIONS'"While the consolidation of FPI categories would be welcomed by the industry, the reclassification of FPIs from category II to category I on the basis of FATF jurisdiction could potentially disqualify funds/investors organised out of Mauritius and Cayman Islands. Both are the most commonly used jurisdictions by investors for investing into India," said a member of the Khan committee, requesting anonymity.Though Sebi has applied a look-through principle to enforce the qualification test on the underlying investor, it appears that unless these structures have a 'feeder' in a FATF jurisdiction — which holds more than 75 per cent in these vehicles — most may not qualify for a category-I FPI licence.ET had reported in its edition dated September 3, 2018, that funds coming from countries which are not members of the FATF will have to meet stricter disclosure standards and face greater scrutiny and regulatory hurdles."The government should provide adequate clarity and time to fund structures to evaluate their options or restructure to meet the new criteria. Further, some form of grandfathering should be offered so that existing investors are not subjected to hardship and forced to liquidate positions, leading to a further selloff in the markets," said the member of the Khan committee.
BENGALURU: Will a drone deliver your dinner home during a Dussehra holiday in the near future? The Directorate General of Civil Aviation (DGCA) has taken a small but significant next step in firming out the government's policy on allowing drones for civilian and commercial purposes. The DGCA has sought additional details from seven consortia that had applied to conduct long-range, or beyond visual line of sight (BVLOS), drone experiments. The seven that were picked were food and delivery companies Zomato, Swiggy and Dunzo, medical delivery providers Zipline and Redwing, and large enterprises Tata Advanced Systems and Honeywell. The civil aviation authority also rejected 27 applicants, multiple people aware of the matter told ET. These individuals spoke off record.Rejections were largely due to incomplete information furnished by the companies. 71485628 Zomato, Swiggy, Dunzo and Tata Advanced Systems did not respond to ET's queries till press time Monday. Zipline and Redwing said they were waiting to receive approvals from the DGCA."The DGCA has sought additional technical details pertaining to our BVLOS application," said one of the consortia members. The person requested anonymity as the DGCA has not made these details public yet. 'First Operational Flights by Jan/Feb'"We're hoping that they (the DGCA) will grant us approvals in the next one month, which will allow us to begin work on setting up our solutions and hopefully begin flying by January next year," the person added. The DGCA had sought applications from players interested in conducting BVLOS drone operations on an experimental basis in May, and set a deadline for July 10 to receive expressions of interest. As per the original plan chalked out by the civil aviation authority, approvals to conduct the experiments should have been received in August, with each approved party receiving two months for preparations and two more months to run experiments. 71485631 "The process has been drawn out because of the unavailability of members of the BVLOS Experiment Assessment and Monitoring committee," said a person working with the DGCA on the programme. While a sub-committee has been formed for expediting approvals, the process is taking longer than anticipated as final endorsements still require the entire committee to sign off on them.Redwing and Zipline have partnered with the state governments of Uttarakhand and Maharashtra, respectively, along with other technical partners, to enable delivery of drugs, vaccines and blood packets to remote areas. With both solutions being largely focused on operating outside metropolitan regions, the DGCA-approved experiment will be the commercial launch of their services. However, given that metropolitan areas are no-fly zones under the Digital Sky policy, Swiggy, Zomato and Dunzo are likely to conduct technical demonstrations without actually delivering packages to customers. ET was unable to ascertain the details of projects that Tata Advanced Systems and Honeywell are planning to conduct. "We're hoping that by January or February we will see the first operational flights, because regulatory approvals are taking time. But we can say with some certainty that it's no longer a matter of 'if ', but 'when', as far as experiments go," said another member from a consortium that had heard back from the DGCA.
BENGALURU|KOLKATA: India Inc has a new agenda — making sure employees, especially millennials, manage their finances better. In August, Myntra rolled out 'Thrive', a wellness framework for employees, in which financial well-being is one of the main tenets.Experts in asset and wealth management guide employees on investments to save tax, as well as growing their wealth for a secure future. "We want our employees to create good investment habits. When they are able to get expert advice on such matters, it keeps financial stress at bay," Abhishek Sen, head of human resources at Myntra, told ET. The company also plans to leverage internal experts to extend peer support."Companies are realising that for more holistic well-being of employees, all four aspects — physical, emotional, financial and family well-being have to be addressed. The onus of financial well-being is not just to make employees — including millennials — financially literate but to prepare them for future financial resilience and reduce potential stress as a result of not being adequately prepared," said Sudesh Shetty, head of health and benefits, Willis Towers Watson India Insurance Brokers. In startups, employees may enjoy windfall gains and it is important to invest those wisely, said experts.71483906 "A predominantly millennial workforce likes to live life to its fullest, so employers must share the need to balance it out with a sustained savings plan. A large section of these millennials are also migrants who have come in search of work and live away from their families — so their salaries are split across their necessities, sending money home and their discretionary spends," said Chaitanya Ramalingegowda, cofounder of mattress startup Wakefit.co.Tanuja Tewari, vice-president, HR, BigBasket, said, "Women play a very critical role in managing finances and investment in most families, and we initiated financial literacy programmes for women associates working at our distribution centres." As the company looks to increase the female workforce at the distribution centres, there are plans to educate all women employees at the company.Hindustan Unilever runs financial well-being and education programmes throughout the year. It has also tied up with external experts for knowledge sessions, said a spokesperson. Leaders, too, are getting involved and sharing their wisdom. Amit Agarwal, co-founder of home rental startup NoBroker, conducts sessions explaining the differences between real estate and equity investment options."We have partnered with companies such as Upwardly and Fisdom for presentations and query resolution sessions for employees, for them to understand the importance of savings, the benefits of compounding and various investment options that they can look into," Agarwal told ET.
NEW DELHI: India will soon have its own index to estimate the costs of logistics in its top nine export sectors including agriculture, leather, apparel and, gems and jewellery. The department of commerce has begun an exercise to develop sector-specific indices to estimate the logistics costs and bring them down to 10% of the gross domestic product (GDP) from 14% at present as they are higher than those in developed countries. The government also aims to break into the list of top 30 countries in the World Bank Logistics Performance Index which ranked India 44 in 2018 from 54 in 2014. "Internationally, no one has made sector-specific indices to estimate logistics costs. We have taken the top exporting sectors and will move on to domestic trade later," said Manoj Pant, director, Indian Institute of Foreign Trade (IIFT). The institute, an autonomous body under the ministry of commerce and industry, is developing the index which is likely to be released early next year.Data collection for the index started three months ago and is being done through perception based surveys through the respective export promotion councils."We are getting to know about their problems such as biggest constraints in transportation and warehousing," Pant said. The index would also look at the logistics issues of electronics, marine, chemical and engineering goods and serve as a common measure of logistics performance for various industries in India.71486024 At 14%, logistics cost in India is much higher than Japan's 11% and the US' 9-10%. Of this, transportation and warehousing make the bulk."While movement of goods is a major problem in most exports, temperature-controlled facilities are key for agricultural goods and pharmaceuticals. So, by and large, the issues are same for most exports," said Ajay Sahai, director general, Federation of Indian Export Organisations.Globally, coastal transportation is the most favoured way followed by railways and then roads. But the trend is reverse in India where nearly 60% of the cargo is moved by road, 32% by rail and rest by the coastal shipping, airways and inland waterways. The index will help identify the cost efficient way of transporting inputs and finished goods.
NEW DELHI: Luxury hospitality chain The Oberoi Group is planning to put Oberoi Flight Services on the block after the air-catering business suffered a jolt following the grounding of Jet Airways, its primary client, according to people familiar with the matter. The group, which witnessed a drop in revenue and fell into the red in the quarter ended June, has approached investment bankers to initiate an exit, the sources said. The aviation crisis triggered by the closure of Jet and aggravated by a debt laden Air India – its second largest customer -- is said to have had an impact on the air catering business."We do not comment on market speculation. Jet Airways was EIH flight kitchen's largest account, hence the closure of the airline did impact our flight catering business. We have, however, put in place a plan to replace the business that we had from Jet," the company said in a statement. However, sources said a sale is on the cards. "Oberoi flight services is on the block. They have decided to exit that business. Most likely, there could be an announcement in quarter one of the next calendar year. There is a deck circulating in investment banking circles for the sale," said a source.Another source said no other domestic carrier has any tie-up with EIH flight kitchen. "It's a clear write off on the balance sheet. Vistara, Indigo and SpiceJet don't use their services."International airlines like British Airways, Air Canada and Cathay Pacific use EIH services. "But that cannot compare with the number of flights of domestic carriers. They were also catering to Qatar Airways, but they bring their own food now," the source said.In its unaudited results for the quarter ended June this year, the Oberoi Group, or EIH Limited, reported a 14% decline in revenue from operations at Rs 340.58 crore, compared with Rs 388.34 crore a year ago, and a loss of Rs 1.13 crore, compared with a profit of Rs 14.70 crore a year ago, on a consolidated basis. The company attributed the drop in revenue to a general slowdown in business activity, decline in air travel and a reduction in the airline catering business. The company said exceptional items for the three months ended 30th June 2019, and 31 March 2019 represent a provision of Rs 0.47 crore and Rs 84.75 crore, respectively, against receivables from a single customer in the flight catering business due to uncertainty in business continuity of the customer.EIH's subsidiaries include EIH Flight Services, EIH Holdings, EIH Investments NV, EIH International, Mashobra Resort, Mumtaz Hotel and Oberoi Kerala Hotels and Resorts among others.
You would be better off deploying your money over the next few months, rather than all at once, says Deepak Shenoy, Founder, Capital Mind. Excerpts from an interview with ETNOW. Shenoy is bullish on auto and good quality financials. How convinced are you about the prospects of Zee?The interesting thing about Zee is the asset itself. Zee Entertainment is actually solid. It used to be one of the few profit-making companies in the media space that consistently has been able to maintain and perhaps even grow market share. The problem in the company is just the leverage and the promoters. The fear is only that Subhash Chandra will no longer be able to own a significant part of the company. If you take that away, Zee is actually in a fairly good shape. The only other small concern here is that Zee does not have any debt. They have actually given money as loan to some of these promoter entities that are being part of the defaulting gang of companies of the Essel Group that have been in trouble with mutual funds and in their borrowings. If Zee were to give more money to these companies, then that would be a dangerous sign for Zee itself. But otherwise, the prospects of the company is sound and in the next six months, we should see more of their assets getting sold at promoter level and some of the debt coming down. However, I expect some more sales in the next two or three months by some entities that continue to hold the debt, which perhaps for regulatory reasons or otherwise, will want to sell the stake even if it depresses the price. The market is going to be volatile but if you are a long-term player, and I think if the company can be sequestered beyond the holding of Subhash Chandra, then it is a pretty good company. I am just torn here because I do not know whether the company will be the same without the promoter in the saddle. When the corporate tax cut was announced, the market ran up almost 8.5% in two trading sessions. Many were sitting there with a missed out kind of feeling. They were already sitting on a pile of cash which they continue to do so because since then the market has been that shaky. Should one buy stocks right now? If yes, then what would you recommend? It is better to spread your investment over a period rather than just get in at one point in time. Even now, we are looking at debt issues in the market and another round of debt damage is going to come and hurt our markets -- be it in October or November or December. Nobody can say, but it is going to come and hurt markets and in the longer term, you would be better off deploying your money over the next few months, rather than all at once. There is always going to be feelings of being left out and not participating when the tax cut happened but now that markets are back to about the same level as they were before the tax cut for a lot of stocks, it is useful to continue to purchase those stocks. We are still quite positive on auto. The cycle is going to bottom out at some point. The numbers already look good in September from a registration's perspective. The first few days of October also looked encouraging. I believe in the longer term, we will see much recovery in the auto cycle. It may take a month. A base effect will start from next January onwards which will make the numbers look good. If you are looking at 10-year investment, I do not think India is in any way saturated when it comes to four-wheelers or two-wheelers. They continue to be good plays. Among financials, we are looking at the NBFCs and saying there are some outright winners. There are some outright losers. You can make that out in the stock prices as well and I am just saying stick with the outright winners because in the finance field, once your reputation takes a hit, it is always the other people that will win, at least in the medium term. It may be better to stick with the people who have untarnished reputation compared to anyone who has had issues with corporate governance or with rumours of court cases and so on. Don't you think markets are overreacting to every negative news? Some of the news flow that markets are reacting to may not have such a big impact. Are these classical signs of very high risk aversion?Quite true. In fact, markets always go through this phase after a shock of some sort, in this case the IL&FS and the DHFL shocks of last year and earlier this year. That translated to shocks in a number of other NBFCs as well even if they have reasonably good cash balances in stocks like YES Bank or in others, where the fear is not really of promoters having forcibly sold their shares but also in the fundamental stability of a very large institutions. I do not think that in all of these cases, it is useful to just say across the board that everybody is in bad shape or everybody is a fraud. We have had situations where things have been bad. The PMC Cooperative Bank issue was quiet bad and perhaps not well handled by RBI. There was a panic situation in a bank that has more than Rs 11,000 crore in deposits, the size of Equitas or Ujjivan Small Finance Bank. I feel, perhaps we need the authorities to deal with this kind of a panic situation with a little more sensitivity and as investors and commentators, we also need to look at the situation with a little bit less alarmist attitude because there will always be certain things wrong with certain companies, but not all the time this is going to be a dramatic situation. To give an example, we are staring at a deferred tax asset potential loss of more than Rs 4,000 crore in some of the best banks in the country simply because to avail the lower tax rates, they will have to write off Rs 4,000 crore odd and this, even HDFC Bank will have to do if it has to avail of a 22% tax rate. But the situation is not so bad that everybody should go around shorting HDFC Bank because I am sure there will be some kind of forbearance given by RBI to stretch this across quarters and that it is not really a physical hit in accounting entry. Therefore, it can be taken over time. But in the current situation, any news like this can be blown up out of proportion. So I think you are right that the market is taking literally everything on its chin even when it does not have to. We have seen these situations in the past. Hopefully, they do not last us more than a few months and we will be back to normal within a few months. But it needs a lot of patience and a lot of action from both the authorities and market players. What are you making of some of the pharma news today? Glenmark and Auro Pharma got whacked today. There just seems to be no end to the bad news in pharma. Although we have been quite heavily invested and we have actually taken a few losses this year and walked out of some of the scrips, I still feel that in some specific cases, there continues to be a lot of interest. Look at Abbot or Sanofi, they continue to do well whereas most of the Indian generic players or pharma companies that are exporting are in bad shape. One reason for that is also due to perhaps overtures by the USFDA and by President Trump that indicate that there will be some measures, if not now, then a little bit later, to perhaps reduce the profitability of such firms or reduce their potential for growth. Apart from that, local corporates, in some cases have governance issues, in some cases regulatory issues are popping up. Right now, I am not confident enough to tell anybody else to participate in pharma. Let us wait for a more favourable news timeframe and then take a call.
