Picture Of The Day

Posted: 11 Sep 2019 09:30 PM PDT

Duane Matters was living near Boston when terrorists hijacked four planes on September 11, 2001 and used them to crash into the Twin Towers in New York City, the Pentagon near Washington DC, and one that ended up in an empty field in Shanksville, Pennsylvania after passengers fought back. The attacks claimed the lives of nearly 3,000 people. A geologist by training, Matters was sent by the construction company he was then working for, AMEC, to help with the cleanup and recovery effort at what became known as Ground Zero, the 16-acre site of the World Trade Center towers in Lower Manhattan. Above, a New York City firefighter acts as a spotter during the early morning 16 days after the attacks while a grappler works on the debris. The U.S. Intelligence Community Never Paid A Serious Price For 9/11

Brandon J. Weichert, American Greatness: Never Forget How U.S. Intelligence Failed You

Countless Americans' lives changed forever on 9/11. But the sclerotic administrative state never paid any serious price.

The September 11, 2001 attacks were the result of an unmitigated intelligence failure. No, 9/11 was not an "inside job," as many conspiracy theorists believe. Osama bin Laden and his al-Qaeda network were responsible. But, the 9/11 plot did not happen in a vacuum.

In reality, America's elephantine national security state had known of bin Laden and his network years before the horrific events of 9/11. Some of the most powerful people in the national security state routinely downplayed and ignored the threat al-Qaeda posed to the United States before 19 hijackers murdered 2,911 people in New York, Washington, and Pennsylvania.

Warzone/The Drive: This Video Of A Rocket Sled Doing 6,599mph At Holloman AFB Is Absolute Insanity

The sound alone of something ripping by at hypersonic speed just feet above the desert floor is worth the click!

The internet is full of many wondrous things, most of which you have likely already seen. But something you probably have never seen before is an object rocketing along a set of tracks at 6,599 miles per hour, or right around Mach 8.6. No, I did not screw those metrics up, the video below shows a test being conducted on an object that is moving far beyond the threshold of hypersonic speed (Mach 5) just a few feet over the desert floor near Alamogordo, New Mexico.

Make sure your audio is on for this, the sound alone is worth the click:

VIENNA — Despite a slew of unsuccessful tests, Russia's nuclear-powered missile with so-called unlimited range will be ready for war within the next six years, a slightly accelerated timeline than previously reported, according to a U.S. intelligence assessment.

The revelation of the new, more ambitious timeline for the missile comes even though the Kremlin has yet to secure a successful test over multiple attempts, according to sources with knowledge of a U.S. intelligence report.

It also comes on the heels of a mysterious explosion off Russia's northern coast that killed five scientists and sparked fears Moscow had tested the missile in question, called Burevestnik. A U.S. intelligence assessment found that the Aug. 8 explosion occurred during a recovery mission to salvage a lost Burevestnik from the ocean floor.

Reuters: Trump says Bolton a 'disaster' on North Korea, 'out of line' on Venezuela

WASHINGTON (Reuters) - U.S. President Donald Trump said on Wednesday that John Bolton, dismissed a day earlier as national security adviser, had been a "disaster" on North Korea policy, "out of line" on Venezuela, and did not get along with important administration officials.

Trump said Bolton had made mistakes, including offending North Korea's leader Kim Jong Un by demanding that he follow a "Libyan model" and hand over all his nuclear weapons.

"We were set back very badly when John Bolton talked about the Libyan model ... what a disaster," Trump told reporters at the White House.

"He's using that to make a deal with North Korea? And I don't blame Kim Jong Un for what he said after that, and he wanted nothing to do with John Bolton. And that's not a question of being tough. That's a question of being not smart to say something like that."

After years of reporting on the Great War on Terror, many questions behind the US attacks remain unresolved

Afghanistan was bombed and invaded because of 9/11. I was there from the start, even before 9/11. On August 20, 2001, I interviewed commander Ahmad Shah Massoud, the "Lion of the Panjshir," who told me about an "unholy alliance" of the Taliban, al-Qaeda and the ISI (Pakistani intel).

Back in Peshawar, I learned that something really big was coming: my article was published by Asia Times on August 30. Commander Massoud was killed on September 9: I received a terse email from a Panjshir source, only stating, "the commander has been shot." Two days later, 9/11 happened.

Reuters: UK's worst-case no-deal Brexit plan warns of food shortages, public disorder

LONDON (Reuters) - The British government's plans for a no-deal Brexit warn of severe disruption to cross-Channel routes, affecting the supply of medicines and certain types of fresh foods, and say that protests and counter-protests will take place across the country, accompanied by a possible rise in public disorder.

The "Operation Yellowhammer" worst-case assumptions published on Wednesday were prepared on Aug. 2, the government said, nine days after Boris Johnson became prime minister, and form the basis of its no-deal planning.

Moscow's Local Elections Show Waning Support for President Putin

Time: Moscow's Elections Show Putin Is Losing the War at Home

Russian liberals are celebrating the relative success of the Communist Party and other Kremlin-friendly quasi-opposition parties in the elections to the Moscow city council on Sunday as an almost revolutionary breakthrough — but it takes some unpacking to explain why. Candidates from these parties gained around 20 out of 45 seats in the council; meanwhile the ruling United Russia party, which supports Russian President Vladimir Putin, only just retained a majority, losing about 13 seats in the city council (from the current 38 down to just 25).

Al Qaeda Leader Calls For New /Terror Attacks Against The U.S.

Al Qaeda leader Ayman al-Zawahiri called Wednesday on Muslims to attack U.S., European, Israeli and Russian targets in a speech on the 18th anniversary of the 9/11 terror attacks.

SITE Intelligence Group, which tracks online activity of jihadist groups, reported that in a video released by the militant group, the 68-year-old al-Zawahiri also criticizes "backtrackers" from jihad, referring to former jihadis who changed their views in prison and called the 9/11 attacks unacceptable because innocent civilians were harmed.

Ahval: Turkey could steal U.S. nuclear weapons at Incirlik - analyst

Turkish President Recep Tayyip Erdoğan's hinting last week at acquiring nuclear weapons left observers envisioning how that might happen, including a possible theft from its NATO ally, said an analysis on Monday in conservative U.S. outlet The National Interest.

Joseph Cirincione, president of the Plowshares Fund, told National Interest reporter Matthew Petti that the threat is real, but not imminent. "If Turkey wanted to build a nuclear bomb, it could," he said. "It would take decades. It's not something that would happen overnight."

A U.S. State Department official pointed out that Turkey agreed to never acquire nuclear weapons by signing the nonproliferation treaty.

Soner Çağaptay, director of the Turkey programme at the Washington Institute for Near East Policy, told Petti that Erdoğan's comments came from his perception that the unipolar world order imposed by the U.S. is collapsing and he can be more aggressive in his neighborhood.

Global Military Spending Rising

VOA: Data Shows Global Military Spending Rising

PENTAGON - Eighteen years after the deadliest terror attack on U.S. soil, the world's military spending is at an all-time high.

According to data from the Stockholm International Peace Research Institute, military spending was $1.8 trillion in 2018 alone, which SIPRI Senior Researcher Pieter Wezeman called a "worrying trend."

"We have to see that as a warning signal, not necessarily something which will lead to war, but something which needs very close attention," Wezeman told VOA.

Military spending hit a post-Cold War low in 1998, but took a sharp rise after the attacks on Sept. 11, 2001, which killed nearly 3,000 people.

World Leaders React To The Firing Of U.S. National Security Adviser John Bolton

France 24: World leaders react to John Bolton's sudden departure

The sudden ouster of John Bolton as Donald Trump's national security adviser has been met with varying reactions from leaders around the world. Notably hawkish on Iran, Bolton had been a key opponent of holding talks with leaders in Tehran.

Trump and Bolton, known for his hawkish views, had disagreed on key foreign policy challenges including Russia, North Korea, Iran and Afghanistan. Last year Bolton masterminded a quiet campaign inside the administration – and with allies abroad – to persuade Trump to keep US forces in Syria to counter the remnants of the Islamic State group and Iranian influence in the region.

Venezuelan President Maduro has accused Colombia of plotting his overthrow, while Bogota said Venezuela harbors and backs rogue rebel fighters. The US offered Colombia its "full support" against any attempted aggression.

Venezuelan President Nicolas Maduro deployed 150,000 troops to his country's border with Colombia as tensions continue to rise between the two countries.

"The moment has come to defend our sovereignty and national peace by deploying our defense resources in full force," Maduro said on Twitter.

Aside from personnel, Maduro's government deployed tanks and missile carriers to its western Tachira state, an area that has become the departure point for millions of Venezuelans migrating to the south. There are currently more than 1 million Venezuelans living in Colombia.

Gallop Poll: U.S. Views Are Split On Whether War In Afghanistan Was A Mistake

Posted: 11 Sep 2019 09:17 AM PDT

The Hill: Views split on whether war in Afghanistan was a mistake: poll

Eighteen years after the U.S. invaded Afghanistan, Americans are split on the necessity of the war, with just over half saying it was not a mistake in a new poll from Gallup.

The survey found 52 percent of respondents say the U.S. invasion, initially launched in response to the Taliban's refusal to turn over Osama bin Laden, was not a mistake, compared to 43 percent who say it was.

The split is roughly the same as the one Gallup found four years ago, when 54 percent it was not a mistake and 42 percent said it was.

Although the divide has largely stabilized in recent years, it is far more balanced than in the initial years following the invasion. In July 2004, only 25 percent opposed the war, a figure that had climbed to 43 percent by August 2010.

Business Insider: F-35s and F-15s just obliterated an entire Iraqi island to root out ISIS fighters

* US Air Force F-15 Strike Eagles and F-35 Lightning II aircraft dropped 80,000 pounds of bombs on an island in Iraq's Salah al-Din province believed to be used as a transit point for ISIS fighters between Syrian and Iraqi cities.
* "We're denying Daesh the ability to hide on Qanus Island," Maj. Gen. Eric T. Hill, the commander of Operation Inherent Resolve's Special Operations Joint Task Force, said in a press release, using the Arabic acronym for ISIS.
* Although President Donald Trump said earlier this year that ISIS was defeated, the militant group has been resurgent in Iraq and Syria, at least partly because of Trump's decisions to pull troops out of Syria, create a diplomatic vacuum in Iraq, and focus attention in the region on Iranian activity.

On Tuesday, US and Iraqi forces dropped 80,000 pounds of munitions on Qanus Island, in Iraq's Salah-al-Din province, to destroy what Operation Inherent Resolve (OIR) called a "safe haven" for ISIS fighters traveling from Syria into Iraq.

"We're denying Daesh the ability to hide on Qanus Island," Maj. Gen. Eric T. Hill, the commander of OIR's Special Operations Joint Task Force, said in a press release, using the Arabic acronym for ISIS.

Operation Inherent Resolve spokesman Col. Myles Caggins tweeted a video of the operation on Tuesday morning that shows bombs carpeting the tree-lined island from end to end, saying the island was "Daesh infested."

Reuters: Buying a big stick: South Korea's military spending has North Korea worried

SEOUL (Reuters) - South Korea and North Korea have continued to pour resources into modernizing their militaries despite a frenzy of diplomacy since 2018, data shows, creating a point of tension that has sharpened as talks have stalled.

Military buildups on both sides of the heavily fortified border between the two nations have come to the forefront with recent short-range missile launches by North Korea, perfecting an arsenal it says is necessary to defend against new South Korean weapons.

On Wednesday North Korean state media reported that leader Kim Jong Un had personally supervised on Tuesday the test firing of a large multiple-rocket launch system, a type of weapon analysts say threatens forces in South Korea.

The Pentagon Has Given Up On Paticle Beams Weapons

Popular Mechanics: The Pentagon Is Giving Up on Particle Beam Weapons

The Department of Defense doesn't think they could be weaponized soon enough.

* The DoD, which showed interest in neutral particle beams earlier this year, now thinks they're too hard to field anytime soon.
* Particle beams work by using atomic and subatomic particles to "melt" their target.
* The Pentagon wanted to use neutral particle beams to shoot down incoming ballistic missiles during takeoff phase.

The Department of Defense is pushing hard into directed energy technologies, particularly lasers, but there's one weapon that won't be deployed in the field anytime soon: neutral particle beams (NPBs). Just over a year after announcing a renewed interest into the tech the Pentagon has decided to shelve research into NPBs, stating that they were "not near term enough." Translation: even with military funding the services wouldn't see a particle beam weapon soon enough to make worthwhile.

WNU Editor: The Pentagon's focus is on lasers right now, not particle weapons.

A Tentative List of the Missing in the Bahamas Has 2,500 Names

Posted: 12 Sep 2019 12:44 AM PDT

FREEPORT, Bahamas (AP) — An estimated 2,500 people are listed as missing in the Bahamas in Hurricane Dorian’s aftermath, the government said Wednesday. But it cautioned that the names had yet to be checked against the rosters of people evacuated from the devastated islands or staying in shelters.

Carl Smith, a spokesman for the country’s National Emergency Management Agency, said he expected the list to shrink as the names are checked.

More than a week after Dorian smashed thousands of homes on the country’s Grand Bahama and Abaco islands, the death toll stood at 50 and was expected to rise, with search-and-rescue crews still making their way through the ruins.

“The number of deaths is expected to significantly increase,” Prime Minister Hubert Minnis said in a national address Wednesday night.

He said the Bahamas would hold a national day of prayer, and named hurricane response coordinators for the two most-affected islands.

While power has returned to much of Grand Bahama, Smith said the electrical infrastructure around Marsh Harbour, Abaco’s largest city, was destroyed.

In Freeport, the largest city on Grand Bahama, rental car company driver Clifton Williams said he was driving home Monday when he saw an illuminated streetlight for the first time since the hurricane.

“I was happy to see that. I didn’t expect that so quickly,” he said. “First thing I do, I cut on the fan and cool off myself,” he added, saying he slept well for the first time in more than a week thanks to the fan.

Others in Freeport didn’t have power yet.

“It’s the same as it was a week ago. It’s very hot,” said Samuel Antonio.

Canada’s Trudeau Begins His Reelection Bid Ahead of the Oct. 21 Vote

Posted: 11 Sep 2019 06:53 PM PDT

TORONTO (AP) — Canada’s Prime Minister Justin Trudeau launched his reelection campaign Wednesday, saying that Canadians need to decide whether they want to return to the “failed policies” of a conservative government that believes in cuts and austerity.

Trudeau kicked off his bid to remain in office ahead of an Oct. 21 vote after meeting the country’s governor general and dissolving Parliament.

“Canadians have an important choice to make,” Trudeau said. “Will we go back to the failed policies of the past or will we continue to move forward?”

Tall and trim, Trudeau channeled the star power of his father in 2015 when he defeated Conservative leader Stephen Harper, who ruled for nine years and was the most right-leaning prime minister in the country’s history. But the son of late Prime Minister Pierre Trudeau could now be in trouble. Polls say the opposition Conservative party, with its unknown and untested leader Andrew Scheer, is running close to Trudeau’s Liberals.

Not since 1935 has a government that won a majority of seats in Parliament in its first term lost power in the next election in Canada.

“Canada has been a beacon and has tried to lead by example but it’s really hard to lead by example when you are Canada and you are by yourself,” said Ian Bremmer, president of the Eurasia Group.

Trudeau has been admired by liberals around the world for his progressive policies in the Trump era, with Canada accepting more refugees than the United States. His Liberal government has also strongly advocated free trade.

But the 47-year-old finds himself vulnerable following one of the biggest scandals in Canadian political history, which arose when Trudeau’s former attorney general said he improperly pressured her to halt the criminal prosecution of a company in Quebec. Trudeau has said he was standing up for jobs.

The scandal rocked the government and led to multiple resignations earlier this year, causing a drop in the leader’s poll ratings.

Scheer, the head of the conservative party, said Wednesday that Trudeau had lost the moral authority to govern.

“Over the next five weeks I will be explaining the reasons why Justin Trudeau has lost that authority and our alternative plan,” he said.

Trudeau’s warning of conservative cuts and austerity measures are likely aimed at voters in Ontario, who elected a now unpopular conservative populist in 2018 as government premier.

“Ontario Premier Doug Ford has reminded Ontarians what a conservative government can be like,” said Robert Bothwell, a professor of Canadian history and international relations at the University of Toronto.

“They are running against Ford and they are running against former Prime Minister Harper,” he added, referring to Trudeau and the Liberal party.

Trudeau’s father, Pierre Trudeau, swept to power in 1968 on a wave of support dubbed “Trudeaumania,” but narrowly avoided losing the 1972 election just four years later. He ended up leading Canada for almost 16 years, becoming a storied name in Canadian history who was responsible for the country’s version of the bill of rights.

Justin Trudeau’s decisive victory in 2015 restored his family to the national political stage and allowed Canadian voters to reclaim their country’s liberal identity after nearly a decade under Harper.

Since then, he has legalized cannabis nationwide, put a price on carbon and bought a proposed pipeline expansion project that would get Canada’s oil to international markets. Canada has the third-largest oil reserves in the world.

Trudeau will need to win 170 of the 338 seats in the House of Commons in Parliament to win a majority, but a minority government is highly possible. In that scenario, either Trudeau or Scheer would have to rely on at least one opposition party to pass legislation.

Tentative List of Missing in the Bahamas After Hurricane Dorian Has 2,500 Names

France’s Macron Says U.K. Has Given E.U. ‘No Clear or Concrete Proposals’ for New Brexit Deal

Posted: 11 Sep 2019 10:03 AM PDT

British Prime Minister Boris Johnson has not floated any negotiable changes to the Brexit deal with E.U. officials in the two months since he came to power, according to French President Emmanuel Macron, who said he had heard only “a lot of noise without a lot of serious discussion.”

In an interview in the Elysée Palace on Monday, Macron told TIME that the U.K. had not suggested “any clear or concrete proposals” to E.U. negotiators, and that the E.U.’s chief Brexit negotiator Michel Barnier, who is French, had told him last Friday that he had conducted “very few discussions with British negotiators” since Johnson became Prime Minister on July 24.

“This deadlock is a British deadlock, it’s not a European deadlock,” the French President said, displaying clear irritation over the ongoing battles within the British parliament. “So if they propose something which is compliant with the E.U. requirements, our negotiator can move.”

British lawmakers voted on Sept. 4 to make leaving the E.U. without a deal illegal, despite widespread speculation that a so-called “no deal” Brexit is Johnson’s preferred option. Johnson insists publicly that he would prefer to leave with a good deal than without one. However he has also said Britain will leave on Oct. 31 “do or die.”

On Sept. 7 Amber Rudd, a member of Johnson’s cabinet, resigned, saying that she had seen no evidence that the U.K. government had offered new options to the E.U. to break the deadlock. “I no longer believe leaving with a deal is the Government’s main objective,” she wrote in her resignation letter.

But the vote to make “no deal” illegal means that Johnson might be forced to request another delay to Brexit in order to continue negotiations, which E.U. leaders including Macron would have to agree to at the European Council summit on Oct. 17-18.

On Sept. 8, Macron’s foreign minister, Jean-Yves Le Drian, suggested France might veto any extension to Brexit. Macron himself would not be drawn on that possibility but said Johnson could yet propose a workable deal to E.U. officials. “The important point is to have a U.K. that is fully engaged in the discussion with Europe,” he said. “Let us propose and let us see if it is acceptable.”

Deal or no deal, Europe’s top officials increasingly talk as though Brexit is in the past, and they are simply waiting for the dust to settle in London in order to sign the exit document. “Our position is not for the E.U. to be moving along the lines of British domestic politics,” one of Macron’s top aides told TIME last week, who spoke on condition he was not named. “You become crazy, because you cannot know what will happen this afternoon in parliament,” he said. “The Brexit crisis is mainly a British domestic crisis.”

However the French President suggested another still-possible scenario: That the U.K. cancels its decision to leave the E.U. by revoking Article 50 of the Lisbon Treaty — the legal mechanism that triggered Brexit.

“They always have the possibility to withdraw Article 50; nobody should forget that,” the French leader told TIME. Given that exit route, he added, a no-deal Brexit would be “a British decision.”

TIME will publish the full interview with Macron in coming days.

French Police Appeal for Victims and Witnesses to Come Forward in Jeffrey Epstein Probe

Posted: 11 Sep 2019 09:42 AM PDT

(PARIS) — French police are appealing for victims and witnesses to come forward to aid their probe into Jeffrey Epstein and anyone else involved in the disgraced financier’s alleged sexual exploitation of women and girls, and say they have already interviewed three people who identified themselves as victims.

The police appeal published Wednesday on Twitter provided both a phone number and an Interior Ministry email address for victims and witnesses to use. It said police specialists have been mobilized for the French investigation, which opened on Aug. 23. Police are investigating the alleged rape of minors and other possible charges linked to the Epstein case.

Three victims who have already come forward were interviewed by French investigators in August and earlier this month, the last as recently as Monday, the Paris prosecutor’s office said.

Epstein, who rubbed shoulders with the elite and politically powerful, maintained an apartment at a luxury Paris address near the Arc de Triomphe. He killed himself on Aug. 10 in the Metropolitan Correctional Center in New York while awaiting trial on sex-trafficking charges at age 66. Numerous women in the United States allege they were sexually abused by Epstein.

The French investigation is broadly probing possible charges of rape of minors 15 and older, sexual aggression and criminal association. Prosecutors haven’t yet named any suspects. The aim is to uncover any infractions in France as well as on any French victims abroad and to determine whether any French citizens were linked to crimes.

A France-based advocacy group, Innocence in Danger, that has also been gathering testimony said it was delighted by the police appeal, calling it proof “that the affair is being taken seriously.”

“It’s necessary and it can perhaps allow people who have things to say, victims and witness, to understand that France is interested,” Homayra Sellier, the group’s president, told The Associated Press.

She said she hopes it will also encourage witnesses who wrote anonymously to the group to come forward and testify to investigators. About 10 people have contacted the group in relation to the Epstein case, and testimonies that weren’t anonymous have been forwarded to French prosecutors, she said.

Among those of potential interest to French investigators is Jean-Luc Brunel, a French modeling agent and frequent companion of Epstein who occasionally flew on his plane and visited him in jail in Florida, where he served 13 months as part of a deal for a 2008 guilty plea, according to records.

One of the women who accused Epstein of sexually abusing her when she was a teenager, Virginia Giuffre, has claimed that she also had sex with Brunel, along with a long list of other prominent men, including Britain’s Prince Andrew .

All of those men have denied her allegations. Epstein, likewise, had denied all charges against him. Epstein faced up to 45 years behind bars on federal sex trafficking and conspiracy charges. He had pleaded not guilty.

Austrian Doctor Sues Food and Drug Administration For Seizing Her U.S. Patients’ Abortion Drugs

Posted: 11 Sep 2019 08:34 AM PDT

(BOISE, Idaho) — An Austrian doctor who prescribes abortion drugs to patients around the world is suing the United States for allegedly blocking her American patients from getting abortions by seizing their prescriptions.

Dr. Rebecca Gomperts filed the lawsuit in U.S. District Court in Idaho on Monday, asking a judge to stop the Food and Drug Administration from taking any steps that would prevent her patients from accessing the abortion-inducing drugs. “For many women seeking to terminate their unwanted pregnancies prior to viability, the only practical option is found on the internet,” Gomperts and her attorney Richard Hearn wrote in the lawsuit.

In many rural states, abortion providers are few and far between, Hearn said on Monday. That limits abortion access to women with the money and means to travel or those who can find a provider on the internet such as Gomperts.

One of Gomperts’ first patients was a 14-year-old girl, Hearn said. “How many 14-year-olds can rent a car, drive down secretly to Salt Lake City or Boise, and then spend the night there and take these pills and go to a follow-up appointment and then go home? Practically, it’s just not available to poor people in states like Idaho,” Hearn said.

Women seeking abortions generally have two options: A surgical abortion where the embryo or fetus is physically removed from the womb or a medication abortion where medications are essentially used to induce a miscarriage in the first few weeks of a pregnancy.

The drugs typically used for a medication abortion, misoprostol and mifepristone, are highly regulated by the FDA and doctors in the U.S. must have a specialty license to prescribe them.

Gomperts, who splits her time between homes in Wien, Austria, and Amsterdam, the Netherlands, started an organization called Aid Access to serve women seeking first-trimester abortions in early 2018. She prescribes the abortion-inducing medications through the Aid Access website, and then the organization gives the women information on how to fill their prescriptions using a merchant prescription drug exporter based in India. India’s laws allow the exporter to legally export small quantities of drugs for a patient’s personal use.

More than 40,000 women have contacted Aid Access since the organization began, according to the lawsuit, including roughly 37,000 women from the United States. Of those, Gomperts has prescribed the abortion-inducing drugs to more than 7,000, including roughly 40 women in Idaho, where the lawsuit was filed.

The FDA sent Gomperts a letter in March warning her that the agency believed she was violating federal law by “introducing into interstate commerce misbranded and unapproved new drugs.”

After she received the letter, Gomperts learned the FDA had seized the abortion medications from between three and 10 of her patients. Gomperts says the FDA also blocked the transfer of money between her patients and Aid Access by blocking the patients from using companies such as Moneygram and Xoom.

She stopped providing medical abortions for women in the U.S. for almost two months after getting the letter, according to the lawsuit, but ultimately resumed the practice in May. Gomperts says the FDA’s actions have created an undue burden on herself and her patients, effectively barring them from getting abortions.

“This is the federal government interfering with a woman working with her doctor, and then threatening the doctor who wrote that prescription,” Hearn said

The FDA has declined to comment on the case because it’s a pending lawsuit.

It’s not just abortion-inducing drugs that the FDA is cracking down on; the federal agency has long been trying to stop the unregulated flow of medications into the U.S. Many American patients turn to online pharmacies in countries like Mexico and India because the medications are cheaper.

Hearn says the abortion-inducing drugs should be treated differently because they’re effectively the only way some women can access early-pregnancy abortions.

“It’s a stupid idea, but if you want to block drugs like insulin, that’s OK,” Hearn said. “But if you block a woman — or a 14- or 15-year-old girl — who only has a couple of weeks when she can take these pills and you seize them? That’s not only unconscionable, it’s unconstitutional.”

This Italian-Egyptian Singer Was Attacked By Populist Politicians. His Groundbreaking Success Is Silencing Critics

Posted: 11 Sep 2019 08:06 AM PDT

In February, Alberto Biancheri, the mayor of a small Italian coastal town near the French border, walked onstage carrying a statuette of a golden lion: the prize of the 2019 Sanremo Festival, awarded every year to the best new Italian song. TV cameras zoomed in on the winner’s shocked face, immediately sparking memes on social media. Mahmood, then 26, had pulled off a surprising upset and managed to conquer Italy’s most prestigious music competition with his song ‘Soldi’ (‘Money’). His victory quickly became a cultural turning point in Italy’s polarized climate around immigration, drawing scorn from Italy’s leading populist and far-right politicians, and catapulting Mahmood into the national spotlight.

Released on Feb. 6, after Mahmood’s first EP came out in late 2018, ‘Soldi’ was performed in public for the first time at Sanremo and instantly became a hit. ‘Soldi’ is not really about money. Written by Alessandro Mahmoud (stage name Mahmood), who was born in Milan to an Italian mother and Egyptian father, the song tells the story of Mahmood’s father’s absence during his childhood, after his parents separated when he was 5 years old. The lyrics describe a father who disappears and reappears as he pleases, smokes a hookah, drinks champagne during Ramadan and keeps asking: “come va?” (“how’s it going?”). “There’s quite a bit of anger in Soldi, it was a way to let off steam,” says Mahmood, speaking over the phone from Milan. It also includes a verse in Arabic: “waladi habibi ta’aleena(my son, my love, come here), which recalls memories of his father calling him from the playground in a language he doesn’t speak himself.

Since its launch in 1951, the Sanremo Festival has become one of the country’s biggest televised events, with the winning song going on to represent Italy at the Eurovision Song Contest in May. That Soldi could win what is widely regarded as a traditional festival of Italian music, seemed to be a moment redefining “Italianess.” Mahmood agrees. “I’m very happy that people appreciated my style,” he says. “I think it was one of the more modern festivals in the past years, also thanks to other artists who brought a “new wave,” and breathed new life into Italian music.”

Not everyone saw it that way. The country’s leading politicians were among the first to express their dissatisfaction on social media, saying Mahmood’s victory — which was decided in part by music industry personalities and journalists— represented the division between ordinary Italians and the liberal elite.

Luigi di Maio, the leader of the anti-establishment Five Star Movement and then Deputy Prime Minister complained in a Facebook post that it represented the wishes of a jury made up of “journalists and the radical chic” rather than those of the voters at home. “Sanremo has shown to millions of Italians the abysmal distance that exists between the people and the ‘elite,’” he said. “Maybe next year the winner could be chosen only with the tele-voting, given that it costs Italians 51 cents, let’s make it count.”

Matteo Salvini, leader of the far-right League party who was recently ousted from government as Interior Minister, tweeted: “#Mahmood….mah….The most beautiful Italian song?!? I would have chosen #Ultimo, what do you say??” He later told Italian daily La Repubblica: “Sanremo is the mirror of Italy. There’s the jury and then there’s ordinary people: they are two worlds far apart. And the winners are victims of the system.”

So far, Mahmood has seemed unperturbed by the xenophobic rhetoric coming from politicians like Salvini, who implemented several anti-immigration policies while in office. “Of course, I don’t like the idea that my music may be used for a political cause,” he says. “But in the end, all this stuff about politics only lasted a while and Soldi has continued to travel a lot since Sanremo, and people are no longer talking about it in this way.”

And ‘Soldi’ has traveled unusually far for an Italian song. It has been streamed over 100 million times on Spotify since February, topped the charts in Italy and reached platinum status in Spain, Switzerland and Greece. It also made it to second place at the Eurovision Song Contest in Tel Aviv in May, and in June it became the most listened to Italian song in Spotify’s history. A European tour of his debut album, Gioventù Bruciata (“Wasted Youth”), has been announced for October, and tickets are selling out fast. Extra shows have been announced in London, Paris and Berlin.

Daniele Venturelli/Daniele Venturelli/WireImage Mahmood with his winner’s award on stage during the closing night of the 69th Sanremo Music Festival at Teatro Ariston on February 09, 2019 in Sanremo, Italy.

Mahmood’s rise could be compared to that of Lil Nas X or Lizzo in the U.S. — artists who have managed to break down cultural barriers. His music resonates with many Italians who grew up in the suburbs with immigrant parents, often at odds between two cultures. As for ‘Soldi, its catchy, impassioned and personal lyrics are also very relatable. The story of being abandoned by a father, “could easily be the story of many other families,” Mahmood says.

Though Mahmood’s mother is Italian, she represents a different kind of migrant in Italy: those who left the country’s rural areas for the industrialized north. One of 13 children, she moved to Milan from Sardinia with her family at the age of 18. She met Mahmood’s father at the bar where she worked with her brothers and sisters.

“I listened to both Italian and Arab music growing up,” Mahmood says. “That Arab influence is very much present in my music and I really feel it when I’m writing.” But American hip hop also made an impression on him. One of the first albums he bought was The Score by the Fugees. He recently met Lauryn Hill when he was her opening act at her Italian show. “I was ecstatic. To me she’s mythical, she’s one of the biggest artists in the world. I listened to that album on repeat for months.”

That mix of influences has made Mahmood’s music difficult to categorize. It has been described as “rap”, “trap” and “pop,” but to settle any doubts, Mahmood came up with his own term: “Morocco pop.” “People wanted to put my music in a category at all costs, but I don’t really know what it is,” he says, “So that’s what I came up with.”

Like Mahmood, many emerging Italian artists, such as Italian-Tunisian rapper Ghali, come from the deprived outskirts of Milan. In an apparent tribute to this setting, Mahmood’s newest song released on Aug. 30 is titled ‘Barrio’ (Spanish for ‘neighborhood’) and mixes in some Latin American influences into his Arab-Italian mix, with a collaboration with Colombian pop star Lalo Ebratt.

Mahmood always sings in Italian, but has previously added Spanish lyrics to a version of Soldi by collaborating with a Spanish singer. As the role of English as pop’s lingua franca is changing, artists like Bad Bunny, Rosalía or BTS have found international success singing in their own languages. Mahmood hopes he can be part of this trend. “With this new wave of music in Spanish, people are a bit more open-minded regarding languages,” he says. “A few years ago it was limiting. If you didn’t sing in English people turned up their noses. But language has become something people are less fussy about. When people listen to music they are less prejudiced than they used to be.”

Desperation Mounts in Bahamas as Overflowing Shelters Are Turning Hurricane Dorian Evacuees Away

Posted: 11 Sep 2019 07:33 AM PDT

(NASSAU, Bahamas) — Desperation mounted in the Bahamas on Tuesday as hurricane survivors arriving in the capital by boat and plane were turned away from overflowing shelters.

As government officials gave assurances at a news conference that more shelters would be opened as needed, Julie Green and her family gathered outside the headquarters of the island’s emergency management agency, seeking help.

“We need a shelter desperately,” the 35-year-old former waitress from Great Abaco said as she cradled one of her 7-month-old twins on her hip, his little face furrowed. Nearby, her husband held the other twin boy as their four other children wandered listlessly nearby. One kept crying despite receiving comforting hugs.

Hurricane Dorian devastated the Abaco and Grand Bahama islands in the northern part of the archipelago a week ago, leaving at least 50 dead, with the toll certain to rise as the search for bodies goes on.

Nearly 5,000 people have arrived in Nassau by plane and by boat, and many were struggling to start new lives, unclear of how or where to begin. More than 2,000 of them were staying in shelters, according to government figures.

Green said that shelter officials told her they couldn’t accept such young children, and that the family has slept in the home of a different person every night since arriving Friday in New Providence, the island where Nassau is situated.

“We’re just exhausted,” she said. “We’re just walking up and down, asking people if they know where we can stay.”

Erick Noel, a 37-year-old landscaper from Abaco with a wife and four children, found himself in the same situation. They will have to leave a friend’s house by Wednesday and had not yet found a shelter where they could stay.

“They are full, full, full,” he said. “I keep looking for a place to go.”

He said he found one small home for his family in Nassau but could not afford the $900 monthly rent. Undeterred, Noel said he would keep searching.

Meanwhile, government officials said they were helping all evacuees and considering building temporary housing, perhaps tent or container cities.

“We are dealing with a disaster,” said Carl Smith, spokesman for the Bahamas’ National Emergency Management Agency. “It takes time to move through the chaos. We are responding to the needs.”

The government has estimated that up to 10,000 people from the Abacos alone will need food, water and temporary housing.

Getting back to Abaco is the dream of Betty Edmond, a 43-year-old cook who picked at some fries with her son and husband in a restaurant at a Nassau hotel, where her nephew is paying for their stay.

They arrived in Nassau on Saturday night after a six-hour boat trip from Abaco and plan to fly to Florida on Wednesday, thanks to plane tickets bought by friends who will provide them a temporary home until they can find jobs. But the goal is to return, Edmond said.

“Home will always be home,” she said. “Every day you wish you could go back.”

“You try to keep your hopes up, but …,” she added, her voice trailing off as she shook her head.

The upheaval, however, was exciting to her 8-year-old son, Kayden Monestime, who said he was looking forward to going to a mall, McDonald’s and Foot Locker.

Also flying to Florida was 41-year-old Shaneka Russell, who owned Smacky’s Takeaway, a takeout restaurant known for its cracked conch. The restaurant, named after the noises her son made as a baby, was destroyed by Dorian.

Russell said good Samaritans had taken her and a group of people into their home over the weekend and found them a hotel room in Nassau for a couple of days.

“To know that we were going to a hotel, with electricity and air conditioning and a proper shower, I cried,” she said.

The nearby island of Eleuthera also was taking in evacuees as unmet needs keep growing, said Sadye Francis, director of a nonprofit organization.

“There are still others that have nowhere to go,” she said. “The true depth of the devastation in Abaco and Grand Bahama is still unfolding.”

Dimple Lightbourne, a 30-year-old Abaco resident now in Nassau, said she couldn’t wait to escape the disaster Dorian left behind.

“I don’t want to see the Bahamas for a while. It’s stressful,” she said. “I want to go to America. … This is a new chapter. I’ve ripped all the pages out. Just give me a new book to fill out.”

Bulgaria Charges NGO Official With Spying For Russia, Attempting to ‘Completely Overhaul’ the Country’s Politics

Posted: 11 Sep 2019 05:07 AM PDT

SOFIA, Bulgaria (AP) — Bulgarian prosecutors have charged an official from a non-governmental organization with spying for Russia for allegedly supplying information that aimed to turn the Balkan country away from its pro-Western orientation.

Deputy chief prosecutor Ivan Geshev said Tuesday that Nikolay Malinov, chairman of the National Russophile Movement, has been charged “with putting himself in the service of foreign organizations to work for them as a spy.” If found guilty, Malinov faces 15 years in prison. He was released on bail but is barred from leaving the country.

Geshev said prosecutors found a document prepared by Malinov outlining “the steps needed to be taken to completely overhaul the geopolitical orientation of Bulgaria away from the West toward Russia.”

Malinov was not immediately available for comment.

Bulgarian President Rumen Radev called the charges against Malinov “very serious” but added that “undisputable evidence of wrongdoing” was needed. Bulgaria, Moscow’s closest ally during the Cold War, has joined NATO and the European Union in the last decade but is still almost totally dependent on Russian energy supplies.

The charges against Malinov come after a diplomatic quarrel between Sofia and Moscow, which was sparked by an exhibition that the Russian embassy opened on Monday marking the “liberation of Eastern Europe from Nazism.”

In an unusually strong statement, Bulgaria’s Foreign Ministry advised the Russian embassy to not support the “dubious” historical claim that Bulgaria was liberated by Soviet forces in 1944. “Soviet army bayonets brought to the people of Central and Eastern Europe half a century of repression, a suppression of civil conscience, deformed economic development and detachment from developed European countries,” the ministry said.

Scottish Court Rules British Prime Minister’s Suspension of Parliament ‘Unlawful’

Posted: 11 Sep 2019 03:42 AM PDT

(LONDON) — A Scottish court dealt another blow to Prime Minister Boris Johnson’s Brexit plans Wednesday, ruling that his decision to suspend Parliament less than two months before the U.K. is due to leave the European Union was an unlawful attempt to avoid democratic scrutiny.

The government immediately said it would appeal, as the political opposition demanded Johnson reverse the suspension and recall lawmakers to Parliament.

With Brexit due in 50 days, the court ruling deepened Britain’s political deadlock. Johnson insists the country must leave the EU on Oct. 31, with or without a divorce deal to smooth the way. But many lawmakers fear a no-deal Brexit would be economically devastating, and are determined to stop him.

In a surprise judgment, justices at Scotland’s highest civil court said the government’s action was illegal “because it had the purpose of stymieing Parliament.” But the Court of Session judges said Britain’s Supreme Court must make the final decision at a hearing next week.

Johnson claims he shut down the legislature this week so that he can start afresh on his domestic agenda at a new session of Parliament next month. But the five-week suspension also gives him a respite from rebellious lawmakers as he plots his next move to break the political impasse over Brexit and lead Britain out of the EU by Oct. 31, “do or die.”

The Scottish judges said “the only inference that could be drawn was that the U.K. government and the prime minister wished to restrict Parliament.”

They ruled that the suspension, known as prorogation, was “null and of no effect,” but referred the matter to the Supreme Court for resolution. A hearing there is due to begin Tuesday.

Catherine Haddon, a senior fellow at independent think-tank the Institute for Government, tweeted that the ruling “does not (yet) change the prorogation itself. Though of course will add to pressure.”

Opposition politicians, however, insisted that the government must recall Parliament. Lawmakers were sent home this week despite the objections of House of Commons Speaker John Bercow and opposition lawmakers, who held up signs in the chamber saying “Silenced.”

“He should do the right thing now, which is to reopen Parliament, let us back to do our job and to decide what to do next,” said Labour Party Brexit spokesman Keir Starmer.

Dominic Grieve, one of 21 lawmakers kicked out of the Conservative group in Parliament by Johnson last week after voting against the government, said it was possible the prime minister had misled Queen Elizabeth II — whose formal approval is needed to suspend Parliament — about his motives.

He said if that turned out to be true, the prime minister would have to “resign — and very swiftly.”

The court ruling came after more than 70 opposition lawmakers challenged the government’s decision shut down Parliament until Oct. 14 — just over two weeks before Britain is due to leave the EU.

Last week, a court in Edinburgh rejected the lawmakers’ challenge, saying it was a matter for politicians, not the courts, to decide. But that was overturned Wednesday on appeal.

The British government said it was disappointed by the decision and would appeal to the Supreme Court.

It noted that another challenge to the suspension, brought by transparency campaigner Gina Miller, was rejected at the High Court in London last week by judges who said the decision was inherently political and “not a matter for the courts.”

With a no-deal Brexit looming, rebel members of the governing Conservatives joined with the opposition to deliver a series of blows to Johnson in the days before Parliament was suspended. They passed a law that orders the government to seek a three-month delay to Brexit if no agreement has been reached by late October, and rejected Johnson’s call for a snap general election.

Britain’s 2016 decision to leave the European Union has left the country’s politics gridlocked and tested to the limit the U.K.’s largely unwritten constitution.

Both the Conservatives and main opposition Labour Party are divided over Brexit, and voters of all stripes are fed up.

Johnson, one of the leaders of the 2016 “leave” campaign, is trying to deliver Brexit and counter an electoral threat from the newly founded Brexit Party. Its leader Nigel Farage took out newspaper ads Wednesday, offering an electoral pact with the Conservatives if Johnson backed a “clean break” — a no-deal Brexit.

But Johnson’s office said “the PM will not be doing a deal with Nigel Farage.”

Labour is caught between those who want to go through with Brexit — albeit a softer version — and a faction that wants to reverse the decision.

Leader Jeremy Corbyn says the party will negotiate a new and improved withdrawal agreement with the EU. But his deputy, Tom Watson, argued Wednesday that there is “no such thing as a good Brexit deal” and Labour should campaign to remain in the bloc.

Johnson says he wants to strike a new deal with the bloc after the agreement made by his predecessor Theresa May was rejected three times by Britain’s Parliament. But EU officials say the U.K. has made no concrete proposals.

German Chancellor Angela Merkel said Wednesday that “we still have a chance to achieve this in an orderly way,” but that Germany was also prepared for a no-deal Brexit.

Will Modi govt's bank merger plan make any difference?

Posted:

By Sushmita GandhiThe scheduled amalgamation of public sector banks (PSBs) at this juncture poses a drastic change to India's socioeconomic condition. It brings with it issues not only of cultural and managerial alterations, but also various financial conflicts, such as interse disputes between the banks that could affect lending as well as recovery.Issues could include something as simple as an internal hierarchical muddle to more direct and larger conflicts like priority of charge on securities in cases of common stressed assets, and the different recovery process being followed by each bank. A key reason for the merger is the weight of mounting bad loans over the years. While various laws have been brought in force to deal with such stressed assets, are these mergers an effective step to shed the weight of such bad loans? The merger of public sector banks raises a considerable risk to the recovery process, which may differ from one bank to another. In the case of stressed assets, the creditors' pool could be common, which may include several of the merged public sector banks while their hierarchy in the list of creditors would vary. There can be situations where one bank may have taken a different stand from the other bank in relation to the same stressed asset, leading to inconsistent claims where conflict of interest will be evident. This could lead to prolonging the recovery process so as to resolve the situation — which, in turn, could be perceived as a threat by strategic investors.Such operational problems arise as the merged entity would be represented as a joint entity. There may be a scenario in which the pending recovery action by Bank A will have to be continued by Bank B despite hurdles — or, in a common borrower case, under the insolvency process, if Bank A has objected to a resolution plan and Bank B has supported it. The impact may then have to be reviewed. But this may be resolved if the merged entity were to adopt and develop an effective internal mechanism to resolve such conflicts in the ongoing recovery proceedings. This process could kick off by weighing the interests or claims of each bank entangled in such conflict and by balancing the pros and cons in the interest of the merged entity. Necessary steps to assess the risk and outcome of such situations are inevitable. The merger will entail movement of staff, bringing about situations where, say, a different team, having conducted no forensics with respect to stressed accounts, is deployed leading to ineffective recovery steps. Forensics on non-performing asset (NPA) accounts often get lost during such a transition phase of amerger, especially when the latter happens to be of a large scale. The merged entity is also likely to face post-disbursement risks and detection of fraudulent accounts or transactions in this transition phase, not to mention staff accountability issues. These can be resolved by issuing specific guidelines for maintaining proper documentation of each account, in a uniform manner across the banks prior to the merger. It is necessary that resources be dedicated towards engaging competent teams to oversee and resolve issues arising out of such a transition phase. The merger also raises the threat of differences in prioritisation, in which the factors for internal risk assessments based on the forensics can vary between the banks. This is more likely since the merging banks are almost at the same level, thereby increasing the possibility of a rift. While non-performing assets and their resolution are one of the major factors for the merger, what remains to be seen is whether such an action really provides a solution. Whilst it may have played a crucial role for GoI to infuse funds into public sector banks, with the current economic conditions, one needs to wait and watch for actual benefits accruing.(The writer is partner, IndusLaw)

Soaring airfares won't go down anytime soon

Posted:

Air passengers are likely to shell out the highest fares for domestic travel this fiscal with the ticket prices expected to spike 7-9 per cent during the period because of limited capacity additions since the grounding of Jet Airways, rating agency Crisil Research said on Wednesday.Crisil also forecast domestic passengers traffic to grow 6-8 per cent in FY20, as against a healthy 19 per cent growth registered in the year ended March 2019, on account of non-revival of Jet Airways, which ceased all operations in April due to liquidity crisis and is now under insolvency proceedings. The 7-9 per cent expected rise in airfares will be the highest since fiscal 2013, which had seen then Kingfisher Airlines going bust, it said."This is way below the 14 per cent growth logged in fiscal 2019 and the compound annual growth rate (CAGR) of 18 per cent was seen in the last five years. Nevertheless, is higher than our earlier estimate of 2 per cent growth and factors an upward revision in capacity addition plans of low cost carriers (LCCs)," Crisil added.Even if Boeing 737 Max aircraft, which have been grounded globally since March following two fatal crashes, resumes operations post H1FY20, the domestic passenger traffic growth for the industry could grow faster by about 80-100 bps at best to 7-9 per cent it said. The LCCs, led by a robust expansion of domestic capacity by SpiceJet and IndiGo, on their part are expected to post strong double-digit growth of 25-30 per cent in passenger traffic for fiscal 2020, it said.Consequently, Crisil Research expects domestic passenger load factor (PLF) for the industry to remain flat at around 86 per cent in fiscal 2020, the rating agency said.PLF is a metric that measures how much of an airlines passenger-carrying capacity is used. With the improvement in fares and a likely robust growth in passenger traffic for budget carriers, Crisil said it anticipates the EBITDAR (earnings before interest, taxes, depreciation, amortisation, and restructuring or rent costs (EBITDAR) margin to rebound to 24-25 per cent this fiscal from 15-16 per cent in fiscal 2019.The carriers operating margin had come off after touching a decadal high of around 30 per cent in 2016, Crisil said adding the recovery this time will be led by a significant jump in airfares due to sudden squeeze in capacity by airlines, following the grounding of the Jet Airways. With the improvement in EBITDAR margin, the LCCs operating cash flows are expected to touch a decadal high of Rs 4,700-5,200 crore this fiscal, Crisil Research said.

Apple is all set to put a chill on Netflix

Posted:

Apple Inc's move to offer a free TV+ subscription for a year with every new device may briefly crown the iPhone maker as the biggest streaming service by user numbers, leapfrogging Netflix Inc.But it doesn't mean Apple will keep the lead.Under the company's plans announced on Tuesday, any purchaser of an iPhone, Macbook, iPad, or iPod Touch will now get the Apple TV+ streaming service free and will be charged $5 a month only if they decide to continue after the year is over.Given Wall Street expects Apple to sell at least 130 million iPhones outside of China in the next 12 months, and that last year it sold more than 60 million Macbooks and iPads, that should allow TV+ to easily top Netflix's almost 160 million users. Thereafter, however, all bets will be off, with Apple facing the same need for fresh shows to make subscribers pay, which drove Netflix to sink a reported $12 billion into new programming last year. While the company has spent months assembling a roster of Hollywood talent and planned shows, analysts say the $2 billion Apple plans to spend this year is a long way from a guarantee of the hits it would need to pull in viewers, regardless of the cheaper $5 per month price tag for TV+."We believe Netflix's 10-year head start, scale, breath of content and customer engagement is unlikely to be dented by an Apple TV+ subscription service with a relatively light content slate and no library content," Credit Suisse analysts said.CROWDSThe video streaming market is on the verge of becoming a very crowded space, with the new services from Apple and Walt Disney set to compete with Hulu, Amazon.com Inc's Prime Video and HBO Max.Analysts say that will change the nature of a business where the relatively limited number of services and the idiosyncrasy of them - Prime for example is bundled with Amazon's free delivery service - meant users rarely had to choose.Whereas Netflix in the past took content from a wide range of studios and networks, now many of them will have their own streaming services and keep franchises like, for example, the Marvel cinematic universe, to themselves.Launching on November 1 in 100 countries, Apple TV+ promises to launch a new show every week and has already announced drama "See" starring Jason Momoa, "The Morning Show," with Reese Witherspoon and Jennifer Aniston, and "Helpsters," a children's series from the makers of "Sesame Street."But that still leaves it way short of the 700 separate shows Netflix made last year, including dozens in the U.S. list of top 100 most-watched. The streaming pioneer also reportedly plans to up spending to $15 billion this year "Apple is primarily focused on selling subscriptions to other services (e.g. HBO, Showtime) and modestly focused on original content," said Daniel Morgan, a portfolio manager at Synovus Trust Company in Atlanta who currently owns Apple shares."It seems unlikely that new entrants such as Apple TV Plus will be able to find a footing given how crowded the field has become."In that light, Apple's main focus with the project may prove to be as much keeping iPhone and iPad sales rolling as wading into a costly streaming war.Analysts from another Wall Street brokerage, Wedbush, said Apple's base of 900 million global iPhone users could allow it to steal 100 million streaming subscribers within 3-4 years. But they also pointed to iPhone sales, particularly in China, as the company's bigger priority."Apple is offering Apple TV+ free for a year ... to help stimulate demand for its trifecta of (new) smartphones," Wedbush said. "Cook & Co. recognize this is a crucial product cycle."

Adani puts in bid for Rs 45,000-cr submarine project

Posted:

NEW DELHI: In a last-minute entry, the Adani Group submitted a bid for the Rs 45,000-crore Indian Navy submarine project, taking other contenders by surprise for what is the largest ongoing Make-in-India initiative in the defence sector. The much-awaited contest was expected to be a faceoff among traditional contenders such as Larsen and Toubro (L&T), Mazagon Dock Shipbuilders Ltd (MDL) and Reliance Naval and Engineering Ltd, all of which own shipyards. The Adani Group does not currently own an active shipyard, which is why the bid has come as a surprise. Those familiar with the details told ET that the Gujarat-based group could float a special purpose vehicle (SPV) with state-owned Hindustan Shipyard (HSL), which has experience in submarine repairs and overhauls.HSL's Standalone BidInterestingly, HSL has also put in a standalone bid.The Adani Group, which did not respond to queries, is now a contender for all three mega defence acquisition plans under the government's strategic partnership model – for future fighter jets, naval helicopters and conventional submarines.71089554 Others that submitted bids for the submarine programme are L&T, MDL and Reliance Naval. The contract, under which an Indian shipyard will be chosen to manufacture six conventional submarines in collaboration with a foreign partner, is in its initial stages. Over the next two months, the defence ministry will scrutinise the bids to shortlist qualified Indian contenders. The formal tender for the contract — after foreign partners from Russia, France, Germany, Spain and Sweden are selected as part of a parallel process — is expected by the end of the year. At the earliest, the submarine contract can be awarded to the winning contender after two years. The single biggest shipbuilding plan under the strategic partnership model is expected to see stateowned MDL as the frontrunner, given its experience in building the Shishumar class of submarines as well as the current production line for the Kalvari (Scorpene) class of boats. As reported by ET, the Adani Group has ambitious plans in defence, with its acquisition late last year of Bengaluru-based Alpha Design Technologies Pvt Ltd that has a strong order book and tieups with big Russian and Israeli companies. The acquisition has enabled Adani to get involved in the specialised defence and space business. Its product list now ranges from drones to helicopters and simulators. It's also one of the major suppliers for the indigenous Light Combat Aircraft (LCA) programme. The acquisition placed Adani Defence and Aerospace in the big league that includes the Tata Group, Mahindra & Mahindra, Reliance Defence and L&T, which are vying for large Make-in-India projects under the strategic partnership scheme. Adani unveiled a manufacturing facility in Hyderabad last year to make Hermes 900 drones in collaboration with Israel's Elbit Systems.

JSW Steel to seek immunity from Bhushan Power and Steel 'fraud deals'

Posted:

MUMBAI: JSW Steel chairman Sajjan Jindal said his company will approach a higher court to seek immunity against claims arising from alleged money-laundering frauds at Bhushan Power and Steel (BPSL), a steelmaker in administration that Jindal has offered to buy for Rs 19,700 crore."We want a neat and clean company, and we don't want any confusion," Jindal told ET."We as a resolution applicant had offered this value under certain conditions. The NCLT order has modified the plan in ways that can have an impact on the viability of the plan," Jindal said. "We will go for judicial intervention to make sure our conditions are approved."Jindal said the company will either seek clarifications from the NCLT or challenge the order in the appellate tribunal (NCLAT). The company will file an appeal before the end of next week. There are two clauses in the NCLT September 5 order that have not gone down well with the steelmaker.First, the court has refused to grant JSW Steel immunity from claims arising from money-laundering frauds reported by Punjab National Bank and Allahabad Bank in the last few months. A total of more than Rs 5,580 crore worth of loans taken by the company have been declared fraudulent by the two banks collectively. The Delhi High Court's April ruling held the money-laundering law above the bankruptcy law. So, JSW Steel is worried that the assets of the acquired company may get attached as "proceeds of crime", which will affect its health after JSW Steel has taken it over. Second, profits generated by the company during the insolvency process that could have been used as working capital by JSW Steel have been ordered to be distributed among the financial creditors on a pro rata basis. However, the order does say that criminal investigations going on against the ex-promoters will not come in the way of implementing the Rs 19,700-crore bid for the company. This refers to the case filed by the Serious Fraud Investigations Office (SFIO) against ex-promoter Neeraj Singhal and a number of bankers for their alleged role in siphoning off funds from BPSL. Jindal also remained unperturbed about the timing of the 3.5-million tonne company's acquisition, even though he said he is disappointed it has taken so long and the time advantage of a good market has been lost."The steel business is cyclical in nature. We are not so time-sensitive," Jindal said.

Vodafone Idea looks to bundle broadband with top 4G plans

Posted:

KOLKATA: Vodafone Idea is looking to selectively bundle fast home broadband services with its top-end 4G postpaid and prepaid mobility plans in priority markets, adapting global learnings from its UK-based coparent, as part of moves to scale up its unit, YOU Broadband, and take on Reliance Jio Infocomm and Bharti Airtel, people familiar with the matter said.Analysts though said financially stressed Vodafone Idea's major challenge would be to cough up the $2-2.5 billion (Rs 14,200-Rs 17,500 crore) it needs to invest to make a serious play in the wired home broadband market and compete with its aggressive rivals."Voda Idea plans to use a mix of global learnings, and subsidiary YOU Broadband's network infrastructure resources, to bundle home broadband services to its high-spending 4G mobile users in its top 10-to-12 markets," one of the persons told ET.Voda Idea, which has been losing subscribers by the millions every quarter, is coowned by the Aditya Birla Group, headed by Kumar Mangalam Birla, and UK's Vodafone Group. The Vodafone Group recently became Europe's leading converged services operator following the British telco's ¤18.4-billion buyout of Liberty Global's cable network assets in July. It offers converged communication services in important markets such as Germany, Italy, the UK, Spain, Czech Republic, Hungary and Romania. A convergent telco, unlike a pure mobility player, bundles a mix of mobile, fixed broadband and media services, including digital TV.At press-time, Vodafone Idea did not reply to ET's queries. Erstwhile Vodafone India bought YOU Broadband three years ago from TRG Capital for some Rs 400 crore. Loss-making YOU Broadband, which offers wired broadband and landline calling services, then became a Voda Idea unit in August 2018 following the Vodafone India-Idea Cellular merger. Its network infrastructure comprises 3,000 km of optic fibre cables and 17,000 km of last mile coaxial cables across 18 cities. YOU Broadband serves roughly a million subscribers currently, in an under-penetrated market with 18.42 million wired broadband users at end-June, with Bharat Sanchar Nigam with 9.05 million customers as the top player, followed by Bharti Airtel (2.40 million), trailed by Atria Convergence Technologies, Hathway Cable & Datacom and MTNL with 1.45 million, 0.84 million and 0.74 million users, respectively, as per the regulator's data.Vodafone Idea's move to augment its home broadband services comes after Jio last week launched ultra-fast home broadband services, and Airtel also came up with a converged digital entertainment services platform, Xstream, and further matching Jiofiber's 1Gbps peak fibre broadband speeds. On Wednesday, Airtel launched Xtream Fibre with 1 Gbps data speeds at Rs 3,999 a month — similar to Jio's pricing — offering unlimited landline calls to any network in India, besides a host of content services. Both telcos are trying to lure premium customers by offering triple play services of content and calling, backed by highspeed wired broadband. You Broadband though faces an uphill task to compete, given it is still a relatively smaller player in the space which is capex intensive and takes time to expand. You also doesn't offer DTH services, said analysts.Besides, it would need significant capital infusion for scaling up, which could be a challenge, given the balance sheet pressures Vodafone Idea faces in its loss-making core mobility business."It's bound to be a tough call as Voda Idea would need to pump in around $2-2.5 billion capex into YOU Broadband to target 5 million homes, as wiring a million households would, typically, entail investments of $400-500 million," said Rajiv Sharma, co-head of research at SBICap Securities.

Info Edge founder explains why unicorns don’t go public in India

Posted:

Zomato is currently focussing on cutting burden and getting into near breakeven which I think looks possible in the next few months, says Sanjeev Bikhchandani, Founder, Info Edge and investor in Zomato. Excerpts from an interview with ETNOW. What is the situation between Zomato and the National Restaurant Association of India? There has been talk that Zomato has been laying off delivery stuff as a number of restaurants have gone off Zomato?Zomato and NRAI are talking constantly. Their problem is being resolved as we speak. A lot of it has been resolved. A number of restaurants have came back on to the platform and I think that the problem is either behind us or hopefully will be behind us soon. Restaurants need Zomato, Zomato needs restaurants and both of them need customers and therefore it will get fixed. It is a matter of a week or two. As far as Zomato letting go of some employees are concerned, these are difficult decisions. It is never easy. It helps nobody to have employees when there is not enough work. The key is when you let go of somebody, you do it to human face, you give enough notice, you give enough pay and you help them find jobs so that there is a soft landing. If you are able to do that, it is fine and that is what Zomato is working on. At the same time, I would like to remind you that Zomato is hiring in a number of other areas. The number of delivery partners for Zomato has gone up from 50,000 fifteen months ago to almost 2.5 lakh or maybe 2.3 lakh. That means 1,80,000 more people are earning livelihoods. As organisations grow, there are calibrations, there are adjustments and this is one of them. You are saying that this is just recalibration in a department where Zomato is laying off because a lot of people have jumped the gun and say that maybe that is also happening because of the logout controversy? That is not true. Would you look to give more money to Zomato, increase you investment?Zomato has many options to raise money from should it need money, but it is currently focussing on cutting burden and getting into near breakeven which I think looks possible in the next few months. Do you think Swiggy is beating Zomato now?I do not think so. Swiggy and Zomato are neck and neck on delivery and then Zomato has got this whole other non-delivery business which is almost as big. I do not think Zomato is losing out in any way. In fact, Zomato is winning. It is like the start-up ecosystem is in a parallel universe. Look at what is happening in the equity markets. In July, there was $2 billion selloff and you had over a billion dollars come into this universe. Is this a different world altogether?Eventually they will converge but it will take time. Usually private markets are behind public markets on activity and valuations by a few months or a year or so. So it will converge. You cannot really divorce start-ups and private valuations from pubic valuations. But is it not a problem that you are not seeing a lot of the unicorns go in for the public markets?Well as long as private capital is available and they have the option, they do not need to go public unless there is a specific reason. But increasingly, there will be investors who want an exit and some of those exits will have to come from the public market. Having said that, in India if you are not a profit-making company, it is harder to go public and in private markets, they are willing to give a lot more time for start-ups to get to profits. So, there is that dichotomy and that needs to be fixed.

Saudi Aramco gives nine banks top roles in world's biggest IPO

Posted:

DUBAI: Saudi Aramco has hired nine banks as joint global coordinators to lead its planned initial public offering (IPO), slated to be the world's largest, two sources familiar with the matter told Reuters on Wednesday. The mandates have been heavily sought by the world's biggest investment banks for a transaction which, according to Saudi Crown Prince Mohammed bin Salman's initial plans, could generate around $100 billion for Saudi Arabia's state coffers. The kingdom plans to list 1% of the state oil giant - the world's largest oil company - on the Riyadh stock exchange before the end of this year and another 1% in 2020, sources told Reuters this week, as initial steps ahead of a public sale of around 5% of Aramco.Aramco has selected JPMorgan Chase & Co, Morgan Stanley and Saudi Arabia's National Commercial Bank , which were previously working on the share sale before it was paused last year, the sources said, declining to be identified due to commercial sensitivities. It has also chosen Bank of America Merrill Lynch, Goldman Sachs Group Inc, Credit Suisse Group AG, Citigroup Inc, HSBC Holdings PLC and Saudi Arabia's Samba Financial Group, they added. To secure the lead role on the IPO, JPMorgan's efforts were led by senior bankers in New York, London and Saudi Arabia who had long-standing relationships in Saudi Arabia, rather than Chief Executive Jamie Dimon, according to a person familiar with the matter.Aramco, JPMorgan, Bank of America, Citi, Credit Suisse, Goldman Sachs and HSBC declined to comment. The remaining banks did not immediately respond to requests for comment. The IPO plan has rapidly gained momentum in recent days with the appointment of the head of the kingdom's PIF sovereign wealth fund, Yasser al-Rumayyan, as Aramco's new chairman.Rumayyan, a close ally of Prince Mohammed, took over from former energy minister Khalid al-Falih in a move to separate Aramco from the ministry, a step Saudi officials have said was important to pave the way for the IPO.Bankers have been courting Saudi Arabia to secure roles in the transaction, which has faced repeated delays, but which officials have said will happen by 2020-2021.Aramco's chief executive, Amin Nasser, said this week that the domestic IPO would be the "primary" listing but that the company was also ready for an international share sale. He said the final decision on venue and timing rested with the government. The flotation is crucial for Prince Mohammed's plans to diversify the Saudi economy in an era of low oil prices.Based on the indicated $2 trillion valuation that Saudi Aramco had hoped to achieve, a 1% float would be worth $20 billion, a huge milestone for the local stock market.Analysts and bankers, however, have said $1.5 trillion is a more achievable valuation for Aramco.Aramco raised $12 billion this year in its first international bond, gaining more than $100 billion in demand, in a deal that many saw as a pre-IPO relationship-building exercise with international investors.

Apple in deep India push with streaming service, iPhone 11 at 'aggresive' prices

Posted:

NEW DELHI/KOLKATA: Apple made a determined bid to push deeper into India, unveiling what analysts termed was a disruptive pricing for its upcoming video streaming services to take on the likes of Netflix, Hotstar and Amazon, and lowering the price of its latest entry model, iPhone 11, by nearly 16% compared with last year's similar model, iPhone XR."While taking the competition head-on, Apple's current focus is unmistakably on building a sizable subscriber base and, driving revenues for both services as well as hardware," said Prabhu Ram, head of intelligence group at Cybermedia Research. "It will push other players to take note, and cut rates as well," he said. The pricing of the streaming services at Rs 99, to be launched on November 1 across iPhone, iPad and Mac, and on other platforms such as Amazon Firestick for non-Apple users in the future, makes it not only amongst the lowest in India, but also the cheapest monthly plan for Apple anywhere in the world. In the US market, for instance, the monthly plan is $5 (about Rs 350), said market watchers. The Cupertino-based smartphone maker will offer a year of the service free with sales of its new iPhones -- iPhone 11, iPhone 11 Pro and iPhone 11 Pro Max -- and iPads. At the same monthly pricing, Apple has also opened up its gaming service called Apple Arcade to India as well.Market watchers feel that the move could help push sales of its devices including iPhones, thereby propping up revenue and profitability."The key message from Apple is that though hardware incremental innovations will continue to happen, future is all in content. Apple wants to stay focused on revenues with profitability and it cannot come from hardware alone," Faisal Kawoosa, founder of market research firm TechArc, said.Apple is launching all its iPhone 11 devices, including its pricier models, on September 27. The company on Wednesday also dropped the price of its erstwhile best-selling model in India -- iPhone XR -- for the base 64GB model, besides those of iPhone 8.Analysts described the price of Apple's iPhone 11 base model of Rs 64,900 as 'aggressive', given that last year's iPhone XR's base model price was Rs 76,900. In contrast, the price drop of iPhone 11 base model in the US is just 6.7% against the comparable iPhone XR model.Hong Kong-based market tracker Counterpoint Research associate director Tarun Pathak said the pricing of the iPhone 11 is quite aggressive in the Indian market and is set to become a best-seller for Apple."Apple must have looked into how sales of the older iPhone XR had gone up in few territories like India after the price was dropped in April, which is why it has priced the iPhone 11 at a similar range. The new iPhone models will have maximum shelf life this year during the festive season unlike previous years when they were launched 1-2 weeks before Diwali," said Pathak.Counterpoint estimates that iPhone shipments in India will grow this year due to the aggressive pricing of iPhone 11, unlike last year when shipments contracted to 1.7 million units from 3.2 million units in 2017.Retailers say this year for the first time Apple may drive iPhone sales volume in India during the crucial September to December period on the newer and pricier models unlike earlier years when the sub-Rs 25,000 models would drive sales."Enquiries have already started for pre-booking of iPhone 11. Apple may also have EMI offers to push sales. The price drop for iPhone XR will also make it a good sales grosser," said Subhasish Mohanty, chairman of cellphone retailer Spice Hotspot, which runs over 100 stores in the North and East.Apple's India journey though has been bumpy so far, with its market share currently hanging around 1% by volume and 3% by value, due mainly to a lack of demand for its historically expensive phones in a price-sensitive market flooded with affordable high-spec devices of Chinese players such as Xiaomi and OnePlus. But now, the company has re-calibrated its plans and is focusing on increasing revenue and profits from its premium devices -- and not volume market share through sub-Rs 20,000 devices -- besides its new services, backed by its move to open its iconic super stores, and expansion of its local production capacities of even high-end models and exports out of India, said analysts.

The long hunt for top talent at India Inc

Posted:

NEW DELHI | MUMBAI: Job postings for top executives are taking twice as long to decide than they did a year ago as companies cope with factors such as an adverse economic climate and technology disruption that are undermining business models, according to search firms.A recent CEO search for a passenger car maker took a year to be finalised. The company, with a turnover of half a billion dollars, was looking at a candidate with expertise in R&D, design and styling along with a strong operations background. It interviewed eight candidates before closing the search."Normally, companies would interview about five candidates but now firms are scanning a larger pool of around 10 or even more candidates," said R Suresh, founder of Insist, a boutique CXO search firm. "This is due to uncertainty every business is facing nowadays resulting from technology disruption, complexities in product mix and overall slowdown."CEO and CXO searches are getting inordinately delayed with uncertainty shrouding most businesses and digital disruption hitting business models across sectors. Risk appetite is also low among most companies, forcing them to go slow on searches while widening their scope.71089664 "Companies are making sure that the (departing) CEOs serve the notice period until they find a fit candidate," said Uday Chawla, managing partner, Transearch India. "In the current market conditions, everyone is sceptical, cynical and cautious… So the firms are taking more time for due diligence. They are risk-averse."Cos More PickyAnother CEO search for a Rs 2,000-crore industrial chemicals company has already taken 10 months and is still not over. The company is looking for an Indian with global business development experience.Companies in sectors such as auto, auto-related, industrial, engineering, pharmaceuticals and telecom are taking the longest. Things haven't changed as much in some other sectors, such as newage companies, ecommerce and consumer-focused startups that are deciding on top talent quickly. Everyone else is taking their time."Companies are getting more picky and choosy in the selection of senior talent," said Navnit Singh, chairman and country head, Korn Ferry India. "They do not mind waiting now for additional couple of months or even more to close the hunt for top talent… The idea is to grab the best in the market."At the same time, the number of recruitment mandates has not declined at any of the search firms such as Korn Ferry, Heidrick & Struggles, Quess, Transearch, Insist and EMA Partners.Choosing top talent is taking as long as nine months now compared with four about a year ago at Quess, a company that specialises in recruitment and executive searches. It recently led a search for a leading financial services company to hire a head of finance in a non-metro city. Candidates with prior financial services experience were preferred."Market scanning from the direct talent pool didn't result in a closure due to factors such as culture misfit, compensation misfit etc., hence the search was expanded to other sectors," said Lohit Bhatia, president, Quess Corp. The search is incomplete after five months. From three months, it's now taking six months to close a CXO/ CEO search, according to A Ramachandran, senior partner at EMA Partners India. EMA currently has seven CEO search mandates compared with a total of 13 in FY19.Arun Das Mahapatra, partner-incharge-India at Heidrick & Struggles, agreed with this."Firms need better people to turn around especially in sectors that are facing slowdown like auto and auto ancillaries," said Mahapatra.
