The new privacy feature is a months-later response to the April revelation that some Amazon employees manually review recorded exchanges with Alexa, and can see where the user is located. You can find it in the Alexa Privacy section of Amazon's website or smartphone apps.
All Alexa users should probably go ahead and opt out now, given Amazon's handling of the issue so far. The latest item to qualify in the "the Dystopian Future Is Now" category is a system that aims to help bartenders keep track of their customers with facial recognition and AI.
There's just one teensy problem: Bartenders are really, really not into it.
The British company DataSparQ announced the launch of the "A.I. Bar" Thursday. It works by using cameras and sensors to place people who come up to the bar in a queue; it's like a digital "take a number" system, but based on facial recognition.
People can see where they are by viewing themselves on a screen (with a number above their head, depicting their place in line). Bartenders will know who to serve by consulting a tablet that has pictures of all the people, in order of who they should serve first. According to The Information, Facebook is set to change the names of Instagram and WhatsApp to better reflect their second-tier status and better credit Facebook for the apps' growth. And just what, exactly, will the new names be?

Conspiracy theories have been radicalizing believers across the country, and finally, the FBI is connecting the dots between conspiracy theorists and real-world violence. According to a new report from Yahoo! News, the FBI has published a document warning that conspiracy theories constitute a domestic terrorism threat.
"The FBI assesses these conspiracy theories very likely will emerge, spread, and evolve in the modern information marketplace, occasionally driving both groups and individual extremists to carry out criminal or violent acts," the document states.
The FBI also specifically calls out internet companies' role in proliferating the QAnon and Pizzagate theories, which led to violence. Read more...
A crowd of determined festival goers just stormed Lollapalooza, jumping the fence en masse to get in.
Photographer Jeremy Cohen, who's shooting the event, caught the phenomenon on video. In a Twitter DM to Mashable, he said he saw the mob "casually walk down the street."
"When they saw a spot with not many cops around, they stormed the gate all at once," Cohen said. "It was def planned ... [It] was very strategic."
He's photographed many music festivals, but added that he's "never before" seen anything like this.

Sorry, crypto companies, you can’t register a .bank domain name.
fTLD Registry Services, which operates the new top-level domain (TLD) extensions .bank and .insurance, is looking to ban cryptocurrency services from registering a domain name.
The registry, which is run by “a coalition of banks, insurance companies and financial services trade associations from around the world,” announced its proposed amendments to its registrant eligibility policies late last month. fTLD concurrently opened a public comment period on the changes; it will run until August 24.
While anyone can register most top-level domain extensions, some registries do apply restrictions to who qualifies for its names. The .bank TLD, which costs around $1,000 per year, is among those with the most restrictive policies. To qualify for a .bank domain name, the registrant must be a government-regulated retail bank, savings association, national bank, or bank holding or parent company. There are exceptions listed in the policy, however — one such entity that can also currently apply for a .bank domain are financial service providers. Read more...

According to documents obtained by The Guardian, the U.S. military is currently in the process of testing a large-scale surveillance system made up of floating radar designed to monitor everything from individual cars to entire cities.

(Bloomberg) — At Mexico’s state-run oil company, skinnier waists mean bigger bonuses.
Under Petroleos Mexicanos’s new collective bargaining contract with its union, workers who meet certain body weight standards will receive a “health incentive” of 5,545.40 pesos ($287) a year. To qualify, they must have a body mass index, or BMI, of not more than 25 — or a maximum waist circumference of 90 centimeters (35 inches) for men and 80 centimeters (31 inches) for women. The so-called health bonus is a 4.6% increase from the last union contract.
The policy runs counter to recommendations by health experts, who warn that BMI and other bio-metric markers are influenced by genetics and environmental factors, and aren’t easy to control. “Employers mandating differential treatment of individuals based on BMI serve to institutionalize the already pervasive stigmatization of obese people,” according to one report from The Obesity Society in Maryland.
Pemex and its union did not immediately respond to requests for comment.
“This is an uninformed policy,” said Dr. Scott Kahan, director of the National Center for Weight and Wellness in Washington. “It’s inconsistent with the science of what we know about body weight regulation and it’s tone deaf to progress being made in societal perceptions around obesity. On top of all of that, we have very strong scientific data now that weight shaming causes more weight gain.”
Pemex workers who are overweight or obese and decrease their weight by 10% annually will also get the bonus, and there are metrics for blood glucose levels, blood pressure and cholesterol, according to the contract seen by Bloomberg. Details of the contract, including a bonus for “productivity” equivalent to 30.85% of workers’ salaries, were first reported in national newspaper Reforma.
A more productive method of encouraging wellness among employees is to incentivize healthy behaviors, said Kahan. These can include giving workers’ insurance rebates for trips to the gym, or encouraging participation in lectures on healthy eating and living. Also, companies can reduce sweets and provide healthier snacks in the office, or give employees’ more time during their lunch break to buy wholesome food or exercise.
“There are a lot of companies big and small that are moving forward on this in much better and much more productive ways,” said Kahan.
Many of the globe’s far northern regions have been experiencing extreme weather events over the past two months. Plumes of smoke have been picked up by satellites from wildfires across Alaska and Siberia and Greenland has experienced rapid ice loss as usually frigid regions have experienced heatwaves and record temperatures.
As the Arctic faces extreme weather events caused by climate change, the events could have ripple effects that accelerate temperature increases across the world, according to scientists and experts.
“The basic chemistry and the basic physics of how the atmosphere absorbs heat — there’s no path where you can imagine that the Arctic is going to start to cool off again,” says Brian Brettschneider, a climatologist and post doctoral fellow at the International Arctic Research Center at the University of Alaska Fairbanks.
“Cold air has to come from somewhere, cold air doesn’t just magically appear, and that somewhere has to be accounted for in the entire energy balance of the Earth. Right now the whole Earth has just warmed up,” Brettschneider tells TIME. “It would take a dramatic reversal of the chemical composition of the atmosphere.”
In Alaska, 2.4 million acres of wildfire have burned through July. In the northern Russian province of Siberia, more than 7 million acres have burned. Greenland has also seen several wildfires in July, but the largest threat to Greenland is a heatwave that spread from Europe to the Arctic country, causing 197 billion tons of ice melt in July alone.

Meteorologist Eric Holthaus says the Arctic is nearing a point of no return, as the global temperature increases closer to 1.5 degrees Celsius above preindustrial era levels, which the Intergovernmental Panel on Climate Change (IPCC) warns would have destructive consequences, creating more frequent and extreme weather events and causing high sea level rise.
“We haven’t crossed any major irreversible tipping points yet, but for each tenth of a degree that we get closer to 1.5 [degrees Celsius], it’s sort of like time’s running out,” Holthaus tells TIME. “We’re already there in some places where the ice just doesn’t exist in the times and places that it used to. That’s a permanent change effectively to those parts of the Arctic.”
“Extremes are a natural part of the climate system,” Ahira Sánchez-Lugo, a climatologist at NOAA tells TIME. “But the problem that’s happening right now is as the climate warms, what used to be an extreme hot temperature is now becoming more frequent.”
Sánchez-Lugo says the world can expect to see more intense and frequent drought, heavy rain in other areas and extreme heat waves as climate change continues.
A heatwave also struck in Alaska, which saw record-breaking temperatures in June and July, lowering humidity and moister content in plant life, making them more flammable. Lightening and thunder, which occur naturally, have sparked about 95% of wildfires in remote Arctic areas that experienced dry weather, according to Brettschneider.
“It’s a natural process that initiates the fires, but it’s a warm environment that makes the fire more severe,” Brettschneider says.
Similarly, in Siberia, lightning strikes ignited fires that have burned to such an extreme that smoke has spread to Alaska and Canada. President Donald Trump on Thursday offered Russia President Vladamir Putin help in fighting the wildfires, which Putin took as a “sign that it is possible that full-scale bilateral relations will be restored in the future,” according to an online statement by the Russian government.
According to the Associated Press, Maxim Yakovenko, head of Russia’s meteorological services told reporters at a Friday press conference that the fires are linked to climate change.
Meanwhile, the heatwave that caused record-breaking extreme temperatures in Europe in July has struck Greenland, which was already experiencing warm temperatures. The Greenland ice sheet has been in a vulnerable position, and on August 1 lost 12 billion tons, according to Holthaus.
Why should people worry about wildfires and ice sheet melt?
As fires burn and temperatures increase in the Arctic, thousands of years worth of carbon stored in and plant life is released into the atmosphere, potentially accelerating global warming.
“You get the accumulation of plant material year after year after year that never fully decomposes, and that carbon becomes locked away in that plant material that doesn’t fully decompose,” Brettschneider says. “But, as you warm up the environment, you let that natural decomposition process fully play out… You end up with tens or hundreds or thousands of years of plant decomposition happening in one or two or ten years.”
That adds up to massive amounts of methane, and ultimately carbon dioxide, being released into the atmosphere, Brettschneider adds. “We think we have a handle on the trajectory of warming, but if we have this unexpectedly large release of methane from permafrost, then we’re going to have to change our assumptions about how fast warming is going to occur, and that change would be faster.”
More immediately, smoke from the wildfires can have damaging effects on people’s health.
Though the wildfires in Alaska and Siberia have happened in remote and hard to reach portions of the terrain — which has contributed to the slow response efforts in Siberia — some smoke has made its way into highly populated areas of Russia. Inhaling wildfire smoke can have a range of side effects from burning eyes and running nose, to lung and heart disease.
Along with record-breaking heat, wildfires pose another threat to ice sheet melt, according to Holthaus. As fires burn and release smoke into the atmosphere, they release black carbon, also known as soot. Soot is landing in Greenland because of the wildfires, making the ice sheet darker and and therefore absorbing more thermal energy and melting quicker, says Holthaus. He adds that researchers are still studying the extent of melt as a result of soot.
“Besides maybe coral reefs, Arctic sea ice has been the quickest response system in the world in terms of warming,” Holthaus says. “We still don’t know a lot about how ice sheets behave when they’re pushed to such extremes like what we’re doing right now… We’re sort of watching in real time what’s happening and trying to understand it.”
Melting ice sheets and glaciers contribute to sea level rise, and also contribute to global temperature increases as the surface goes from white to blue. Blue water absorbs heat rather than reflects it the way that ice does.
“Trying to understand how glaciers and ice sheets behave is extremely consequential science right now,” he adds. “It’s the question of do we have 50 years or 250 years until the ice sheet melts?”
If the Greenland ice sheet melted completely, the global sea level would rise by roughly seven meters, or 23 feet, according to the National Snow and Ice Data Center.
“What’s special about the Arctic is that there really is an on and off switch,” Holthaus says. “Once the ice is gone, it really changes things dramatically, and that’s the process that we’re starting to see play out.”
(WASHINGTON) — President Donald Trump on Friday downplayed recent missile tests by North Korea and flattered the country’s leader as a friend with a “great and beautiful vision for his country,” as the U.S. tries to lure Kim Jong Un back to nuclear talks.
Trump’s series of three tweets — which took great pains to excuse the actions of a man he once dismissed as “Little Rocket Man” — shows just how much the president has riding on North Korea. Despite widespread skepticism that Kim will give up his prized nuclear weapons program, Trump regularly touts his personal diplomacy with Kim as a great success.
Trump tweeted that North Korea’s recent tests of short-range missiles weren’t part of the commitments he and Kim made at their historic June 2018 summit in Singapore, although he conceded they might be in violation of a U.N. resolution.
“There may be a United Nations violation, but Chairman Kim does not want to disappoint me with a violation of trust,” Trump tweeted. “There is far too much for North Korea to gain – the potential as a Country, under Kim Jong Un’s leadership, is unlimited.”
Trump said Kim can only achieve his “great and beautiful vision for his country” if he is the U.S. president.
“He will do the right thing because he is far too smart not to, and he does not want to disappoint his friend, President Trump!”
Trump has frequently called his diplomacy a success and said the U.S. would have been war with North Korea if he hadn’t made a breakthrough with Kim.
The North’s new missile launches came as the United Kingdom, France and Germany — following a closed U.N. Security Council briefing — condemned the North’s recent ballistic activity as violations of U.N. sanctions and urged Pyongyang to engage in “meaningful negotiations” with the United States on eliminating its nuclear weapons.
Trump’s chief U.S. envoy to North Korea, Stephen Biegun, had hoped to meet Friday in Thailand with a representative of North Korea. But North Korea stayed away from the annual gathering of the Association of Southeast Asian Nations, which has served as a venue for their talks in the past.
Unable to meet with a North Korean official, Biegun met with his Japanese and South Korean counterparts to discuss prospects for resuming the stalled denuclearization negotiations with the North.
Secretary of State Mike Pompeo said earlier Friday that he wished North Korea had sent its foreign minister to the meeting. But he also expressed optimism that talks would resume soon.
“I always look forward to a chance to talk with him,” Pompeo told an audience at the Siam Society. “I wish they’d have come here. I think it would have given us an opportunity to have another set of conversations, and I hope it won’t be too long before I have a chance to do that.”
Pompeo said diplomacy is often fraught with “bumps” and “tos and fros,” but stressed that the Trump administration remains willing to restart the talks, which broke down after Trump’s second summit with Kim in Vietnam in late February.
Trump and Kim met again in June at the Demilitarized Zone between North and South Korea. After that, U.S. officials expressed hope talks would resume in a matter of weeks. Despite that hope, the negotiations have remained stalled.
“We are still fully committed to achieving the outcome that we have laid out — the fully verified denuclearization of North Korea — and to do so through the use of diplomacy,” Pompeo said Friday.
(KAMPALA, Uganda) — Researchers in Uganda have launched the largest-ever trial of the experimental Ebola vaccine that is expected to be deployed in neighboring Congo, where a deadly outbreak has killed over 1,800 people.
The trial of the Janssen Pharmaceuticals vaccine involves up to 800 people in the western district of Mbarara and is supported by Doctors without Borders and the London School of Hygiene and Tropical Medicine.
Pontiano Kaleebu, a Ugandan researcher who leads the trial, said Friday that he regrets that the Janssen vaccine has not yet been deployed in Congo. The health minister there who stepped down last month had argued against its deployment, saying a second vaccine could create confusion on the ground.
Already more than 180,000 people in Congo’s yearlong outbreak have received an experimental but effective Merck vaccine, but health experts worry about the availability of doses as the virus now spreads in a major city, Goma, along the Rwanda border. The wife and 1-year-old daughter of the man who died this week of Ebola in Goma now have the disease.
Both the wife and child were doing well in treatment, Congo’s new Ebola response coordinator, Jean-Jacques Muyembe, told reporters on Friday.
But he warned that about half of the cases in this outbreak are going undetected and at that rate “this epidemic could last two or three years.” The current goal is to strengthen surveillance and bring the detection rate to 80%, he said.
Health experts have watched with dismay as the promise of the Merck vaccine in this outbreak has been largely overshadowed by severe challenges to virus containment efforts including rebel attacks and community resistance in a part of Congo that had never experienced Ebola before.
The Janssen vaccine has already been tested in about 6,000 people, most of them Africans, Kaleebu said. “We are excited about this (trial) … because this is one of the promising vaccines,” he said. “It’s one of those vaccines that have shown a lot of promise in animal studies but also in other trials that have been conducted.”
Ugandan researchers said the new trial is expected to last two years and will test how long any protection from Ebola would last. Juliet Mwanga, a co-investigator on the trial, said there is the need “to study many vaccines” in light of Congo’s epidemic.
Uganda has had multiple Ebola outbreaks in the past. While it is currently free of the virus, three people died in June after crossing into the country’s Kasese district on an unguarded footpath. Their family members were taken back to Congo for treatment.
The Ebola virus can spread quickly and be fatal in up to 90% of cases. Symptoms include fever, vomiting, diarrhea, muscle pain and at times internal and external bleeding. The virus is most often spread by close contact with bodily fluids of people exhibiting symptoms and with contaminated objects such as sheets. Health care workers are often at risk.
(WASHINGTON) — President Donald Trump celebrated a new agreement Friday to increase beef exports to the European Union, saying sales should increase by 46 percent in the first year.
Trump portrayed the agreement as standing up for farmers and ranchers. Producers have been hurt by retaliatory tariffs that China imposed after Trump imposed 25% tariffs on $250 billion in Chinese products.
The signing of the agreement comes the day after Trump increased pressure on China to reach a trade deal by saying he will impose 10% tariffs Sept. 1 on the remaining $300 billion in Chinese imports he hasn’t already taxed.
The European Commission announced in June that it had reached an agreement with the U.S. to allow more hormone-free U.S. beef onto the European market.
“Opening markets for our farmers is about more than just an industry. It’s about a way of life,” Trump said from the White House before the signing of the agreement.
During his two and a half years in the Trump Administration, Mike Pompeo has mostly managed to stay on President Donald Trump’s good side, even as other senior officials have come and gone. But the Secretary of State’s relationship with the President is now being tested after an apparent split over whether or not to further punish Turkey for buying an advanced Russian missile system.
Turkey, a NATO ally since 1952, is now receiving parts for Russia’s S-400, an advanced mobile surface-to-air weapon system designed to detect and shoot down aircraft and missiles up to 155 miles away.
Pompeo has publicly stated that Turkey’s purchase ran afoul of a 2017 law meant to punish Russia for election meddling and the Crimea annexation. “The law requires that there be sanctions,” Pompeo said on July 14. “And I’m confident that we will comply with the law, and President Trump will comply with the law.” That assertion was supported by the top Democrats and Republicans on the Senate Foreign Relations and Armed Services Committees, as well as the House Foreign Affairs Committee.
But Trump appears increasingly reluctant to punish Turkey––at a time that ties between Turkish President Recep Tayyip Erdoğan and western allies are increasingly under strain. Despite Pompeo’s apparent promise to impose sanctions, a senior Trump Administration official told TIME last Friday, “The United States does not preview sanctions decisions.” (Asked by TIME that same day whether Pompeo still believed that the law requires sanctioning Turkey, a State Department official echoed that the United States would not preview decisions in advance.)
The President has also undercut Pompeo by opening up an alternative channel of communication –– directing Sen. Lindsey Graham to work with Pompeo’s Turkish counterpart to resolve the issue.
Trump “told me to call Turkey,” Graham told Defense One. “I’m in the camp of, if they don’t activate the [Russian] S-400, the sanctions don’t have to be applied,” Graham said, adding that he relayed this by phone to Turkish foreign minister Mevlüt Çavuşoğlu (who, prosecutors alleged, directed a six-figure deal with Mike Flynn’s firm during the 2016 campaign.) But not activating the system may not be a viable option for Turkey, which just purchased the $2.5 billion technology from Russia.
Later that day, Pompeo was asked on Bloomberg TV whether Graham’s position was shared by the Administration. “I’m not going to talk about internal deliberations,” Pompeo replied. “We’re all working, everyone’s working together to do our best…there could be more sanctions to follow, but frankly what we’d really like is for the S-400 not to become operational, that’s our objective.”
(Graham, a former Trump adversary who has over the past three years increasingly morphed into a defender of the President, was also reportedly asked to work on developing a new Iran deal.)
“Everything about the way that this has developed benefits Vladimir Putin, and benefits Russian interests,” Ross Wilson, who served as a U.S. Ambassador to Turkey under President George W. Bush, tells TIME. “And that’s exactly why the Russian authorities struck this deal, as a way to as a way to estrange the United States and Turkey from one another, as a way to loosen Turkey’s ties with the [NATO] alliance, reflecting a strategy that goes all the way back to Soviet times of trying to break up the alliance.”
After Turkey began receiving the S-400 from Russia, the U.S. canceled Turkey’s order of more than 100 Lockheed-manufactured F-35 Lightning II stealth fighter jets. (Key U.S. allies, including the U.K., Israel, Japan and Australia, have also signed on to buy the fighter for their own defense forces.) Pentagon and NATO leaders have long said that Turkey’s use of the S-400 could allow Russia to observe and “attempt to exploit” vulnerabilities in F-35 stealth capabilities, which means that Turkey’s arms deal with Russia also violates NATO’s interoperability policy. Secretary of Defense Mark Esper testified at his confirmation hearing that he told Turkey’s defense minister, “You can either have the S-400 or you can have the F-35. You cannot have both.” When Turkey took delivery of S-400 parts last month, Washington made good on its threat just days later.
But Trump has balked at even having to drop Turkey from the F-35 fighter program, publicly saying that the cancelation “is not a fair situation” –– let alone having to impose further economic sanctions.
Meanwhile, Turkey has taken to arguing that the Countering America’s Adversaries Through Sanctions Act (CAATSA), the U.S. law that mandates sanctions, gives Trump the authority to waive or delay penalties. But to get such an exemption, Trump would need to submit a justification to congressional committees, where he would face bipartisan pushback. If Trump elects to formally waive or delay the sanctions, it could set up a clash with Republican lawmakers that would draw renewed attention to the 2017 veto-proof passage of the law to punish Russia for interfering in U.S. elections –– and the President’s own tepid response to that interference. Such a showdown would also be a test of whether the relatively new law gives Congress the ability to constrain the president on foreign policy, a realm mostly controlled by the executive branch.
There is concern that sanctions on Turkey could paradoxically benefit Russia by widening the growing rift between the U.S. and its increasingly wayward ally. “I think the Administration is absolutely right to try to respond to this in a way that doesn’t unduly harm the alliance,” Wilson, the former ambassador, says. “How it’s going to do that — it’s not very easy to see.”
Asked whether the Trump Administration ultimately intends to impose economic sanctions on Turkey, the senior Administration official told TIME last week that “nothing has changed about our serious concerns over Turkey’s pursuit of the Russian S-400, as evidenced by previous statements from the Administration as well as the President’s comments last week.” (The State Department official also echoed that language, signaling that at least for now, Pompeo’s messaging has shifted to remain in lockstep with Trump.)
Those comments came during a cabinet meeting on July 16, when Trump indicated that he blamed the Obama Administration for not selling Turkey an alternative system — the Raytheon-manufactured Patriot missiles, which would not create the same security risk, and which the Trump Administration offered to sell to Turkey for $3.5 billion. Trump made no promises on sanctions, and summed up the cancelation of the F-35 deal by saying, “Because of the fact he [Erdogan] bought a Russian missile, we’re not allowed to sell him billions of dollars’ worth of aircraft. It’s not a fair situation. Do you have something to add to that, Mike?”
“No, sir,” Pompeo replied. “I think you explained it well.”
“I think so. Good. You said the right thing,” Trump said, to laughter.
The New York-born rapper will also be allowed to leave the country for the first time since his July 3 arrest while he awaits the decision if the judge in the case. A verdict is scheduled to come on Aug. 14, Karin Rosander, spokeswoman for Swedish Prosecution Authority tells TIME.

The scuffle escalated into an international incident over the last month, withPresident Donald Trump telling Sweden’s Prime Minister Stefan Löfven that he was “very disappointed” he refused his personal request to secure bail and help free the musician. However, Sweden does not have a bail system and the country’s constitution forbids the prime minister from trying to intervene in a legal case.
After the court announced the rapper’s release, Trump tweeted, “It was a Rocky Week, get home ASAP A$AP!”

Prosecutors have asked that the Grammy-nominated artist receive a sentence of at least six months in prison. The maximum sentence for assault in Sweden is two years.
Anne Ramberg, the secretary-general of the Swedish Bar Association, tells TIME she would be “shocked” if A$AP Rocky would still have to serve time in a Swedish prison. “If the court released him today that means either he will not be convicted or he will be convicted but he will not be sent to prison for more time than he has already been detained,” Ramberg says.
In the unlikely event that the rapper would face a longer prison sentence, she says, extradition laws between Sweden and the U.S. do exist.
A$AP Rocky, 30, was first taken into custody on July 3 after afight broke out in Stockholm. Prosecutors say the alleged victim, Mustafa Jafari, was beaten and hit with a bottle.
Jafari, 19, was left with cuts, bruises and a blood-stained shirt, court records allege. He is now asking for $14,700 in damages for his physical and psychological injuries, lost income and damage to his appearance.
Video footage circulating online shortly after the fight showed A$AP Rocky and what appeared to be members of his entourage, including his security team, hitting Jafari, who was born in Afghanistan. A$AP Rocky took the stand Thursday to testify that he acted in self-defense after pleading not guilty to the assault charges.
The rapper said hedid everything possible to avoid conflict with the two men whom he said followed his entourage, the Associated Press reported. He further alleged that the men appeared to be under the influence of drugs and said Jafari provoked one of his bodyguards, who then “started pushing him away, begging him to leave, go from there.”
Jafari said through his lawyer, Magnus Stromberg, that he was angry because the security guard had broken his headphones after an argument that occurred earlier.
A$AP Rocky had posted an Instagram video that appears to show Jafari and a friend following him even after he warned them to leave. “We don’t want to fight you all, we’re not trying to go to jail.”
However, Stromberg tells TIME that video had edited out a scene showing the rapper’s bodyguard throwing Jafari to the ground.
American interest in the trial was enough that Trump’s special envoy for hostage affairs, Robert C. O’Brien, was evenin the Swedish courtroom earlier this week and told the New York Times on Tuesday that, “The President asked me to come here and support these American citizens.” The State Department previously said it would be following the case closely.
The Swedish government confirmed O’Brien’s presence in Stockholm, and said that “this case isnot in any way a ‘hostage affair,’ “ the Associated Press reported.
The court’s ruling may come down to a glass bottle, specifically: whether the rapper or the two other suspects, who have also been charged with assault, used the bottle to hurt Jafari. A$AP Rocky has denied doing so.
It’s important for the prosecutor to prove whether a glass bottle was used because that could prove “you armed yourself against a person who was not armed,” Dennis Martinsson, a senior law lecturer at Stockholm University, tells TIME. “Then (the prosecutor) would say it’s clearly not a case of self-defense.”
Showing that the bottle was used as a weapon could also result in a longer prison sentence, Martinsson says.
A young woman who says she and a friend witnessed the fight occur outside of a fast-food restaurant they were eating in, testified anonymously as a witness via video link on Friday, and said she did not actually see A$AP Rocky hitting a man with a bottle—changing her story from what she said in initial police reports, the AP reported.
She testified that she could not say with certainty whether the rapper’s entourage threw the bottle to the ground or hit Jafari with it but she did hear a bottle being crushed, according to the AP. She also saw the rapper and his partners beating and kicking Jafari.
Stromberg, Jafari’s lawyer, tells TIME that a “brutal assault” started when his client was hit from behind with a bottle.
“They cannot explain why my client has lots of cuts in his underarms, on his head and left hand,” Stromberg says, adding that police found glass on the side of the street where he says the rapper grabbed and threw Jafari but not where he landed — disputing the idea that Jafari may have simply fallen on broken glass.
Video footage also shows A$AP Rocky holding a bottle that is sticking out from his sleeves, Stromberg says. And a text from A$AP Rocky’s assistant uncovered during the investigation states: “Harlem came out and smashed a bottle on a person.” Prosecutors tried during the trial to figure out whether “Harlem” was a nickname for the rapper, who has denied that he hit anyone with a bottle.
But the defense has argued these texts may not have been usable evidence, according to independent journalist Maddy Savage.
The defence has argued that texts from #ASAPRocky's assistant imply that bottles were used in the fight. But the rapper's lawyer says these can't be used as evidence, since the woman was not called as a witness to explain the messages.
Slobodan Jovicic, A$AP Rocky’s lawyer, denied the accusation that a bottle was used in the attack on Jafari in a press conference on Tuesday. “I’m pretty sure that when we are done, we’re going to show that no bottle has been used or not in the way that the prosecutor is claiming anyway,” Jovicic told reporters.
The bottle is not the only evidence the court is considering. How the court interprets the surveillance footage, which showed the argument escalate outside a fast-food restaurant, is even more important, according to Martinsson.
Jafari’s lawyer says the video shows A$AP Rocky’s security guard lifting and throwing his client. “Usually a security guard takes care of his client. In this case, they are claiming that A$AP Rocky had to defend his security guard,” Stromberg said.
Both lawyers say the media attention and political spotlight has not been helpful.
“The enormous attention makes it even more stressful,” Stromberg says. “The assault has haunted (Jafari) and he is very, very scared.”
Asked whether political influence could affect the verdict, Jovicic told reporters on Tuesday: “Absolutely not.” Jovicic said the verdict would depend on the evidence and arguments put forth by the prosecution and defense.
(PARIS) — Cleanup work at fire-ravaged Notre Dame Cathedral will resume later this month but under stricter lead-protection rules, amid growing public concern about toxic pollution.
Under pressure from labor inspectors concerned about lead risks, the Paris region administration suspended cleanup work at the cathedral last week, and ordered new checks of schools and nurseries in the neighborhood.
The administration announced in a statement Friday that workers will be allowed back starting Aug. 12, but in smaller numbers and with tougher new decontamination measures and equipment “to prevent any release of polluting elements to the outside.”
Critics say authorities didn’t move fast enough to protect workers and residents when the cathedral’s massive lead roof and spire melted in the April fire, spewing toxic dust into the Paris air.
A lawsuit has been filed, and a union-led collective is demanding the “total confinement” of the site.
Astronomical levels of lead were measured in the area at the time. And they remain exceptionally high at some spots inside the cathedral, and in soil of the adjacent park and forecourt, according to the Paris regional health agency. Those areas have been closed to the public since April 15 and are likely to stay that way for years.
No dangerous levels have been registered, however, in nearby streets, where tourists and residents continue to circulate and souvenir shops and restaurants have reopened.
The health agency released a 109-page report last month detailing efforts to monitor lead levels among the population and in the soil and nearby buildings.
But environmental groups say authorities weren’t aggressive or open enough about warning the public about lead levels at the time of the fire.
Children are especially vulnerable to health problems from lead poisoning and exposure, so authorities ordered a deep clean for neighborhood schools and recommended blood tests for children under 7 and pregnant women who live near Notre Dame.
The new security measures for the cathedral will limit the number of workers allowed inside at any time to 30-40 instead of the 60-70 currently allowed, at least until new decontamination kits are delivered in the autumn when the pace of work is expected to pick up.
The main focus is “to ensure that the work doesn’t generate any pollution outside the work zone,” the statement said.
The U.K. faces “consumer panic”, “food shortages” and “gaps” in security if it leaves the E.U. without a deal in place on its future relationship with the bloc, a leaked government document states.
The U.K.’s new prime minister, Boris Johnson, has pledged to take the country out of the bloc “come what may” by the current deadline of October 31. He has refused to rule out a no-deal Brexit unless E.U. leaders allow him to overhaul the agreement they had negotiated with his predecessor Theresa May – something the E.U. says is impossible.
In the first two weeks, it warns, the U.K. would face “potential consumer panic and food shortages, even in areas which are not directly affected at the border” and “possible friction at sea between U.K./E.U. fishing vessels.”
The document also cites security risks, including the “possible increased risk of serious organized crime” and “operational gaps” in security as extra policing becomes “unsustainable”.
Northern Ireland, a region of the U.K. that has a land border with the Republic of Ireland, is singled out as being particularly at risk, with “small businesses [facing] distress and potential law and order challenges” in the first month after leaving without a deal.
The document also warns of increased volatility in the British economy and further devaluation of the British pound, which lost 4% of its value against the dollar in July alone.
On Thursday, British finance minister Sajid Javid, appointed by Johnson last week, announced $2.6 billion in extra funding to prepare for a no-deal Brexit, bringing the total amount allocated by the government up to $7.6 billion. Javid asked the treasury to make no-deal preparations its “absolute top priority”.
The prospect of leaving without a deal has divided the U.K., with strong supporters of Brexit, including Johnson, casting a no-deal as an acceptable price to pay for getting out of the E.U. by October 31 — more than three years after the country voted to leave in 2016 and following more than six months of delays from the original March 29 deadline for leaving.
But a majority of British lawmakers voted against leaving with no deal in a non-binding parliamentary vote in March, including some from Johnson’s own Conservative Party.
Johnson’s control of parliament is fragile. On Friday, his majority was reduced to just one seat in a parliament of 650, when the Conservatives lost a special election in the Brecon and Radnorshire region of Wales to anti-Brexit party the Liberal Democrats.
It remains unclear whether lawmakers can block Johnson from taking the U.K. out of the E.U. without a deal, which will happen by default on October 31 unless a new deal is reached or a new extension granted by the E.U.
Hong Kong’s civil servants symbolically turned against the city’s government Friday evening, joining forces with the protest movement that has rocked Asia’s financial center this summer.
The staid two-hour gathering at a garden in the heart of the financial district reflects just how far the sustained demonstrations have reverberated across Hong Kong. Beyond prompting teenage protesters to take to the streets, discontent over the city’s governance has flared even among usually apolitical sectors of society, and further polarized establishment and pro-democracy camps.
On Friday evening, it was clear that many within the administration are unimpressed by their bosses’ handling of the snowballing political crisis. To chants of “add oil”—the protesters’ mantra of encouragement—bureaucrats and civil servants ended the work week by shuffling into Chater Garden, which was the site of a flash mob by financial workers the previous night.
“I’ve seen a lot of unfairness over the past two months, I’m very unsatisfied with how the government and police have handled things,” says an official from Hong Kong’s Food and Environmental Hygiene Department who gave her name as Kat.
The gathering under spitting evening skies risked blowback from the city’s embattled leaders, who have already warned of possible retribution against wayward administrators.
Before the civil servants assembled, the government sought to dampen turnout by calling on “the principle of political neutrality.”
“Civil servants should be dedicated; be committed to the rule of law, objectivity and impartiality; and at all times ensure that their behaviour would not impede their performance of official duties in a fair and professional manner,” the Hong Kong government said in a statement Thursday.
According to the civil servant’s code of conduct, government staffers are required to be loyal to the city’s administration and not take part in political events that could be construed as a conflict of interests.
The neutrality appeal was to little avail, however. As the event started, the train station emptying into the garden quickly devolved into a crush of people trying to join the rally. Demonstrators spilled into nearby roads and out into the surrounding area. “Loyalty is earned not imposed,” read one of the signboards.

“I think many civil servants in different departments are unhappy about the situation, namely about how this has become a ‘lame duck’ administration,” says Willy Lam, an adjunct professor at the Chinese University of Hong Kong’s Center for China Studies. “So this has precipitated an unease and explains this unprecedented phenomenon of civil servants coming out in rallies whose purpose [is] to put pressure on Carrie Lam.”
Hong Kong’s Beijing-backed leader has come under mounting pressure to restore calm to the city, which has increasingly been the scene of tear gas-strewn battles between protesters and police. On Wednesday, the Chinese military released a video depicting soldiers quelling protesters in a drill that was seen a thinly veiled warning to the city’s authorities: end the unrest, or we will.
In an unprecedented press conference Monday, the top Chinese government department responsible for Hong Kong affairs denounced the demonstrators’ “riotous behavior” and urged city officials “to govern, develop and manage Hong Kong well.”
But the protests show no sign of abating. A series of demonstrations are planned for the weekend, and next Monday, a general strike threatens to grind the city to a halt.
The sustained protests, which are set to enter a ninth consecutive week, have posed one of the greatest popular challenges to the Communist Party’s control.
What began as a protest against a now-suspended extradition bill has since spiraled into a movement demanding greater democracy. Many in Hong Kong, a former British colony which retroceded to China in 1997, are now openly rebelling against Beijing’s authority over their semi-autonomous enclave, and calling for self-determination.
Last week, a group of 100 administrative officers reportedly endorsed the growing call for an independent investigation into various incidents around the protests, including the police response and a mob attack at a train station on July 21.
In an open letter, the officers slammed the government for turning a deaf ear on the public and “sugarcoating instead of admitting the problem.”
“Facing the immediate political crisis, we feel the obligation to voice out in a bid to guard the Government’s credibility and respectability,” the letter said.
Even the usually more pro-establishment Hong Kong Law Society spoke out on Thursday, issuing a statement in support of an independent inquiry.
Danny Kwok, a 42-year-old IT technician who joined the civil servant’s rally Friday, said the addition of these officials could be a tipping point for the protest movement.
“I’m not a civil servant, but I think it’s very important that I and everyone here comes out to this rally,” he says. “Civil servants have the most power in Hong Kong to put pressure on the government.”

NEW DELHI: India's biggest automaker, Maruti Suzuki India Ltd, has cut the number of workers it employs on temporary contracts following a plunge in vehicle sales, it told Reuters. The company said it employed 18,845 temporary workers on average during the six months ended June 30, down 6%, or 1,181 people, from the same period last year, adding that job cuts had accelerated since April. It is the first time the reduction has been reported. The listed company doesn't have to disclose reductions in temporary workers. Maruti Suzuki, majority-owned by Japan's Suzuki Motor Corp, said it had not reduced its permanent workforce -- which numbered 15,892 at the end of March -- over the past year but declined to say whether further reductions were planned. It said previously that it had cut production by 10.3% in the first six months of the year. Maruti Suzuki, which produces about one in two of the passenger vehicles sold in Asia's third-largest economy, on Thursday reported a 33.5% decline in sales in July to 109,265 vehicles compared with July 2018.
The government has begun to look at providing quick relief to foreign portfolio investors (FPIs) structured as trusts from the super-rich surcharge, worried about the exit of overseas investors from the capital market and overall sentiment turning negative, said people with knowledge of the matter. This could be by way of a circular, they said.This follows the intervention of the Prime Minister's Office. One of the options is ringfencing entities registered with the Securities and Exchange Board of India (Sebi) from the increased surcharge, said the people cited above.The finance ministry was looking at measures to allow FPIs to convert themselves into companies from a trust structure to escape the surcharge. But policymakers are of the view that this would take time and something needed to be done immediately. Conversion would require several changes to the income tax law, something that would have to possibly wait for the next budget, and wouldn't provide quick relief.A circular could be issued under Section 119 of the Income Tax Act empowering the Central Board of Direct Taxes (CBDT) to direct assessing officers to provide relief to a class or category of taxpayers.SC-backed PowerEntities regulated by Sebi including FPIs and Alternate Investment Funds (AIFs) can be protected through this, said the persons cited above. The Supreme Court has held that a circular issued under Section 119 by CBDT to mitigate the effects of a tax provision on a class of taxpayers is valid in law and binding on assessing officers.Finance minister Nirmala Sitharaman had in the July 5 budget raised the surcharge levied on top of the applicable income tax rate to 25% from 15% for those with taxable incomes between Rs 2 crore and up to Rs 5 crore, and to 37% for those earning Rs 5 crore and more, taking the effective tax rate for them to 39% and 42.74%, respectively. This increased surcharge impacts individuals, Hindu Undivided Families (HUFs), trusts and associations of persons (AoPs). 70506698 Foreign portfolio investors, sovereign wealth funds and alternate investment funds that are structured as trusts or AoP are covered by this. Although I don't want to be tempted to repeat the dialogue, it is possible, and we are, as a government, willing to even help out if FPIs registered as trusts want to come over to being companies."While temporary relief can be provided by way of a circular, the government needs to look at a more lasting solution, tax experts said."Ideally, this (circular) should be followed by a proper amendment in the statute in due course," said Sudhir Kapadia, national tax leader, EY India."This was done effectively on a previous occasion on the issue of MAT (minimum alternate tax) on FIIs (foreign institutional investors) when initially assessing officers sought to impose this levy on FIIs in a few cases."
MUMBAI: HDFC chairman Deepak Parekh exuded optimism that the slowdown, driven by lower consumption, is "temporary" in nature as there is adequate demand for assets across the country. Untitled Carousel 70493541 There has been a distinct slowdown in the economy which was reflected in the lower GDP growth of 6.8 percent in FY19, he said."While there has been an across-the-board slowdown in consumption, given the inherent demand and low penetration levels, I believe this is temporary in nature," he told the shareholders at the 42nd AGM here Friday.There remains adequate demand for affordable housing across the country, which is supported by the government flagship credit-linked subsidy scheme and incentives provided to developers to increase the supply of affordable homes.The demand for commercial real estate has been buoyant, especially across the top eight cities, he added. "One is seeing increased demand for commercial real estate, particularly from the IT sector, e-commerce and professional and services sector," Parekh said, adding even the demand for retail space has picked up in certain pockets.In recent times, several investors such as pension funds, sovereign funds & private equity players with deep pockets have evinced interest in the country's commercial real estate sector, he said.He said the challenge in the housing sector has been with the upper middle segment and high end luxury housing."It is this segment where unsold inventory levels are high. This is where the price of the apartments are typically upwards of Rs 2 crore," he said, adding "I would like to reiterate that the demand for smaller sized homes at affordable price points is still strong".Parekh said the problem got compounded with the tight liquidity situation that prevailed since last September. This particularly impacted the non-banking finance companies and housing financiers and blamed it on banks' risk averseness."Banks are reluctant to lend and there has been a flight to safety where a select, few, high rated NBFCs and HFCs have access to funding, while for several others, access to credit has been chocked," he said.Due to this a number of NBFCs and HFCs have curtailed disbursements. This in turn has had spillover effects into a number of other sectors."One is hopeful that normalcy will be restored soon and by the time the festive season sets in, some of the risk averseness should taper off. To my mind, what is critical is re-instilling confidence in lenders to support growth in the economy," he added.
MUMBAI: A harassment tool or a better performance enabler? Indian companies are mostly anxious about recent changes in Companies Act making compliance with corporate social responsibility (CSR) norms more stringent. Some see more positive than negative.CSR norms violations now may attract fines ranging between Rs 50,000 and Rs 25 lakh, and even imprisonment of up to three years for defaulting executives after Parliament amended the Companies Act, 2013, on Wednesday."The nature of the amendment is like penalising tax evaders but it may become tools in the hands of authorities who may use it to exert pressure on companies," said a top executive of a prominent manufacturing company, speaking on the condition of anonymity."In the current scenario, there is a lot that is spooking businesses — people are reluctant to sit on boards as directors anymore due to increased scrutiny," the executive said.CSR rules mandate that every company with a net worth of Rs 500 crore or more, or turnover of Rs 1,000 crore or more, or a net profit of Rs 5 crore or more, during any financial year has to constitute a CSR committee and has to spend 2% of the average net profit over the last three financial years on CSR activities.70506782 Smaller Cos may Face ConstraintsFinance minister Nirmala Sitharaman said Wednesday that the amendments seek to check the practice of companies "getting away" by providing an explanation on why they were unable to fulfil CSR norms.Legal practitioners, however, believe that such clauses are harsh and can be misused. "Imprisonment for violation of CSR requirements is arguably too harsh. Penalties are more appropriate for such violations," said Sudip Mahapatra, partner at law firm S&R Associates.But the new provisions may lead to better adherence by company executives. "Companies will have to proactively ensure compliance with CSR requirements and now boards will have to pay more attention to the deployment of CSR funds," Mahapatra added.Industry observers say most large-cap companies have adhered to the prescribed minimum in their spending and some companies spend more than what is required of them. Smaller companies, however, may have human resources constraint.Seshagiri Rao, joint MD at JSW Steel, said that there should have been some relaxation for MSMEs that often lack an organised CSR unit to carry out the mandate, and that third parties or NGOs hired for this purpose by smaller companies may not properly fulfil the CSR mandate.After the amendment, companies are allowed to transfer the money they fail to spend in a year to an "unspent CSR account" from which they can draw within next three years to spend on CSR activities. If a company is still unable to spend the amount within that period it can transfer it to a government fund specified in schedule 7 of the Companies Act, such as the Prime Minister's National Relief Fund, failing which the fines and imprisonment clauses will kick in."By and large the amendment is an enabling one, at least for CSR activities…it is being made to appear draconian but it is actually not," said, Neelima Khaitan, CSR head at Vedanta. Through the amendment, the government has actually given companies time to spend any unspent money judiciously, instead of rushing to spend it in one financial year, she said.
MUMBAI: Tata Motors plans to set up a network of 500 public fast-charging stations for electric vehicles in five cities in the next 24 months in partnership with Tata Power to address potential EV buyers' concerns over per-charge range and long charging time.The first 300 of these fast-charging stations will come up by the end of this fiscal across key locations in Mumbai, Delhi, Pune, Bengaluru, and Hyderabad, the Mumbai-based carmaker announced on Friday."The top three barriers to EV adoption are price, range anxiety and (lack of) charging infrastructure. Without an ecosystem in place, you can't see demand in the market," Shailesh Chandra, president of the electric mobility business at Tata Motors, told ET. "From a consumer perspective… they will know that something has started getting in motion now and they can think of buying electric cars."The development is in sync with the government's push towards electric mobility. This is the first major private initiative in this space. The companies refused to reveal financial details of the move.Tata Motors chairman N Chandrasekaran had earlier this week said the company plans to launch four electric cars in the coming 18 months. These include the electric variants of the Tigor, Nexon, upcoming hatchback Altroz, and another unnamed vehicle. The cars will have a range of upwards of 200 km in a single charge. So far, Tata Motors has sold Tigor EV exclusively to government and private fleets. These cars have a claimed range of about 140 km per charge.
MUMBAI: State Bank of India (SBI) swung to a profit from a year-ago loss but fell short of expectations, prompting chairman Rajnish Kumar to invoke divine intervention."Every morning I am looking at the sky and praying to God that the three large NCLT accounts stuck in the middle of resolution get resolved — these alone will give us more than Rs 16,000 crore writeback," Kumar said, referring to Essar Steel, Bhushan Power and Steel and Alok Industries, where SBI has made 100% provisions against bad loans. The National Company Law Tribunal (NCLT) decides on cases under the Insolvency and Bankruptcy Code.Net profit for the June quarter at the state-owned lender was Rs 2,312 crore compared with a loss of Rs 4,876 crore in the year earlier. Profit fell short of the Rs 4,106 crore expectation due to widening losses in the corporate loan book while the treasury and retail segments performed well.Debt WaiversThe increase in fresh slippages to the most in more than a year spooked investors as it suggested that asset quality pressures persist. The stock fell 2.8% to close at Rs 308.45 on Friday on the BSE. Kumar expressed the hope that recoveries, especially from companies undergoing bankruptcy proceedings, will increase.Total provisions fell 35%, margins expanded and a rise in other income made up for tepid net interest income growth. Fresh slippages increased to Rs 16,212 crore from Rs 9,984 crore a year earlier and were at the highest since Rs 29,037 crore reported in the quarter ended March 2018."While we were not ruling out volatility in corporate slippages… higher slippages across segments (including retail) remain a concern," said Mona Khetan, analyst at Reliance Securities.Besides corporate loans, slippages also rose in agricultural accounts, mainly due to loan waivers in Maharashtra, as well as in the accounts of some small and medium enterprises (SMEs)."Debt waiver issues emanating from just one state contributed around Rs 2,000 crore to the slippages," Kumar said.Indian banks, especially private sector lenders, are on the mend with many reporting profit and lower provisions for bad loans in the first quarter of this fiscal. State-run lenders in general are still struggling. SBI had been an exception, showing signs of strength. "Our focus remains on improving operating profit and how to keep fresh slippages under control," Kumar said. "If we maintain the pre-provision operating profit momentum and maintain a 12% growth and all goes well, then the picture looks alright. But making tall claims is not in the nature of SBI."While overall loans grew 12.47% to Rs 22.38 lakh crore, state-run corporations dominated, accounting for nearly 100% growth in sectors such as power, roads and ports.The services sector loan growth by Rs 1.05 lakh crore was dominated by state and large private institutions in the non banking finance company (NBFC) sector — they accounted for all the disbursals while for others it shrank.Kumar cited two large accounts that were still classified as standard for which Rs 2,300 crore had to be set aside as provisions, pending restructuring, without giving more details.A large company classified as a Maharatna by the government was also marked as a nonperforming asset (NPA) due to some technical issues, he said."One regular account of a Maharatna company, which slipped into NPA books of another bank, further impacted the gross slippages," he said. "One bank did not successfully implement the resolution plan fully on time. This account added about Rs 2,000 crore to the slippages, but the situation can be corrected."Kumar expressed confidence that stress in the retail segment will not hit the bank much because SBI's personal loans are mostly to government employees who have greater job security than others.
Do not look at short-term factors, sentiment, earnings, flows. You cannot really make money by focussing on those sorts of factors on any consistent basis, says Saurabh Mukherjea, Founder and Chief Investment Officer, Marcellus Investment. Excerpts from an interview with ETNOW. Mukherjee says his focus has always been on companies with clean accounts, essential products and monopoly franchises. Excerpts from an interview with ETNOW. What is your take on the fact that after today's fall, sub that 10,900 mark, we have erased all of our 2019 gains and the Nifty has turned negative for 2019 for real?I have to confess that none of us at Marcellus really spend that much time figuring out what the market outlook is, what is going to happen next week or next month. We have never been. Our focus consistently has been to analyse and look for companies whose governance is good, accounting is actually bona fide, genuine accounts, companies who sell essential products and have monopoly franchises there in. So clean accounts, essential products, monopoly franchises and that is what we spend all our time doing. Honestly, we really have very little interest in knowing what the sentiment is today or what it will be tomorrow morning that sort of question is probably best asked to other punters who try to do short-term trading. Our emphasis has been to look after the 500 families whose wealth that we manage, to look after the wealth by focussing on consistent compounders, high class companies, say an Asian Paints or HDFC Bank or say Dr Lal PathLabs, companies that we own personally and that is it inside the 500 portfolios that we manage for family offices across the country.One of the key issues has been that FIIs have been consistent sellers and have accelerated the selling post budget. What do you think can be done to bring FIIs back?It is important that there is no knee-jerk reaction to this. Obviously whatever has happened has happened, we are a large economy, one of the six, seven large economies in the world and I am sure the government did whatever it did on 5th July with the best intentions. There has been an inadvertent consequence, which is that some of the FIIs who have trust structures have ended with a higher tax rate than they or the government had bargained for. I think remedial measures can be found and it does not necessarily mean reversing the tax rate. A more liberal FII regime which allows foreign investors to invest more easily in India will lead to them coming in. I was in America 10 days ago talking to some of the pension funds and endowments who are discussing whether they will give us some money to invest and their view was that this remains one of the most attractive economies in the world to invest in. So there is an underlying foreign investor desire to invest in the Indian stock market. I am sure if the government comes up with a couple of measures with SEBI to make it easier for foreign money to come into India, the FII flows will return in due course. But again, one should not be trying to second guess FII flows or DII flows. If you try to second guess these sorts of things and make investments therein, it is a very dicey way to think about stock market investing.How would you look at the earnings season because after all earnings will decide where the prices go?It has been very similar to the earnings seasons we have seen for the last 30 quarters odd in our country. If you do not have a capex cycle you are not going to see anything dramatically different in the earnings season. I am not so sure again why people get worked up every time the quarterly earnings season comes around. The economy has been in slow motion mode for six, seven years now and therefore in that context, it is a little challenging for companies to show decent earnings growth. There is obviously some companies of the ilk of Pidilite or Kotak Bank or a HDFC Bank, which can consistently chug out good numbers but their ability to chug out good numbers has been proven a long time ago. You and I do not need to wait for the next earnings season to assess that a Pidilite or a Dr Lal Path Labs will consistently grind out good results, that is a well established fact. What I am trying to repeatedly highlight is do not look at short term factors, sentiment, earnings, flows you cannot really make money by focussing on those sorts of factors on any consistent basis.

The index finally settled with a gain of 17 points. The headline index formed an Outside Bar on the daily scale, as it traded in the broader range of 230 points and covered the entire price move of the last session. It remained highly volatile, but formed a bearish candle on the weekly scale as overall trend remained under pressure. The index has been making lower highs lower lows from the last four weeks. The medium-term trend is under pressure, but the index is turning from deep oversold territory. A hold near 11,000 could see a bounce back towards 11,111 and then 11,150 while on the downside, supports are seen at 10,900 and then 10,850.On the options front, maximum Put open interest was at 11,000 followed by 11,200 strike while maximum Call open stood at 11,500 followed by 11,700 strike. We have seen Put writing at 10,900 followed by 10,800 strike while Call writing was seen at 11,000 followed by 10,900 strike. Option data suggests a trading range between 10,800 and 11,300 level. India VIX moved up by 4.31 per cent to the 15.18 level. Nifty Bank continued its formation of lower highs lower lows on the daily scale from the past four trading sessions and it failed to hold above 28,500. It formed a Doji Candle on the daily scale and a bearish candle on the weekly scale as overall trend remained under pressure. However, now it has to hold above 28,250 zone to witness a bounce towards 28,555 zones while a hold below the same could drag it towards swing low of 27,900 and then 27,750 level.Nifty futures closed with a gain of 0.04 per cent at 11,019. Builtup of long positions were seen in Voltas, Tata Global, MFSL, TVS Motor and Bharti Airtel while Shorts were seen in Ashok Leyland, Motherson Sumi, Jindal Steel and Indigo.(Chandan Taparia is Technical & Derivative Analyst at MOFSL. BRUSSELS/BENGALURU: Alphabet Inc's Google will allow rivals to compete to be the default search engines on new Android devices in Europe, but they will have to pay for the privilege.In its latest proposal to ward off fresh EU antitrust penalties, Google on Friday announced plans to auction spots on a "choice screen" from which users will select their preferred search engine.The move comes a year after the European Commission fined the U.S. tech giant 4.34 billion euros ($4.81 billion) for blocking rivals by pre-installing its Chrome browser and search app on Android smartphones and notebooks.The EU competition enforcer also ordered the company to halt its anti-competitive practices or face fines up to 5% of Alphabet's average daily worldwide turnover.Google said in a blog post that users in Europe will, from early 2020, be able to pick a default search engine from four options, including Google, when they set up a new Android smartphone or tablet.Rival search engines can apply to join Google among the four options in separate auctions for each individual country. In the event that fewer than three search providers meet or exceed the bid threshold, Google will fill any remaining slots randomly from a pool including those that asked to take part in the auctions but did not submit bids.COOL RECEPTIONWhile consumers will have a choice of default search engine on their new Android devices for the first time, the plans were not well received by some of Google's rivals."It's Google's way of creating a new revenue stream while giving rivals an option. Basically they are complying with the EU order in the letter but not in the spirit," said Ecosia, which describes itself as an ethical search engine that uses profits to plant trees.Ecosia was one of the rivals used as an example in Google's blog post."If we choose to enter an auction and pay Google for the privilege of being a search engine option on Android, this will potentially be at the expense of millions of trees we could otherwise have planted," said Ecosia Chief Executive Christian Kroll."The EU's anti-competition ruling is clear - Google has too much power. The decision over which search engines are able to use Android, which is the second-largest operating system in the world, shouldn't be up to Google. It should be up to users."Czech search engine Seznam said it was not clear what the implications will be."It is hard to comment based on a screenshot and a few sentences. Seznam, and I believe others, too, were not contacted by Google about this proposition, so we have to wait for all-important details," said Michal Feix, Seznam's former chief executive and now partner at a consultancy advising the company.EU WATCHING CLOSELYGerman rival Cliqz criticised the proposal, saying some companies could lose out to competitors with deeper pockets."If the highest bidder wins the contract and not the best search engine, then the user is the biggest loser.
